1 VILLAGE OF GLENDALE 30 Village Square Glendale, OH Minutes - Regular Council Meeting, May 3, 2004 Mayor Todd called the Council to order at 7:07 p.m., and led all assembled in the Pledge of Allegiance. It was determined by the Mayor and certified by the Clerk Treasurer that a Quorum of the Council was present. There were several Glendale residents in attendance. Minutes from the Regular Council Meeting Mrs. Grueninger moved, and Mr. Hubbard seconded, that the Minutes of the April 5, 2004, regular Council Meeting be adopted as proposed. The motion carried unanimously. 2. Mayor s Proclamation. Mayor Todd began the meeting by reading a proclamation in honor of Glendale s Yellow Ribbon Campaign: ~ P r o c l a m a t i o n ~ Proclaiming Glendale s Yellow Ribbon Campaign in the Spring of 2004 WHEREAS, the historic Village of Glendale has so much to be thankful for, all owed to our freedom of which so many in the past have sacrificed their life for, and

2 WHEREAS, today there remains conflict and aggression in the world that if left unchecked would surface in the very lands where we live, and WHEREAS, our young sons and daughters serving in the Army, Air Force, Marines and Navy remain in heated battles to bring an end to aggression and terrorism, and WHEREAS, these sons and daughters, who risk their lives daily, are now suffering shortages of basic food, hygiene supplies, correspondence and more. WHEREAS, Candy Ryan, Courtney Ryan and Shelly Chin, on April 19 th, 2004, initiated a Glendale Yellow ribbon Campaign to fill the Village with yellow ribbons to remind us of our children s sacrifices and to ask that food, materials and funds be gathered in the Village Office for shipping to those in need. NOW, THEREFORE, BE IT PROCLAIMED, by Thomas U. Todd, MD, Mayor of the Village of Glendale, Hamilton County, State of Ohio; That the highest honor and recognition is hereby bestowed upon the Ryan and Chin Families for initiating the Glendale Yellow Ribbon Campaign 2004, and to our sons and daughters who risk their lives each day while under such great sacrifice; we honor and thank you. This is yet another reason to live in, enjoy, and raise children in beautiful and historic Glendale, Ohio, U.S.A. May God bless! Mayor Thomas U. 3 2. Persons wishing to address Council Mayor Todd invited Mrs. Rachel Schmid to address Council on the subject of the renovation of the Glendale Elementary School. At the April 19 Meeting of the Princeton City School Board, representatives of G.G.B.N., the Board s architectural firm, made a 45-minute presentation on the Glendale School, including two proposed renovation plans (designated Option 1 and Option 3 ). Mrs. Schmid indicated that these options basically consisted of replacing the gymnasium with a large, two-story addition. The cost estimates were in excess of the budgeted amounts. Prior to the Board s meeting, however, Mr. Gordon Kwiecinski became aware of an existing renovation plan partially developed by the firm of McDonald, Cassell & Bassett (a Columbus firm with a fiftyyear experience in school renovation). Glendale Heritage Preservation and a number of private donors, including Mr. and Mrs. Grueninger, Mr. and Mrs. Hoeweler, Mr. and Mrs. Hoop, Mr. and Mrs. Slap, Mr. and Mrs. Murray, Mr. and Mrs. Shardelow, and Mr. and Mrs. Verchot, funded the work necessary to make that plan ready for presentation to the school board. Mr. Kwiecinski made the presentation, indicating that an adaptive reuse plan could be made to renovate the school, meet the School Board s educational requirements, and at a cost one million dollars below that budgeted for the Glendale school. A supporting letter from the Midwest Director of the National Trust for Historic Preservation strongly supported this alternate design approach. The plan employs an addition behind the Gymnasium, preserving the playgrounds and the lawn, while reinstituting a circular drop-off driveway. Mrs. Schmid has attended all of the open meetings regarding the different proposed schools, and shared some of the District s plans with Council. Mrs. Schmid indicated that the School Committee has taken all the appropriate steps that are needed at this time, but asked that Council remain ready to intervene. Mr. Hal Goldberg and Mrs. Carol Muntz also offered Council their perspectives on the School Board process. 3. Old Business Mayor Todd reported that the Village received a substantial grant ($14,838) from the United States Park Service for the Design Guidebook approved by the Planning Commission and Council. This Grant will enable an additional 1,000 copies to be printed. He asked for a recommendation that Council accept this Guidebook and order that it be published. Mr. Hoeweler moved, and Ms. White seconded, that the Guidebook be accepted. The Motion carried unanimously. Mr. Hubbard noted that the Guidebooks may not be distributed until the contributing homes listed in the document are approved by ordinance. 4. New Business Mayor Todd introduced the following ordinances for their second reading, all having been recommended by the Laws and Claims Committee: Ordinance AN ORDINANCE AMENDING GLENDALE CODIFIED ORDINANCE (B); TEMPORARY SIGN REGULATIONS

