AUDIENCE COMMENTS. Any person wishing to address the City Council on any matter not on the agenda may do so at this time. However, the State open meetings law (Government Code Section et seq.) prohibits the City Council from providing a detailed response or acting upon any item not contained on the agenda posted 72 hours before a regular meeting and 24 hours before a special meeting. If you wish to address the City Council at this time, please complete a speaker s card and give it to the City Clerk prior to the commencement of the meeting. Please use the microphone provided, clearly stating your name for the official record and courteously limiting your remarks to three (3) minutes so others may have the opportunity to speak as well. 1. Ronald Richards 2. Melinda York A - DIRECTION 1. City Council Meeting Dates from April Through December 2018 This item schedules City Council Meeting dates from April through December 2018.

2 Page 2 of 5 City Clerk Byron Pope asked for confirmation on the proposed Council meeting dates. Council agreed to remove the May 3rd, May 15th, and August 28 dates. They also agreed to change the May 7th Budget Study Session #2 meeting time from 2:30 p.m. to 1:30 p.m. to 5 p.m. and to add a 2:30 p.m. Study Session meeting and 7 p.m. Formal meeting to the May 8th Budget Study Session #3 meeting. 2. Request by Mayor Gold to Establish a Strategic Planning Committee Request by Mayor Gold to establish a Strategic Planning Committee with the primary focus of developing a long term plan for the economic sustainability for the commercial area of Beverly Hills. Senior Management Analyst Cynthia Owens reported on the proposed Committee s tasks, focus, leadership and participants, and process. She reported that no new allocation is required at this time. Mayor Gold spoke on his vision for the proposed Committee. Council approved the request. 3. Request for City Council Direction Regarding the Land Use Classification of Several Proposed Uses Within the City s C-3 Commercial Zone Staff seeks City Council direction on classifying three proposed land uses as either permitted, conditionally permitted, or excluded. The uses in question include 1) Balloon Haus at 257 North Canon Drive; 2) Alchemy 43 at 440 North Canon Drive; and 3) SmileDirectClub at 371 North Beverly Drive. Assistant Director of Community Development/City Planner Ryan Gohlich provided background information on the City s various land use classifications. He discussed the proposed land uses for Balloon Haus, presented the potential benefits and concerns, and then provided staff recommendations and alternate options. Balloon Haus representatives Greg Lombardo and Austin Katz each provided information. Councilmember Bosse suggested to promote the City and include parking information on Balloon Haus s website. Vice Mayor Mirisch and Councilmember Friedman requested that adequate drop off locations be addressed. Council approved categorizing the land use as permitted. Mr. Gohlich discussed the concerns regarding the land use for Alchemy 43. He presented the Beverly Hills Municipal Code s definition of medical office then presented the considerations for categorizing the land use as either medical or non-medical. 1. Nicci Levy, Alchemy Patrick Perry, Alchemy Philip Klaparda, Alchemy 43 City Attorney Laurence Wiener spoke on the option to stay the enforcement.

3 Page 3 of 5 Council majotity agreed that Alchemy 43 should be categorized as medical-use and directed to stay the enforcement until their lease terminates in September Mr. Gohlich presented the considerations for categorizing the proposed land use for SmileDirectClub as either medical or non-medical. He provided staff recommendations and alternate options. 1. Sarah Thomas & Alex Fenkell, SmileDirectClub Council approved SmileDirectClub as non-medical use Legislative Platform The City s Legislative Platform is updated annually. This item provides an overview of the update to the City s 2018 legislative platform for both state and federal priority issues. 1. Mark Elliot Council approved the concept of the update but requested adjustments to the text and directed to bring it back to Council for approval. 5. Request for the City Council to Take a Positon on (a) Proposition 68 - California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act of 2018, (b) Proposition 69- Motor Vehicle Fees and Taxes: Restriction on Expenditures: Appropriations Limit, (c) the Tax Fairness, Transparency and Accountability Act of 2018 (# , Amdt. #1), and (U) the Proposed Ballot Initiative (# ) to Repeal Senate Bill I - the Road Repair and Accountability Act On March 15, 2018, the City Council Legislative/Lobby Committee (Liaisons Mayor Gold and Vice Mayor Mirisch) recommended that City Council consider (a) opposing Proposition 68, (b) supporting Proposition 69, (c) opposing the Tax Fairness, Transparency and Accountability Act of 2018, and (d) supporting the repeal of the proposed ballot initiative to repeal Senate Bill 1. Should the City Council concur with these recommendations, staff is seeking direction for sending letters of support/opposition for these initiatives and/or adoption of a resolution in su pport/o pposition. Item moved to the April 24, 2018 Special Study Session Meeting. 8 ADDITIONAL ITEMS TO CONSIDER (TIME PERMITTING) None C - INFORMATION 6. The Maple Counseling Center - Use of Academy Theater Staff proposes to approve the Maple Counseling Center s request to utilize one of the City s free rentals of the Academy of Motion Picture Arts & Sciences Theater in 2018.

4 Page4of5 7. Annual El Rodeo School 5K Fun Run on April 11, 2018 The fourth annual El Rodeo School 5K Fun Run is on Wednesday, April 1 1 from 9:30AM- 11:30AM. There will be temporary partial street closures along Whittier (northbound), Trenton and Elevado during the event. This is an informational item. 8. State and Federal Legislative Update This report is for informational purposes only and will provide an update on state and federal legislation. 9. Earthquake Preparedness Month - April Earthquake Preparedness Month is held each April to encourage community members to take simple steps to prepare for earthquakes. Building upon previous years efforts, a variety of outreach activities designed to reach all segments of the community, including employees and residents, will be conducted throughout the month of April. 10. Wyland Clean Water Mobile Learning Center The Wyland Foundation mobile unit will provide outreach at designated school sites in support of the National Mayor s Challenge and the City s Earth Day celebration. 11. Treasurer s Report for Month Ended January 31, 2018 This is the Monthly Treasurer s Report on the status of the City s cash receipts and disbursements and Fund Balance Summary 12. Highlights from Mayor s Cabinet Meeting This report provides monthly highlights from the Mayor s meeting with Commission Chairs.
