I believe CCAC has moved forward on the changes to ensure Nanci LIma, MMC our Association s CCAC President sustainability into the future. We are completing the second year of a multi-year set of goals. We are legally compliant with our 501(c)(3), our financial house is in order, we are promoting our profession, and we are moving forward to ensure equal access to all of our members. Jamie Anderson was and is a great leader. She challenged the Board and she challenged all of us. Was there something in the office or your personal life that you wanted to change or see changed? Did you take the steps to facilitate that change? I am sure that most of our offices are pretty much the same; once you accomplish the implementation of one change you see another area that needs improvement. Change is constant! Has change happened and you have had to accommodate to it? Sometimes that happens not only at work but with our families as well. Each September brings changes to CCAC as well. We will swear-in the new Board at the City Clerks Department meeting at the League of California Cities annual conference. If you would like to see Jamie Anderson one more time she will be at the swearing-in ceremony. We just couldn t let her go. Following the swearing-in will be the Clerks workshop Legislative Advocacy and Process - The Good, the Bad and the Ugly (1 IIMC pt.). Before that change happens I would like to thank all those currently serving on the Boards of CCAC. 2 PAGE 2 Legislative Director s Update Randi Johl-Olson, JD, MMC Legislative Director Legislative Update We are nearing the end of the legislative cycle and the final hearings on several bills are being held as we speak. Post hearing, the Governor has until October 13 th to take action on legislation. We were involved in the process on many of the bills by way of writing and/or proposing language amendments and letters of support/opposition. In addition we write and sponsored our own bill AB1316. The following bills have been chaptered already and will be effective January 1, 2014: AB 331 Under existing law elections may be consolidated under certain conditions. Existing law also requires consolidated statewide or specified local elections to be held and conducted in accordance with the provisions of law regulating the statewide or regularly scheduled election. This bill additionally specifies that whenever an election is consolidated with a special election, the consolidated election shall be held and conducted, and all other proceedings incidental to and connected with the election to be regulated and done, in accordance with the provisions of law regulating the special election. AB 813 Existing law requires local elections official to prepare a certified statement of the results of each election, and requires the Secretary of State to compile election results and prepare, certify, and file a statement of the vote from the compiled results. This bill requires the certified statement of the results of the election and the certified statement of the vote to be posted on the Internet Web sites of each local elections official and the Secretary of State in a downloadable spreadsheet format, as specified, for a period of at least 10 years. The bill only applies to an elections official who uses a computer system that has the capability of producing the election results in a downloadable spreadsheet format without requiring modification of the computer system. AB 1316 In the case of identical names, existing law requires elections officials to place a warning that there are candidates for the same office with identical names on the ballot, any sample ballot, ballot pamphlet, or other mailing sent by the official. This bill modifies the text of the statement contained within the candidate's request for a distinguishing mark next to his or her name on the ballot and introduces revised numerical specifications and procedures for the assignment of the distinguishing mark. The bill also requires the elections official to conduct a drawing of the numbers assigned to the candidates in a similar manner as provided for by existing law to determine the order on the ballot for candidates with similar names.***ccac Sponsored*** SB 311 This bill eliminates the option of submitting a new charter proposal or a proposal to amend/repeal an existing charter to the voters at a statewide primary or regularly scheduled municipal election, except for those that are proposed by voter petitions as specified. With limited exceptions, the bill essentially requires non-specified charter proposals and amendments to be submitted to the voters at a statewide general election. League The League of California Cities Annual Conference will be held in Sacramento on September 18-20, 2013 at the Sacramento Convention Center. In addition, the City Clerks Department Meeting and Legislative Advocacy Workshop will be held on September 18, 2013 as a part of the Annual Conference. An update will be provided after the conference. FPPC At the August 22, 2013 FPPC meeting, the new Commission took unprecedented action with respect to an enforcement case. Jonathon Leone, a seated Sausalito City Council Member, failed to file a (Continued on page 3) VOLUME 14, ISSUE 9