4 SECTION I: That GCO (B) is hereby amended in its entirety to read as follows; (B) Temporary signs not exceeding nine (9) square feet appertaining to the lease, rental or sale of a building or premises and shall be removed immediately upon the property lease, rental or closing. Buildings or premises may have one sign for each full street frontage. Sale Pending or Sold notices may be attached to the For Sale sign(s) until it is removed. Open House signs, separate or attached to the For Sale sign and not exceeding nine (9) square feet, may be posted only in the yard of the property for sale. An optional open house directional sign, not exceeding six (6) square feet, may be placed on Village right-of-way; said Open House signs and directional signs may be posted up to two (2) days prior the open house and must be removed immediately upon the end of the open house. It was moved by Mrs. Grueninger and seconded by Mr. Hoeweler to dispense with the third reading of Ordinance Ms. White and Mrs. Kilgore indicated that there did not seem to be a need for an emergency measure. The Motion failed with two ayes (Mr. Hoeweler and Mrs. Grueninger) and three nays (Mrs. Kilgore, Mr. Hubbard, and Ms. White). The Ordinance was therefore given its second read. Ordinance AN ORDINANCE AMENDING GLENDALE CODIFIED ORDINANCE (A) TO CLARIFY THAT LANDMARK DESIGNATIONS BOTH IN AND OUTSIDE OF THE NATIONAL HISTORIC LANDMARK DISTRICT ARE INCLUDED AND OF PROPER VENUE IN GCO TO SECTION I: That GCO (A) is hereby amended in its entirety to read as follows; (A) The purpose of this section is to preserve and protect the historic character of the entire National Historic District in the Village and any subsequent designated Local Historic District(s), identified landmarks, pivotal buildings, historic sites and contributing buildings, as well as landmark and historic sites that may be located in or outside of the National Landmark Historic District. The existing National Landmark Historic District includes that portion of Glendale which is the Glendale Historic District listed in the National Register on July 20, 1976 and designated as a National Historic Landmark on May 5, In order to preserve and protect the historic character of existing and future historic districts and landmarks, both in or outside of the Historic District, the regulations of this section are imposed in addition to those of the other zoning regulations. Mayor Todd read the title of the Ordinance including Amendments and changes made by the Laws Committee, which were reviewed and discussed by Council, for its second reading. Ordinance

