Present: Kerry McMurray - Administrator (Not voting), Tim Darrington - Member, Bob Kunau, Chair, Paul Christensen - Member, Doug Abenroth - County Attorney (Not voting), Joe Larsen - Clerk (Not voting). 4) 2/13/2017 9:03 AM Review Calendar, Meetings, and Correspondence a. Darrington reported on meeting in Elba regarding the flooding emergency. b. Darrington reported on the Jackson area emergency representative desiring to set up a meeting with the Bureau of Reclamation regarding water release in reservoirs. Christensen recommended the Lower Goose Creek Reservoir (Oakley Reservoir) people be involved as well. c. Presidents Day is a legal holiday 2/20/2017 d. Joint Juvenile and Justice meetings at 7:30 a.m. Tuesday, 2/14/2017 in Rupert e. Special meeting of the Board on 9:00 a.m. Tuesday, 2/21/2017 in the Commission Chambers f. Planning and Zoning meeting at 3:00 p.m. Thursday, 2/16/2017 in the Commission Chambers g. NACo Western Interstate Region conference call 10:00 a.m. Thursday, 2/23/2017 5) 2/13/2017 9:11 AM Website Review and Discussion a. Larsen reported on his department s and others updating their information for the new website. b. The board desired to get this completed soon. c. Larsen asked for an update on the protected employee portal login progress. 6) 2/13/2017 9:14 AM Review and Consider Approval of Clerk s Office Recommendations for Junior College Certificate of Residency Forms 2/13/2017 9:14 AM Motion: Clerk s Office recommendations to approve 27 junior college Certificate of Residency Forms as presented, Action: Approve, Moved by Tim Darrington, ember, Seconded by Paul Christensen, Member. 1 P a g e

2 7) 2/13/2017 9:15 AM Discussion of Flood-related Issues to Include Building Regulations a. Abenroth sent a confirmation to the State of Idaho regarding the declaration of emergency. That was requested during a phone call to them at the emergency meeting of the board on Friday, 2/10/2017 in Boise. b. Heward said a helicopter has been arranged for to have the US Army Corp of Engineers and the Goose Creek Flood District personnel fly over the areas of concern. Water is currently running in the West Canal but had not reached the Golden Valley Road at 1000 West as of this morning. c. Christensen said the Oakley Reservoir had risen two and one half feet in six hours. d. Heward reported that the emergency center is still open in Oakley and they have an extra dispatcher running the emergency flood phone line. They are going to back off having a deputy officer at the Trapper Creek Road. e. The most recent report from Karl DeHart from the Idaho Office of Emergency Management (IOEM) was read by Heward. The Oakley Highway District has 100 miles of gravel roads with an estimated $1 million damage. f. Undersheriff and Emergency Coordinator George Warrell updated the board by phone on the Oakley Reservoir water input and output. If conditions stay the same with no rain and with the current snowpack, it is an estimated 62 days to full. g. Warrell and Heidi Novich from IOEM will be meeting with the Oakley Canal Company. Deputy Chief Brad Rich from IOEM has met with Speaker of the House Scott Bedke as well. h. A flood hotline has been setup and that number is i. Press releases have been put on the County website and Facebook. IOEM has put that on their website as well. He read the most recent press release. j. Currently water releases present no flood potential. They are asking for citizens to stay clear of the area. Water flowing into the reservoir still exceeds what is flowing out even though there is potential for the Oakley Flood to be full. k. Abenroth reported from flood and highway district attorney David Shirley 22,600 miners inches of water flowing into the Oakley Reservoir and 8,000 miners inches flowing out. l. A public service announcement also went out regarding wells and hazardous materials. m. Larsen reported on the large numbers of people reached by way of Facebook and sharing in addition to the notices on the County website. Warrell also said they a getting a large number of hits on the Cassia County Sheriff website as well. n. Ground is being ripped by excavators in the flats in the valley just before water enters Murtaugh Lake according to Warrell. They will also release water into Kloepfer s gravel pit prior to there. o. The 1600 South and 1700 South roads are closed due to the canal breach. Between the Mountain Road and 600 West, the canal has breached and culverts have been removed as well. The West Canal is completely full at those locations. p. The road to the Oakley Reservoir is closed, the Birch Creek road is impassable, and the Goose Creek Road is passable but has damage. q. The Highway District is working in Oakley and they received road closed signs from ITD. r. Many parts of the county have substantial road damage. Warrell is receiving reports regarding that as well. Raft River flows have subsided substantially. A lot of the roads are now passable. s. Darrington reported that the Road and Bridge Department is working hard and the EY Road, the Lind Road near Yost, Utah and the Narrows Road are opened but some areas are not passable. t. Albion is not reporting any flooding at this time as stream flows are down. 2 P a g e

