He will be in Salt Lake City but will attend via conference call. b) Region IV Development meeting at 12:00 p.m. 10/01/2015 in Twin Falls for Commissioner Kunau

2 c) A Resource Conservation and Development meeting at 11:00 a.m. Friday, 10/2/2015 in Twin Falls for Kunau d) Abenroth received a phone call on 09/25/15 from City of Burley Attorney Dave Shirley, inquiring if he had received any complaints regarding Open Meeting Law violation of the City of Burley Council of a non-posted meeting this past Wednesday night. Abenroth acknowledged that he had received a complaint and Abenroth stated that he would begin an investigation as is his responsibility under Idaho Open Meeting law statues. Shirley stated that he will advise the City of Burley to admit to the open meeting law violation no later than Tuesday of this coming week. It was pointed out that that it appeared they will have a meeting today regarding that issue. e) Abenroth stated there will be a jury trial starting tomorrow morning and may be unavailable the next couple of days. f) McMurray noted that Darwin Johnson requested to be in attendance for an agenda item and was told to appear at 9:15 a.m. g) Crane noted the retirement party for 5 th Judicial District Trial Court Administrator Linda Wright will be from 4:00 p.m. to 6:00 p.m. 10/01/2015, at the Turf Club in Twin Falls. h) A retirement recognition for Sandy Albertson from 12:00 to 2:00 p.m. Friday, 10/02/2015 in Commission Chambers. Christensen and Kunau will be unable to attend. i) Crane stated that Doug Manning from the City of Burley notified him that the new Fabri-Kal packing plant open house will be at 11:00 a.m. Thursday, 10/15/15. The Board was invited to attend and asked to RSVP if they plan to be in attendance. j) Crane stated that the County received a bill from the City of Burley in the amount of $7, for garbage removal during the Fair. Crane called City Administrator Mark Mitton about it and he said that the City Council determined they were giving away too much free stuff. Crane expressed his concern that this was an unanticipated expense and they may need to check into other options if the City continued to charge for that service. Mitton told Crane he would work on this and get back to the County. k) A Letter of Engagement was presented from Evans, Poulson, and Catmull, CPA s to conduct the County s independent outside audit for FY2016. Crane asked for Abenroth to review it where it is a contract. McMurray asked to go over it as it is an expenditure that comes from his budget. THE MOTION PASSED UNANIMOUSLY. 5) 9:09 AM COUNTY ROAD AND BRIDGE DEPARTMENT WEEKLY WORK SCHEDULE a) They almost have culverts completed. b) There was rain last night so they will continue grading. 6) 9:11 AM DELIBERATE ON REQUEST FOR SHOWER REPLACEMENT AT THE MINI-CASSIA CRIMINAL JUSTICE CENTER (MCCJC) 2 P a g e

3 a) Johnson addressed the Board regarding ongoing shower replacement projects. b) They currently have money in the maintenance repairs budget line and contingency line, that were not committed to carry over funds c) They requested to be allowed to finish one more shower at an estimated cost of $3, out of FY2015 s budget. The request will also include tile to do another shower next fiscal year. d) Crane asked if this was the shower the Board saw at their last MCCJC inspection. e) Johnson replied that was one they had already started on. 9:12 AM BOB KUNAU, MEMBER, MOVED TO APPROVE EXPENDITURES TO REPLACE ONE SECTION SHOWER AT MCCJC AT A COST OF $3, AS PRESENTED. THE MOTION PASSED UNANIMOUSLY. 7) 9:13 AM DELIBERATE ON DATA STORAGE FOR THE MCCJC a) Johnson requested the original PST bid be amended from an amount of approximately $174,000 to approximately $195, to include the 60 day data storage fee of $21, That was accidently left out of the initial proposal. BOB KUNAU, MEMBER, SECONDED THE MOTION. THE MOTION PASSED UNANIMOUSLY. 9) 09:20 AM DELIBERATE ON IDAHO PUBLIC UTILITIES COMMISSION CASE NO. IPC-E a) Kunau reviewed the case regarding a small hydro project. He indicated that no action was needed. 10) 09:21 AM FINAL DELIBERATION ON ecivis GRANTS NETWORK a) It was proposed at the last department head meeting by Rinehart that Rod Draper might be able to take this project. b) McMurray noted that it was his understanding that Draper has some health issues that may prevent him from being available. c) McMurray will visit with staff and see who might be available to take on this challenge. d) McMurray noted that we sign up for three years but that we can opt out after 1 year if it is not working. 3 P a g e

