I guarantee the Committee has developed a fantastic program with great speakers. In addition to everything you will Jamie Anderson, MMC CCAC President learn and all the networking, there will be time for some great fun. On Wednesday night the optional event will be at Sgt. Pepper s Dueling Pianos. I have never been there myself, but have it on good authority that it will be an event not to be missed, with good food, a few drinks, some singing and a lot of laughs. I promise you now that I will not make you suffer by attempting to sing, at least not loud enough for you to hear. Thursday at lunch we will be honoring our retirees, past presidents and new CMC s and MMC s. On Thursday night we will be honoring fellow City Clerks with Awards of Distinction and City Clerk of the Year. The retiree s lunch is always one of my favorites. It is great to see good friends again and to recognize all the clerks who have received their certifications. It is also always exciting to recognize special accomplishments of our fellow clerks with the Awards of Distinction and to find out who will be the City Clerk of the Year at the banquet. My favorite part of being President interacting with everyone and having the privilege of reading the great nominations I received. It sure confirms that City Clerks do indeed ROCK. The announcements for 2013/14 election for CCAC Board election will be out before you know it. It will be the Southern Division s turn for the office of 2 nd Vice President, plus there will be several other positions open. I encourage all of you to consider a run for the board. I promise you will never regret it. So, when the announcement comes, get out there and throw your hat in the ring. If you have any questions or concerns contact any one of us on the Board and we will be happy to talk to you. I hope everyone had a very Happy Easter enjoying family and friends, and I look forward to seeing you in Long Beach in just a few weeks.

2 PAGE 2 Legislative Director s Report Randi Johl, JD, MMC Legislative Director LEGISLATION UPDATE The current legislative cycle is in full swing and the CCAC Legislative Committee is actively working to review any and all introduced bills that may impact our profession. Generally speaking the Legislative Committee takes the following positions on bills: (1) watch, (2) support, (3) oppose unless amended and (4) oppose. The outright oppose position is usually reserved for severe philosophical differences only. Since we have a pretty good track record of working with sponsors and authors in achieving mutually acceptable amendments, the oppose unless amended option is more likely along with the watch and support positions. The following represents a list of currently proposed bills that we are tracking for direct application to the profession. Please feel free to contact me regarding any feedback you may have on any of these bills. We will keep you posted on the status of these bills as they move through committees and are amended over the next few months. Please note that CCAC and the City Attorneys are already engaged on several of the bills listed below. AB 45 (Dickinson) Political Reform Act - This bill would increase the monetary threshold of contributions or independent expenditures that qualify a person or combination of persons as a committee to $2,000. AB 141 (Gorell) Write In Candidates - This bill would require that a write-in candidate for a voter-nominated office receive votes at the direct primary election equal in number to at least 1% of all votes cast for the office at the last preceding general election at which the office was filled in order for his or her name to be placed on the general election ballot as a candidate for that office. AB 185 (Hernandez) Televised Meetings - The bill would provide that an audio or video recording of an open and public meeting made at the direction of a local agency may be erased or destroyed 2 years after the recording instead of 30 days. AB 193 (Logue) Ballot Measure Arguments - This bill would require the city elections official, for a measure placed on the ballot by the legislative body, to give preference and priority to the argument of a member or members of the legislative body authorized by that body only if the argument is consistent with the position taken by the legislative body on the measure. AB 194 (Campos) Public Criticism at Open Meetings - This bill would make it a misdemeanor for a member of a legislative body, while acting as the chairperson of a legislative body of a local agency, to prohibit public criticism protected under the act. This bill would authorize a district attorney or any interested person to commence an action for the purpose of obtaining a judicial determination that an action taken by a legislative body of a local agency in violation of the protection for public criticism is null and void, as specified. AB 331 (Garcia) Consolidation of Elections - This bill would specify that whenever an election called by a district, city, or other political subdivision is consolidated with a county or statewide election, the consolidated election shall be conducted in accordance with the applicable procedures and practices of the county in which the election is consolidated, as determined by the county elections official, provided that the procedures and practices are not inconsistent with the provisions of law regulating the statewide or county election. AB 642 (Rendon) Online Newspaper of General Circulation - This bill would provide that a newspaper that is available on an Internet Web site may also qualify as a newspaper of general circulation, provided that newspaper meets certain criteria. 