5 AN ORDINANCE AMENDING GLENDALE CODIFIED ORDINANCE (C)(1) REVIEW PROCEDURES OF APPLICATIONS AND (C)(2) ALLOWING THE USE OF CERTIFIED LEGAL NOTICES IN A PAPER OF GENERAL CIRCULATION FOR THE PURPOSE OF PROPER NOTIFICATION WHEN AN APPLICATION FOR CONTRIBUTING BUILDING(S) CONTAINS 25 OR MORE BUILDINGS SECTION I: That GCO (C)(1) is hereby amended in its entirety to read as follows; (1) Any application to designate an historic district, a landmark, pivotal building, historic site or contributing building shall be referred to the GPHPC for review and recommendation. GPHPC shall complete and make recommendations to the Village Council within 60 days after referral. Upon request by the GPHPC, the Council may grant an extension of one additional 30 day period for review of an application. Should no recommendation be rendered by the GPHPC within aforesaid approved time frame, the application shall be considered approved and forwarded to Village Council. SECTION II: That GCO (C)(2) is hereby amended in its entirety to read as follows; (2) After the receipt of the GPHPC s recommendation or should no recommendation be rendered by the GPHPC within the allotted time frame, the Village Council shall convene a public hearing within 60 days of receipt and shall notify property owners of the proposed historic district, landmark, pivotal building, historic site or contributing building by certified mail at least 30 days prior to holding the public hearing to consider such designation. Applications for contributing buildings, when including 25 or more applications, may waive the certified mail notice and instead advertise via legal notice published in a newspaper of general circulation at least 30 days in advance. All hearing(s) under (C)(2) shall be published at least 15 days in advance of such hearing, in said newspaper of general circulation in the Village. This Ordinance received its second reading. Ordinance AN ORDINANCE ESTABLISHING A LOCAL LANDMARK BUILDING INVENTORY, AS SPECIFIED IN GLENDALE CODIFIED ORDINANCE , TO WIT; SECTION (J) LANDMARKS (Reserved) AND AFTER HAVING FOLLOWED DUE PROCESS AS DESCRIBED IN GCO , THE COUNCIL DOES HEREBY DESIGNATE THE FOLLOWING LANDMARKS, ALL LOCATED OUTSIDE OF THE HISTORIC LANDMARK DISTRICT AND WITHIN THE CORPORATE LIMITS OF GLENDALE, OHIO, AS INDIVIDUAL LOCAL LANDMARKS

6 SECTION I: That the Council of the Village of Glendale, having followed due process as described in GCO Designation of Landmarks, does hereby recognize and award the designation of individual Local Landmark to three (3) Local Landmark Applications, and SECTION II: That the GCO (J) Landmarks (list) shall include the following as recognized and accepted Individual Local Landmarks; Structure Address Description Greenwood Ave. H.H. Lippelman House W. Sharon Ave. Edward Haverland House 3 67 W. Sharon Ave. Reva Rath/Katherine L. Rath House The ordinance received its second reading. Ordinance AN ORDINANCE AMENDING GLENDALE CODIFIED ORDINANCE ; SECTION (A) SECTION I: That GCO (A) is hereby amended to read as follows; (A) File an application on a standard form with the Village Clerk accompanied by a basic data package. The Village Clerk will notify or cause to be notified, via certified mail, all property owners within a minimum distance of 200 of the applicant s property and include the nature of the application with the GPHPC meeting date and time. Mr. Hubbard indicated that the Laws Committee received no comments relative to the Ordinance, and recommend that it be given its second reading in Council. This Ordinance received its second reading. Mayor Todd introduced the following ordinances for their first reading, all having been recommended by the Laws and Claims Committee: Ordinance AN ORDINANCE AMENDING GLENDALE CODIFIED ORDINANCE AND AS DEPICTED IN THE ATTACHED EXHIBIT A BE IT ORDAINED, by the Council of the Village of Glendale, State of Ohio, three-fourths of all members elected thereto concurring:

7 SECTION I: That GCO Definitions and GCO Regulations Governing New Buildings, Additions, Demolitions and Removal of Buildings is hereby amended as detailed in the attached exhibit A : Definitions: The following definitions shall apply to this section of the zoning ordinance and are in addition to the definitions found in of this chapter. Non-Contributing Building: A building that does not contribute to the distinctive character of an historic district. Typically constructed after most of the buildings in an historic district were built, non-contributing buildings are usually of a different character than the contributing buildings due to their age and the difference in their scale, massing, material, and detailing. All buildings not identified as landmarks (154.45(J)), pivotal (154.45(K)) or contributing (154.45(M)) within an historic district are considered to be non-contributing buildings Regulations Governing New Buildings, Additions, Demolitions and Removal of Buildings: (A) Limitations on issuance of building and demolition permits: No construction, reconstruction, addition, demolition or removal of any building or significant exterior architectural feature thereof to any pivotal building, contributing building, non-contributing building, or any other structure within an historic district over 300 square feet in floor area; as well as, listed landmarks or historic sites in or outside of an historic district shall be undertaken prior to obtaining a certificate of appropriateness from the GPHPC and a zoning certificate from the Zoning Administrator, if applicable. No zoning certificate shall be issued by the Zoning Administrator for the construction, addition, demolition or removal of a listed pivotal building, contributing building or non-contributing building; as well as, landmark and historic sites in or outside of an historic district, except in cases falling within the exclusion set forth in this section, unless the application for such permit is approved by the GPHPC through the issuance of a certificate of appropriateness in the manner prescribed herein. (B) Certificate of Appropriateness: (1) Applicability: (a) When the owner of a pivotal building, contributing building or non-contributing building; as well as, landmark or historic site in or outside of an historic district intends to construct, reconstruct,

