1 NOTICE OF REGULAR MEETING PLEASE TAKE NOTICE that there will be a regular meeting of the commission of the Madison Metropolitan Sewerage District at 8 a.m., on Thursday, May 24, 2018, at the Maintenance Facility Training Room at 1610 Moorland Road, Madison, Wis The commission will consider, and may take action, on the matters set forth on the attached agenda. If any matter on the agenda is to be considered in closed session of the commission, please be advised that following the closed session the commission will reconvene into open session for purposes of taking any action based on the closed session and concluding its agenda. The operating cash fund account shows an available balance through operating fund check no in the amount of $9,373.67; subsequent receipts totaling $2,542,686.00; less disbursements of $2,252, with a resulting cash balance of $299, The capital projects fund cash statement shows an available balance through capital projects fund account check no in the amount of $675.21; subsequent receipts totaling $679,320.65; less disbursements $42, with a resulting cash balance of $637, The debt service fund shows a beginning investment balance in the amount of $19,491,217.33; subsequent additions totaling $99,175.04; less disbursements totaling $11,216,625.82; with a resulting ending investment balance of $8,373, Action: Commisser Meyer moved, seconded by Commissioner Martin to approve items A-E of the consent calendar. Motion carried Auditor s Financial Presentation for 2017 Presenter: Comptroller and Budget Manager Shirley Fox; Jake Lenell and Shannon Small, CliftonLarsonAllen Representatives Description: Informational presentation of the 2017 financial statements and audit findings. Discussion: Ms. Fox introduced the topic for discussion and turned the presentation over to the speakers from CliftonLarsonAllen. The representatives from CliftonLarsonAllen presented to the commission an overview of the financial audit findings and the district s overall financial condition. Ms. Small gave a positive report on the audit indicating their work found no material weakness or significant deficiencies (a clean audit). Action: No action necessary. 5. Legal Services Presenter: Chief Engineer and Director Michael Mucha Description: Informational presentation and commission direction to staff. Discussion: Mr. Mucha gave an informational presentation outlining the current budget, monthly retainer, amount annually spent on special services and summary of legal services over the last four years. Action: Commissioner Martin moved that the commission be provided with a summary of special project billings on a monthly basis, seconded by Commissioner Wilson. Motion carried: Chief Engineer and Director s Report A. CED Updates Policy Governance Update Mucha: Chief Engineer and Director Michael Mucha gave an update to the commission on policy governance end outcomes. Mr. Mucha also engaged the commission as to how they would like to proceed. PS 15 Review Sereno: Strategic Communications Manager Jennifer Sereno, gave a review of the Pumping Station 15 Valve Opening event that took place May 5, 2018 at Marshall Park. 21 COMMISSION AGENDA REPORT Meeting of May 24, 2018 Review and Approval of Sanitary Sewer Extensions Lead Staff: Curt Sauser, Engineering Technician Requested Action: Adopt resolutions approving sanitary sewer extension plans. Conveyance facility and treatment plant connection charges will also be due for the lands which can be served from the sewers being installed, as identified above. A plan review fee is not charged for reconstruction projects. Background: The district is directed under Section 66.24(3) of the Wisconsin Statutes and NR108.04(4) of the Wisconsin Administrative Code to review and approve any proposed sanitary sewerage system construction or installation projects within the Madison Metropolitan area for which Wisconsin Department of Natural Resources approval is required. It is requested that the commission adopt a resolution approving sanitary sewer extension plans that were reviewed by staff and placed on file with the district. Key consideration: The commission may choose to place conditions on the approval, as necessary. Option 2: Other options brought forward by the commission. 