CALL TO ORDER Joyce Hartman called the meeting to order at 7:00 p.m. This followed a 6:00 p.m. meeting of the Board of Education Audit Sub-Committee. B. PLEDGE OF ALLEGIANCE Everyone joined in the Pledge of Allegiance to the Flag. The sign-in clipboard was brought forward, three students signed up to speak to the Board Cheyenne Matulewich, Jack Eddings, Max Cabrera. C. PRESENTATIONS/GUESTS Cheyenne Matulewich, Jack Eddings, and Max Cabrera, together with Tara Berescik, announced that the school musical The Boys of Syracuse will be Friday, April 8 and Saturday, April 9,

2 D. SUPERINTENDENT S REPORT 1. NYS Budget Update Tom Palmer. Mr. Palmer said the NYS Budget passed, and the Gap Elimination Adjustment (GEA) has been restored. Mr. Palmer reached out by phone to Senator Bonacic and Assemblywoman Tenney. The $15/hour Minimum Wage will be phased in, with counties closest to NYC implementing it first, and counties farther away from NYC implementing it by stages. 2. Memorandum of Agreement Cafeteria. MEMORANDUM OF AGREEMENT REGARDING ABOLISHMENT OF THE CAFETERIA DEPARTMENT BETWEEN THE TRI-VALLEY C.S.D. AND THE TRI-VALLEY ESSENTIAL SUPPORT STAFF ASSOCIATION March 14, 2016 (1) Effective June 30, 2016, the District intends to abolish its Cafeteria Department and assign all school food services to a private contractor, yet to be selected, for the school year. (2) As a result of that action, all positions in the Cafeteria Department will be abolished at the end of the school year. (3) Each Cafeteria Department employee will be laid off on June 30, 2016, except if they elect to continue employment with the District as a teacher aide on the terms set forth below. (4) The District will pay each employee affected by this MoA, who does not elect to continue employment with the District as provided for herein, a one-time stipend equal to $500 multiplied by the total years of current, continuous service to TVCSD. In addition, the District will pay 90% of the cost of COBRA health insurance continuation premiums for any employee affected by this MoA who elects to accept health insurance continuation benefits as a result of their layoff, for one year, ending June 30, (5) Effective as of July 1, 2016, all affected employees will be offered continued employment with the District as a teacher aide, within the TESSA bargaining unit, at a wage rate equal to or higher than their current rate of compensation, and with a minimum scheduled number of hours for the school year equal to the lesser 2

3 of their scheduled hours in the school year or 6.75 hours per day. Employees who accept continued employment as a teacher aide will be placed on the teacher aide pay scale on the lowest step that gives them a wage rate equal to or greater than their final wage rate in the Cafeteria Department. Each employee s current continuous time in service to the District will continue to determine their seniority in the bargaining unit for layoff and overtime purposes. All other terms and conditions of employment applicable to teacher aides in the TESSA bargaining unit will apply. Employees interested in accepting continued employment with the District must put their interest in writing and deliver it to the Superintendent on or before June 15, (6) Nothing in the MoA is intended to alter an employee s right to retire, on or before June 30, 2016, under the normal terms and conditions of the current TESSA collective bargaining agreement. (7) (a) In the event that the District is not successful in contracting with a private contractor to provide food services to the District for school year, any Cafeteria Department employee affected by this Agreement will be offered the option of returning to their former position, salary, and benefits as if this Agreement did not exist. In such a case, none of the benefits set forth in this Agreement will be available to the employee. (b) After the school year, if the District elects to recreate a self-operated Cafeteria Department, employees affected by this MoA will be eligible, if they choose, to seek reemployment in the Cafeteria Department, but at wage rates assigned by the District at the time that it recreates the Department. TESSA agrees that under such circumstances, the wages, terms and benefits set forth in the current TESSA collective bargaining agreement applicable to positions in the Cafeteria Department will not be controlling on the District. Mr. Whitaker said a consultant would be meeting with him and Mr. Palmer the week of April 11, The Board asked to visit area schools who use some of the food service organizations that might bid and asked Mr. Palmer to arrange the site visits. Mr. Palmer said there would be an Open House for community members to ask questions. Mr. Larry Bracken asked if cafeteria prices would increase? Discussion ensued about costs and state regulations and price-setting, which is ultimately a Board decision. Mr. Whitaker reiterated that it is a process with many variables. Mr. Curry asked if a background check would be done on any prospective employees and Mr. Palmer said that is done as a matter of course for all prospective employees. Cathy Russo made a motion, seconded by Janet Dymond, all in favor, none opposed carried, all members present voting in favor of the MoA for abolishment of the cafeteria. 3