8 alter or demolish any exterior architectural feature of such building or an accessory building exceeding 300 square feet in floor area located on the same lot as the landmark, pivotal, contributing or non-contributing building unless said building is designated as an historic site, or when the owner of a pivotal building intends to subdivide the lot containing the pivotal building they shall first apply for and secure a certificate of appropriateness. A certificate of appropriateness is required for any exterior change to the building or its property, as otherwise regulated by this ordinance. (1) The GPHPC shall follow the design requirements as they appear in these ordinances. Any other guidelines approved by the Village Council shall be a guide to GPHPC in its determination of appropriateness. (2) The application for a certificate of appropriateness shall be filed with the Village Zoning Administrator with such plans, specifications, and other materials as the village may from time to time prescribe. (b) When the owner of a pivotal building or contributing building; as well as, landmark or historic site in or outside of an historic district intends to construct, reconstruct, alter or demolish any exterior architectural feature of such building or an accessory building exceeding 300 square feet in floor area, the GPHPC shall follow the design requirements as outlined in division (C), (D) and (E) of this section. Any other guideline approved by the Village Council shall be a guide to GPHPC in its determination of appropriateness. (c) When the owner of a non-contributing building within an historic district intends to construct, reconstruct or alter any exterior portion of a principal building or an accessory building exceeding 300 square feet in floor area, the GPHPC shall follow the design requirements for non-contributing buildings in historic districts in division (F) of this section and comply with the design requirements for site improvements in historic districts and demolition. Any other guideline approved by the Village Council shall be a guide to GPHPC in its determination of appropriateness. (C) Design requirements and guidelines for landmarks, pivotal or contributing buildings: (2) Additions: Existing buildings that are enlarged, extended, or decreased in size shall have the same architectural style, same window and door proportions, and same or similar exterior material for the enlargement, extension, or diminution as found on the existing building except, however, that minor additions to

9 existing buildings, containing less than 100 square feet of floor area, may be allowed to have different but compatible materials. (D) Design requirements for new buildings in historic districts: (1) Scale and Massing: New buildings shall be appropriate in size, scale, mass and architectural style to the surrounding pivotal and contributing buildings. (2) Materials: New buildings shall have exterior material of painted wood, material that simulates painted wood, brick, stucco, or stone masonry. Windows shall be similar to those of adjacent pivotal or contributing buildings. (4) Chimneys: New buildings, other than accessory building of less than 500 square feet, shall include one or more chimneys (whether operational or ornamental) except garages which may include cupolas instead of chimneys unless one-third or more of the buildings on adjacent lots do not contain chimneys. (8) Garages: In order to maintain the characteristics of the historic districts, no new house may be built with garage doors on the front elevation of said building facing the street. For corner lots, garage doors may face the street on the side elevation. Detached garages built behind the rear elevation of new or exiting houses may have garage doors facing the front or side of the lot. (F) Non-Contributing Buildings: Additions and alterations to, and rehabilitations of non-contributing buildings should either be compatible with the style and character of the non-contributing buildings or should cause the buildings to become more compatible with the district. (G) Demolition: The demolition of existing buildings shall not be unreasonably denied. The GPHPC shall consider the following criteria in evaluating applications for demolition. (5) Non-contributing buildings: Non-contributing buildings may be demolished if the demolition will not adversely affect the character of the district. Any new construction on the cleared site will be subject to the guidelines for new construction and site improvements. (H) Subdivision of lots containing landmarks or pivotal buildings.