25 GRANDVIEW COMMONS NORTH - PHASE R1 WHEREAS, plans for sanitary sewer extensions were submitted to the Madison Metropolitan Sewerage District ( the district) for Grandview Commons North - Phase 6, in the City of Madison, on April 27, 2018, by Mark Moder, City Engineering Division, and WHEREAS, the project consists of installing 350 feet of 8-inch diameter sanitary sewer on Driscoll Drive on the City s east side, and WHEREAS, the lands which can be served are lots and Outlot 40 of the plat of North Addition to Grandview Commons, and WHEREAS, Outlot 40 of the plat of North Addition to Grandview Commons has been dedicated to the public for stormwater management purposes, and has been recognized by the Capital Area Regional Planning Commission as being within an environmental corridor, and will not receive sanitary sewer service, and WHEREAS, the proposed sanitary sewer extension will connect to City of Madison s sanitary sewerage facilities, and is within the district s Far East Interceptor/Door Creek extension basin, and WHEREAS, plan review fees are due, and WHEREAS, conveyance facility and treatment plant connection charges for the lands to be served have not been paid, and WHEREAS, the district has received a sewer extension review letter # from the Capital Area Regional Planning Commission dated May 7, 2018 stating the Capital Area Regional Planning Commission staff has reviewed the proposed extension and determined that it is consistent with the urban service area provisions of the Dane County Water Quality Plan and the Dane County Land Use and Transportation Plan, and is consistent with the conditions DNR approval letter DC-0096, which added this area to the Central Urban Service Area, and WHEREAS, the chief engineer and director of the district has recommended the approval of said plans, THEREFORE, BE IT RESOLVED, that the plans for sanitary sewer extensions for Grandview Commons North - Phase 6, in the City of Madison, submitted on April 27, 2018, by Mark Moder, City Engineering Division, be approved subject to the following conditions: 25

26 1. That the City of Madison shall pay the plan review fee of $1,425 to the district within 30 days of receiving an invoice for the fee. 2. That Outlot 40 of the plat of North Addition to Grandview Commons is exempted from conveyance facility and treatment plant connection charges. 3. That prior to connection of the proposed sewers serving said lands to the public sewerage system, the City of Madison shall have paid to the district the sum of $8, for payment of $7, in Far East Interceptor/Door Creek extension conveyance facility connection charges and $1, in treatment plant connection charges; said lands being lots of the plat of North Addition to Grandview Commons. 4. That payment of the aforementioned connection charges shall be made to the district within six months of the date of approval. If payment in full is not received by the district within six months of approval, the approval shall become void and new plans shall be submitted. 5. That conveyance facility and treatment plant connection charges are adjusted from time to time, and said connection charges will be due based on the rate in place at the time at which the payment is made. 6. That if said connection charges for the lands to be served remain unpaid after construction of said sewer extensions, a late fee of 0.5 percent of the amount due shall be charged to the City of Madison for each month or partial month thereafter following connection. A one-time $500 administrative fee shall also be charged. 7. That the City of Madison shall require the presence of an engineer or an inspector on the construction of said sewer extensions who shall make a record showing in detail the construction as built and shall furnish the district with as-built plans in the case of any significant deviations from the original design. 8. That the construction, operation, maintenance and use of said sewer extensions shall be in accordance with the lawful rules and regulations of the district and with the applicable State of Wisconsin plumbing and sewerage codes. 9. That if construction of the sewer extensions covered by said plans has not commenced within four years following the approval date of this resolution, this approval shall become void and new plans shall be submitted. If construction has commenced but has not been completed within the four-year approval period, the unbuilt portion must be submitted for re-approval if it is a significant portion of the project and would require DNR approval. 26

29 GRANDVIEW COMMONS NORTHEAST - PHASE R2 WHEREAS, plans for sanitary sewer extensions were submitted to the Madison Metropolitan Sewerage District for Grandview Commons Northeast - Phase 1, in the City of Madison, on April 27, 2018, by Mark Moder, City Engineering Division, and WHEREAS, similar plans for sanitary sewer extensions titled Eastlawn Phase 2 were previously approved by the district on May 28, 2015 as plan no The Wisconsin Department of Natural Resources approved said sewer extension as DNR project no. S on June 1, These sewers which were previously approved in 2015 have not been constructed, and WHEREAS, the project consists of installing 2,116 feet of 8-inch diameter sanitary sewer on Driscoll Drive, Galileo Drive and North Star Drive on the