3 Region IX Director s Update TRAVELS OF A REGION IX DIRECTOR Kristie and I attended the Washington Municipal Clerks Association s 43 rd Annual Conference in Tacoma, Washington March The conference theme was Learn. Grow. Lead. The Academy session offered, Leadership Lessons of Dr. Seuss was facilitated by Colorado Institute Director Kathleen Novak. We examined the key leadership concepts inspired by Dr. Seuss (and others) while covering the High C s of Leadership: Courage, Creativity, Commitment, Change, Conflict, Conversations and Collaboration. It was an action packed and content rich program which confirmed something I had always suspected Dr. Seuss is very wise. The remainder of the well-planned conference offered sessions on change, diversity, legislation, parliamentary procedure, management, public disclosure and communication. Congratulations to outgoing President Sandy Paul, incoming President Scott Passey, and the conference planning committee for an outstanding week. Why fit in when you were born to stand out Dr. Seuss Kristie will be joining me in California at the Annual CCAC Conference April in Long Beach. This will be Kristie s final Region IX stop as her term will be coming to a close in May at the IIMC Conference. We California Clerks will do our best to make it a memorable event to commemorate her dedication and service to our profession. ATLANTIC CITY CONFERENCE GET- TING THERE As you already know by now, the IIMC Annual Conference for 2013 will be in Atlantic City, New Jersey May The Program includes 8 Academies, 2 Athenian Dialogues, 3 General Session, and 42 Concurrent Education sessions. The program can be found on the IIMC Website and you should have received a hard copy in the mail. For those of you working on your travel arrangements, Kristie and I offer the following helpful information: Spirit Airlines flies directly into Atlantic City from several cities, including Los Angeles. Another option to research would be flying into the Philadelphia Airport, which is the next closest airport. Once in Philadelphia, you can take the Tropiano Airport Shuttle from the airport to Atlantic City. One-way prices are $55 for one person, $50 per person for groups. Contact can be made at or shuttle. Another less expensive option is by train ($17 one way). From the Philadelphia Airport, take the SEPTA Regional Rail Line (entrance on pedestrian bridges and commercial roadway) $7.00 one way to the 30 th Street Station (Amtrak). New Jersey Transit s Atlantic City line runs from the 30 th Street Station to Atlantic City. The fare is $10. Click here for a schedule. Once at the Atlantic City Train terminal, there are free shuttles to all hotels. The return shuttle is also free. Delegates should ask the shuttle driver and/or the hotel front desk for pickup times and waiting area. AB 792 (Mullin) Agenda/Notice Website Postings - This bill, if the local agency is unable to post the agenda or notice on its Internet Web site because of software or hardware impairment beyond the local agency's reasonable control, would require the local agency to post the agenda or notice immediately upon resolution of the technological problems. The bill would provide that the delay in posting, or the failure to post, the agenda or notice would not preclude a local agency from conducting the meeting or taking action on items of business, provided that the agency has complied with all other relevant requirements. AB 813 (Melendez) Election Results. This bill would require the certified statement of the results of the election and the certified statement of the vote to be posted on the Internet Web sites of each local elections official and the Secretary of State in a downloadable spreadsheet format, as specified. By imposing new duties on local elections officials, the bill would impose a statemandated local program. AB 1090 (Fong) Conflicts of Interest in Contracts. This bill would make a person who violates the prohibition against being financially interested in a contract, or who causes another person to violate or who aids and abets another person in violating the prohibition, subject to administrative and civil fines, as specified. The bill would authorize the Commission to enforce these violations by bringing an administrative or civil action against a person who is subject to the prohibition, as specified. AB 1316 (Harkey) Election Ballots, Identical Names. Existing law requires the elections official to place a warning that there are candidates for the same office with identical names on the ballot, any sample ballot, ballot pamphlet, or other mailing sent by the official. This bill would modify the text of the statement contained within the candidate's request for a distinguishing mark next to his or her name on the ballot. The bill would introduce revised numerical specifications and procedures for the assignment (Continued on page 5) VOLUME 14, ISSUE 4

5 PAGE 5 KOFILE Preservation Scholarship Winner As promised, I drew a name out of the hat (literally) from all 45 who submitted an interest in the random drawing for the $500 KOFILE Preservation scholarship. The lucky recipient is Denise Basham. Again, the details of the scholarship are: Up to $500 for conference registration, hotel and transportation Payment upon presentation of receipts after conference Direct payment from vendor to awardee via check Must be current member Drawing is random Thank you all for your interest! Shirley Concolino, MMC Immediate Past President Legislative Director s Report Cont. of the distinguishing mark. The bill would also require the elections official to conduct a drawing of the numbers assigned to the candidates in a similar manner as provided for by existing law to determine the order on the ballot for candidates with similar names. By imposing a new requirement on local officials, the bill would create a state-mandated local program.