3 u. Things seem to be under control in Elba as there is not a lot of significant runoff. Road and Bridge personnel are addressing culvert issues according to Darrington. v. The Marsh Creed crested last night with a small amount of sandbagging near the high school. Clearing of Marsh Creek helped immensely. The main concern is with the Oakley area. w. Warrell said there are records amount of snow in the high country but cold temperature is helping to slow things down. Christensen read the most recent SNOTEL reports. x. A lot of work needs to be done to put our roads back in order. Road and Bridge Supervisor Sam Adams will be contacting LHTAC about potential funding for that. y. Building Issues: i. It was pointed out that siting of homes has been a concern through the years. ii. A report will be put together for next Tuesday about what to do to balance out property ownership concerns and restrictions with future building permits. z. Reimbursement for costs of repairs was discussed. Abenroth said he plans to get with David Shirley this week and have some answers to that. aa. Darrington addressed getting on top of applying for grants. Other organizations have a person working directly with that according to Darrington and Kunau. Larsen commented on talking with the ecivis Grant Management people at the NACo Conference last year in Washington, DC. Cassia County has invested in that service for two years now and haven t received any financial benefit from it yet. He will gather more information from them when he attends that same conference in a couple of weeks. Kunau said we need to look at that as a means to cover costs for repair of roads and culverts. 8) 2/13/ :00 AM Consider Establishing Flood Relief Fund through Community Chest a. Heward and Darrington talked about efforts needing to be better coordinated for volunteer flood relief from businesses and citizens. Humanitarian support should be county-wide and a place for storage of relief should be designated. b. Efforts through the Chamber of Commerce and the Declo Fire Department as instigated by a private citizen generated a lot of support. c. Heward will talk to Warrell and will try to coordinate resources with fire departments to be involved as a clearinghouse. d. Christensen asked for it to be posted on the County website as soon as possible. e. Abenroth said donations to an IRS Title 501(c)(3), it is a non-profit and is tax deductible. f. Administrative Office employee, Timbri Hurst talked to Rae Smith from the Community Chest and they keep from 0% to 5% of proceeds to run their organization. She suggested combining both county s efforts since it is a Mini-Cassia organization. g. Darrington suggested funds be directed to the Community Chest rather than the Chamber of Commerce so those donating would know where funds should be donated. h. Disbursement of funds need to be decided for claims and expenditures. Darrington said where the issue is flooding right now, donors desire to see funds used for that purpose. McMurray said it needs to be identified where funds should go towards a person or to infrastructure. i. Darrington personally felt and encouraged funds be used for individuals with home damage. j. Christensen said people could specify donations to Minidoka, Cassia, or just generally. 3 P a g e

The Board began verbatim recording as required by statute to discuss the transfer of an alcoholic beverage license. b. The Skyline Bar location remains the same but an ownership transfer of the Alcoholic Beverage License from Lee Butterfield to Herbert Crowley was requested. c. The Board discontinued verbatim recording. 11) 2/13/ :24 AM Review and Execute 2017 Bookmobile Service Contract with Box Elder County a. McMurray said this is the standard contract for the Almo, Elba, and Malta area. b. The amount of the contract is $6, and there is currently $7, on account. It does not include tax funds. We only serve as a governmental pass-through entity as required. c. The contract requires signatures of the Board, County Attorney, and Clerk 2/13/ :25 AM Motion: Acceptance of the Box Elder County Bookmobile contract as presented, Action: Approve, Moved by Tim Darrington - Member, Seconded by Paul Christensen - Member. d. Abenroth reviewed the contract and had no objection. 