3 Save the Date CCAC 41 st Annual Conference April 23-25, 2014 PAGE 3 In beautiful Pasadena, CA Legislative Director s Update Cont. Statement of Economic Interest (Form 700) in 2010 and 2011 despite numerous contacts from the local filing officer and FPPC. As you may be aware, the FPPC has enforcement jurisdiction over two general types of cases campaign irregularities (i.e., money laundering, etc.) and campaign disclosures (i.e., failure to file, etc.). Multiple counts can be charged. The maximum fine for each count is $10,000 pursuant to the Political Reform Act. In egregious cases, civil and criminal lawsuits may be filed for greater enforcement purposes. Typically, the maximum fine is reserved for campaign irregularities versus campaign disclosures. In Mr. Leone s case, staff was recommending a $4,000 penalty for two counts of failure to file. New Commissioners Wasserman and Wynne led the charge for assessing the maximum amount in light of Mr. Leone s failure to provide mitigating circumstances or otherwise respond to the charges. Despite consideration for setting precedent in these types of cases, the Commission unanimously assessed Mr. Leone the maximum penalty of $10,000 for failing to file his Form 700 in 2010 and This case may now be used as an example case for how the new Commission will handle these types of violations in the future. We ll keep you posted. IIMC The IIMC Legislative Committee met on August 27, 2013 via conference call and discussed two key pieces of federal legislation directly related to the municipal clerk profession H.R pertaining to the Freedom of Information Act and S pertaining to proof of citizenship for voter registration. Both bills were heard out of committee H.R from the Committee on Oversight and Government Reform and S from the Rules and Administration Committee. The bills are at stand still currently because we are in the first session of this Congress. We ll keep you posted on movement if and when it happens. The text of both bills can be read in full at The Committee is also starting to work on its annual newsletter which will be distributed in January. The newsletter, as in previous years, will focus on legislative happenings in other regions and common trends to be monitored over the upcoming year. VOLUME 14, ISSUE 9
4 PAGE 4 Joann Tilton, MMC Region IX Director Region IX Director s Update TRAVELS OF A REGION IX DIRECTOR Summer is winding down and the travels of a Region IX Director will soon begin. Alice and I will be taking to the air and hitting the road to attend the 31 st Annual Conference of the Oregon Association of Municipal Recorders (OAMR) September The conference will be at The Mill Casino in North Bend, Oregon on Coos Bay. The program has something for everyone, ranging from the nuts and bolts of elections, FMLA/OFLA, legislative updates, disaster recovery and preparedness for our records to health and wellness. There will also be an Athenian Dialogue, for those who might prefer that style of learning. One thing is for sure, the program is packed with plenty of learning opportunities. And, I m willing to wager a bet there will be an occasion or two to have some fun at OAMR s annual conference! 5 What is Your Role? What do you say when someone asks what you do? Do you respond with I take the minutes or I put together the agenda? Or do you say, I am the Elections Official for the City/Town; the custodian of records; I maintain the legislative history of the agency; I am the compliance officer ensuring that all decisions of the Council are done in conjunction with federal, state, and local statutes and regulations? In talking with several council members it was surprising that many of them really have no idea what the City Clerk does, other than putting the agenda packet together and receiving their Form 460. It is up to us to do a better job of promoting ourselves and educating our electeds, department heads, and citizens as to what we do. Over the last several years, CCAC has been focusing on promoting the profession and exploring new ways to do so. Toward that end, we have secured a booth at the League of California Cities Annual Conference in Sacramento. This will give us the opportunity to engage many people on a different level and as a professional organization. The Committee has been very busy putting together information that is pertinent and will be most effective in communicating our message. One piece in particular, Working with Your City Clerk is very informative. Some highlights of the handout are the