The meeting Minutes for October 26, 2016, and the meeting Agenda for January 24, 2017 were adopted as presented.
2 January 24, Page 2 of COUNCIL MEMBERS COMMENTS/REPORTS Kate Bean, Aveson Charter Schools, inquired how the pending decision of the governor to possibly recommend the elimination of SELPAs would affect CAHELP s ability to continue operating as a service entity for local educational agency (LEA) members. Jenae stated the governor commissioned the Public Policy Institute of California (PPIC) to evaluate special education funding. Jenae explained the findings of the PPIC report recommend the elimination of SELPAs. She further stated the State SELPA Administrators have been actively positioned against most of the recommendations of the PPIC. The governor has scheduled stakeholder meetings by invitation only to discuss this issue. A representative from the State SELPA Administrators Group will attend the stakeholder meetings and the Desert/Mountain SELPA superintendents plan to have a voice as well. She further stated in November, the Governance Council briefly discussed how the CAHELP could continue providing services for LEAs should SELPAs be eliminated. Jenae stated being a Joint Powers Authority (JPA) allows for more options. In February, the Governance Council will further discuss options. She concluded the Charter Executive Council will be informed as new information is made available on this issue. Denise Griffin, Encore Charter, commented how difficult it would be for small LEAs to function without a SELPA. 3.0 CHIEF EXECUTIVE OFFICER S REPORTS 3.1 Public Policy Institute of California Jenae Holtz stated the Public Policy Institute of California was covered in Agenda Item 2.0. She concluded there was no additional information to present. 3.2 Governor s Budget Jenae Holtz reported the Governor s Proposed State Budget includes a projected cost of living adjustment (COLA) of 1.48%. Jenae stated she does not foresee this COLA holding through the May Revise. If the COLA does pass, the Charter SELPA would see an increase of ADA to $ The federal funds are projected to remain the same as they were in the year. Jenae stated the SELPA has not received the award letters for local assistance. She concluded the expenditure reports will be sent as soon as possible. 3.3 Chapter 22 Jenae Holtz reported Charter SELPA Policy Chapter 22: Admission of LEAs to the Charter SELPA is currently being revised to correct inconsistencies in the language. The following changes were notated:
3 January 24, Page 3 of 5 Introduction - will require additional editing to clarify the difference between the definitions of an LEA Charter Schools and Charter School of the LEA. Jennifer stated the language will require editing. The deadline for submitting applications for membership will change from April 1 to January 31 of the school year preceding the year the charter anticipates operating as a Charter LEA member. Section A change the council s title to Charter Executive Council throughout the policy. Add If applicable to the requirements to submit the P-1 Certified Attendance and the School Accountability Report Card (SARC) with the membership application. (In the Introduction) add a definition for Charter Management Organization (CMO) Charter SELPA Members. Section C Keep the statement regarding members being diverse geographically and an LEA contracting with another SELPA or nonpublic agency (NPA) to provide services if necessary. Checklist for Application Materials - Remove the requirement to include API scores. Jenae noted the remainder of the edits are formatting and grammatical; not of a substantive nature. She concluded having the consensus of the members, the SELPA will present this chapter to the Governance Council in April for approval. 3.4 New Membership Applications Jenae Holtz reported the SELPA was notified that Opportunities for Learning, Duarte, and Ballington Academy, El Centro charter schools are preparing applications for membership to the Charter SELPA. Recently another school indicated they intend to apply prior to January 31, However as of today none have been received. Jenae invited the council members to participate in the site visits when the applications for membership are received. Jenae then highlighted the recent F3 Newsflash on the debate regarding whether a charter school may operate outside of the geographical boundaries of its authorizing district, but within the same county. Jenae stated at this point uncertainties remain as to how the California Supreme Court s ruling not to review the Anderson Union High School District v. Shasta Secondary Home School will affect Charter SELPA members. Discussion followed on charters applying for waivers for locations outside the boundaries and the implications of the Anderson v. Shasta ruling will have on authorizing LEAs and LEA charters. Jenae concluded asking council members to keep the SELPA informed on their decisions concerning sites located outside their authorizer s boundaries.
4 January 24, Page 4 of PROGRAM MANAGERS ITEMS 4.1 Professional Learning Updates I-MTSS Symposium Corinne Foley highlighted the s upcoming Interconnected Multi Tiered System of Supports (I-MTSS) Symposium on February 15, 2017, at Etiwanda Gardens. Corinne stated the keynote topics include Student Voice, and John Hattie s Visible Learning. Participants will receive books authored by presenters Dr. Russel Qualglia and Kristin Anderson. Corinne concluded everyone is encouraged to attend; including all educators and parents. Professional Learning Summary Corinne presented the Professional Learning Summaries through December Corinne stated currently meetings are being scheduled with LEA directors of special education to discuss each LEA s individual professional learning needs for next year. Corinne then mentioned the statewide Multi-Tiered Systems of Supports (MTSS) grant. She concluded the SELPA will schedule an informational meeting on how to apply for this grant once more details are released on the process. Denise Griffin requested that the Professional Learning Summaries be separated for Encore Jr./ Sr. High School Hesperia, and Encore Riverside. Alternative Dispute Resolution (ADR) Conference & Trainings Jenae stated the SELPA has grant funds that can be used to pay for registration fees associated with ADR conference and/or the ADR trainings. She asked that LEAs contact Marina Gallegos if interested in accessing these grant funds to attend the January 31, 2017 ADR training, or the March 21-22, 2017 conference. Marina requested that individuals her after they register so she can pay the registration fee. Corinne concluded she will the CEOs a link with registration information for the ADR training. 4.2 Due Process Updates Jenae Holtz reported two due process cases were filed year-to-date in the Charter SELPA. Jenae stated both cases have settled. The members commended Denise Edge for her work with due process. 4.3 Fiscal Updates Marina Gallegos inquired whether the executive council members would be interested in having a Charter SELPA Finance meeting in addition to the regularly scheduled
5 January 24, Page 5 of OTHER None. combined CAHELP Finance Committee meeting. Marina said the meeting would include the executive council members and their fiscal managers. The members agreed to hold the Charter SELPA Finance meeting following or combined with the next Charter SELPA Executive Council meeting on March 29 and adjust the time to start at 10:30 a.m. to accommodate longer meeting. 6.0 ADJOURNMENT Having no further business to discuss, the meeting was adjourned at 11:48 a.m. NEXT MEETING: Wednesday, March 29, 2017, in the Desert/Mountain Educational Service Center, Highway 18, Apple Valley.
