Pursuant to notice through the media and in conformance with the Public Meeting Law, Simon Hare, Chair called the meeting to order at 9: 00 a. m. Items discussed were as follows: 1. RECOGNITION OF EMPLOYEES: Chair Simon G. Hare recognized and thanked the following employees for 15 years of service to the County: Calvin Harrison, Public Works; Michael Rustrum, Juvenile Justice; and Annette Sorensen, Community Corrections. None of the employees were able to attend the meeting. 2. ADMINISTRATIVE ACTIONS IN CONSIDERATION OF: a. Approval of Collective Bargaining Agreement between Service Employees International Union ( SEIU) and Josephine County for the term 07/ 01/ 12 06/30/ 15 Sara Moye, Human Resource Director, explained that the County' s bargaining objectives for this term were to maintain the status quo of medical benefits and freeze Cost of Living Allocations ( COLA' s). Both objectives were reached with these two unions. Commissioner Haugen made a motion to approve the Collective Bargaining Agreement between Service Employees International Union ( SEIU) and Josephine County for the term 07/01/ 12 06/ 30/ 15, seconded by Commissioner Hare. Upon roll call vote, motion passed 2-0; Commissioner Haugen yes, and Commissioner Hare yes. Four signature pages signed; 1 complete Agreement retained for recording; three signature pages returned to Human Resources. b. Approval of Collective Bargaining Agreement between American Federation of State, County & Municipal Employees( AFSCME) and Josephine County for the term 07/ 01/ 12 06/30/ 15 Commissioner Haugen made a motion to approve the Collective Bargaining Agreement between American Federation ofstate, County & Municipal Employees ( AFSCME) and Josephine County for the term 07/ 01/ 12 06/ 30/ 15, seconded by Commissioner Hare. Upon roll call vote, motion passed 2-0; Commissioner Haugen yes, and Commissioner Hare yes. Three signature pages signed; 1 complete Agreement retained for recording; two signature pages returned to Human Resources. c. Approval of Use of Space in Courthouse Basement for Nursing Moms Employed by the County Commissioner Haugen, as liaison to the Public Health Department, explained this action was to comply with a requirement of the Patient Protection and Affordable Care Act of 2010, and that the County would receive a federal allowance of$2, 000 to assist in implementing this requirement. Commissioner Haugen made a motion to approve the use of space in the courthouse basement for nursing moms employed by the County, seconded by Commissioner Hare. Upon roll call vote, motion passed 2-0; Commissioner Haugen yes, and Commissioner Hare yes. d. Approval of Economic Development Grants: i. Illinois Valley Data Center: $ 25,000 Grant and$ 25, 000 Loan at 2% Amortized Over 5 Years Tina Gotchall, assistant to Cameron Camp of Illinois Valley Data Center ( IVDC), described the functions of IVDC and stated the intentions for this Economic Development Grant and Loan were to boost Josephine County' s technical structure, especially wireless and internet services in the Illinois Valley. Commissioner Haugen made a motion to approve an Economic Development Grant of$25, 000 and a $ 25, 000 loan at 2% amortized over five ( 5) years to Illinois Valley Data Center, seconded by Commissioner Hare. Upon roll call vote, motion passed 2-0; Commissioner Haugen yes, and Commissioner Hare yes. Rosemary Padgett, CFO. One original document signed and returned to

Kinetic Vehicles: $ 30, 000 Grant Jack McCornack, owner of Kinetic Vehicles, described his business and stated his intentions for this Economic Development Grant were to expand his manufacturing of do- it- yourself kits for high- mileage cars. Commissioner Haugen made a motion to approve an Economic Development Grant of$30, 000 to Kinetic Vehicles, seconded by Commissioner Hare. Upon roll call vote, motion passed 2-0; Commissioner Haugen yes, and Commissioner Hare yes. One original document signed and returned to Rosemary Padgett, CFO. 3. REQUESTS/ COMMENTS FROM CITIZENS: Dale Matthews, Grants Pass, objected to Economic Development( ED) grants, stating all ED funds should only be loaned. Assessor Connie Roach thanked the Board for its approval of a breast pump room for nursing mothers. Rick Wilson, Grants Pass, of Friends of the Fairgrounds( FOE), stated the organization had encountered trouble and resistance in continuing its mission since the new Fair Manager had been hired. After some discussion, Commissioner Haugen suggested inviting all parties to a General Discussion meeting to discuss