3 09 Resolution Establishing Fair Market Value of Property Interests for the WRA New Main Outfall, Phase 17, Segment 4 Project Approve fair market value for the acquisition of property for the project. FISCAL IMPACT Core Project $225,000 plus closing costs In accordance with WRA policy, this WRA Board action establishes the fair market value of property to be acquired for WRA projects. This action also authorizes acquisition of property interests for the project by negotiation or by eminent domain, and allows the Operating Contractor to complete transactions if the negotiated purchase price is based on the established fair market value. On August 17, 2010, by WRA Resolution No , the Des Moines Metropolitan Wastewater Reclamation Authority (WRA) set date of public hearing and authorized mailing of notice of the proposed resolution to authorize acquisition of private property by eminent domain for the Project. On September 21, 2010, by Resolution No , the WRA held its public hearing and authorized acquisition of private property and all property interests needed for the Project, including acquisition by condemnation if necessary. On January 18, 2011, by Resolution No , the WRA Board established the fair market value. That action established the fair market value based on the fee interest and an existing leasehold interest. The lessee opted not to renew the lease as of March 31, The termination of the lease affects the fair market value. The WRA Board will need to establish the fair market value based only on the fee interest without the lease. In accordance with WRA policy, the WRA Board establishes the fair market value for the property interests to be acquired for the project, based on the appraised value of those interests. The following property has been appraised by an independent appraisal firm and based upon the appraisal, the suggested fair market value of the property interests are as follows: Titleholder: Charles Schaefer - titleholder Property Interests to be acquired: Fee Title Suggested Fair Market Value: $225,000, plus closing costs
4 10 Agenda Date: 3/15/2011 Resolution Approving and Accepting the Purchase of Repair Parts & Services for Biosolids Field Application Equipment (Terragators) from Ziegler Inc for $92, Approval FISCAL IMPACT $92, (Funding is available from WRA WRA Equipment Replacement). The WRF has two Terragators that were procured in 2000 at a Price of $162, each. Both Terra- Gators have in excess of 7,000 hours of runtime on each and the cost of a procuring a new Terragator is $450, each. It is anticipated that the refurbishment of these two Terragators will extend the life of the equipment an additional 3-5 years according to Ziegler, Inc. The Operating Contractor s Procurement Administrator has determined that repair parts and services for Terra-gator equipment is available only from Ziegler Inc., PO Box 936, Des Moines, IA , the sole area-wide distributor. Municipal Code section 2-726(a)(6) provides for the non-competitive procurement of repair parts when the required parts are available only from a single area-wide distributor and competitive bids for such repairs are thus not prospectively attainable.
5 11 Resolution Setting Date of Public Hearing and Approving Publication of Notice of Hearing to Review Anticipated Environmental Impact of the WRA West Des Moines Outfall, Phase 13, Segment 6 Project Approval FISCAL IMPACT Expansion Project None The WRA West Des Moines Outfall, Phase 13, Segment 6 Project involves construction of a 54- inch gravity sewer that starts on the east side of Jordan Creek at approximately the 1800 block in the City of West Des Moines. The project then continues southwesterly through the Raccoon River Regional Park. The sewer is located along an alignment adjacent to the park access road. At approximately the 2700 block the sewer crosses the railroad right-of-way and Grand Avenue. The sewer continues southwesterly in the northerly part of the Grand Avenue right-of-way to connect to an existing WRA sewer in approximately the 3400 block of Grand Avenue. Before the WRA can proceed with the above-described Project in accordance with the requirements of the State of Iowa Clean Water State Revolving Fund loan program, the WRA Board must hold a public hearing to inform area residents of the proposed project, to discuss the potential environmental impact of the proposed project to the community as determined by the State s Department of Natural Resources (DNR) Environmental Review, and to address area residents concerns, if any, with the project. The hearing will be set for May 17, 2011 in order to comply with the requirements set forth by State of Iowa Clean Water State Revolving Fund loan program.
6 12 Resolution Approving WRA/WRF Staff Travel/Training Request WRA Board approval. FISCAL IMPACT Mark Dauterive s cost will be $2,270 Andrew Hunter s cost will be $2,270 Lyle Sylvester s cost will be $2,270 Bill Stowe s cost will be $450 Mark Dauterive, Engine Generator Technician; Andrew Hunter, Plant Mechanic; Lyle Sylvester, Plant Mechanic, to Houston, TX on May 2 5, 2011 to attend a course on Superior 825 Series Gas Engines. This 3-day workshop provides a foundation of knowledge for the SUPERIOR 825 series engines. This information can be applied to virtually all SUPERIOR 825 series engines and is very comprehensive in all areas of engine maintenance, operation and troubleshooting. This workshop is recommended for anyone who is responsible for the safe operation and maintenance of the SUPERIOR 825 engines, and for those who desire a thorough understanding of gas engine theory and technology not easily attained in the field. William Stowe, WRA Director, to Madison, WI on April 4 5, 2011 to attend the 16 th Annual Central States Water Environment Association Education Seminar: Emerging Activated Sludge Technologies and Operational Strategies. This seminar will feature national and regional experts from various universities, wastewater utilities, and consulting engineers, and will primarily focus on the central topic of activated sludge in our wastewater industry. The keynote message will deal with the future of activated sludge, as it relates to energy efficiency and effluent quality. Other main topics will focus on ways to enhance the activated sludge process through new technologies such as integrated fixed film systems and membrane bioreactors. The topic of emerging contaminants and their fate through the activated sludge system will also be discussed.