City s east side, and WHEREAS, the lands which can be served are lots , , Outlot 49, Outlot 53 and Outlot 54 of the unrecorded plat of Northeast Addition to Grandview Commons, and WHEREAS, the proposed sewers are being installed adjacent to Lot 2 of Certified Survey Map no. 814, also known as 6211 Milwaukee Street, in the City of Madison. These lands are not yet within the bounds of the district s service area and are not yet eligible to receive sanitary sewer service, and WHEREAS, Outlot 53 of the unrecorded plat of Northeast Addition to Grandview Commons is being dedicated to the public for stormwater management purposes, and is recognized by the Capital Area Regional Planning Commission as being within an environmental corridor, and will not receive sanitary sewer service, and WHEREAS, Outlot 49 and Outlot 54 of the unrecorded plat of Northeast Addition to Grandview Commons are being dedicated to the public for alley purposes, and will not receive sanitary sewer service, and WHEREAS, the proposed sanitary sewer extension will connect to City of Madison s sanitary sewerage facilities, and is within the district s Far East Interceptor/Door Creek extension basin, and WHEREAS, plan review fees are due, and WHEREAS, conveyance facility and treatment plant connection charges for the lands to be served have not been paid, and 29

That the current approval of Grandview Commons Northeast Phase 1 shall supersede and replace the previous approval granted by the district for Eastlawn Phase 2, previously approved as sewer extension plan no That the City of Madison shall pay the plan review fee of $1,425 to the district within 30 days of receiving an invoice for the fee. 3. That Outlot 49, Outlot 53 and Outlot 54 of the unrecorded plat of Northeast Addition to Grandview Commons are exempted from conveyance facility and treatment plant connection charges. 4. That if lot areas shown on the final, recorded plat of Northeast Addition to Grandview Commons differ from the unrecorded plat submitted to the district for approval, additional conveyance facility and treatment plant connection charges may be due from the City of Madison. 30

34 RIVER ROAD RECONSTRUCTION R3 WHEREAS, plans for sanitary sewer extensions were submitted to the Madison Metropolitan Sewerage District ( the district ) for River Road Reconstruction, in the Village of DeForest, on May 1, 2018, by Neil Pfaff of Vierbicher Associates, City Engineering Division, and WHEREAS, the project will replace 3,735 feet of 15-inch diameter sanitary sewer on River Road, Mayapple Circle, and along the southern boundary of wetlands within the village s Western Green Park. The sewers being installed are larger and deeper than the existing sewers and have been designed to eliminate the nearby Vienna lift station as well as to meet increased demands of commercial and residential growth in the area. The sewers are being replaced in conjunction with the street reconstruction project, and WHEREAS, the project is adding capacity to the sanitary collection system, however no new lands will be served at this time. Future sanitary sewer extension approvals will be required to serve additional lands, and WHEREAS, conveyance facility connection charges for the lands currently being served have been paid, and WHEREAS, the proposed sanitary sewer extension will connect directly to the district s manhole MH14-196, and is within the district s Northeast Interceptor/Waunakee-DeForest extension basin, and WHEREAS, plan review fees are waived for street reconstruction projects, and WHEREAS, the district has received a sewer extension review letter # from the Capital Area Regional Planning Commission dated May 14, 2018 stating the Capital Area Regional Planning Commission staff has reviewed the proposed extension and determined that it is consistent with the urban service area provisions of the Dane County Water Quality Plan and the Dane County Land Use and Transportation Plan and fulfills the conditions of Resolution DCRPC No. 219, which added this area to the Northern Urban Service Area, and WHEREAS, the chief engineer and director of the district has recommended the approval of said plans, THEREFORE, BE IT RESOLVED, that the plans for sanitary sewer extensions for River Road Reconstruction, in the Village of DeForest, submitted on May 1, 2018, by Neil Pfaff of Vierbicher Associates, be approved subject to the following conditions: 34

