5 COMMITTEE REPORT DIGEST I. FINDINGS AND RECOMMENDATIONS The Committee on Utilities, Transportation, Public Works, and Veterans Affairs fmds that Section of Chapter 67, oftitle 10 ofthe Guam Code Annotated established the Guam Veterans Commission which, as currently written, consists of"one (1) member each from the currently officially chartered Guam chapters of the Recognized Service Organizations as recognized by the U.S. Department ofveterans Affairs." The Committee finds that Guam chartered veterans service organizations desire to participate on the Veterans Commission, which advocates and advances issues facing veterans. However, these organizations are not recognized by the U.S. Veterans Affairs office and therefore are not eligible to be members ofthe Veterans Commission. In order to achieve the greatest participation of veteran service organizations, Section of Chapter 67, oftitle 10 ofthe Guam Code Annotated should be modified to remove the requirement that only U.S. Veterans Affairs Office recognized organizations may be members on the Guam Veterans Commission. The Committee fmds that membership on the Guam Veterans Commission should be open to all Guam Chapters of multi-branch veterans service organizations and a total of four (4) members representing the respective veterans or retirees association for each branch of the U.S. Armed Forces, i.e. U.S. Army Retirees (or Veterans) Association, U.S. Air Force Retirees (or Veterans) Association, U.S. Navy Retirees (or Veterans) Association, and USMC Retirees (or Veterans) Associations. In addition, all organizations with members on the Guam Veterans Commission must be duly registered as a non-profit organization with the Guam Department ofrevenue and Taxation in accordance with Title 18 Guam Code Annotated relative to non-profit organizations and shall furnish the Guam Veterans Affairs Office each year a copy of the Non-profit Annual Report filed with the Department of Revenue and Taxation. The Committee finds that the definition of a quorum required modification to address the potential change in the number of members on the Veterans Commission. The Committee has modified the language in the bill to provide flexibility in the event the Veterans Commission membership changes. The Committee further finds that the Veterans Commission enabling act does not provide a clear process on how a new member is added to the Commission. A new section New Membership Process has been added to the bill to clarify the process in which a new member is added to the Veterans Commission.

OVERVIEW The Committee on Utilities, Transportation, Public Works, and Veterans Affairs convened a public hearing on December 3, 2009 at 9:00 a.m. in I Liheslatura 's Public Hearing Room. Among the items on the agenda was consideration ofbill No (COR) "An act to amend Section of Chapter 67, oftitle 10 ofthe Guam Code Annotated relative to allowing greater participation of veteran service organizations in the Guam Veterans Commission." sponsored by Senator F.F. Blas, Jr. Public Notice Requirements Notice were disseminated via facsimile and to all senators and all main media broadcasting outlets on November 24 (5-DayNotice) and again on December 1 (48-Hour Notice) of2009. 7 Bill Cundiff Provided oral testimony Mr. Cundiff is in support ofbill and provided a recommendation to include any other entities mandated to provide veteran services. Mr. Cundiff is appointed Director of Andersen Air Force Base Retiree's Office and works for the Wing Commander on retiree Issues. Alan G. Van Aken Provided oral testimony Mr. VanAken is in support ofbil Mr. VanAken is a member ofthe Guam Chapter of the 3rd Marine Division and Chairman of the Guam Veterans Commission. Mr. VanAken stated there were other veteran advocacy organizations not recognized by the Veterans Affairs office that want to participate on the Commission. Mr. VanAken further stated he was in support of Mr. Cundiff's proposed amendment. Art Mesa Provided oral and written testimony Mr. Mesa is in support ofbi Mr. Mesa stated in his written testimony there were several active veterans service organizations not eligible to be members on the Veterans Commission based on current law. Mr. Mesa further stated the amendment is in keeping with the spirit of the late Speaker Antonio Unpingco. Mr. Fred Gofigan Provided written testimony Mr. Gofigan is in support of Bill Mr. Gofigan is the Administrator ofthe Guam Veterans Affairs Office. In his written testimony, Mr. Gofigan stated there were only five (5) veteran organizations that are recognized by the U.S. Veterans Affairs Office which under the current law, is a requirement to be a member on the Guam Veterans Commission. According to Mr. Gofigan, all Guam veteran service organizations should be given equal membership and voting rights on the Guam Veterans Commission. PCol AdolfSgambelluri Provide written testimony PCol Sgambelluri is in support of Bill Mr. Sgambelluri agreed that each organization with a member on the Veterans Commission be registered with the Department ofrevenue and Taxation. Question and Answer Senator Aguon: Asked if Mr. VanAken was the Chairman of the Guam Veterans Commission and ifhe was appointed by the Chief Executive.

