1 SHAMOKIN DAM BOROUGH COUNCIL COUNCIL MEETING MAY 7, 2012 The regular monthly meeting of the Shamokin Dam Borough Council was held on Monday, in the municipal building located at 42 W. 8 th Avenue, Shamokin Dam beginning at 7:00 P.M. Council President Donald Musser presided. MEMBERS PRESENT: David Smeltz, Malcolm Fleming, Andrew Bickhart, Mark Benner, Rue Rothermel, David Herbert, and Don Musser were present. OTHERS PRESENT: Mayor Joseph McGranaghan, Solicitor Robert Slivinski, Manager Ed Hovenstine, Secretary LaDawn Leitzel, Laura Kerstetter-Forgett & Kerstetter P.C., June Stark, Frank Witt, Joan Witt, Leo Kwiatkowski, Eric Hassenplug, and Fire Chief Brad Aurand were present. The meeting was opened with the Pledge of Allegiance. PREVIOUS MEETING MINUTES: A motion was made by Councilman Bickhart to approve the minutes of the April 2, 2012 meeting of Council as presented, seconded by Councilman Rothermel, approved by all. Brad Aurand arrived at this time. STREETS BID: 2012 Streets Project: Seven bids were received for the 2012 Streets Project: Eastern Industries $106, Meckley s Limestone, Inc. $108, Fairchild Brothers, Inc. $127, Mid-State Paving $128, Gutelius Excavating $131, Jay Fulkroad & Sons $142, G&R Charles Paving $172, A motion was made by Councilman Benner to award the bid for the 2012 Streets Project to the low bidder, Eastern Industries, seconded by Councilman Bickhart, and approved by all. VISITORS: Audit 2011 Laura Kerstetter reviewed the 2011 Shamokin Dam Borough Audit. Laura indicated that the General Fund was financially solid. However regarding the Water/Sewer Fund, the sewer charge was not covering the sewer expenses. Manager Hovenstine and Mrs. Kerstetter discussed that an increase of approximately twenty-five dollars per quarter would cover the 2011 difference. President Musser mentioned that an increase would need to cover the 2011 difference

2 Shamokin Dam Borough Council Page 2 and plan on future expenses. Solicitor Slivinski stated that any change to the 2012 rates would be reset by an ordinance. Laura Kerstetter mentioned that a new GASB 54 statement was implemented which changes some terminology in the fund equity section. The Borough s liquid fuels would be classified as restricted money, because it has to be used for that purpose. Manager Hovenstine mentioned that Laura Kerstetter summarized the audit and advised Council to review the MD&A Report and if anyone had any questions to speak directly with him. Fire Chief Brad Aurand reviewed the March 2012 fire department call report. President Musser updated Council on the Shamokin Dam Task Force meetings. The Shamokin Dam and the Hummels Wharf task forces met on Wednesday, April 11, 2012 at the Shamokin Dam Fire Company to discuss the financial situation of the Shamokin Dam Fire Company and reviewed the equipment and the facilities. Wednesday, May 9, 2012, both task forces will meet at the Hummels Wharf Fire Company to discuss the financial situation of the Hummels Wharf Fire Company and review the equipment and the facility. The Borough received an agreement from ABN Consulting regarding the lighting at the Shamokin Dam Fire Company social hall. The total project cost would be $4, with a rebate totaling $3,689.27, which would consist of an actual cost of $ President Musser stated that the Manager would use the Building Maintenance Fund to pay for the Project Cost. COMMUNICATIONS: A Borough resident, Mrs. Jarrett, sent a letter thanking the Borough for all the things it does for the Borough residents. Joe Sewesky, a borough resident located at 7 Kessler Avenue, requested guidance on dead trees that are in the right-of-way along Stetler Avenue. Manager Hovenstine mentioned that the trees are unstable due to the construction of widening Stetler Avenue. If the trees are not dealt with the trees could fall on Stetler Avenue or on Mr. Sewesky s shed. The Solicitor stated that the rightof-way would be the property owner s obligation unless the trees are considered a safety hazard to the traffic. MAYORS REPORT: Mayor McGranaghan reported that Police Chief Bremigen would be absent tonight because he would be attending an honor s banquet with his son. Police Chief Bremigen wrote a letter of commendation to Officer Hassenplug for his quick thinking and professionalism. Officer Hassenplug had a routine traffic stop for speeding, but when the officer approached the vehicle, the driver sped away. Officer Hassenplug chased the vehicle to Routes 11/15, where the officer saw the congestion on the road and discontinued pursuit. Officer Hassenplug then reported incident on the radio, which led to a Sunbury officer apprehending the driver. The Shamokin Dam Police Department in conjunction with the PA Office of Attorney General sponsored a free seminar regarding the Senior Crime Prevention University Program. This program makes citizens aware of the types of scams used by con artists. The seminar was held on