That the Village of DeForest shall require the presence of an engineer or an inspector on the construction of said sewer extensions who shall make a record showing in detail the construction as built and shall furnish the district with as-built plans in the case of any significant deviations from the original design. 2. That the Village of DeForest shall invite the district to the preconstruction conference, and require the contractor to obtain a direct connection permit for the work being performed on manhole MH from the district a minimum of seven (7) days in advance of performing any work on district facilities. That the construction, operation, maintenance and use of said sewer extensions shall be in accordance with the lawful rules and regulations of the district and with the applicable State of Wisconsin plumbing and sewerage codes. 4. That if construction of the sewer extensions covered by said plans has not commenced within four years following the approval date of this resolution, this approval shall become void and new plans shall be submitted. If construction has commenced but has not been completed within the four-year approval period, the unbuilt portion must be submitted for reapproval if it is a significant portion of the project and would require DNR approval. 37 DAVIDSON ST, HEGG AVE, MAJOR AVE, DREXEL AVE & LAKE EDGE BLVD ASSESSMENT DISTRICT R4 WHEREAS, plans for sanitary sewer extensions were submitted to the Madison Metropolitan Sewerage District ( the district ) for Davidson St, Hegg Ave, Major Ave, Drexel Ave & Lake Edge Blvd Assessment District , in the City of Madison, on April 26, 2018, by Kyle Frank, City Engineering Division, and WHEREAS, the project will replace 3,560 feet of 8-inch, 10-inch, 12-inch and 15-inch diameter sanitary sewer on Davidson Street, Drexel Avenue, Hegg Avenue, Lake Edge Boulevard and Major Avenue. The sewers have been determined to be in poor condition and are being replaced in conjunction with the street reconstruction project, and WHEREAS, no new lands will be served as part of this project, and WHEREAS, conveyance facility connection charges for the lands being served have been paid, and WHEREAS, the proposed sanitary sewer extension will connect to City of Madison s sanitary sewerage facilities, and is within the district s East Interceptor basin, and WHEREAS, a variance is being requested by the City of Madison from DNR Chapter NR (2)(c) for some of the proposed sewers which do not the meet minimum design standard for slope. The Madison Sewer Utility intends to have a more aggressive maintenance schedule for this new flat sewer main, and believes their maintenance program can satisfactorily accommodate the new sewer mains with less than minimum slope, and WHEREAS, A variance is being requested by the City of Madison from DNR Chapter NR (3)(c) which requires an outside drop be provided for a sewer entering a manhole where the invert elevation of the entering sewer is 60 centimeters (2 feet) or more above the spring line of the outgoing sewer. The City proposes using inside drops in lieu of outside drops to allow for more precise field construction, improved maintenance, and will increase the diameter of the manholes from 4 feet to 5 feet to facilitate these benefits, and WHEREAS, plan review fees are waived for street resurfacing and reconstruction projects, and WHEREAS, the district has received a sewer extension review letter # from the Capital Area Regional Planning Commission dated May 7, 2018 stating the Capital Area Regional Planning Commission staff has reviewed the proposed extension and determined that it is 37

38 consistent with the urban service area provisions of the Dane County Water Quality Plan and the Dane County Land Use and Transportation Plan. WHEREAS, the chief engineer and director of the district has recommended the approval of said plans, THEREFORE, BE IT RESOLVED, that the plans for sanitary sewer extensions for Davidson St, Hegg Ave, Major Ave, Drexel Ave & Lake Edge Blvd Assessment District , in the City of Madison, submitted on April 26, 2018, by Kyle Frank, City Engineering Division, be approved subject to the following conditions: 1. That the City of Madison shall require the presence of an engineer or an inspector on the construction of said sewer extensions who shall make a record showing in detail the construction as built and shall furnish the district with as-built plans in the case of any significant deviations from the original design. 2. That the construction, operation, maintenance and use of said sewer extensions shall be in accordance with the lawful rules and regulations of the district and with the applicable State of Wisconsin plumbing and sewerage codes. 3. That if construction of the sewer extensions covered by said plans has not commenced within four years following the approval date of this resolution, this approval shall become void and new plans shall be submitted. If construction has commenced but has not been completed within the four-year approval period, the unbuilt portion must be submitted for reapproval if it is a significant portion of the project and would require DNR approval.
