1 CITY OF MONONA Regular Council Meeting Monday, April 7, 2014 The Monona, Iowa, City Council met in regular session Monday, April 7, 2014 at 6:00 p.m. at the Monona City Hall. Mayor Barb Collins presided with Randee Blietz, Dan Havlicek, Andrew Meyer, John B. Elledge and Jason Schubert present. Smith stated that tornado siren located in City Park is currently not working although should be operational by end of the week. Annual Fire Department event held at MJ s Bar & Grill Saturday, April 5 th was successful and well attended. 4) Public Hearing: Aquatic Center Parking Lot Plans & Specifications Mayor Collins opened the Public Hearing at 6:05 P.M. City engineer Jon Biederman reviewed design plans and specifications in detail for rebuilding the Monona Aquatic Center Parking Lot using a permeable paver system. Biederman 3
4 explained that the concrete pavers are not permeable, however, the spaces between the pavers allow rain water to pass through the parking surface for collection and subsequent drainage from the parking subgrade retention area into the adjacent unnamed tributary near Davis Street. Proposed improvements would retain copious amounts of rain water and would eliminate soil and gravel erosion from existing parking area. The parking lot paver system as designed would directly benefit Silver Creek and the Turkey River Watershed (TRW) as intended. There being no oral or written objections received during the hearing or at city hall, Mayor Collins closed the public hearing at 6:17 P.M. 5) Approve Resolution No Approving and Confirming Plans, Specifications, Form of Contract & Cost for the 2014 Aquatic Center Parking Improvements Project At conclusion of public hearing, it was moved by Elledge, seconded by Schubert, to Approve Resolution No Approving and Confirming Plans, Specifications, Form of Contract & Cost for the 2014 Aquatic Center Parking Improvements Project. Roll Call Vote: Ayes Five, Nays None. Resolution was adopted. Review and Consider Bid Proposals Mayor Collins then announced it was the time and place set for the reception and consideration of bids for the 2014 Aquatic Center Parking Improvements Project. It was moved by Elledge, seconded by Havlicek, to consider such proposals as had been filed, after ascertaining that the required bid security accompanied each such proposal. Carried Unanimously. Bids were received from Baker Concrete & Excavating of Waverly, Tschiggfrie Excavating of Dubuque and Bacon Concrete, LLC of Postville. Prices as quoted were $257,420.50, $249, and $248, respectively. Upon review of Bid Tabulation Summary it was recognized that Bacon Concrete, LLC was the low bidder. Engineer Biederman explained that due to a recently noted Federal requirement for State Revolving Fund (SRF) Projects, the Iowa DNR is in the process of obtaining a clarification for provisions related to Section 106 of the National Historic Preservation Act. He further stated that the city council would need to delay the construction contract award until a clarification has been made. Delay Action on Bid Proposals Upon recommendation of engineer Biederman, it was moved by Blietz, seconded by Meyer, that the meeting be adjourned to April 21, 2014 at six o clock 6:00 P.M. at city hall in Monona, Iowa, at which time and place the council will meet to further consider Bid Proposals. Carried Unanimously. 6) Monona Eligible for SRF Clean Water Resource Restoration Program It was confirmed that Monona is again eligible to apply for funding to finance a second State Revolving Fund (SRF) Clean Water Resource Restoration Sponsored Project. Available funding for a Sponsored Project would be in association with the Phase II Sanitary Sewer Drainage Collection System Improvements in the same manner as the Aquatic Center Parking Improvements are with the Wastewater Treatment Plant (WWTP) Improvement Project. 4
5 7) Review Turkey River Watershed Management Authority Projects/Practices Lora Friest, executive director of the Northeast Iowa Resource Conservation & Development (NE Iowa RC&D) discussed proposed projects and practices that are being planned and developed for the Turkey River Watershed (TRW). Friest explained that the RC&D is under contract with the Turkey River Watershed Management Authority (TRWMA) as part of a grant program funded by Iowa Economic Development Authority (IEDA) in 2012 to work with water resource professionals, landowners, city/county/regional employees, producers groups and residents to develop a comprehensive plan to address water quality and quantity issues in the TRW. Her power point presentation was informative and detailed methods being considered to reduce downstream flooding as well as to improve water quality. Permeable paver systems, water retention basins, bio-swales, rain barrels, rain gardens, ponds, wetlands, green roofing, native turf/plants and nutrient reduction practices were mentioned. Potential funding opportunities for communities, county soil & water conservation districts, growers and the TRWMA were discussed along with how they might be implemented as part of the comprehensive plan. Friest concluded her comments by stating she would be willing to set up a public meeting in Monona to discuss water conservation practices. 