4 9:21 AM PAUL CHRISTENSEN, MEMBER, MOVED TO APPROVE THE ECIVIS MASTER SUBSCRIPTION AND SERVICE AGREEMENT FOR ONE YEAR, THEN REVIEW. BOB KUNAU, MEMBER, SECONDED THE MOTION. THE MOTION PASSED UNANIMOUSLY. 11) 09:23 AM DISCUSS USE OF APARTMENT STORAGE a) McMurray noted that there are currently two county apartments that will be vacant. b) The Historical Society will be returning 500 plus boxes of court files that will need to be stored and would fit in the vacant upstairs apartment. c) This could be used as a buffer for noise between the Public Defender offices, and would be out of way of potential water damage if the basement apartment is used. d) Shelving could be built to accommodate the boxes until the files are scanned, using funds out of district court budget, and similar to what was constructed on the third floor of the courthouse. e) Christensen expressed concern regarding the load bearing capacity of the upstairs apartment. f) Discussion occurred regarding other storage options, such as the portable storage containers. g) This matter will tabled for further review. McMurray will gather more data and check on feasibility of storage expense versus loss of potential rent revenue. 12) 09:32 AM INVITATION TO PARTICIPATE IN FLU SHOTS a) McMurray noted that the City of Burley called and invited county employees to join them in participation with Costco for flu shots. That will take place on 10/23/2015 at Burley City Hall. b) Costco is offering the flu shots at a discounted rate of about $ c) This vaccine is covered by the County insurance. d) Additional details will be obtained and notification of employees will take place. 13) 09:38 AM RECERTIFY LEVY RATES (L-1) a) It was noted by the Auditor s office that budget titles needed amended due to bond fund title changes. Those names need to be the same with taxing districts bonding. b) The levy totals remain the same. The titles of the funds are all that have changed. 9:38 AM BOB KUNAU, MEMBER, MOVED TO RECERTIFY L-1 LEVIES TO REFLECT BOND FUND TITLES AS PRESENTED BY THE AUDITOR S OFFICE. THE MOTION PASSED UNANIMOUSLY. 14) 09:38 AM REVIEW NOTICE OF PUBLIC HEARING FROM CITY OF DECLO a) Kunau read the Notice of Public Hearing from the City of Declo received on 09/23/15 regarding proposed rezoning of property located at 116 West Center Street in Declo. b) McMurray noted that this falls within the City of Declo zoning requirements and jurisdiction. 15) 09:43 AM APPROVE PAYMENT OF EXCESS PROCEEDS OF M. HERRERA TAX DEED SALE IC (2) a) Justesen inquired about the reimbursement for the disposition of the deceased b) Abenroth noted that he researched whether or not the County expense for disposition of the deceased could be considered for reimbursement. He found there was no lien that we can pay on or evidence that this expense would take priority over the Medicaid lien. c) He noted that the claim and inquiry submitted by the Welfare Director via to reimburse the indigent budget was made after the 60 day deadline notice. d) Keck noted that the County does not file liens on non-medical applications. e) Keck inquired whether the original approval of the expense paid could be considered a timely claim 4 P a g e

