1 A Butner Town Council Meeting was convened in the Council Meeting Room at Butner Town Hall, located at 415 Central Avenue, Butner, NC on Thursday, December 3, 2015 beginning at 7:00 PM. Roll Call by Clerk 3. Invocation and Pledge of Allegiance Mayor Lane gave the invocation asking for guidance through the transition indicating It s not about us, it s about our people, it s about our community and it is about what we are supposed to be. He asked for guidance in making wise decisions through this meeting and for those that follow in the future. Mr. Branch led the group with the Pledge of Allegiance. 4. WELCOME LEADERSHIP GRANVILLE! Mayor Lane welcomed and recognized Leadership Granville participants. --- OLD BUSINESS adjustments to and/or approval of DECEMBER 3, 2015 meeting agenda Marrow requested a budget amendment be added (for West Lyon Station Road Realignment). Also, Council will need to make item 16 a Project Ordinance (added as 16A). 1 P a g e
2 6. PRESENTATION BY 2015 VETERANS DAY ESSAY WINNERS EmmA oliver, abby holsemback and chase teal Mayor Pro-Tem McKellar made introductions. He noted the teacher being Chris Watson (from Falls Lake Academy). First place winner: Emma Oliver (daughter of Chris and Sarah Oliver of Stem) and grand daughter of Mr. & Mrs. Bill McKellar. Next Chase Teal (daughter of Jeff and Tracy Teal of Creedmoor and Butner) read her winning essay. Both received a round of applause. Abby Holsemback (daughter of Jerry and Kim Holmes of Creedmoor) could not be in attendance tonight. Mayor Lane gave the participants a Butner pin and photos were taken. 7. approval of NOVEMBER 5, 2015 meeting MINUTES (See Attached) Minutes were approved on motion by Council Member Emory, duly seconded by Council Member Cates. All voted in favor. 8. PUBLIC COMMENT PERIOD Representing Butner Community Association, Michael McFadden of th Street, Butner addressed the group reminding all of Christmas in the Park tomorrow night, beginning at 6 pm to include singing of Christmas carols, reading of The Night Before Christmas as well as visiting with Santa (with picture taking at two separate times). Secondly, McFadden was an advocate of Michel Branch to fill the unexpired seat held by Council Member Cates. McFadden referred to Branch as an activator and problem solver. 9. monthly (October) financial report (See Attached) Finance Director Susan Hiscocks said as of 10/31 our cash and investments were up approximately 9% over this time last year. She indicated 33% of the fiscal year is over at this reporting. Spending is at 35%, which is in line and revenues are at 46% (ahead of schedule). The Town has completed the sale of timber an upcoming report will be given at the next meeting. Ultimately, all is moving along financially as it should. Therefore, Council Member Turner motioned to receive the financial report, seconded by Council Member Branch. All voted in favor. 10. BPS presentation recognition/retirement of Senior admin support specialist chris bracci Lane said This is one of those times when you are happy for folks and you are sad. He turned the presentation over to Chief Roberts. 2 P a g e
3 Roberts said back in 2008 (when Chris Bracci was hired), they tried out a new process having the candidates wait. Some got mad and left; however, there was one candidate that was chipper and eager after waiting as when she first arrived (Bracci). He said she had an accent (part German, part Boston and part Stem)! Chris Bracci was hired, in part, due to her enthusiasm. Chief Roberts spoke kindly of her he said She kept my head above water and kept things on task. Ms. Bracci is retiring the end of December and moving to New Hampshire (she and her spouse). Roberts said Chris didn t want or need special attention; however, he stated to her You have been everything to me like a sister to me and a life saver. He asked Town Manager Marrow to present the appreciation plaque for her seven (7) years of service. Marrow said she always has a smile. There was a round of applause. Bracci thanked all and said she will miss her co-workers greatly. She noted it has been an honor and privilege to work with Butner Public Safety/Town of Butner. 