10 Discussion: Mr. Hubbard indicated that the Laws Committee reviewed the attachment and discussed a number of proposed changes with Mr. Sam Allen. The Laws Committee felt that those changes should be recommended, and communicated the revised text to the Village Administrator. The Ordinance was therefore recommended for its first reading. Ordinance AN ORDINANCE INCREASING THE APPROPRIATIONS OF THE COMMUNITY FUND (SESQUICENTENNIAL LINE ITEM), IN THE AMOUNT OF $20,000, AND TRANSFERRING $20,000 TO SAID SPECIAL FUND FROM THE UN-APPROPRIATED FUNDS OF THE VILLAGE, SAID INCREASE AND TRANSFER BEING NECESSARY TO FACILITATE THE ADVANCE PURCHASE OF SESQUICENTENNIAL BLACK SQUIRRELS OF WHICH WILL BE SOLD TO PARTICIPANTS WITH SALE PROCEEDS RETUNED TO THE VILLAGE UN-APPROPRIATED FUNDS. BE IT ORDAINED, by the Council of the Village of Glendale, State of Ohio, three-fourths of all members elected thereto concurring: SECTION I: An ordinance increasing the appropriations of the Community Fund (Sesquicentennial Line Item) in the amount of $20,000, and transferring $20,000 to the Community Fund Sesquicentennial Line Item from the un-appropriated funds of the Village; said increase and transfer being necessary to facilitate the advance purchase of the Sesquicentennial Black Squirrels of which will be sold to participants and proceeds returned to the Village un-appropriated funds. SECTION III: This ordinance is hereby declared to be an emergency measure for the purpose of the timely and efficient administration of Village affairs and shall take effect immediately upon passage. In discussion, Mr. Cordes indicated that the total un-appropriated amount is approximately $400,000, representing the cash reserves maintained by the Village. Mr. Cordes explained that this appropriation was necessary to pay for the sesquicentennial squirrels and that once the squirrels were sold, the money would be returned to the unappropriated funds. There was considerable discussion of the amount and the process. It was suggested by Ms. Grueninger that a separate Sesquicentennial Budget be prepared for the entire celebration, and Mr. Cordes indicated that he had already started work on that process. Mr. Hubbard wondered if the V.P.G.I. might not be used for this purpose, but Mr. Cordes indicated that such a use might not be appropriate. He felt that utilizing the un-appropriated funds would be more appropriate.

11 It was moved by Mr. Hoeweler and seconded by Mrs. Kilgore that the Ordinance be adopted. It was moved by Mr. Hoeweler and seconded by Mrs. Kilgore that Council dispense with three readings of the Ordinance as an emergency measure for the timely and efficient administration of Village affairs. The motion to dispense with three readings carried unanimously with five ayes (Mr. Swafford, absent). The motion carried unanimously with five ayes (Mr. Swafford, absent). Resolution A RESOLUTION AUTHORIZING THE MAYOR TO ESTABLISH AND JOIN A FIRST SUBURBS CONSORTIUM Mr. Cordes explained that the Suburbs Consortium would specifically address issues affecting established communities. This group would help Glendale with many issues of concern to Village residents. Mr. Slap explained that the term First Suburbs refers to the inner ring of older communities that surround the central cities. These inner ring communities are being hurt by policies that foster the development of sprawling exurban communities. A group such as this Consortium would help the inner ring communities defend the interests of their homeowners and residents. It was moved by Mr. Hubbard and seconded by Mrs. Grueninger that Council adopt Verbal Resolution The motion carried unanimously. Ordinance AN ORDINANCE AMENDING ORDINANCE BE IT ORDAINED, by the Council of the Village of Glendale, State of Ohio, three-fourths of all members elected thereto concurring: SECTION I: An ordinance amending Section 1.6 Basis for Establishing Areas of Special Flood Hazard as follows 1) Amend 1.6(A), in its entirety, to read as follows; A. FIRM (Flood Insurance Rate Map) for Hamilton County, Ohio and the Incorporated Areas; final date of May 17, ) Amend 1.6(B), in its entirety, to read as follows; B. Other studies and or maps may be relied upon for establishment of flood protection elevation,