5 f) Abenroth stated that he found no statutory authority that this expense could be considered, even if determined timely filed. He recommended that the Board approve the claim to Medicaid and direct the Auditor s office to remit the excess proceeds from the tax deed sale. 09:41 AM PAUL CHRISTENSEN, MEMBER, MOVED TO APPROVE THE PAYMENT OF EXCESS PROCEEDS TO MEDICAID FROM THE M. THE MOTION PASSED UNANIMOUSLY 16) 09:47 AM EXECUTE UNIVERSITY OF IDAHO COUNTY EXTENSION BUDGET FOR FY2016 a) McMurray had the auditor s office review the budget and all appears in order. b) It was noted that this budget is typically not reviewed until the County Budget is finalized. 09:47 AM BOB KUNAU, MEMBER, MOVED TO APPROVE THE UNIVERSITY OF IDAHO COUNTY EXTENSION BUDGET FOR FY2016. PAUL CHRISTENSEN, MEMBER, SECONDED THE MOTION. THE MOTION PASSED UNANIMOUSLY. SCHEDULED INFORMATION AND ACTION AGENDA ITEMS 17) 09:47 AM STATEMENT OF TREASURERS CASH AND URBAN RENEWAL REPORT a) Justesen presented the Statement of Treasurer s Cash and Urban Renewal Report. b) Christensen asked if decisions to expend Urban Renewal funds for projects could be done without notice and in a public meeting. He asked if there had ever been notice of any such meetings. c) Kunau responded that we have not received any notices. d) Abenroth will review Urban Renewal statutes and see what the requirements are for providing notice of an open meeting for Urban Renewal expenditures. 18) 9:53 AM DEPARTMENT HEAD MEETING a) PATTY JUSTESEN TREASURER i) Justesen stated that she chose not to attend the IAC meetings this week in Boise, but will attend in February. ii) The Treasurers office is preparing for the tax drive and will be busy the next month or two. iii) Their office employees have all vacations out of the way and everything is going okay in their office. b) CRAIG RINEHART CORONER i) Rinehart noted that last week was quiet for a change. ii) Rinehart will attend an IAC meeting on Wednesday for Coroners. iii) The Coroner s Association will hold a class regarding mass casualty shootings in high schools. iv) Christensen stated that a notice was received from Ada County regarding costs for holding a murder victim and evidence for an extended period of time and the storage rates. v) Abenroth noted he can t speak to details regarding this open case in a public meeting. c) JAY HEWARD SHERIFF i) Heward noted that it has been busy with nasty cases. ii) He referred the Board to the daily blotter for details on citations and calls. iii) Heward noted the need to hire one more person for a full staff that they are approved to have. iv) He will not attend the IAC meetings this week, but will go in February of 2016 for the Sheriff meetings. d) DARWIN JOHNSON MINI-CASSIA CRIMINAL JUSTICE CENTER i) Johnson thanked the Board for approval of bids to continue with projects. ii) Current census is 143 with 56 from Cassia, 46 from Minidoka, and 41 that we receive revenue from. 5 P a g e

6 iii) They would like to continue the lighting upgrade to LED. The project was half completed last year, noting savings of 100 kilowatt hours per day. iv) Johnson asked if the Med Pass compensation for deputies who distribute medication to inmates went away which was two hours per day comp-time in the past. v) Heward noted that to the best of his knowledge, any extra incentive programs are not included in the FY2016 Budget which becomes effective 10/1/2015. He will check with Auditor s office for verification. vi) Johnson asked for clarification of whether or not the addition of one deputy was approved during the final budget process. vii) Christensen stated that it was his understanding that it was not funded. viii) Heward spoke that it may be reviewed again in January and if the funds are there, the budget could be reopened and this matter reconsidered. ix) Johnson asked who the first contact person is for questions regarding employee health claims and benefits. x) Christensen stated that Bowen Insurance Group should be contacted first and are very helpful. McMurray said to contact him if Bowen s office is not effective. xi) Johnson asked the status regarding the contract with PST. xii) McMurray said that he just received it the other day and will be putting it together. Johnson noted they will begin in January. e) GORDON EDWARDS WEED AND PEST CONTROL i) Edwards noted they have been busy doing fall work at the Fairgrounds, the Museum, the Almo County buildings, the snowmobile lot in Sublett, and cleaning up Goose Creek. ii) They are also working with City of Burley store owners for corners and parking lot clean up. iii) The Burley Highway District has been working hard to keep their area cleaned up. iv) Christensen noted that it appeared efforts in our barrow pits are woefully