introduction of the idea that public service is a balanced triangle - Success in public service requires an even-sided, balanced triangle. The City Council, City Clerk, and City Manager must understand and respect each other s roles and share an obligation in maintaining this balance. It also discusses the role of the City Clerk as the Elections Official, Local Legislation Auditor, Municipal Officer, Political Reform Filing Officer, maintain Records & Archives, handling Public Inquiries & Relationships, and City Council Support Services. A copy of the handout can be found on the CCAC website and I would encourage you to review it and share it with others in your agency and community. As Mahatma Gandhi said, Our greatness lies not so much in being able to remake the world as being able to remake ourselves. We are an association of individuals that have developed into outstanding and educated professionals and it s imperative that each of us be our own best advocates. It s up to us! PAGE 5 Rebekah Barr, MMC 1st Vice President Upcoming Athenian Dialogue TEAM OF RIVALS The City of Pacific Grove is hosting an Athenian Dialogue on the book Team of Rivals. The Dialogue will be held at the Pacific Grove Museum of Natural History on October 19, 2013, starting at 9:00 am. The Dialogue will be led by Casey Lucius, PhD, Associate Professor at the Naval War College and Pacific Grove City Council Member. This multiple biography is centered on Lincoln's mastery of men and how it shaped the most significant presidency in the nation's history. "Lincoln's road to success was longer, more tortuous, and far less likely" than the other men, and when opportunity beckoned, Lincoln was "the best prepared to answer the call." Stay tuned for more information Give Back to the Community Campaign The Southern Division of the California City Clerk s Association wants to give back to the Community by participating in a Plane Pull! We would like to take this opportunity to invite Northern and Central division members to participate in giving back to the community. You ask: What is a Plane Pull? It s a fun and competitive team-building exercise pitting teams of men and women against a REAL aircraft and it benefits the USO facility at Ontario. The USO is recognized as a safe haven for the military troops and their families. The Ontario facility serves the needs of almost 20,000 members of the Armed Forces and their families each year. Additional beneficiaries of the Plane Pull include Travelers Aid of the Inland Empire, Baldy View ROP Foundation and Ontario s educational outreach programs for disadvantaged students. Each team of 20 gets two tries to pull the 120,000 lb Boeing 727 aircraft 25 feet. Awards go to the Fastest Pull Team, the Slowest Pull Team, the Most Creative Team Name and the Top Fundraising Team. Individuals awards go to the First, Second and Third Place teams, but all team participants receive a Plane Pull commemorative t-shirt. The date of the event is Saturday, November 16, 2013; it begins at 8:30 am and is over by noon. There is a $25-$30 registration fee per person (they haven t given me the actual team registration amount, the last two years it was $500) and then the price of a team shirt (so we all match). If you want to participate in this really fun event for a wonderful cause, or if you have a creative idea for a team name, contact Eva Buice (ebuice@ci.ontario.ca.us) (909) , as soon as possible to secure a spot on the team. Registration begins in September and we need to have our team members ready and registration fees collected so we can get them in immediately as the event is limited to 15 teams. At the Southern Division s fall meeting we will be having a special basket of goodies to raffle off with the proceeds going towards our fundraising efforts for this event. We are open to other ideas for fundraising for this worthy cause, and of course all monetary donations are gladly accepted (checks can be made out to Ontario Friends of the Airport. With the help of its supporters, the USO continues to provide a home away from home to service men and women around the world. The Ontario USO Center offers a welcoming place to come between flights, and offers the following services FREE to our military members and families: A place to rest, sleep, nap, recharge The Plane Janes after the plane pull, with the Mayor as our Coach Snacks, drinks, meals Computers with internet connection Library with many books to read there or take with you when you leave Recreation Room with pool table, air hockey, basketball game, puzzles, and more Media room with hundreds of DVDs to watch while you wait Family and kids room with toys, TV, crib and child's bed Outdoor patio area for fresh air eating, or smoking (if you must!) We also have a multitude of knowledgeable volunteers who can help arrange transportation, hotel stays, and other services.
