2 February 5, Page 2 of CALL TO ORDER The regular meeting of the California Health and Education Linked Professions Joint Powers Authority () Governance Council was called to order by Tom Hoegerman, Chairperson, at 12:30 p.m., at the Roy C Hill Education Center, San Bernardino. 2.0 PUBLIC PARTICIPATION None. 3.0 ADOPTION OF AGENDA AND APPROVAL OF MINUTES 3.1 & 3.2 BE IT RESOLVED that a motion was made by David McLaughlin and seconded by Denise Griffin, to approve the February 5, 2016 Governance Council Meeting Agenda and adopt the November 20, 2015 Meeting Minutes as presented. A vote was taken and the following carried: 14:0 Ayes: Members: Alejandre, Gomez, Gonzales, Griffin, Hoegerman, Malan, McLaughlin, McNeil, Ontiveros, Rosenstock, Soholt, Tarver, Tomes, and Tremblay. Nays: None. Abstentions: None. 4.0 PRESENTATIONS 4.1 Proposed Fee-for-Service Rate Schedule Desert/Mountain Operations will present ideas related to the Fee-for-Service design regarding bus aides, interpreters and 1:1 aides. Rich Frederick presented a proposal to separate the Desert/Mountain County Operations (DMOPS) Fee-for-Service (FFS) 1:1 Aides service rates. Rich explained that currently DMOPS has approximately 80 1:1 aides. The current rate for 1:1 aides exceeds $49,900. Rich stated this includes the expenses for 1:1 aides, American Sign Language (ASL) interpreters and Bus Aides. Currently there are 10 ALS interpreters and 41 DMOPS paraeducators working extra hours as bus aides on local education agency (LEA) transportation routes. The ASL salary is approximately $10 per hour higher than ($10,000 annually) the 1:1 aide. Rich stated the majority of the aides are for students with behavior issues versus medically related issues. DMOPS is suggesting to collaborate with a LEA representative to participate in an annual special circumstances instructional assistance (SCIA) assessment to evaluate the continued need of a 1:1. Rich stated he sees a need for additional discussion on establishing specific guidelines and criteria for determining the need for an aide from a program standpoint. It may be more cost effective for LEAs to provide the staffing for bus aides.
3 February 5, Page 3 of 6 Jenifer Alvarado, SBCSS, stated DMOPS will prepare the following three options to the Finance Committee and then to the Governance Council for consideration: 1) FFS Rate for 1:1 Aide Services with no changes, 2) FFS Rate for 1:1 Aide Services with the cost of ASL Interpreters separated out, and 3) FFS Rate for 1:1 Aide Services with the costs of ASL Interpreters and Bus Aides separated out. 4.2 Positive Behavioral Interventions & Support (PBIS) Kami Murphy presented on the work the Desert/Mountain SELPA has provided for LEAs on Positive Behavioral Interventions and Support (PBIS). She stated 113 schools have implemented PBIS. Kami stated there are 26 Early Childhood sites and 45 K-12 sites. Kami highlighted the drops in suspension rates for several districts including Silver Valley USD, participating since (decreased suspension rate by 63%), Helendale SD since (decreased suspension rate by 81%), Needles USD since (decreased suspension rate by 59%) and Barstow only since (decreased suspension rate by 13%). Kami stated the SELPA is in partnership with Placer County and SBCSS on a grant application. Kami then shared a comparison of cost for services by SELPA, Placer County & SBCSS. The average cost of PBIS per site/per year is $8,200 and since SELPA s implementation of PBIS training support, there have not been any costs to LEAs. Currently the SELPA provides more ongoing services at no cost to LEAs. Kami also stated the SELPA provided on-site coaching and training and recently hired an additional PBIS Specialist, in order to provide additional levels of training based on the needs of individual school sites. Jenae stated the current CAHELP budgets for next year do not support an increase in expense for PBIS coaching. Tom commended the SELPA staff for gathering and maintaining the data and for providing PBIS support to LEAs. He stated prior to expanding PBIS to other LEAs it may be good to consider a discussion and action item on whether or not to keep at no cost. Ted Alejandre, SBCSS, commented that at a recent ACSA conference he heard a presentation titled Proactive Behavior Interventions Systems. Kami stated yes there are others providing different approaches to providing support. The SELPA follows the national model for PBIS as written in law. Jenae stated the SELPA PBIS Team is very cognizant of implementing PBIS with fidelity, using evidence-based practices. Luke Ontiveros, Snowline JUSD, inquired whether the SELPA has surveyed LEAs about the cost; whether they would be interested in continuing and/or adding additional sites.