the issue. Walter Ciszek, Williams, stated he was a member of Friends of the Fairgrounds and advocated the completion of the Memorandum of Understanding. Barbara Gonzales, Grants Pass, discussed her impressions of the voting records of the Board and the ability of the public to comment on agenda items. Michael Klein, Pennington Mt., discussed the lack of response to his past economic proposal involving a casino and stated that if Measure 82 passed, the County would be able to build a casino in Cave Junction. Larry Ford, Grants Pass, discussed timber sales that were being protested and/ or stopped by lawsuits filed by a local environmental group and suggested that the O& C Counties fight back by suing that group for obstruction. Jim Frick, Cave Junction, thanked the Local Public Safety Coordinating Committee for its efforts at determining the allocation of Secure Rural Schools Funds, and discussed various manners by which timber sales could fund County services, especially Public Safety. Toni Webb, Grants Pass, spoke in favor of both Economic Development requests but was dissatisfied with the process followed by the County to approve the applications. Rycke Brown, Grants Pass, displayed a large dead weed she picked in front of the Courthouse and declared the need for a City Gardner to monitor public property for flowering weeds. She submitted for the Board' s information Exhibit A, a speech she intended to give at the next City Council meeting. Sandi Cassanelli, Merlin, stated that the version she viewed of the Memorandum of Understanding regarding coordination with the Bureau of Land Management recently approved by the Board did not contain the changes discussed. Pat Sitze, Grants Pass, discussed her contentions with the Sheriff 4. CONSENT CALENDAR: a. Approval of Resolution In the Matter of Appointment to the Josephine County Parks Advisory Board Commissioner Hare advised that Larry Ford had been appointed to this Board. One original Resolution signed and retained for recording. Commissioner Haugen made a motion to approve Consent Calendar Items 4a through 4j as listed, seconded by Commissioner Hare. Upon roll call vote, motion passed 2-0; Commissioner Haugen yes, and Commissioner Hare yes. 5. OTHER: ( ORS ( 1) "... notice shall include a list ofthe principal subjects anticipated to be considered at the meeting, but this requirement shall not limit the ability of a governing body to consider additional subjects. ") a. Approval of Allocation of SRS 2012 Funds($ 500, 000) Commissioner Haugen stated that the recommendations of the Local Public Safety Coordination Committee regarding allocation of these funds arrived late yesterday and suggested taking this item out of order to allow the public opportunity to comment. Commissioner Reedy appeared by phone at approximately 10: 55 a. m. to voice his objections to the recommendations because they only concerned the current fiscal year and therefore those positions would be eliminated next fiscal year. Commissioner Reedy recommended all monies go to increasing the jail capacity by 49 beds and court security by 5 FTE for this and next fiscal year, believing that spreading the money over two years will avoid more layoffs and more prison releases next fiscal year. Commissioner Haugen made a motion to approve the allocation of SRS 2012 Funds of$500,000 as recommended by the Local Public Safety Coordinating Council, seconded by Commissioner Hare for matters of discussion. Commissioner Haugen disagreed that this Board can or should commit funds for next fiscal year; that was the responsibility of a new board. He stated that the District Attorney' s Office was an integral prong of the Criminal Justice System, needed to move people through the jail, and questioned when allocated changes would be implemented. Commissioner Hare suggested that numbers were challenging regarding SRS Funding; that what they were really dealing with was the fact that the Sheriffs Office did not pursue all funding available to them, which will result in budget shortfall of over $ 200, 000 at the end of this fiscal year. Commissioner Haugen suggested that this Board direct the Forestry Department to initiate timber sales to generate instant revenue for the remainder of this fiscal year and the next three. After further deliberation, Commissioner Haugen called for the question. Upon roll call vote, motion failed 2-1; Commissioner Haugen yes, Commissioner Reedy no, and Commissioner Hare no. Commissioner Hare requested a 10- minute recess to further consider the matter.
