I didn t either. And that original blue is still proudly displayed on the Ireland presidential standard and flag. On March 17 th, I may just have to wear blue from now on. Now on to the real business at hand: MEMBERSHIP SURVEY As you will recall, in October the CCAC Executive Board established three goals for the current year. The goals are as follows: Engage the membership in a sustainable manner to encourage maximum participation at all levels of the Association. Provide professionally relevant education responsive to the membership while facilitating CMC/MMC certification and/or higher education. Promote the understanding of the City Clerk s role as an executive municipal officer. The first goal included the creation and administration of a membership survey to ascertain the professional and educational needs of the membership at large. The survey was administered through Survey Mon- M A R C H key and responses were due by March 1 st. The responses will be provided to the membership at the Annual Conference and through listerv thereafter. To date, 267 responses were received. With a more than 25% response rate, the information received will be reliable for statistical purposes. Keep your eyes open for the listserv announcement of the winners of the American Express gift cards. FPPC TASK FORCE RECOMMENDATIONS Several of the FPPC Task Force recommendations have made their way to legislation as anticipated. To date, those bills include the following: AB 447 (Huffman and Fletcher) Declares intent of Legislature to enact legislation related to the Political Reform Act AB 1146 (Norby) Increases the current campaign contribution and expenditure limits from $100 to $200 AB 1148 (Brownley) Requires certain slate mailers to have the candidate or ballot measure noted by an asterisk SB 18 (Blakeslee) Limits the ability of special interest groups and lobbyists employers to give gifts to members of the Legislature SB 19 (Blakeslee) Declares intent of Legislature to enact legislation regarding telephone calls related to candidates and ballot measures SB 31 (Correa) Declares intent of Legislature to enact legislation requiring local governments to create lobbyist registration programs as condition of being eligible to apply for discretionary grants from state agencies or departments (Continued on page 2)

We will also keep you apprised of the status through the Official Word. LEAGUE LEGISLATIVE COMMITTEE The next set of League Policy Committee meetings will occur on April 7 th and 8 th in Ontario. Follow-up reports will be provided in the May Official Word. Congratulations to the CCAC Legislative Committee on its successful submission of three legislative proposals which are now being carried in an omnibus bill by the Senate Elections and Constitutional Amendments Committee. The bill number is SB 327. Additional information regarding this bill and others can be found in the Legislative Director s report below. That is all for now. I have the wonderful opportunity to represent California at the annual conference of the Washington Municipal Clerks Association in late March and will report back accordingly in next month s Official Word. You may have seen the many listserve announcements letting you know that you can now renew your CCAC membership on line and pay with a credit card. Many of you have already renewed your membership. For those of you who have not heard the news, the process is very easy. Go to the CCAC webpage at and click Joining CCAC. Fill out the Membership Form and hit the Submit by e- mail button in the top right hand corner. When you hit send the form information is submitted electronically and you are taken back to the Joining CCAC page to submit your payment. Simply go to the bottom of the page and select the category that fits your organization and add as many members as you like. When everyone has been added to the cart, check out using a Pay Pal account or just hit the Check Out button and you can pay with a city or personal credit card. If you are unable to use a credit card or another type of electronic payment, just print out the form and submit it with a check, but please hit the Submit by button so that we get the information transmitted electronically. If you printed out last years form and paid your dues before we went live with the new system, please go online and submit the Membership Form electronically. 4 PAGE 4 Master Municipal Clerk Academy The Master Municipal Clerk Academy, offered through CEPO s Professional Development Series, was held at the beautiful Dolce Hayes Mansion in San Jose February 9-11, Thirty- two participants representing City Clerks, Deputy and Assistant City Clerks, Special District Clerks and Clerks of the Board of Supervisors worked tirelessly over the two and one-half days. The program included sessions on conquering ones fear of public speaking, project management, knowledge management and sustaining ethics in a challenging world. JoAnne Speers, Executive Director and Ethics Program Director of the Institute for Local Government, facilitated a session on Thursday evening, Impacts of the Unethical Actions of Others Where Do We Go From Here. The participants learned about resources available through the ILG s website ( such as Understanding the Basics of Public Services Ethics (Promoting Personal and Organization Ethics, and Success in Public Service: What You Need to Know Before You Are Appointed Or Elected and shared best practices in ethics established within their agencies. Orange County City Clerks Networking Group The Orange County City Clerks Networking Group met on January 24, 2011 in the City of Santa Ana where Neal Kelley, O.C. Registrar of Voters, provided post-election information from the November 2010 election. He also discussed issues regarding the special election Governor Brown will likely be calling this year. As always, Neal and his incredible