4 3. Budget Presentation Revenue Update Bob Whitaker. Mr. Whitaker said the Board could adopt the budget tonight and had the option of raising taxes by $53,000 tonight or for next year. A few Board Members stated they would be in favor of rolling over the increase next year, and a few Board Members stated that they desired more time to think about the issue. Mr. Whitaker encouraged the Board to adopt the budget tonight if they did not have serious reservations. Mr. Palmer explained that the Office of Real Property Taxes finalizes equalization rates in August each year. 4. Budget Adoption Mr. Palmer explained in further detail the process and variables by which he and Mr. Whitaker drew up this year s budget. He also said Mr. Musson and Mr. Whitaker worked very closely for months going over each detail of the budget codes and categories, costs and reductions. With this discussion and clarifications, Keith Edwards made a motion, seconded by Kimberly Botsford, all in favor, none opposed carried, all members present voting in favor of adopting a budget of $31,894,801 for the school year. E. RECOMMENDED ACTION E. RECOMMENDED ACTION. Mrs. Hartman said to change 4B to the abolishment of JV Softball for the school year. 1. Lori Schmitz made a motion, seconded by Pat Kelly, all in favor, none opposed carried, all members present voting in favor of the Recommended Action Portion of the Agenda including the Business Portion, and Item 4b. F. OLD BUSINESS 1. Architects Contract Mr. Palmer will be speaking to the attorneys about the contract for SWBR Architects on April 8, Iatauro Sports Complex Snack Bar Mr. Palmer will follow up on this. 3. ES Playground SED Number Mr. Palmer will be meeting with Mrs. Clevenger, Mrs. Ruston, and the ES BLT the week of April 11, 2016, to discuss the ES Playground. He will also seek the required SED Number. Handicapped accessibility will be discussed. 4. Construction Project Community Meeting SWBR Architects will be in the District on April 13, 2016 to give a presentation to Mr. Palmer. Mr. Palmer will be holding a community meeting that night to answer community questions about the proposed projects. Mr. Palmer reiterated that these proposed projects will be paid for 100% in cash, they will not be bonded, and they will put a 30-year warranty on the roofs of the buildings in the District. 5. PE Teachers, ES Playground, PEP Grant Mrs. Hartman asked about the participation of PE Teachers regarding the ES Playground. Mrs. Botsford asked about the deadline for applying for the PEP Grant, as well as when recipients would be notified? Mr. Adams said the deadline is in early May, we are working with grant writer Great Activities, at this time we 5

6 do not have a date when the grant will be awarded, we only know the deadline by which to have completed the grant application. G. NEWS AND OTHER BUSINESS None. H. EXECUTIVE SESSION At 7:53 p.m., Joyce Hartman announced the need for a motion to enter into Executive Session for Litigation. Mrs. Hartman stated there would be no more business for the night in Open Session and thanked everyone for coming to the meeting. Pat Kelly made a motion, seconded by Lori Schmitz, all in favor, none opposed carried, all members present voting in favor to enter Executive Session. At 8:44 p.m., Cathy Russo made a motion, seconded by Pat Kelly, all in favor, none opposed carried, all members present voting in favor to exit Executive Session. I.