11. BPS presentation - achievement certificates Lt. Kevin Bryant Sgt. Nicholas Williams Sgt. Richard Garrett Capt. Greg Champion Senior Fire Officer Leadership Institute Certificate Intermediate Law Enforcement Certificate Advanced Law Enforcement Certificate Advanced Law Enforcement Certificate Roberts said what the guys obtained was no small task. It took a lot of initiative and they did it on their own. With Lt. Bryant, Roberts spoke of classes that dealt with ethics, budget planning, grant preparation, policy procedure development, etc., etc. The classes involved participation over a year. It started out with 35 attendees with 15 achieving their goal(s) in the end. Roberts spoke of achieving the different levels of certification all the hard work and dedication. He recognized Sgt. Williams, Sgt. Garrett and Capt. Champion accordingly. Recipients received a round of applause. Mayor Lane thanked the guys for their efforts and commitment. 12. COUNCIL CONSIDERATION budget amendment IN THE AMOUNT OF $17,500 for commission paid to timber consultant (See Attached) When the budget was prepared in April, it was done as if the consultant s commissions would be taken out of the sale proceeds prior to the Town receiving payment. The process that has occurred is that the total sale proceeds have been paid to us and we then pay the commission to the consultant. Therefore, we need to budget funds to cover those payments since the payment will be made by the Town to the consultant. Marrow spoke of the $117,000 in sales from the timber cutting. He noted there is still 30 acres to cut on the 750 acre tract. Bad weather halted the work. Council Member Cates motioned to approve Budget Amendment 008. Motion was 3 P a g e
4 seconded by Council Member Jordon and all voted in favor. 13. COUNCIL CONSIDERATION budget amendment IN THE AMOUNT OF $3,000 FOR COST OF REPAIRS TO 12 TH STREET FOOT BRIDGE (See Attached) The cost of repairing the 12 th street foot bridge was not part of the original FY budget. Additional funds are being requested to increase the Public Works budget to cover the cost of those repairs. Marrow spoke of the new substantial bridge of metal (versus wood). Council Member Turner motioned to accept/approve the budget amendment 009. It was seconded by Council Member Emory with all voting in favor. 14. PUBLIC HEARING - CONSIDERATION OF A.15.10, LAND DEVELOPMENT ORDINANCE TEXT AMENDMENT TO ARTICLE 15-WATER SUPPLY WATERSHED PROTECTION (See Attached Staff Report and Proposed Amendment) Town staff requests an amendment to the Land Development Ordinance to prohibit illicit discharges to the stormwater system. As part of our NPDES (National Pollutant Discharge Elimination System) Phase II permit, the Town is required to adopt an ordinance prohibiting illicit discharges to the stormwater system. Planning Director Hodges briefed the Council and spoke of potential civil penalties (up to $500) in Article 4 Enforcement. She spoke of the illicit discharges and connections (shown on page 2 of 4) under Article 15. The floor was open to any public comments. There were none. Hodges read the associated Consistency Statement. Mr. McKellar motioned to approve the Amendment to the LDO, along with approval of the Consistency Statement. Motion was seconded by Mr. Branch and unanimously approved. 15. CONSIDERATION OF BUTNER GATEWAY SMALL AREA PLAN The Butner Gateway Small Area Plan has been completed. A thorough review of the plan and proposed code/ordinance was given by consultant, Kimley-Horn on October 29, The Plan is available on the Town s website at At this time only adoption of the plan is being considered. The ordinance amendments will be brought for consideration later. Sal Musarra with Kimley-Horn presented a PowerPoint presentation. Hodges hopes to bring the ordinance and zoning changes before the Planning Board at its January meeting. Sal said it has been a pleasure working with Staff and Council on the project. He was pleased with the level of public input during the process with good attendance at meetings. Vision and work on the Plan started in P a g e