team provided interesting (and humorous) information and answered everyone s questions. A very special thank you to Maria Huizar and her outstanding staff in Santa Ana for hosting this fiesta The facility was fantastic, the sessions were packed with information and tools to take back to the workplace and the networking among participants was extremely beneficial as always. A Training of Trainers with nine participants was offered through the Professional Development Series and ran parallel to the MMC Academy. This group will return to the Dolce Hayes Mansion February to complete the second phase of the program. The goal of the final phase of the program is for the participants, in pairs or groups of three, to create and administer an eight-hour training session of their choice using all of the newly acquired training knowledge, in their local agency or community organization. As your Professional Development Director, I encourage you to mark your calendar now and plan to attend the February 2012 MMC Academy in Southern California (exact dates and location to be determined). themed event! 5 PAGE 5 Employee Relations Policy Committee On January 20, 2011, the League s Employee Relations Policy Committee met at the Sacramento Convention Center. Below is a summary of topics that were discussed: The committee did self introductions, reviewed parliamentary procedure for conducting committee business and discussed how League Policy Committees work. Policy committees review issues and legislation for which the League does not have existing policy. One of the committee s main purposes is to make recommendations on legislation, regulatory actions, and/or propositions to the League s Board of Directors. The Board of Directors reviews and considers the committee s recommendation when making final policy decisions. Staff also reviewed the League Mission Statement and Strategic Goals for 2011, which were set at the League Leaders meeting in November. These goals will guide the committee s and League s actions. The 2011 League Strategic Goals are as follows: Strong Partnerships for a Stronger Golden State. Collaborate and partner with other public and private groups and leaders to reform and revitalize the structure, governance, fiscal integrity and responsiveness of our state government and intergovernmental system. Sustainable and Secure Public Pension Systems. Work in partnership with other groups and stakeholders to promote sustainable and secure public pension systems to help ensure responsive and affordable public services for the people of our state and cities. Responsible and Accessible League Services. Implement distance learning, meeting and other cost-effective strategies to deliver even more responsive and accessible League educational, information and advocacy services to the city officials of California. League Deputy Executive Director, Dwight Stenbakken, discussed how the committee will have an opportunity to focus on the second strategic goal, related to a sustainable public pension system as well as the other strategic goals. In the past, the committee has discussed pension reform and reviewed the 2005 pension white paper. League staff will make changes to the 2011 Draft Work Program to incorporate the committee s suggestions and bring it back to this committee in April for final approval. The 2011 Draft Work Plan for the Employee Relations Policy Committee included the following: Pension Sustainability Healthcare/Insurance Workers Compensation Legislative Updates and Monitoring. League Staff provided the committee with an overview of what issues they can expect to see this year evolve into legislation and mentioned that the committee s April meeting will likely have a heavy legislative agenda. A panel of Assembly and Senate consultants also gave the committee some insight into what might happen during this legislative year. We can anticipate seeing legislation on prevailing wages, charter cities, transparency, and pension reform. League staff will keep the committee informed on these issues as they move through the legislative process. Patrick Whitnell, League General Counsel, briefed the committee on the local government impacts of Proposition 26. Mr. Whitnell reviewed the seven fee exceptions that are not covered by Proposition 26. The League City Attorneys Department has put together an initial Q&A document and is working on a more detailed analysis. 6 PAGE 6 Volunteer Opportunities Raise you hand and volunteer to assist CCAC. We are looking for assistance with committees at the State and Division level. Serve on your Division Board, work at the annual conference, or work on special projects. Just volunteer!!!! You will feel good and if you are working on certification it will also help you with points. The Member Interest Card is on Page 14. Fill it out and send to your Division Trustee! Employee Relations Policy Committee Cont. David Lamoureux, Deputy Chief Actuary and Danny Brown, Chief, Office of Governmental Affairs discussed CalPERS sponsored legislation that will be introduced this year. Some of the sponsored bills include their yearly housekeeping bill and the survivor benefit bill from last year. Mr. Brown also answered specific city questions about the increase in employers contribution rates. Dan Pellisier, Advisor, California Pension Reform, briefed the committee about his organization s effort to put a pension reform initiative on the 2012 ballot that he argued would make pensions more sustainable. According to Mr. Pellisier, California Pension Reform conducted a survey that indicates that Californians are ready to vote on pension reform. The committee did not take any action on this item. The below League of California Cities Vision, Mission and Core Beliefs document was distributed It was revised by the League Board of Directors at its November 19, 2010 meeting. Vision To be