4 Weekly Business Session September 5, 2012 Page 4 Meeting re- convened at 11: 09 a.m. Commissioner Hare stated that the need to go forward two years was not as important as keeping all facets of the Criminal Justice System in motion. He advised that additional funding streams could still be pursued by the Sheriff's Office. Commissioner Hare made a motion to approve Items a and b of the Local Public Safety Coordination Committee' s recommendations. Motion died for lack ofa second. Commissioner Reedy stated he did not share Commissioner Hare' s confidence in additional funding being available; he would support Commissioner Hare' s motion if it included 49 additional jail beds. Commissioner Haugen moved to accept Items a and b of the Local Public Safety Coordination Committee' s recommendations, seconded by Commissioner Hare. Commissioner Haugen again asked when the Departments could bring laid off workers back. Rosemary Padgett, CFO, responded that to with Union rules, the soonest would be September 19. Commissioner Hare stated that a review of all prongs of the comply Criminal Justice System needed to be made, with budget adjustments occurring if indicated. Commissioner Reedy stated he would not support the motion because it only dealt with one fiscal year. Upon roll call vote, motion passed 2-1; Commissioner Haugen yes, Commissioner Reedy no, and Commissioner Hare yes. 6. MATTERS FROM COMMISSIONERS: Commissioner Haugen stated that the efforts of environmental groups providing obstacles to timber sales were in effect denying their communities services and members jobs as the revenue from those sales would go far to fund them. Commissioner Hare stated that good forest management is necessary, which includes timber cutting. Commissioner Hare further discussed his relationship with Friends of the Fairgrounds. 5 City Police are Demoralized Speech to the Grants Pass City Council, 9/ 5/ 12. Video ofthe meeting is available at: S Honorable Councilors, Mayor, and Manager: I went to Baker Park to see if that trash pit had been cleaned at all since I complained two weeks ago. It was still a trash pit. I watched a woman come and clean the bathrooms and leave. Two weeks ago, I watched 4 men in an Aspire truck empty two trash cans. Apparently, that' s all the city does in that park, while the trash and weeds pile up in and around it. A police officer rode in on his motorcycle. I had to ask him if he was there in response to the litter compliant I' d called in. Of course not, but he said that he had complained numerous times about the trash himself. He said that he' d talked every year to Parks about thinning out the weeds so police could see people camping. He was down there to see who he could cite for disorderly conduct offenses. We had a nice chat, commiserating about the mess. I call this man a police officer for good reason; he is one who actually tries to keep public order, for which he is widely hated among the disorderly poor. Unfortunately, he is not allowed to cite richer people or organizations for letting their property become disorderly, like Baker Park. That power was taken away under Manager David Frasher after police and firemen were combined and called Public Safety, when Code Enforcement was created and later called Community Service Officers, or CSOs. Public Safety officers are not allowed to notice and cite weeds and litter, and even CSOs work only by citizen or supervisor complaint. A year or so ago, when I tried to get a passing CSO to look at a problem, he said that I had to call it in, and then he would be told to look at it. With supervisors who pick and choose what will be looked at and who do their best to discourage citizen complaints, powerful landowners have become safe from citation for allowing their properties to become disorderly nuisances. A few properties get abated, but one can complain about others repeatedly and nothing is done. And now, as he pointed out, he can cite, but the disorderly poor mostly don' t care, because we have no jail space for disorderly conduct or failures to appear for it. He seemed to be thoroughly demoralized, as others must be also. They signed up to police, not just enforce state laws. Please eliminate the CSO department and ask all of your officers to read our nuisance code and enforce it on sight. Rycke Brown, Natural Gardener rycke@gardener.com
6 City Manager, Please Pick Up Litter Speech to the Grants Pass City Council, 4/ 18/ 12; replayed on RVTV Channel 21; schedule at roguetv.org. Video of the meeting is available at: Last week, I asked our County Commissioners to order all county employees, including themselves, to pick up litter from public property for one half-hour after lunch. You got a copy of that speech by e- mail, so I won't belabor the reasons given then; there are more reasons why you should order all of our City servants, including yourselves, to do the same. One good reason is that it would open your eyes to the ugliness of the litter around you. One tends to ignore ugliness that is not one' s job to fix, to the point of not seeing it at all. We are busy people, rushing from one place to another when outside, and we don't feel that we have the time or the responsibility to pick up every piece of litter along the way. I' m the same way; I do most of my litter pickup on my job, which is one of my duties, or when I' m walking my dog, and not in a hurry. One learns to see something by seeking and finding it; if you seek it, you will see it, and you won't stop seeing it as long as it is one of your duties. Another is that we have nuisance codes regarding weeds and litter that you cannot rightfully enforce until the City and other governments obey them. City workers have not been taught to see and pick up the smallest litter; community corrections work crews have actually been trained to ignore cigarette butts and such, to cover more ground. If management picks up litter every day, you will consciously see that small litter, and ensure that these workers are better trained. Training the miscreants among us to properly pick up litter is a priceless opportunity that we are wasting. Indeed, with all public servants picking up litter, we can get those park workers and slaves to pull our weeds, which is the only really effective way to control most weeds in the long term, and much harder work than litter-picking. Cutting just keeps them seeding and violating code; spraying fertilizes the soil and sends some annuals into instant seed production before they die. These workers can take their weedpulling skills home and use them on their own properties, providing positive peer pressure among the lower classes. Last, but certainly not least, picking up litter daily will remind all of our public servants that you are our servants, not our masters. And yet, it will allow all of you to lead the rest of us by your example.