5 Even though this wasn t a Public Hearing, Mayor Lane asked if there were any comments from the public (pro or con) no comments. Therefore, Ms. Cates made a motion, seconded by Mr. Branch to approve and adopt the Butner Gateway Small Area Plan. It was approved unanimously. Lane said I think this puts us on the right track. 16. Council approval of engineer selection for design services of the East Lyon Station Greenway, Extension I In 2011, Town Council approved a grant application to extend the East Lyon Station Greenway approximately 2,200 feet to connect two (2) more industries. The grant was awarded to Butner and the project is ready to be designed. The original project cost was estimated to be a total of $247,000, with Butner paying 20% of that cost, which would be $49,400. The professional engineer (PE) for that project was estimated to be $35,000. These cost estimates were done in 2011 and they were based on the previous greenway costs. Since that time, project costs have gone up. Once we select an engineer, we will negotiate a contract which will come back to Town Council for approval. There were two (2) submittals for the PE on this project. The Town has worked with both companies and recommends Kimley-Horn. Planning Director Hodges spoke of history with the Town obtaining a CMAQ Grant (80% with the Town paying 20%). Hodges said we don t anticipate this being a complicated project. Mr. Turner motioned to approve engineering selection (Kimley-Horn) for this project, seconded by Ms. Jordon. All voted in favor. The Manager noted we will be doing this project in two (2) parts and it is best to make it a Project Ordinance. Undoubtedly, the project will go beyond our fiscal year and by making it a Grant Project Ordinance, it will continue to live until the project is completed. Therefore, the Grant Project Ordinance was introduced by Council Member Cates, seconded by Council Member Jordon. The vote was unanimously approved. 16A. The Manager said in an effort to acquire ROW to realign W. Lyon Station Road to hit Butner Gateway property in the middle, we approached DOT requesting they abandon a portion of their ROW (it is more than they need) allowing land to be returned to the original property owner. Early on, it was denied and Kimley-Horn has taken the lead and is working with DOT clarifying this matter. Butner s request will require going back through DOT Board process. In light of not budgeting for this unexpected expense, Marrow asked for some extra money to complete the task. We are getting close to acquiring all ROW needed. Mr. McKellar motioned to approve Budget Ordinance Amendment in the amount of $5,000. Motion was seconded by Council Member Branch. All voted in favor. 5 P a g e

Acceptance of Granville County board of elections Abstract of Votes for Butner Mayor and Council -- Municipal Election held November 3, 2015 and a recount held November 20, 2015 on race between bill birdsong and michel branch (See Attached) The Council accepted the Abstract of Votes accordingly (motion by Ms. Cates, seconded by Ms. Jordon. All voted in favor). 18. Council consideration - proceed with Patrol Camera order (already in budget) or continue to wait for grant assistance Chief Roberts said this matter has been handled since submitting as an agenda item. Governor s Crime Commission presented guidelines with a deadline of 1/31/2016. We originally thought it would run $60K expecting a grant. BPS budgeted $30K. The Chief indicated it s going to be $2 from BPS for $1 of grant money. However, good news Lt. Knutson (who performed the study on body cameras) found a system BPS likes better (and purchasing what is needed for less). BPS is looking at 6 mobile systems and 8 body cameras (cameras link up to mobile systems). 19. Council Consideration to approve the BPS Front Apron REPlAcEmENT TO ThE low BIDDER, carrington S clearing AND grading in the amount of $79,598 The Town received three (3) bids for this project, with Carrington s Clearing and Grading submitting the low bid. The three (3) bids received: Low bid: Carrington s (Oxford) at $79,598, Rightway Construction (Oxford) at $86,000 and PGA Construction, Inc. (Cary) at $134,850. Marrow said the recommendation is the low bid Carrington s (which is well within the budget). Public Works Director Daniel has worked out an agreement with Jason Falls at the Landfill whereby some of the old dug up concrete and bad soils will be disposed of at no charge. Ms. Emory motioned to accept the low bid (from Carrington s Clearing and Grading), seconded by Mr. Turner. All voted in favor. 20. RECOGNITION/PRESENTATION TO MICHEL BRANCH Mayor Lane presented a plaque that read: Mayor Tom Lane, the Butner Town Council and staff of the Town of Butner, NC express sincere appreciation to Michel Branch, Butner Town Council, January 6, 2011 December 3, 2015 for your community spirit and involvement with BCA sponsoring the Chicken Pickin, Christmas in the Park 6 P a g e