recognized and respected as the leading advocate for the common interests of California s Cities. Mission and Core Beliefs To expand and protect local control for cities through education and advocacy to enhance the quality of life for all Californians. We believe Local self-governance is the cornerstone of democracy. Our strength lies in the unity of our diverse communities of interest. In the involvement of all stakeholders in establishing goals and in solving problems. In conducting the business of government with transparency, openness, respect, and civility. The spirit of honest public service is what builds communities. Open decision-making that is of the highest ethical standards honors the public trust. Cities are vital to the strength of the California economy. The vitality of cities is dependent upon their fiscal stability and local autonomy. The active participation of all city officials increases the League s effectiveness. Partnerships and collaborations are essential elements of focused advocacy and lobbying. Ethical and well-informed city official are essential for responsive, visionary leadership, and effective an efficient city operations. 7 PAGE 7 City Clerk Spotlight - Pat Hammers On January 28, 2011, our very own Pat Hammers, City Clerk of Cathedral City, was named Woman of the Year in her community. The honor was bestowed on her by the Cathedral City Chamber of Commerce during the annual Orion Awards. In addition to being a wonderful City Clerk, Pat has served CCAC at both the state and division level for many years. Currently, Pat is serving as the Southern Division Professional Development Representative. Congrats Pat!! The award is well deserved! City Clerk Handbook Update The CCAC City Clerk s Handbook is an invaluable resource for the City Clerk profession. The most recent version of the handbook is the 2004 Edition. The Handbook Committee, formed of member volunteers, diligently reviewed each section of the 2004 publication and submitted an updated, much improved version to the CCAC Board. In addition, the CCAC Board is reviewing options to have a consultant create new sections to the handbook that will incorporate modern technologies and current best practices. 8 PAGE 8 Shirley Concolino, MMC CCAC 1st Vice-President Membership and CCAC Directory First off I want to say thank you for all who hung in there with us on the implementation of the eform and esubmittal of dues and directory information, and to those who provided constructive recommendations for changes. You never really know how it will all work until you get in there and use it. If you have not yet paid dues and/or provided your information electronically on the new form please do so. We will be posting to the CCAC website the first edition of the directory within the next 2-3 weeks. If you have not completed the information form your information will not be in the directory. The directory can be updated and reposted as many times as we wish as it converts the forms via a database (similar to a merge) into the formatted document. So once posted, if you don t see your info then you will know to submit the eform. Additionally, we have heard the recommended changes many of you have suggested regarding the form. Within this same 2-3 week period the form will be updated to accommodate as many suggestions as we are able to make. That new form will then be posted to the web. 10 PAGE 10 Dawn Abrahamson, MMC Legislative Director Legislative Update The Legislative Committee recently submitted three proposals to the Assembly and Senate Elections Committees. We are pleased to report that all three have been included in SB 327 as an omnibus bill. SB 327 is comprised of the following: Clean-up legislation changing the 5:00 p.m. reference in Elections Code Section to the close of business. The primary reason for the proposal is consistency with other sections and to allow flexibility for those cities which may close sooner or later than 5:00 p.m. Clarify legislation stated in Elections Code Section 9205 that the text of the measure does not need to be published with the notice of intention, title and summary. The written text of a measure is often lengthy and is already filed with the local elections official under Section The proposed legislation provides clarity only and does not change current requirements. Addition of a residence statement under penalty of perjury for the nominee on the Nomination Paper form as set forth in Elections Code Section There already exists a My residence address is line for the Affidavit of Circulator. Since the circulator is sometimes someone other than the candidate, the proposal is to include the same sentence under the Affidavit of Nominee. This proposal would be relevant to local elections only. The Committee is proactively monitoring legislation that will be introduced this cycle by regularly reviewing a bill list on the League of California Cities website. There are several bills of importance that you all should be aware of. These bills have been introduced and the Committee is actively watching the status of the following: AB 23 (Smyth): Local agency meetings: simultaneous meetings: prohibition. Existing law, the Ralph M. Brown Act, requires each legislative body of a local agency to provide the time and place for holding regular meetings and requires that all meetings of a legislative body be open and public and all persons be permitted to attend unless a closed session is authorized. This bill would prohibit the members of a legislative body, during a meeting of that legislative body, from convening simultaneous or serial order meetings of any other legislative body for which the members of the convened legislative body constitute at least a quorum, except as provided. AB 148 (Smyth): Local government: ethics training: disclosure Existing law, for purposes of ethics training for officers