1 Cassia County Board of Commissioners MEETING MINUTES Cassia County Courthouse Commission Chambers 1459 Overland Ave Room 206 Burley ID :00 AM The Cassia County Board of Commissioners met today at the place and time as posted by agenda pursuant to Idaho Code for Open Meetings Law. AGENDA ITEMS 1) Call to order 2) Pledge of Allegiance and prayer 3) Roll call 9:02 AM Roll Call. Present: Tim Darrington - Member, Bob Kunau - Chair, Paul Christensen - Member, and Joe Larsen - Clerk (Not voting). Kerry McMurray - Administrator (Not voting) and Doug Abenroth - County Attorney (Not voting) joined the meeting following the roll call. 4) 10:25 AM Amendment of agenda 10:26 AM Motion and Action: The board amend the agenda for this meeting pursuant to Idaho Code (1) (f) to review a potential litigation matters (good faith reason the agenda item was not included in the posted agenda): timeliness for addressing the issue was deemed important and information concerning the matter came by way of a telephone conversation on Friday with persons involved in the situation after posting of the agenda, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. 5) 9:03 AM Calendar, meetings, and correspondence a. Christensen will be leaving town tomorrow and will also be out of town for 2/26/2018 meeting b. Christensen will also miss meetings in June c. Joint Juvenile Probation Meeting will be at 7:30 a.m. Tuesday, 2/13/2018 in Rupert d. Joint Justice Meeting will be at 8:00 a.m. Tuesday, 2/13/2018 in Rupert e. Kunau will attend the Joint Meetings in Christensen s absence f. Darrington will be out of town on 4/16/2018 g. Fair Board Meeting on Tuesday, 2/13/2018 for Darrington h. Mini-Cassia Transportation Meeting on Wednesday morning, 2/14/2018 for Darrington i. Road and Bridge issues on Thursday, 2/15/2018 in Elba for Darrington j. Idaho Homelessness Community Report for 2017 from Idaho Housing and Finance Association k. Mail-in ballots have been sent out for the March Cassia School Supplemental Levy Bond Election l. Early vote crews will only work one week right before the election and the first week before that will be handled by the Elections Office as a large voter turnout is not expected. m. The Clerk s office is working with four software updates: Odyssey with the courts, CAI with the Recorders and Auditors Offices, GIS-based voter registration system with the Secretary of State s 1 P a g e

2 Office in 2019, and new software from the State Tax Commission to replace the AS400 programming that is currently in beta testing in Owyhee County to go live this fall. n. Planning and Zoning Meeting at 3:00 p.m. Thursday, 2/15/2018 in the Commission Chambers o. President s Day is 2/19/2018 and as a legal holiday, there will be no regularly-scheduled Board meeting 6) 9:10 AM Approval of Clerk s Office recommendations regarding junior college Certificate of Residency Forms 9:11 AM Motion: Clerk s Office recommendations to approve three junior college Certificate of Residency Forms as presented, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. k. Larsen updated the Board on a change in the policy of CSI regarding tuition waver for employees and their family members. Dual credit high school students no longer have their tuitions waived. We are recommending approval of payment for those students who are residents. 7) 9:14 AM Personnel Matters: a. Change of Status Requests i. Sheriff s Office Hiring of Barbara J. Crocker as a dispatcher ii. Mini-Cassia Criminal Justice Center hiring of Minidoka County employee Veronica Juarez as a part time Detention Deputy b. Time card Road and Bridge Supervisor Sam Adams was in order 9:15 AM Motion: Change of Status Requests and time card as presented, Action: Approve, Moved by Tim Darrington - Member, Seconded by Paul Christensen - Member. c. Auditor s Office Accrual Payout Report i. Darrington recommended that Comp Time be limited to 40 hours for the new budget year. It was suggested to talk to department heads about that as it is a liability to the County and is out of control. ii. Christensen said that Comp Time ebbs and flows but he suggested to approach the matter cautiously. iii. It was pointed out that it is difficult with seasonal employees such as the County Fair and Weed and Pest. iv. It was determined to keep the issue in the forefront for discussion. 8) 9:26 AM Consider and approve transfer of Alcoholic Beverage License from Burley Golf Pro Shop owner, Scott Draper to the City of Burley a. An audio recording of the Alcoholic Beverage License considerations was in place. b. The proposed transfer of the Alcoholic Beverage License was explained by Kunau and he said all things appeared to be in place appropriately. 9:28 AM Motion: Transfer of the Alcoholic Beverage License from Golf Pro Shop owner Scott Draper to the City of Burley, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. 2 P a g e