***ccac Sponsored Bill*** AB 1333 (Hernandez) Local Government Contracts. This bill would require the legislative body of a city, county, or district to review any contract with a private party with a total value of $250,000 or more, that contains an automatic renewal clause on or before the annual date by which the contract may be rescinded. SB 2 (Lieu) Political Reform Act Filings. The act requires elected officers, candidates, committees, and slate mailer organizations to file semiannual reports, preelection statements, and supplemental preelection statements. This bill would repeal these reporting requirements. This bill would establish quarterly statements, monthly statements, preelection statements, postelection statements, and cumulative statements for filing, as specified. SB 268 (Gaines) Political Reform Act Filings. The Political Reform Act of 1974 requires candidates and committees to file specified campaign finance reports, including semiannual statements, preelection statements, supplemental preelection statements, and late contribution reports, that include prescribed campaign finance information. This bill would repeal the requirements to file these reports and would, instead, require that a candidate or committee who makes or receives a contribution of $100 or more to report that contribution to specified filing officers within 24 hours of receiving the contribution. The bill would require a candidate or committee making the contribution to report his, her, or its full name and address, the full name and address of the recipient, the office sought by the candidate or the ballot measure, as appropriate, and the date and amount of the contribution. The bill would require the recipient of the contribution to report his, her, or its full name and address, the date and amount of the contribution, whether the contribution is in the form of a loan, and the full name of the contributor, and his or her street address, occupation, and employer or the name of the business, if self-employed. 6 PAGE 6 Athenian Dialogue - After the Conference We re very excited to announce that there is a wonderful opportunity for you to extend the learning from the CCAC annual conference and attend on Saturday, April 27, 2013, at the Long Beach Hilton Hotel (same hotel as the conference) an Athenian Dialogue on the book We Band of Angels facilitated by the amazing Mary Lynne Stratta previous IIMC President and Athenian Fellow. Mary Lynne is flying in from Texas just to lead this Dialogue for us. She has led many Dialogues, including one for the IIMC board on this book just this past year. The reviews from participants from that session are that it was an amazing experience of deep insight into the evolution of leaders in trying circumstances. So if you have ever wanted to try a Dialogue, this is a great opportunity to earn 2 points while reading an absolutely fascinating book of incredible courageous leadership and then get to delve more deeply into the story with your fellow clerks under the tutelage of the amazing Mary Lynne Stratta. IIMC REGION IX DINNER IN ATLANTIC CITY If you are attending the Annual IIMC Conference in Atlantic City, don t forget to RSVP and pay for the Region IX Dinner which will be held May 20 at 6:00 p.m. at The Melting Pot. PAGE 7 Master Municipal Clerk: ο Pilar Archer, MMC, International Institute of Municipal Clerks Legislative Director s Report Cont. SB 311 (Padilla) Charter and Charter Proposals - This bill would eliminate the option of submitting a city or city and county charter, charter amendment, or charter proposal to the voters at a statewide primary or regularly scheduled municipal election, and would require the charter, charter amendment, or charter proposal to be submitted to the voters at a statewide general election, provide there are at least 95 or 88 days, as applicable, before the election. SB 338 (Hill) Teleconferencing - This bill would require, if the legislative body of a local agency elects to use teleconferencing and a teleconference location is located outside the boundaries of the local agency, that the agenda be posted at that location at least 24 hours in advance of the meeting rather than 72 hours. SB 401 (Rubio) Petition/Paper Signatures - This bill would delete the requirement that the voter be unable to personally affix his or her information in order to request that another person print the voter's name and place of residence on the petition or paper. This bill would also delete the requirement that a witness subscribe his or her name on the petition or paper and would instead require the person who assists the voter in completing the petition or paper to sign and date the petition or paper below the signature of the voter. SB 638 (Lara) Election Candidate Misrepresentation - This bill would make it a misdemeanor for an individual to become, or induce another individual to become, a candidate for a local or state elective office under a name that is identical to, or very similar to, another candidate for that same office, with the sole intent of deliberately misleading voters who desire to vote for that other candidate, and otherwise would vote for that other candidate, but for confusion caused by the similarity in names. The bill also would authorize a candidate for a local or state office election in which this conduct occurs to seek a writ of mandate or an injunction requiring the removal of the offending candidate from the ballot. The bill would make the authority to issue a peremptory writ of mandate or injunction contingent upon clear and convincing proof that the specified conduct has occurred. The full text and history of the abovereferenced bills can be found online at or through the League s website at LEAGUE OF CALIFORNIA CITIES The next Administrative Services Policy Committee is scheduled for April 5, 2013 in Pasadena. The next League Board meeting is scheduled for April 24-25, 2013 in Sacramento. An update will be provided in next month s article. FAIR POLITICAL PRACTICES COMMIS- SION The regularly scheduled meeting of the Commission for March 28, 2013 was canceled. The next meeting is scheduled for April 25, Commission meetings are held at the FPPC office in Sacramento unless otherwise indicated. An update will be provided in next month s article. 