and employees of a local government, defines the term ethics laws to include, among others, laws relating to government transparency. This bill would additionally define the term ethics law to include compensation setting guidelines as established by specified organizations. This bill contains other related provisions and other existing laws. AB 413 (Yamada): Elections: allmailed ballot elections Existing law authorizes a local, special, or consolidated election to be conducted wholly by mail if specified conditions are satisfied. This bill would authorize, as a pilot program, until December 31, 2017, elections in Yolo County, other than statewide primary or general elections or special elections to fill a vacancy in a state office, the Legislature, or Congress, to be conducted wholly by mail if specified conditions are satisfied. The county would be required to report on these elections to the Legislature and the SOS, as specified, if an election is conducted wholly by mail pursuant to this authority. SB 304 (Kehoe) Elections: allmailed ballot elections: San Diego County Existing law authorizes a local, special, or consolidated election to be conducted wholly by mail if specified conditions are satisfied. This bill would authorize elections in San Diego County to be conducted wholly by mail until January 1, 2016, if specified conditions are satisfied. If San Diego County conducts an all-mailed ballot election, the bill would require the county, on or before December 31, 2016, to report to the Legislature and to the SOS regarding the success of the election, as specified. 11 Legislative Update Cont. PAGE 11 AB 392 (Alejo) Ralph M. Brown Act: posting agendas Existing law, the Brown Act, requires the meetings of the legislative body of a local agency to be conducted openly and publicly, with specified exceptions. Existing law requires that the legislative body of a local agency post an agenda, as specified, at least 72 hours before a regular meeting of that body, and prohibits the legislative body from acting on or discussing any item not appearing on the agenda, except as provided. This bill would additionally require the legislative body of the local agency, at least 72 hours before a regular meeting of that body, to post the writings that relate to an agenda item for the open session of that regular meeting. This bill would require the legislative body to post the agenda and the writings on its Internet Web site, if any, as specified. This bill would repeal the procedure for the disclosure of any writings that are distributed less than 72 hours prior to the meeting and would instead prohibit the legislative body from acting on or discussing an item on the agenda for which a related writing was not properly disclosed at least 72 hours prior to the meeting, except as provided. By expanding the duties of local agencies, this bill would impose a state-mandated local program. This bill contains other related provisions and other existing laws. SB 31 (Correa) Local government: lobbyist registration The PRA of 1974 provides for the comprehensive regulation of lobbyists, as defined. This bill would state the intent of the Legislature to enact legislation that will require each local government to create a lobbyist registration program as a condition of the local government being eligible to apply for any discretionary grant from any state agency or department. The Legislative Committee is aware that several of these bills contain issues of concern and we have already heard from some of our members. Please be aware that we are actively monitoring the status of the bills listed above and many others, and at the appropriate time we are prepared to provide comments and take a position. If you would like to express your comments and/or concern regarding any legislative matter, please send me an outlining your thoughts. STATE BUDGET Grim and getting worse! As of February 18, the Senate and Assembly Budget Committees voted to take the redevelopment funding and, in the case of the Senate, to kill redevelopment agencies. Budget conference committee meetings continue to be held the week of February 21. An alternative to the Governor s proposal to abolish RDAs has been presented and 8 out of the 10 large city mayors support the alternative, with some individual concerns, with Fresno and Santa Ana not in favor. Some sources have suggested that the proposal has not been received favorably by State Treasurer Bill Lockyer and the Governor s Office, but a formal response remains to be issued. At the direction of the Executive Committee, League staff responded by stating that we will study and consider the alternative and any proposal that does not violate or undercut Prop 22 and other parts of the constitution that protect local RDA funding. Staff has also stated that the League s support of any alternative would require the approval of the 475 member League General Assembly, as ratified by the board at its meeting in February Backing up a bit, you should know that the League Board, at its meeting in February, authorized League staff to begin preparation for possible litigation in the event any proposal violates Prop. 22 and other parts of the constitution. If this isn t bad enough, in his efforts to cut state spending, the Governor has proposed suspending funding to local governments for posting public notices for the entire fiscal year, leaving the mandate in legal question. You should also be aware that several news articles have already picked up on this and have been quoted as stating that this will raise the prospect that some local government bodies will stop complying altogether. I dispute this statement and I m sure many of you do as well. As our agency s Local Legislation Auditor, we will continue to strive to maintain transparency and provide notice of any and all open meetings with or without state reimbursement.