3 9) 9:28 AM Consider and approve Alcoholic Beverage License for Wick s Steak House a. The license application is for draft beer on premises, bottled wine, wine by the glass, and bottled beer off premises. b. The matter has been checked out by the Sheriff s Office. 9:29 AM Motion: Alcoholic Beverage License for Wick's Steak House in Declo as presented, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. 10) 10:02 AM Report from the Idaho Electronic Recording Commission (ERC) and recommendation for membership and involvement with the Property Records Industry Association (PRIA) a. Larsen reported on his meeting of the ERC of which he is chairman. Their group discussed the importance of a membership contingency in Idaho with PRIA. b. The mission of PRIA is to integrate and collaborate with stakeholders of the property records industry. Larsen said the Recorder s Office is going to affiliate with PRIA and attend some of their meetings. 11) 10:07 AM Review and execute MBA Annual Health Benefit Agreement a. Abenroth presented three documents from MBA i. An Application for Excess Insurance in conjunction with our Annual MBA Health Benefit Agreement 10:08 AM Motion: Allowing the Board Chair to sign the Annual MBA Health Benefit Agreement for Excess Insurance as presented, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. ii. Core Services Agreement with ELAP for 2018 iii. Cost-Containment and Guide Services Agreement 10:11 AM Motion: Signing of the Core Services Agreement with ELAP as presented, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. 10:11 AM Motion: Signing of the Cost-Containment and Guide Services Agreement with ELAP as presented, Action: Approve, Moved by Tim Darrington - Member, None seconded. 12) 10:13 AM Execute NuQuo services agreement a. McMurray said some changes were made to the agreement from what was originally presented. b. He recommended signing of the agreement as he felt the changes would meet NuQuo s satisfaction. If there are problems with NuQuo, McMurray said it could be amended. c. Kunau said the agreement includes no cost to the County. NuQuo keeps 25% of any savings realized with copier and printer purchases. 3 P a g e

4 10:15 AM Motion: Chairman to sign the NuQuo Services Agreement as presented, Action: Approve, Moved by Tim Darrington - Member, Seconded by Paul Christensen - Member. 13) 10:16 AM Approval of electrical, plumbing and cabinetry work at courthouse a. McMurray said they are maxed out in the electrical panel box on the third floor of the courthouse and they are tripping breakers. They received a quote for changing that out in the amount of $1, b. The Prosecutor s Office needs a cabinet for a microwave oven and plumbing for a kitchen sink. The plumbing cost is $1, Two options were for a ready-made or a custom-built cabinet. All costs for a custom-built cabinet totaled $5, A pre-built cabinet totaled $3, :21 AM Motion: Lower bid on the pre-made cabinet, wiring, and plumbing as presented, Action: Approve, Moved by Tim Darrington - Member, Seconded by Paul Christensen - Member. c. Larsen explained remaining amounts in the repairs line that would be exceeded with what is presented to approve in today s payables and with the Prosecutor s Office approvals. He suggested that the budget be amended to include building reserve funds to meet these needs presented, future requirements for security windows at the Clerk s payment area at the Judicial Center, and to cover what remains to finish the main floor bathroom. 14) 11:10 AM Approve minutes 11:10 AM Motion and Action: Approve minutes from 1/29/2018, Moved by Tim Darrington - Member, Seconded by Paul Christensen - Member. 15) 11:10 AM Approve payables a. Kunau addressed lateness on any payables when the Board does not meet. b. Larsen said the Auditor s Office already screens that to be paid by due dates as previously by the Board. 11:11 AM Motion and Action: Approve payables for the past two weeks dated 2/12/2018, Moved by Tim Darrington - Member, Seconded by Paul Christensen - Member. SCHEDULED AGENDA ITEMS 16) 9:30 AM South Central Public Health Department (SCPHD) review and update a. Adriana Masoner from the SCPHD presented an update on services from SCPHD. Their new District Director is Melody Bowyer, who desires to be more community oriented. They would like to meet with the Board on a regular basis rather than just once a year. Masoner provided information and an invitation to their free Looking Glass Academy Workshop. b. SCPHD Immunization Coordinator Lisa Klamm discussed the involvement of law enforcement with the schools regarding police, fire, government officials, and other matters. She reported on the flu which has caused 52 deaths so far this year and trends indicate there could be record 4 P a g e