7 13 Resolution Approving WRA Transaction Register for February 2011 WRA Board approval of the Transaction Register FISCAL IMPACT The schedule of bills allowed totals $ 6,695, DETAILS The transaction register summarizes expenditure activity of the Wastewater Reclamation Facility. February expenditures include payment for projects, payroll, contractual services, and commodities. The attached report shows the dollars for projects ($5,337,744), payroll and expenses ($1,358,027), debt service ($1,207,515) and transfers ($9,562,857) totaling $17,466,143. 8 14 Resolution Approving Reallocation of Certain Series 2006 Bond Proceeds for WRA Improvements WRA Board approval to reallocate available Series 2006 Bond proceeds within categories to current improvement projects of the WRA s CIP (capital improvement program) including the WRF Digester Improvements project and the WRA Equalization Basin Utilization project. FISCAL IMPACT Bond proceeds received in December 2006 will maintain original category allocation. No changes in debt servicing. This is the fifth reallocation of the 2006 bond proceeds. The WRF Digester Improvement project was previously allocated $100,000 for administration costs with design and construction costs funded with an SRF bond loan. The project estimates in the CIP include over $200,000 of non-eligible costs. The unspent bond proceeds currently allocated to the New Main Outfall project can be re-allocated to provide funding for this core project. WRA is ordering construction on CIP project entitled WRA Equalization Basin Utilization which will have a funding match up to $500,000 from the I-Jobs program. The Operating Contractor has determined Core Bond funds to be the best source for the WRA match and is recommending a reallocation of unspent proceeds in lieu of additional SRF bond loans. The Ingersoll Run Sewer project has unspent bond funds that can be used for another core project. This resolution allows spending in the aforementioned project, which is desirable for arbitrage reporting. This reallocation does not change any debt service for the Bond Issue. The new allocation of proceeds, as listed on the following page (2006 Bonds), does not include investment earnings.
9 15 Resolution Ordering Construction of WRA Equalization Basin Utilization Project and Fixing a Date for Receiving of Bids on April 5, 2011 and Public Hearing on April 19, 2011, Engineer s Estimate is $1,044, Approval FISCAL IMPACT $1,044, partially funded with a $500,000 I-JOBS II Targeted Disaster Relief Grant and the remainder from WRA Core Bonds This improvement includes modifications to the existing WRA Southern Tier Equalization Basin, Phase 10, Segment 13 and modifications to the existing Beaver Creek Equalization Basin, Phase 6, Segment 1. The project includes the construction of approximately 2,144 feet of sanitary sewer pipe in open cut, 10- inch diameter through 48-inch diameter, 110 feet of 48-inch sanitary sewer pipe tunneled in place, new concrete special structures with sluice gates and operators, modification of existing special structures to replace sluice gates, plug valves and operators, modifications and replacement of the electrical and control systems and other associated items. The improvements to these facilities will allow the WRA to utilize these basins in high flows which will reduce peak flows in the WRA conveyance system. The Southern Tier equalization basin is located in Des Moines, Iowa, along the north side of SE Hartford Avenue east of SE 30 th Court. The Beaver Creek equalization basin is located in Urbandale, Iowa, easterly of the east end of NW 68 th Street on the north side of Interstate 35/80. The engineer s estimate for this project is $1,044,820; bids will be taken on Tuesday, April 5, The bids will be presented at the April 12, 2011 Technical Committee meeting for review and recommendation to the WRA Board for consideration at its April 19, 2011 meeting. The funding sources for this project will be 50% I-JOBS II Targeted Disaster Relief Grant funds ($500,000 maximum) with the remainder from Core Bonds. Interim funding will be WRA surplus and/or R & R funds while waiting for I-Jobs reimbursements. Construction on this project should be completed by December 31, 2011.