7 and Movies in the Park This 3 rd day of December, RECOGNITION/PRESENTATION TO TERRY TURNER The Mayor, likewise, read Mr. Turner s plaque: Mayor Tom Lane, the Butner Town Council and staff of the Town of Butner, NC express sincere appreciation to Terry Turner, Butner Town Council, December 3, 2009 December 3, 2015 for your steadfast loyalty in honoring veterans on Memorial and Veterans Day and advocacy for the town employees while serving on Butner Town Council - This 3 rd day of December, MAYOR/COUNCIL COMMENTS Mr. McKellar noted it has been a pleasure working with Branch and Turner. He said I hope things go your way and he spoke of the well known Butner military events Turner has spearheaded. Mr. Branch said it was an emotional moment. He said he wanted to be a part of helping the community and feels he has done so. He has enjoyed working with all. He stated I love Butner. He thanked everyone for support and guidance. Ms. Jordon, too, said it has been a pleasure to work with both Branch and Turner. She said they both have been dedicated, very sincere and care about Butner. She thanked them for their service. Ms. Cates also thanked the guys for their contributions. Cates also thanked Mayor Lane for his vision carrying Butner forward before and after incorporation. She spoke of the Butner soils in connection with the Butner Athletic Park. The Park is here and open for business (some thought they would never see it to fruition)! Ms. Emory thanked Branch and Turner as well. She has worked on committees with both and thanked them for all they have done for Butner. Mr. Turner commented on essay winners he stated This country has nothing to worry about. He said it has truly been a pleasure working with everyone on the Council from the Mayor/Council to the Town staff. He is honored to have been a part of many groundwork projects. He looks forward to the new Council being seated indicating all genuinely care for the people of Butner. Mayor Lane said For me, it has been a sweet ride most of all, a pleasure working with every one of you. He said working together; a lot was accomplished through dedication by all. Lane feels the groundwork is laid for things to come. He plans to stay in contact and see more successes for Butner being the community we want it to be. He said it was a joy for him to work with the Town staff. Going back to the 7 P a g e
8 Advisory Council, he said We made a commitment We started talking about incorporation and with Mr. Crawford s help, we actually incorporated. We made a conscious decision to go after experienced staff. We did that and I think the results speak for exactly what we wanted to happen. Again, my thanks to the Staff I mean that sincerely thank you. Lane continued I would like to say a thank you to a special lady that is here my wife, Judy. She has put up with a lot, a lot of missed meals, a lot of meetings, a lot of time alone, having to deal with my frustrations when I came in frustrated and as many of you know, we tend to take out frustrations, some times, on the wrong people. She has always been there for me. The Mayor s daughter and a grand-daughter were in attendance as well. Lane concluded his comments by saying It has been a great privilege, I really appreciate this opportunity (serving as Mayor). Ultimately, Lane declared the present Council Sine Die. 23. CALL FOR MOTION - adjournment sine die Sine Die officially ends the term of any Council Member whose term is up and also officially ends this portion of the meeting. --- RECEPTION FOR OUTGOING MAYOR Thomas W. Various family members stood with each of the four (4) elected officials. REMINDER: In accordance with NCGS 160A-87 Ethics Education Requirement All members of governing boards of cities, counties, local boards of education, unified governments, sanitary districts, and consolidated city-counties shall receive a minimum of two clock hours of ethics education within 12 months after initial election or appointment to the office and again within 12 months after each subsequent election or appointment to the office. 8 P a g e