5 deaths. Hospitals are experiencing a large number of admittances for respiratory ailments. She extolled the value of the flu shot and the shingles vaccine. Whooping cough exposure in Minidoka County has not affected Cassia County yet. She further stated that the flu vaccine is not perfect but it does help. She updated the Board on Hepatitis A and C cases which are ongoing issues. c. Darrington addressed road and pavement situations at the new John V. Evans Elementary School. Heward also addressed situations regarding safety issues and what had been planned for the pickup zone has not taken effect. He said that issue needs to be fixed by the school, the City of Burley, or the County for picking up students. Heward said it has created traffic gridlock. 17) 10:26 AM Designate polling places for the 3/13/2018 Special Election a. Cassia Joint School District #151 has called for a special election for a supplemental levy. b. The election will include all 24 Cassia County precincts. The Jackson Precinct was requested to be designated as vote by mail for just this election. That has been approved by the Secretary of State s Office. c. There will be seven vote by mail precincts for this election. Early voting will begin at the courthouse on 2/26/2018 and will conclude on 3/9/2018. d. Once ballot coding is completed, a public test with the Commissioners will take place. e. There are currently 8,939 eligible registered voters for this election. It is predicted for about a 20% voter turnout. f. Outside help for the early vote crew will only be used for the second week of early voting to save on costs. The Elections Office will handle all early voters the first week. 10:30 AM Motion: Acting on the recommendations of the Clerk s Office in designating polling places for the 3/13/2018 special election as presented, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. 18) 10:31 AM Executive Session (for the purpose of discussing indigent matters and pending litigation 10:32 AM Motion: To consider records that are exempt from public disclosure for the purpose of evaluating indigent recommendations and to address pending litigation matters, Action: Enter Executive Session pursuant Idaho Code (1) (d) and (f), Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. Vote: Motion carried by unanimous roll call vote (summary: Yes = 3). Yes: Tim Darrington - Member, Bob Kunau - Chair, Paul Christensen - Member. 11:09 AM Motion: Recommendations of the Social Services Director regarding indigent matters, Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. 11:09 AM No action was taken regarding the pending litigation matter. 19) 11:29 AM Joint Hearing with City of Burley and Cassia County regarding Area of City Impact a. Kunau began the hearing with a brief synopsis of the proposed hearing. 5 P a g e

6 Joining the Board and other Cassia County officials present included City of Burley Councilmen Randall Hawkins, Casey Anderson, and Jon Anderson; City of Burley Mayor Steve Ormond; and City of Burley attorneys Jason Naess and David Shirley b. County and Planning and Zoning Administrator Kerry McMurray detailed that the City of Burley began negotiations and hearings with their respective Planning and Zoning Commissions a few months ago regarding the City of Burley Area of Impact. There were some things that citizens desired to do but couldn t. c. A map provided included areas that the City of Burley desired to add to the Area of Impact with the City of Burley s C3 zone designation. d. An area of the map at the south was proposed to be changed to an R4 designation e. An R2 zone area was proposed to be changed to an R2A zone which would allow expanded uses in that area with a conditional use permit. f. The recommended proposal was to apply the City of Burley s substantive rules and the County s procedural rules to govern the Area of Impact. g. Jason Naess, representing the City of Burley, said under the new Area of Impact Agreement, the County would not enforce the animal portions of the R4 zone district. They would rely on their own animal enforcement regulations in that area. h. The addition of the C3 areas on the western edge were included to square up the boundaries of the Area of Impact. i. County substantive and procedural rules were not changed. j. A new Technical Review Committee will include both city and county personnel so that all parties of interest who need to review new subdivisions in the Area of Impact will have input. They will review technical aspects of a subdivision such as water, sewer and streets. 11:37 AM Councilman John Craner arrived to constitute a quorum of City of Burley councilman. a. Kunau asked if there were any who would like to make public comment. b. Jolene Graham, a County resident, spoke in favor of the R2A zone change to allow the City of Burley growth and to establish professional buildings. c. Kunau closed the joint hearing. 20) 11:40 AM Consider and execute Ordinances and regarding plans and regulations for zoning districts in Burley Area of City Impact and new official zoning map for Burley Area of City Impact 11:40 AM Motion: County Ordinance , Action: Approve, Moved by Paul Christensen - Member, Seconded by Tim Darrington - Member. a. City of Burley Mayor Steve Ormand opened the City of Burley hearing and asked for any comments to which there were none. b. Ormand closed the City of Burley hearing. c. The City of Burley councilmen passed a motion to dispense with the rule and read the City of Burley Ordinance No by title only one time. All other zoning changes were described by Naess and passed by motion of the City of Burley councilmen. d. McMurray said County Ordinance adopts the designated maps for changes approved. 6 P a g e