4 5.0 CONSENT ITEMS February 5, Page 4 of 6 Jenae concluded she will bring a draft survey to the superintendents regarding PBIS training, implementation, and possible future costs. The survey will also determine LEAs level of interest in continuing to add additional sites. 5.1 BE IT RESOLVED that a motion was made by Ronda Tremblay and seconded by Jan Gonzales to approve the following Consent Items as presented. A vote was taken and the following carried: 14:0 Ayes: Members: Alejandre, Gomez, Gonzales, Griffin, Hoegerman, Malan, McLaughlin, McNeil, Ontiveros, Rosenstock, Soholt, Tarver, Tomes, and Tremblay. Nays: None. Abstentions: None CAC Bylaws 6.0 ACTION ITEMS The Community Advisory Committee (CAC) approved the updated version of the CAC Bylaws in order to include the Desert/Mountain Charter SELPA language during the October 22, 2015 meeting. The Bylaws were presented and approved by the Steering Committee on October 23, 2015 which is a requirement in the Bylaws. The updated Bylaws (track change version and final) are being submitted to the Governance Council for information at this time Low Incidence Equipment The Desert/Mountain SELPA is seeking approval from the Governance Council for the release to surplus or salvage of unassigned and/or obsolete low incidence equipment currently in storage. All of the low incidence equipment identified on the inventory report has been reviewed and determined to be unassigned and/or obsolete. 6.1 Amendment to the Bylaws (TABLED) Jenae Holtz reported the proposal to amend the Bylaws will be tabled due to the lack of having two-thirds of the voting members present to meet quorum. 6.2 Sky Mountain Charter & Lucerne Valley USD (TABLED) Jenae Holtz reported additional information is needed prior to the Sky Mountain Charter School (SMCS) discussion; therefore this item will be tabled. 6.3 CAHELP Legal Counsel (ACTION) Jenae Holtz reported the current legal counsel has been non-responsive on inquiries regarding the status of the CAHELP Foundation; therefore CAHELP is seeking approval to have the option to change legal counsel.

A vote was taken and the following carried: 14:0 Ayes: Members: Alejandre, Gomez, Gonzales, Griffin, Hoegerman, Malan, McLaughlin, McNeil, Ontiveros, Rosenstock, Soholt, Tarver, Tomes, and Tremblay. Nays: None. Abstentions: None 7.0 CHIEF EXECUTIVE OFFICER AND STAFF REPORTS 7.1 Property Update Jenae Holtz reported CAHELP has sent letters of interest on various properties in the High Desert. The owner of the former Walmart building is not interested in selling at this time but considering leasing the property. Jenae stated CAHELP will continue to look at other options including the cost to build if affordable and there is suitable land available to purchase. 7.2 Data Identified Noncompliance (DINCs) Update Jenae Holtz reported no sanctions for Data Identified Noncompliance (DINCs) have been imposed on any LEA or SELPA by the California Department of Education (CDE). Jenae stated the SELPA continues to work with LEAs to monitor records on a monthly basis. She concluded the Governance Council will receive a report in April should there be any updates or changes. 7.3 Information Items Due Process Summary Denise Edge reported two additional cases were filed since the December 2015 report presented. A total of 19 cases have been filed year-to-date. Denise stated 13 of the 19 have settled at Resolution (first step of due process). Hearing is scheduled for one of the five open due process cases and the SELPA is preparing to file the due process case on behalf of the Charter SELPA. She concluded Alternative Dispute Resolution (ADR) training information will be presented in April Professional Learning Summary December Pupil Count Janet Crabtree stated the December Pupil Count is preliminary and pending verification of duplicates Proposed Special Education Revenue Distribution Janet Crabtree stated the budget information included are projections and have been reviewed the Finance Committee.
6 February 5, Page 6 of Maintenance of Effort Report Summary and Information Monthly Nonpublic School/Agency Expenditure Report Monthly Nonpublic School/Agency Placement Report Monthly Low Incidence Equipment Reimbursement Requests Report Professional Learning Opportunities Corinne Foley highlighted the upcoming Herding Cats How to Improve Team Performance training on June 8 & 9, Corinne stated this master class designed for leaders and managers will be facilitated by Steve Zuieback and Michael Grinder. She concluded the cost is $675 per individual. 8.0 GOVERNANCE COUNCIL COMMENTS / REPORTS None. 9.0 CEO COMMENTS Jenae Holtz reported the SELPA recently hired Bonnie Garcia as a program specialist with an expertise in behavior for the secondary level. Jenae also commended the Desert/Mountain Children s Center (DMCC) staff for the their immediate response and continued support to the children, parents, and community members in San Bernardino city and county areas as a result of the tragic incident that occurred at the Inland Regional Center in December MATTERS BROUGHT BY CITIZENS None CLOSED SESSION 11.1 Establish Subcommittee for CAHELP Chief Executive Officer s Evaluation ADJOURNMENT The Governance Council closed session convened at 1:17 p.m. to discuss and establish a subcommittee for the CAHELP Chief Executive Officer s Evaluation. Having no further business to discuss, the meeting was adjourned at 1:30 p.m. The next regular meeting of the Governance Council will be held on Friday, April 8, 2016 at 12:30 p.m., at the Roy C Hill Education Center, San Bernardino.