3 Shamokin Dam Borough Council Page 3 Tuesday, May 1, 2012 from 10:00 AM 11:00 AM located at Stayman Park Apartments, 8 Smokehouse Lane, Shamokin Dam and was well attended. The Shamokin Dam Police Department office conducted a pharmaceutical collection on Saturday, April 28, 2012 from 10:00 AM 2:00 PM, which collected approximately twenty-five pounds of pharmaceuticals. Police Chief Bremigen and Officer Gaugler were called to a disturbance at the Aldi Inc store, where an autistic 20 year old male was accused of assaulting the caregivers. After assessing the situation the Police Chief and Officer Gaugler agreed that the male wanted to continue shopping, so they escorted him through the store. Mayor McGranaghan mentioned that the Police Chief and Officer Gaugler displayed common sense, intelligence, and sensitivity in dealing with what could have been a difficult situation. Mayor McGranaghan asked Council to consider purchasing a logo sign for Council Chambers from Ace of Signs with an approximate cost of $ OTHER BUSINESS: A motion was made by Councilman Rothermel to adopt Resolution A resolution authorizing destruction and disposal of computer program and computer data files from the years of , seconded by Councilman Benner, and roll call vote called: Don Musser yes, Rue Rothermel-yes, David Smeltz-yes, Mark Benner-yes, Andrew Bickhart-yes, Malcolm Flemingyes, and David Herbert-yes. The Manager reported that Brad Miller, residing at 28 MacIntosh Road, was hired with a start date of April 23, 2012 for the Borough crew position. Mr. Miller has experience in various trades and will be a good asset to the crew. The Hampton Inn was sold in the amount of $3,349, with a real estate transfer tax paid to the Borough in the amount of $16,746.00, which was deposited into the General Fund. MANAGERS REPORT: Dog Park/Weller Field Update Manager Hovenstine contacted Hurricane Fencing for an estimated cost of fencing for the dog park site and Weller Field upgrades. The ball field fencing was quoted as keeping the original posts and raising them 2 to 2-1/2 feet with new fencing at 4 feet instead of 6 feet fence at an estimated cost of $8, The dog park fencing was quoted as a rough draft for 700 feet of 4 high fencing and a few gates at an estimated cost of $8, On May 23, 2012, Sunbury Generation will be hosting a golf tournament to benefit the Weller Field and the dog park. Councilman Rothermel commended Manager Hovenstine for nurturing and retaining a relationship with Sunbury Generation. Manager Hovenstine mentioned that the Borough Crew will be placing a directional sign to better locate Weller Field on Maple Street, a sign at the park to explain park hours, and a stop sign at the exit of Weller Field.

4 Shamokin Dam Borough Council Page 4 PEMA Reimbursement from Tropical Storm Lee The Borough received all the PEMA reimbursement for Tropical Storm Lee in the amount of $12,683.95, which included cost of cleanup, dumpsters, labor, and the sewer line issue. PPL Rebates The Borough received the PPL rebates from ABN Consulting in the amount of $ for General Fund and $ for Water/Sewer Fund. Healthcare Renewal Currently the Borough pays 100% of the monthly premium and deductibles for the Police Department, and pays 90% of the monthly premium and deductibles for the non uniform employees. Manager Hovenstine and Officer Brad Gaugler are not on the Borough s health plan due to coverage on spouses insurance plan. The Geisinger Health Plan initially announced a 4% increase, but some of the individual plans within the plan had substantial increases. Kluge Insurance received an estimated cost from Capital Blue Cross, which was approximately $8, less than the Geisinger Health Plan. The deductible amount for the single plan would be $1, Geisinger and $1, Capital, and for the family plan would be $2, Geisinger and $2, Capital. Manager Hovenstine recommended switching health insurance plan to Capital Blue Cross. A motion was made by Councilman Herbert to accept the Capital Blue Cross plan as the health care provider for the Borough, seconded by Councilman Bickhart and, roll call vote called: Rue Rothermel yes, David Smeltz abstain not enough information, Mark Benner yes, Andy Bickhart yes, Malcolm Fleming yes, David Herbert yes, Don Musser yes. Spring Clean Up Review Ted s Disposal hauled approximately 29 tons during the spring clean up. The Borough budgeted $5, for spring clean up and an amount of $4, was billed. Highway Drainage Class Manager Hovenstine attended an LTAP educational drainage class presented by PENNDOT and SEDA-COG. SOLICITOR: Solicitor Slivinski received the Service Electric Cablevision s cable franchise agreement, which proposed 3% of the revenue from cable service including the premium channels, which would begin April 2013 with a length of five years. The agreement now would be equivalent to 2% of the revenue. The Solicitor stated that the Borough would be allowed up to charge 5% of the revenue and suggested negotiation of the provision for internet service at the Borough buildings. A Franchise committee should meet with a representative from Service Electric Cablevision to discuss terms and possible provisions. A motion was made by Vice President Fleming to adopt Ordinance , which would accept dedication of certain roads (Weatherfield Drive, from Station to Station ; Eighth Avenue, from Station to Station ; and Woodridge Lane, from Station to Station ) in Phase One of the Weatherfield Development and establishing them as public streets, seconded by Councilman Benner, and roll call vote called: David Smeltz yes, Mark Benner yes, Andrew Bickhart yes, Malcolm Fleming yes, David Herbert yes, Don Musser yes, Rue Rothermel yes.

PAYMENT OF BILLS: General Fund bills in the amount of $42,851.33, Water and Sewer Fund bills in the amount of $12,750.75, and Local Service Tax Refund in the amount of $ A motion was made by Councilman Rothermel to pay the bills as presented, seconded by Councilman Benner, and approved by all.