12) 2/13/ :27 AM Indigent Matters 2/13/ :27 AM Motion: To consider Indigent matters of a personal nature that are exempt from disclosure under Idaho Code (6), Action: Enter Executive Session under Idaho Code (1) (d), Moved by Paul Christensen, Member, Seconded by Tim Darrington, Member. 5 13) 2/13/ :42 AM Amendment of Agenda 2/13/ :44 AM Motion and Action: Approve Amend Agenda under Idaho Code (4) (c) (reason for amendment): set up a governing body to distribute donations to Community Chest (good faith reason why it was not included on the original posting): an emergency situation with thoughts and ideas coming to the Board throughout the day, Moved by Paul Christensen, Member, Seconded by Tim Darrington, Member. 14) 2/13/ :45 AM a. Darrington stated Minidoka County desired to be a part of a unified effort for a relief fund through the Community Chest. b. They will move forward on with criteria to determine how those collected funds are disbursed. c. One person from each county would be added to that board. Three would constitute a quorum. d. Commissioner Moore from Minidoka County desired no more than 5% be kept back for administering to operate. e. Darrington will contact Minidoka County to submit two names to be considered to be on the committee with authority to disburse the funds. f. Donor s requests of specific funds directed to a particular county would be honored. g. McMurray will write up the criteria for submission to Minidoka County for their input. h. Names of individuals need to be identified for suggestion from Cassia County as well. Christensen suggested consideration of Gale Garrett. 15) 2/13/ :50 AM Review and Approve Minutes 2/13/ :50 AM Motion: Minutes from 1/30/2017, 2/9/2017, and 2/10/2017, Action: Approve, Moved by Paul Christensen, Member, Seconded by Tim Darrington, Member. 16) 2/13/ :51 AM Review and Approve Payables a. A correction to payables was required to reflect corrected credit card charges from the Administrative Office for the out of town training of Dave Zanone and Timbri Hurst. b. It included an extra day s lodging for Hurst that originally was to be on Zanone s credit card. 2/13/ :52 AM Motion: Ratification of Chair Kunau s approval of corrections on last meeting s payables, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. c. Darrington said the Sheriff s Office charges are very close to their annualized allocation. d. He also noted duplicity of information on the payable pages that Larsen said he would review. e. 6 SCHEDULED INFORMATION AND ACTION AGENDA ITEMS 17) 2/13/ :55 AM East and West Soil Conservation District Funding Request a. Mark Webb from the East Cassia Soil Conservation District reported on projects they are currently working with. b. Richard Kunau from the West Cassia Soil Conservation District reported on projects they are currently working with. c. County funding is matched by the State to help with their work and scholarships. d. Kathy Poulton, West Cassia Supervisor said they support Ag programs in the schools in Burley and Oakley. They also sell trees. e. They invited the Board to attend their banquet on 3/9/2017. f. Meg Patterson, who represents both East and West Soil Conservation Districts, made comment. They are partnering with the Idaho State Department of Agriculture for boat check stations. The Cottrell boat station will be manned in partnership with them. They will start on 7/1/2017. They will be reimbursed from the State Department of Agriculture for employee wages and for providing their service. g. The County has contributed $5, for each district in the past. h. Christensen asked Kathy Poulton and Mark Webb to report on flooding. i. Brent Stoker recommended adding additional areas to flood districts that would include the entire county. Christensen suggested those who desire to pursue that should present and vet the information. McMurray said a petition would need to go before the Idaho Department of Water Resources. 18) 2/13/ :01 PM The Board Traveled to Oakley to Have a Working Lunch and to Review Areas of Flooding in the County a. The Board had lunch and discussion of flooding issues at Searle s In Oakley. b. Review of the Oakley Dam, the West Canal, and areas of flooding and damage near the West Canal area. Canal breaches and culvert removals along with areas of flood were reviewed. 19) 2/13/2017 2:20 PM Personnel Matters: a.