11 17 Resolution Notifying WRA Board of WRA West Des Moines Outfall Emergency Sheetpile Repair and Ratification and Approval of Said Emergency Repair RECOMMENDED ACTION Ratification and approval of the actions of the Operating Contractor to issue bids and approve a contract for the WRA West Des Moines Outfall Emergency Sheetpile Repair FISCAL IMPACT $143, On January 18, 2011, under WRA Board Resolution No. WRA11-012, the WRA Board approved a contract with Peterson Contractors, Inc., in the amount of $177, for the removal and replacement of approximately 220 lineal feet of sheet pile damaged due to high flows in the Raccoon River adjacent to the WRA West Des Moines Outfall, Phase 13, Segment 7 sewer. This project is currently under construction. Recently, staff noticed that the sheetpile 300 upstream and 200 downstream was showing signs of distress and eminent failure as stated in the attached certification from H. R. Veenstra, P. E. who certified the construction plans of the repairs currently under contract. Mr. Veenstra has also recommended construction of H-pile deadmen to provide additional support to the existing sheetpile 300 upstream and 200 downstream of the contracted repair similar to the contracted design to be constructed as a change order to the WRA Outfall Sheetpile Repair, Activity ID The City Engineer concurred with Mr. Veenstra s recommendation regarding the emergency and sheetpile repair method, which is supported by the WRA Staff, and recommend that the emergency repairs and mitigation measures be done immediately. The sheetpiling supports the 54 West Des Moines sanitary sewer trunk, and eminent failure of the sheetpiling could result in failure of the 54 trunk and discharge of sanitary sewage into the Raccoon River upstream of the Des Moines Water Works affecting the Des Moines Water supply. The Operating Contractor took action to enter into an emergency repair contract to install the sheet piling pursuant to its authority in the Operating Contract and Sections (2) and 28E.6(4) of the Iowa Code. The Operating Contractor provides, In any emergency affecting the safety of persons or property, Operating Contractor shall act, at its discretion and without prior Board authorization to prevent threatened damage, injury or loss. Section (2) of the Iowa Code provides: Bonds authorized - emergency repairs.
12 2. a. When emergency repair of a public improvement is necessary and the delay of advertising and a public letting might cause serious loss or injury to the city, the chief officer or official of the governing body of the city or the governing body shall make a finding of the necessity to institute emergency proceedings under this section, and shall procure a certificate from a competent licensed professional engineer or registered architect, certifying the emergency repairs are necessary. b. In that event the chief officer or official of the governing body or the governing body may accept, enter into, and make payment under a contract for emergency repairs without holding a public hearing and advertising for bids, and the provisions of chapter 26 do not apply. Section 28E.6 (4) provides: 4. A joint board of an entity created in an agreement that is responsible for the operation of a public facility or a public improvement may undertake the emergency repair of the facility or improvement in the manner provided in section , subsection 2. If the an emergency repair is undertaken by the joint board, the chairperson, chief officer, or chief official of the joint board shall perform the duties assigned to the chief officer or official of the governing body of the city under section , subsection 2. Section (2) authorizes action by the chief officer or chief official of governing body to make a finding of the necessity to institute emergency proceedings when emergency repair of the public improvement is necessary and the delay of advertising and a public letting might cause serious loss or injury to the city, and the chief officer or official shall procure a certificate from a competent licensed professional engineer or registered architect, certifying the emergency repairs are necessary. Section 28E.6 (4) then provides that the chairperson, chief officer, or chief official of the joint board shall perform the duties assigned to the chief officer or official of the governing body of the city under Section (2). The WRA Director approved a contract with Peterson Contractors, Inc. in the amount of $143, to address the need for emergency repairs and mitigation measures to the WRA West Des Moines Outfall Sewer. It is recommended that the Board ratify and approve the actions of the Operating Contractor and the WRA Director.
13 Agenda Item 18 A & B WRF Building 91, 92, & 96 HVAC Improvements A. Public Hearing, Approving Plans, Specifications, Form of Contract Documents, and Engineer's Estimate on WRF Building 91, 92, & 96 HVAC Improvements; Receive and File Bids; and Designation of Lowest Responsive, Responsible Bidder as The Waldinger Corporation, Guy M. Gast, President, $139, B. Resolution Approving Contract and Bond for WRF Building 91, 92, & 96 HVAC Improvements, $139, Approval FISCAL IMPACT $139, from Facilities Rehabilitation In recent years the usage of space in the laboratory (Building 96) has changed. Rooms that were designed with specific intentions are no longer being used as designed (the original lunch/conference room is now an office space, a lab space is now a lunch room and another is an office space, etc.) and the heating, ventilation, and air conditioning system demands have changed. Occupants have complained about the comforts of the existing HVAC system and modifications to the system to provide the level of comfort needed are required. The modifications include: A new humidification system due to the fact that the existing humidifier is only capable of providing half of the required capacity during peak conditions. Exhaust duct work modifications Removing the pneumatic controls from the existing VAV boxes and installing direct digital control (DDC) for optimum capacity and energy consumption control The Administration Building and the Maintenance Building (Buildings 91 and 92) will also have the same modifications to the existing VAV boxes as Building 96 (removal of the pneumatic controls and installation of DDC). On March 8, 2011 bids for the project were received from two contractors as summarized below: The Waldinger Corporation $139, AirCon Mechanical Corporation $149,575.00
14 The Operating Contractor has reviewed the bids and recommends that the low bid be accepted and a contract awarded to The Waldinger Corporation. The Technical Committee, at its March 8, 2011 meeting recommended the project to the WRA Board for approval. Construction on this project should be completed by July 29, 2011.