inadequate. v) Edwards noted that with budget shortages they are stretching timing as to when they can get most effective use of treatments and that continued work is needed with highway districts to remind them of the problems and to continue to get them on board. f) JOEL PACKHAM EXTENSION AGENT i) Packham noted that they are busy planning a full slate of winter schools and meetings for October through March. ii) They are wrapping up 4-H for this year and starting up for the new year. iii) They are also working on using up accrued comp time. iv) Christensen thanked Packham and his department for all of their help during Fair week. g) DOUG ABENROTH PROSECUTING ATTORNEY i) Abenroth noted that it has been an interesting past 30 days with quite a few criminal cases of public interest. ii) Paul Jefferies is at a trial training class funded by IPAA that only involves the costs for mileage reimbursement as far as county expense. iii) Abenroth has a felony trial this week and Deputy Prosecutor Larsen will cover other matters. iv) Abenroth expressed appreciation to the Board on behalf of the Prosecutor s Office for the raises and said his employees are grateful and that it helped. h) KERRY MC MURRAY ADMINISTRATOR i) McMurray noted their office continues to move steadily along. ii) They have a couple of Planning and Zoning hearings coming up in the next couple of months. 6 P a g e

7 iii) The Building department has been busy with construction projects all attempting to be completed before winter. The building official has been traveling the County regularly for these projects. i) DENNIS CRANE COMMISSIONERS i) Crane noted the presentation of a plaque to the County by the Governor, on behalf of the Leading by Example Program, commemorating the County s attempts to conserve energy by converting LED lighting, sealing holes, and the routine auditing of county buildings. ii) Crane also noted the employee appreciation luncheon held last month had a good attendance from every department and he asked the department heads to think of ideas or changes for next year s event. 19) 10:11 AM UNITED STATES FOREST SERVICE (USFS)/BUREAU OF LAND MANAGEMENT (BLM) REPORT a) LOREN POPPERT USFS DISTRICT RANGER i) Poppert reported that Kelsaw Canyon has reopened and the closing order has been rescinded. ii) The road crew has removed debris and the road is back open. They are already getting campers there. iii) The Thompson Flats campground was finished and is open through the end of this month and will be available next season. iv) There was good participation at the National Public Lands Day event. v) A Record of Decision regarding Sage Grouse was signed last week and will be in implementation phase over the next months. It will have an impact on approximately 572,000 acres of Sage Grouse habitat or about 30% of habitat acres on the south end of the County. vi) They are still assessing impact regarding grazing permittees, monitoring efforts, roads, trails, etc. vii) They will be striving to prove they can meet the standards. b) NANCY ADY BLM (FILLING IN FOR KEN CRANE) i) BLM is working to secure funding through the Federal Land Access Program to get the County road paved out of the Milner area. They are also working on getting easements from the road districts involved. ii) Protests and appeals are expected regarding the Land Use Plan Amendment. iii) Burley BLM Archeologist Suzann Henrikson provided an update on the 2012 conceptual design for the Milner Historic Recreation Area. They are hoping to involve Gateway proponents to pay for interpretive efforts for the area as part of off-site mitigation. iv) The State BLM office is planning to go to Washington, DC with the proposal, which with inflation now has a $4.2 million dollar price tag. v) Henrikson asked for a letter of support from the Board for the funding to go to the Milner Historic Recreation Area. vi) The Board will take the request under advisement. 20) 10:23 AM EXECUTE RESOLUTION NO DESTRUCTION OF SEMI-PERMANENT RECORDS FOR THE SHERIFF S OFFICE 10:23 AM PAUL CHRISTENSEN, MEMBER, MOVED TO APPROVE RESOLUTION NO FOR THE DESTRUCTION OF SEMI-PERMANENT RECORDS FOR THE SHERIFF S OFFICE.