12 delineation of the 100 year floodplain, floodways or delineation of other areas of special flood hazard include: Flood Insurance Study for Hamilton County, Ohio and Incorporated Areas, Printed May 17, SECTION II: This ordinance is hereby declared to be an emergency measure for the purpose of the timely and efficient administration of Village affairs, the immediate preservation of the public peace, health and or safety, as provided by Ohio Revised Code , and shall take effect immediately upon passage. The Mayor explained that the purpose of this amendment is to change the dates specified in the Flood Hazard ordinance. Chief Latta indicated that the areas indicated are tentatively accepted for inclusion. It was moved by Ms. White and seconded by Mr. Hubbard that the Ordinance be adopted. It was moved by Ms. White and seconded by Ms. Grueninger that Council dispense with three readings of the Ordinance as an emergency measure for the timely and efficient administration of Village affairs. The motion to dispense with three readings carried unanimously with five ayes (Mr. Swafford, absent). The motion carried unanimously with five ayes (Mr. Swafford, absent). 5. Reports from the Mayor, Standing Committees and Special Committees MAYOR (Todd): Mayor Todd reported that 119 new members had joined the Queen City Racquet Club, and that therefore membership rates for all Glendale residents are being reduced as promised. Any Glendale resident may join at the reduced rates. The Mayor suggested that the July 5 th meeting of Council be rescheduled to Tuesday the 6 th, Monday the 12 th, or to Thursday the 1 st. After considerable discussion, it was suggested that Thursday the 1 st would be preferable. The Mayor received a nice thank you note from Mr. Ken Sims. One of his neighbors was putting a lot of waste out on the kerb on different days of the week. He noted that Glendale does not have an ordinance regulating the times at which refuse may be brought to the kerb. He thought that a Keep Glendale Beautiful Campaign might be an appropriate effort. The Mayor has received a notice regarding restructuring of the metropolitan bus system. Apparently routes in the metropolitan area are being modified effective in August. Route 78 will be changed to run along Vine Street from Springdale to Lincoln Heights. Finally, the Memorial Day Parade will be held as usual. The Village Monument is being

13 cleaned and refurbished. The World War II Memorial is being dedicated in Washington, and the Mayor knows of 26 WWII veterans now living in Glendale. FINANCE (Hoeweler): Mr. Hoeweler reported that the Committee met in his absence. The budgets were carefully supervised. On the whole, the Village is under budget. The Fire Department and the Mayor s Court are over their budgets, and Mr. Cordes and the Department Heads will address those issues. Mrs. Kilgore indicated that the Fire Department s spending appears to be over budget only because of front-loading the opnetime yearly payment to the Workman s Compensation fund. The Mayor s Court has been running over the anticipated hours. Mr. Cordes indicated that the Clerk Treasurer had addressed a memorandum to the Mayor, enabling the Department Heads to maintain control on expenditures. Mr. Hoeweler indicated that he was pleased with budgetary performance to date. FIRE (Kilgore): Mrs. Kilgore indicated that the Committee did not meet. Chief Latta reported that there were 21 details in April, 10 in the Village. The communities continue to work diligently on the processes that will lead to recommendations for a joint fire district. He feels the process is coming along nicely. LAWS, CLAIMS, MISC (Hubbard): Mr. Hubbard noted that the Committee met on April 21 st, and reviewed the proposed ordinances that Council had discussed. Contributing Building applications were also discussed. Council will need to submit applications for these properties. The Committee reviewed the listing dated March 22 nd, but there is a new list (including 315 houses) that was prepared on April 6 th. After corrections and revisions, there are 314 houses on the revised list. Mr. Hubbard moved that the list be submitted to The Planning Commission. Mr. Hoeweler seconded the motion. After the Planning Commission acts, the property owners will be notified. The motion was carried unanimously. The next meeting of the Laws Committee will be held Monday, May 17 th, at 7:00 PM in the Village Offices. POLICE (Swafford): Mr. Swafford was absent. Lieutenant Warman presented the Chief s report. The Open House will be held on May 22 nd. An additional officer will receive bicycle training. He also presented the monthly statistics. There have been only 27 traffic collisions so far this year, compared with 53 during the same period last year. PUBLIC BUILDINGS, HISTORIC PRESERVATION (Swafford): Mr. Swafford was absent. Mr. Cordes indicated that the Town Hall renovation is 95% complete. Mr. Cordes is hopeful that everything will be ready for Memorial Day. RECREATION, PLAYGROUNDS (White): Ms. White indicated that the GYS Board met on April 13 th. Six teams are playing soccer, and a number of children from other communities are involved in our teams. A coach s clinic was held and judged an entire success. An annual referee clinic will also be held. A soccer camp will also be held this summer. GYS development will also proceed with a logo contest, solicitations to the public and to the Chamber of Commerce, and having a GYS fair.