There were no other nominations. Ms. Emory was unanimously appointed as Mayor Pro-Tem. 26. APPOINTMENT - TOWN OF BUTNER REPRESENTATIVE TO SGWASA BOARD Mayor Lane s term expires end of Mayor Cates opened the floor for nominations. Mayor Pro-Tem Emory nominated Mayor Cates as Butner rep to SGWASA Board. There were no other nominations. All voted in favor. 27. COUNCIL APPROVAL 2016 COUNCIL MEETING SCHEDULE (See Attached) The attached meeting schedule (with one amendment October, 2016 Meeting) was approved on motion by Mayor Pro-Tem Emory, seconded by Council Member Birdsong. All voted in favor. 28. reports Manager o Town Manager said we continue to meet with Veterans Life Center folks in determining what type building, how much we can afford there is a scheduled meeting next week o Paving from E to F Street came in considerably under budget we used unit cost prices and they didn t use as much asphalt as anticipated. Also they didn t cut out as much as anticipated and used less fabric. The traffic island on Central was installed today should be unveiled tomorrow. Marrow spoke of an automated crossing 9 P a g e
10 installed at intersection of C St. and Central Av. The State is absorbing that cost. The project will be complete once the automated crossing is installed. o On Saturday (Christmas Parade), Town Council will be riding in the red wagon pulled by the Town s Polaris meet up at Granville St. & Central Av. around 1:30ish... Parade begins at 2 pm. Attorney Planning/Parks & Rec Director o Jessica Gladwin reported Pictures with Santa tomorrow night trying something new (2 photo sessions - before & after Christmas in the Park) Public Safety Director o Roberts welcomed the new Mayor and Council Members and spoke of how smoothly the previous Board handled matters o Finished up training today on firehouse software will be implementing first of year o Kudos to Sgt Williams and Sgt Massey on recent break-ins all have been apprehended with the exception of one (who is wanted by 3 other agencies) o BPS is preparing for Christmas festivities (parade, etc.) 29. INTERVIEW PROCESS FOR VACANT COUNCIL SEAT HELD BY VICKY cates three (3) applications received as follows (alphabetically) (See Attached) Michel Branch James Jones Terry Turner Attached you will find a sample ballot, adopted Policy for Filling Vacant Seat, applications/resumes for each candidate and pre-approved interview questions. Mayor Cates went over the policy. Applicants were given time for opening remarks, five (5) questions were asked by seated Council and applicants answered accordingly. The top vote getter was Michel Branch announced by the Town Attorney following a count by the Attorney and Clerk. Mayor Cates thanked applicants. She said all gave good responses. 30. Mayor and Council Comments Mr. McKellar handed out info on Camp Butner Cancer Study. With receiving facts and figures, it appears Butner has a problem with cancer lung and colorectal cancer are significantly higher in Granville County. He said 1. Slightly higher rate of environmentally caused cancers in Butner and Creedmoor. 10 P a g e
11 2. Granville County has the highest rate of cancer per 100,000 people than any county in NC 3. He said we must be diligent with our healthcare and investigate any possible cancer signs 4. McKellar recommended repeating the study in two (2) years Ms. Jordon noted from (Granville Human Relations Commission) the MLK Breakfast will be held again this year. Also, (from a KTCOG Meeting), she said guest speaker was Will Collins, Asst Secretary of Work Force Solutions who shared the new website. Ultimately, Jordon welcomed new Butner Council Members Mr. Birdsong said it s all new and it is nice to be on the Council. He thanked all. Ms. Emory congratulated Ms. Cates on her victory as new Butner Mayor. She, too, welcomed new Council Members Vickie Smoak and Bill Birdsong (also welcoming Michel Branch back on board). She looks forward to working with all. Ms. Smoak indicated it is an honor to be on the Council and is looking forward to working with the Mayor/Council and Town Staff. Mayor Cates is looking forward to working with all as well.