9 Message from CEPO Institute Director They say that experience is the best teacher. If you have ever been to a CEPO, Inc. session, you know that we believe that it is not in the doing or the experience that we find the teachings but rather it is in the reflecting or reflection on the experience that insights are learning are discovered. As CEPO, Inc. celebrates our 40 th anniversary, we find ourselves as an organization, doing exactly what we train others to do stop and take some time to reflect on where we ve been, who we are, and where we want to go. We thank those of you who have taken this journey with us the past 40 years, and we look forward to welcoming new friends who join us we together we journey down the path of the next 40 years. As I reported to you last November, CEPO, Inc. has been conducting outreach to our learning community in the form of surveys and focus groups. Since then we have held two focus groups, one in northern and one in southern California. The purpose of these two focus groups was to engage our learning community in your thoughts and ideas about how we, as an organization, can create even greater value for you, your agency, and your community. We received some great input and we are using it to inform our strategic plan going forward. You can expect to hear more about the outcome of these focus groups in a different and more detailed report, and also to receive invitations to future focus groups. I am pleased to announce that one of the most significant outcomes of the feedback received was an exciting and robust schedule of programs for As we celebrate our 40 th anniversary, we are proud to offer a series of programs throughout the state. We are honoring our legacy with traditional CEPO, Inc. programming and celebrating new program partnerships and collaborations. This is a first for CEPO, Inc.! As the organization carefully considered the input received by our learning community, and as we continue to look internally at how to create even greater value for you, your agencies, and your communities, we are making some program timing changes and also expanding our programs. As you will see by the CEPO, Inc Program Lineup below, the traditional Leadership Institute is being transitioned from August to February, and the Professional Development Series (and the Master Municipal Clerk Academy - MMCA) is transitioning from February to August. This transition will begin this year. Furthermore, additional program offerings have been added to our list of programs this year, and more are being planned. So what does that mean for you? The Leadership Institute scheduled for August 2013 has been moved to February Those new dates are February 23 28, From a budgeting perspective, this is still the same fiscal year as August 2013, so you will want to budget for this session in your next FY budget cycle. We will hold the February 2014 Leadership Institute at La Casa de Maria in Santa Barbara. The next Professional Development Series (and MMCA) will be held in August 2014 in southern California (location still to be determined). We will continue to rotate the location of the PDS between northern and southern California as we have done the past six years. 10 PAGE 10 Peggy Johns, MMC SCCCA Chair SCCCA Update One of my goals as Chair of the Southern California City Clerks Association this year is to recognize City Clerks, Assistant/ Deputy City Clerks and Support staff who have made significant contributions to their City, the City Clerk s profession, and have gone above and beyond by influencing others with their mentoring, guidance, and teaching. In February the Southern Division solicited nominations from its members to recognize their peers who were worthy of this acknowledgement. The standards that the Recognition Committee used to rank the nominees were the development of programs/ideas that provided cost savings/time savings to their organization, contribution(s) made to the City Clerk organization(s), volunteer service provided to their community and to others outside their community, continuing education in the City Clerk field, mentoring of fellow City Clerks and/or support staff, and demonstrating and promoting their City s vision. It is my pleasure to announce the very first recipients of the SCCCA s selection of Molly McLaughlin, City Clerk, City of Rancho Santa Margarita; Vicki Kasad, Assistant City Clerk, City of Ontario; and Alicia Duarte, Executive Assistant, City of Lynwood. At the Southern Division General Membership meeting in Ontario on March 21, 2013, I had the great pleasure of announcing and presenting these awards to these deserving women. This has definitely been the highlight of my year in serving as Chair of the SCCCA! Molly McLaughlin s City Council honored her for this achievement at its March 13th City Council Meeting, with many supportive friends and family in attendance. Molly is also the Southern Division s nomination for the Statewide City Clerk of the Year Award, which will be announced at the CCAC Annual Conference Banquet in April. Good luck Molly! We are working on ensuring that these changes are also cost effective. We are also working closely with CCAC on their scholarship program to ensure your scholarship eligibility for the longer sessions being offered. IIMC educational staff has been notified of these changes and they are in support of ensuring the appropriate course approvals. For those of you who want your CEPO fix before February 2014, there are plenty of program options for you to join other CEPO community members this year. For those of you who previously graduated from the Leadership Institute and want to take your insightful learning to the next level, this year we are offering our first stand-alone Advanced Leadership Institute. I am available to answer any questions you may have about the transition of the Leadership Institute from August 2013 to February 2014, or for any of the program offerings listed.