8 Mr. Aken: Confirmed that he was the Chairman ofthe Guam Veterans Commission and was duly elected by members of the Guam Veterans Commission, not appointed by the Chief Executive. Senator Aguon: Pledged his support of the bill. Senator Muna-Bames: Asked how many veterans organizations are on Guam and how many would be eligible to participate on the Guam Veterans Commission if the bill were signed into law. Mr. Art Mesa: Responded that there were approximately 15 veteran service organizations and 2 auxiliary organizations. Mr. Mesa noted there were approximately 8 Guam Chapters recognized by the U.S. Veterans Affairs. The bill would allow for 7 additional organizations to participate on the Guam Veterans Commission if the bill were signed into law. Senator Ada: Asked Mr. Cundiffifhis organization was funded and a counterpart to the Guam Veterans Affairs Office. Mr. Bill Cundiff: Responded that his office was not funded and that he was appointed to the Wing Retired Activities Office. Mr. Cundiff stated his office was not the counterpart ofthe Guam Veterans Affairs Office but rather an additional conduit to the Guam Veterans Affairs Office and Guam Veterans Commission. Mr. Cundiff asked ifthere was a Guam website that provides general and benefits information specifically for Guam veterans. Senator Ada: Raised concerns regarding the Guam Veterans Commission quorum established by public law. Currently, a quorum of5 is required. Ifthe Commission expands its membership, the minimum requirement for a quorum should be revisited.

Blas, JJi T.C.Ada ~ AN ACT TO AMEND SECTION OF CHAPTER 67, OF TITLE 10 OF THE GUAM CODE ANNOTATED RELATIVE TO ALLOWING GREATER PARTICIPATION OF VETERAN SERVICE ORGANIZATIONS IN THE GUAM VETERANS COMMISSION. 1 BE IT ENACTED BY THE PEOPLE OF GUAM: 2 Section 1. Legislative findings and intent. I Liheslaturan Guahan finds that 3 the Guam Veterans Commission is the "voice" of the many veterans that reside on 4 Guam. There are some Veteran Service Organizations that are not recognized by the 5 U.S. Department of Veteran Affairs; however, these Veteran Service Organizations 6 continue to provide support and resources to Guam's veterans and provide and 7 invaluable service. These Veteran Service Organizations deserve to be represented on 8 the Guam Veterans Commission which is tasked to provide veterans and their families 9 infonnation regarding benefits and services to the Guam veteran population. By I 0 allowing all veteran Service Organizations to be represented on the Commission, more 11 Guam veterans and their families will receive information about the services and 12 benefits available to them. 13 Section 2. Section of Chapter 67 of Title 10 of the Guam Code 14 Annotated is hereby amended to read as follows:

10 1 " Guam Veterans Commission. There is hereby established, 2 in the Office of Veterans Affairs, a Guam Veterans Commission which shall 3 consist of one ( 1) member each from the currently officially chartered Guam 4 chapters of the Recognized Veteran Service Organizations.:. recognized by the 5 U.S. Department of Veterans Affairs. The Commander or designee of each 6 Recognized Veteran Service Organization shall be the representative. Every 7 representative shall serve for the tem1 of the Commander, but not more than 8 two (2) years. if the Commander's term exceeds two (2) years, the service 9 organization shall appoint, by Chapter Executive Council vote, a successor to 10 serve during the term of the incumbent Commander. Should a Recognized 11 Veteran Service Organization have more than one ( l) Chapter, then the 12 membership within the Commission shall be rotated among the Commanders of 13 those Chapters, with the order of the rotation decided among those Chapters. 14 Five (5) members shall constitute a quorum. The Commission shall meet 15 quarterly and shall advise the Veterans Affairs Officer regarding matters 16 affecting veterans and eligible claimants regarding Veterans Administration- 17 related issues. The Commission shall provide veterans and their families with 18 the opportunity to air grievances for the purpose of effecting corrective action 19 or change to existing policies that affect delivery of benefits and services to the 20 Guam veteran population. 14 TESTIMONY ON BILL (COR) SUBMITIED BY Fred Gofigan Administrator, Guam Veterans Affairs Office Good Morning Mr. Chairman and members ofthe Committee, I apologize for not being here to testify on Bill I am attending the 12th Chief Executive Summit of Micronesian. I am working on having Veterans Issues included as one of the priorities for our Chief Executives to address. Thank you for allowing me to testify on Bill I am in support of said Bill. The present Law only allows the Veteran Service Organizations not recognized by Congress to participate in the Veterans Commission. Currently, only those Veterans Service Organizations (American Legions, Military Order ofthe Purple Heart, Veterans of Foreign Wars, Vietnam Veterans of America and Disabled American Veterans) recognized by Congress have the voting power on any issues brought before the Veterans Commission. Senators, all the veterans of these organizations (not recognized by Congress) fought for our freedom and equality; therefore it is only right that they be given equal right. I encourage the passage of Bill Thank you for the opportunity to testify.