8) Parolee Community Services Program At previous regular council meeting Gene Bries of Iowa Department of Corrections explained Parolee Community Services program. Bries stated there would be no cost to the city to utilize the program whereby parolees would perform various tasks like lawn mowing, grass trimming, weeding, pruning, cleaning, raking and painting as well as other misc. jobs. He noted that if a parolee would get hurt while doing community service, they would be covered by the state and that there are people living in Monona who have court costs that they need to pay off that would participate in the program. Cleaning, painting, weeding, raking, pruning and other misc. jobs were mentioned that could be done by parolees in city parks, facilities and properties. City maintenance employee Bill Benda stated there is plenty to do and would be able to keep two (2) people busy. At conclusion of discussion, it was consensus of council to utilize the services of the parolee program for performing various tasks within the city. Mr. Bries would be contacted to schedule workers. 9) Status of Iowa DOT (IDOT) U.S.18 Ditch Slope Project Communication dated March 24, 2014 was received from District 2 design engineer Mark Callahan that the Iowa DOT would not pursue the U.S. 18 Ditch Slope Project as proposed. It was confirmed that the project to flatten ditch slopes in portions of DOT Right-of-Way (ROW) from Postville to Marquette would not be taking place. Administrator Canton explained that the city of Monona was required to convey three (3) small parcels of property to the IDOT as part of the project. The parcels are adjacent to existing ditch slopes near the Monona Wastewater Treatment Plant (WWTP) and the Monona Wire Factory. He further stated that a verbal request had been made March 31 st asking the IDOT to Deed the property back to the city of Monona since the project would not be initiated. IDOT officials indicated they would review the matter and determine a course of action within sixty (60) days. 5
6 10) Approve City Investment Policy In order to be in compliance with Chapters 12B.10B of the Iowa Code, it was recommended that city council adopt an Investment Policy for handling of city s cash and investments. A standard policy used by many cities was provided by Hacker Nelson & Co., PC for consideration. After review of provisions, it was moved by Blietz, seconded by Elledge, to adopt the Monona Investment Policy as submitted. Carried Unanimously. 11) Approve NEIT Easement for Installation of Fiber Optic Cable Northeast Iowa Telephone (NEIT) requested an easement to install new fiber optic cable along north boundary of real estate parcel No located in alley west of North Page Street. Arial map of easement area and existing structures was provided that also identifies adjacent properties and landmarks. Moved by Havlicek, seconded by Schubert, to approve proposed NEIT easement. Carried Unanimously. 12) Approve Appointment to Mae Reusser Board Upon recommendation of the mayor, it was moved by Blietz, seconded by Meyer, to appoint Ann Howe to Mae Reusser Board of Trustees. Carried Unanimously. 13) Nuisance Committee It was previously suggested that the council consider establishing a committee to determine and make recommendations regarding abatement of Nuisance matters within the city. It was also mentioned that it is not always clear what constitutes a nuisance as defined by city ordinance and whether the abatement of suspected nuisances are actually enforceable. Nuisance Abatement Chapter 50 and Junk & Junk Vehicles Chapter 51 was also made available for review. At conclusion of discussion it was consensus of council to form a committee of two (2) council members and 2-3 citizens to address and make recommendations regarding nuisance matters. Formal appointment would be made at next meeting. 14) Gordon Subdivision Storm Water Drainage Monona Enterprises previously requested that council consider extending existing storm water drainage pipe an additional 300 feet from the current pipe outlet located in vacant Lot 19 approximately 150 south of Darby Drive near the Council Street intersection in Gordon Residential Subdivision. Proposed storm water pipe would extend in a southeasterly direction toward US 18. Cost for proposed work was estimated at $6,000. No action taken. 15) Consider Appropriation to MCED It was agreed to consider an appropriation for FY2015 after Monona Chamber & Economic Development (MCED) Group has established the executive director position and determined future needs. Mayor/Council/Clerk Notes: Council member Blietz informed council that proposed conversion of six (6) Garden View Independent Living units to Dependent Living units has been approved 6
7 New All-Inclusive Playground Equipment is scheduled to be installed by All-Inclusive Recreation Co. with assistance of local volunteer help on Friday, May 16 th and Saturday, May 17 th A public hearing date will need to be set at next council meeting to Amend FY2014 City Budget as well as confirm dates for annual Garbage Amnesty Days/Appliance Pickup Day Mayor Collins declared meeting adjourned at 7:39 P.M.