14 STREETS, PUBLIC IMPROVEMENTS, LIGHTS (Grueninger): Ms. Grueninger noted that the Committee met in April to discuss the anticipated street repairs. It was recommended that Albion Avenue and Grove Avenue will be the priority, and that other work will be scheduled in as possible. The crosswalk and paving at Congress and Sharon will be completed this year. The Committee also noted areas where the edges of the streets are being damaged by parking off the berms. These problems will be addressed by explaining the situation to residents. The Chester Road sidewalks were also discussed. UTILITIES (Hoeweler): Mr. Hoeweler reported that almost all of the water meters have been installed. Mr. Cordes indicated that there are about 70 left to be installed, and a meeting was held with the installers. The remote reading heads will be installed this fall. The Village is already noting some increased meterings. 5. Miscellaneous Business Village Plan Progress Reports. Mr. Hubbard indicated he had nothing in particular to report. Report from the Clerk/Treasurer; Financial. The Clerk Treasurer asked Council for a formal motion noting receipt, review, and approval of the Monthly financial reports. It was so moved by Ms. Grueninger, and seconded by Ms. White. The motion carried unanimously. The Mayor brought up a request to brick over the area extending from the sidewalk near the bakery. There was an extended and spirited discussion of possibilities for rehabilitating this little area, from which unknown and unauthorized persons had previously removed the Village s shrubbery. There was no consensus. Some members of Council felt that the evergreens should be replaced, although others felt that a brickedover area would be attractive. Mr. Slap suggested that the matter be made part of a Village Square beautification process to try to accommodate tables and chairs for patrons of several of the Village businesses along that sidewalk. The Mayor will take the matter under advisement. Ms. White indicated that a pile of dirt at the Matthews Court development has not yet been removed as ordered by Council, and wondered if the Village should not do the work and place a lien on the property to get paid. Mr. Slap suggested that payment could be taken from the performance bond instead of using a lien. He thought that he could provide Council with a legal opinion within the next week in order to take care of the problem most appropriately. Ms. White indicated that such a process would be fine. Mrs. Grueninger also asked about the berm at the Carruthers Pond development, which has also not yet been removed. This matter will also be examined by the Solicitor. Ms. Grueninger brought up a question regarding emergency ordinances. Sometimes, these ordinances have been in Committee for several months. Ms. Grueninger thought that the Committee minutes should be published more widely so that Village residents

15 would be more aware of what is being done all along. 6. Approval of Expenditures a General Fund Ordinance to Pay b. 261 Enterprise Fund Ordinance to Pay It was moved by Mr. Hubbard, and seconded by Mr. Hoeweler, that the proposed Ordinances for the purpose of payment of certain bills be adopted. The motion was passed unanimously. 7. Adjournment Mr. Hoeweler moved, and Ms. Kilgore seconded, to adjourn the Meeting.
