3 Minutes Executive Committee February 7, a Mr. Dzwinel explained that Lasata Senior Living Campus owes the General Fund $4 million. This is the highest level in 10 years. If the deficit is not addressed it will negatively impact our countywide 2017 audit results and could impact our Aaa Bond Rating. 10:12AM Supervisor Nelson joined the meeting. Mr. Dzwinel presented an analysis of operational results which included historical data from of what was due to the General Fund; 2017 Lasata financials; impact of the renovation of the number of beds filled and payor mix; pool staffing usage; available fund balances of other departments to address the shortfalls at Lasata; historical General Fund balance percentage maintained ; focus for 2018; and the recommended approach for assuming the $4M. Ms. Kohal spoke to the aggressive approaches staff has taken for 2018 for maintaining revenue and controlling expenses. Discussion on payor mixes; State funding; county-owned homes in Wisconsin; pool usage; whether or not to assume the entire $4M; and future plan. b. Schedule of County Board Meetings February 21 - cancelled March 21 - Youth Government Day 6. COMMITTEE REPORTS There were none. 7. Progress Drive in the Village of Saukville, subject to the conditions contained in the Ozaukee Economic Development memo, dated March 5, This resolution will move forward to the County Board for final action. 6 5.a RESOLUTION NO LABOR AGREEMENT BETWEEN OZAUKEE COUNTY AND DEPUTY SHERIFF'S ASSOCIATION - COURT SERVICE UNIT WAGE RATE ADJUSTMENT WHEREAS, employees assigned, in the Sheriff s sole and absolute discretion, to the Court Service Unit (CSU) shall be considered members of the bargaining unit and engaged in active law enforcement (protective occupation participant under Wis. Stat (48)(a)) while assigned to the CSU; and WHEREAS, all employees whether from a patrol assignment or a jail assignment assigned to the CSU shall be placed in the Patrol Officer classification in Sec of the collective bargaining agreement and paid at the rate in the classification most closely corresponding to the Employee s wage rate prior to the CSU assignment that does not result in a reduction of wage rate; and WHEREAS, all CSU Employees shall progress in the Patrol Officer classification wage table according to tenure and shall receive all increases, if any, to the wage rates that otherwise apply to Patrol Deputies in the same wage classification within the wage table. NOW, THEREFORE, BE IT RESOLVED by the Ozaukee County Board of Supervisors that the County Administrator is authorized to execute any contracts, agreements or other documents necessary to carry out the intent of this resolution. 7 5.a Executive Committee AGENDA INFORMATION SHEET AGENDA DATE: April 4, 2018 DEPARTMENT: Human Resources DIRECTOR: Chris McDonell PREPARER: Chris McDonell Agenda Summary Labor Agreement Between Ozaukee County and Deputy Sheriff's Association - Court Service Unit Wage Rate Adjustment Court Service Unit (CSU) employees provide a wide variety of service to the courts on behalf of the Sheriff to include, but not limited to providing security in courtrooms, hallways, meeting rooms and public areas adjacent to the courts; ensuring proper decorum within the courtrooms; carrying out orders of the court; serving civil process warrants and enforcing orders of the court; and transporting inmates to and from the courts and to and from the jail. The attached Side Letter of Agreement addresses two issues with CSU wages: 1) The labor association and county administration would like all CSU employees to be paid on the same wage scale, and 2) all CSU employees should receive the same wage increases that apply to Patrol Deputies. The current bargaining agreement includes the following language to set CSU employee wages, Upon an Employee being assigned to CSU, the Employee s wages shall be set at the lesser of either the Employee s contractual rate or the top patrol rate. Once set, Employee s wage rate shall remain frozen for the entirety of the CSU assignment, but Employee s progression on the pay scale shall continue so when the Employee leaves his/her CSU assignment, Employee s service on the CSU is recognized for progression on the pay scale. There are currently four CSU employees. Three were transferred from jailor positions, and one from a detective position. Based on the current bargaining language, the former detective CSU employee is making a higher rate than the other three. The labor association and county administration would like to update the language so all CSU employees are paid on the same wage scale. Prior to the current collective bargain unit agreement, CSU employees were receiving the same wage increases as Patrol Officers. Based on the current language, CSU employees are not receiving these increases. It is the intent of the labor association and county administration that all CSU employees should receive all wage increases that otherwise apply to Patrol Deputies in the same wage classification. The financial impact of these wage adjustments to the 2018 budget is an increase of $9,860. ATTACHMENTS: Side Letter of Agreement CSU Wages (PDF) Packet Pg. 7
8 5.a.a Side Letter of Agreement CSU Wage Rate It is hereby understood that employees assigned, in the Sheriff s sole and absolute discretion, to the CSU shall be considered members of the bargaining unit and engaged in active law enforcement (protective occupation participant under Wis. Stat (48)(a)) while assigned to the CSU. For purposes of establishing wage rate all Employees whether from a patrol assignment or a jail assignment assigned to the CSU shall be placed in the Patrol Officer classification in Sec of the collective bargaining agreement and paid at the rate in the classification most closely corresponding to the Employee s wage rate prior to the CSU assignment that does not result in a reduction of wage rate. Thereafter, all CSU Employees shall progress in the Patrol Officer classification wage table according to tenure and shall receive all increases, if any, to the wage rates that otherwise apply to Patrol Deputies in the same wage classification within the wage table. It is hereby further confirmed that the assignment to CSU is made in the Sheriff s sole and absolute discretion and an employee may be removed from such assignment in the Sheriff s sole and absolute discretion. This side letter amends the second paragraph of Sec. 7.03(e) of the collective bargaining agreement and the remaining provisions of the collective bargaining agreement are unaffected. 9 5.b RESOLUTION NO LABOR AGREEMENT BETWEEN OZAUKEE COUNTY AND OZAUKEE COUNTY DEPUTY SHERIFF'S ASSOCIATION - JAIL SERGEANTS BECOME PART OF OZAUKEE DEPUTY SHERIFF'S ASSOCIATION WHEREAS, Jail Sergeants are sworn personnel classified by Ozaukee County as "protective occupation participants" in the Wisconsin Retirement System per 40.02(48)(a) Stats.; and WHEREAS, the job description for Jail Sergeants is being changed so that only persons so classified by the County may be placed into that position; and WHEREAS, all Jail Sergeants for seniority purposes will be treated in the same manner as Jail personnel being promoted to patrol in that their seniority date begins with the date they now become a part of the Association, and in the future, the date they are promoted into the position versus their original hire date. NOW, THEREFORE, BE IT RESOLVED by the Ozaukee County Board of Supervisors that Jail Sergeants shall become part of the Ozaukee Deputy Sheriffs Association and the County will immediately begin taking the required fair share dues that all other Association members are required to make. BE IT FURTHER RESOLVED by the Ozaukee County Board of Supervisors that the County Administrator is authorized to execute any contracts, agreements or other documents necessary to carry out the intent of this resolution. The on duty Shift Commander is responsible for all staff working that shift. Up until January 1, 2018, the Jail Sergeants were the only members of the Shift Commander team that were not classified as protected for WRS (Wisconsin Retirement System). As part of the 2018 budget process, Jail Sergeants were reclassified as protected for WRS because they were performing law enforcement duties 51% or more of the time.
