Public Comment This is the time in which anyone in the audience may address the Council on any items not on the Agenda. Comments will be limited to three (3) minutes unless the Council agrees to extend the time beyond three (3) minutes. The Council has the discretion to restrict public comments to those matters it deems relevant to the subject matter jurisdiction. 3. Action Items: 3.1 Approval of Minutes Approval of the minutes from the February 26, 2015 meeting is requested. 3.2 Approval of COS Proposed Meeting Dates Approval of the meeting dates for is requested. 3.3 Approval of Annual Budget Plan (ABP) Approval of the Annual Budget Plan is requested. 3.4 Approval of Annual Service Plan (ASP) Approval of the Annual Service Plan is requested. 4. Discussion: 4.1 Allocation Plan Update Updates from other governance committee meetings will be presented for discussion. 5. Information Items: 5.1 Mental Health Update The legal opinion on mental health expenditures and information on the audit request will be presented. 5.2 Charter School Update The current status of compliance and exit notices will be reviewed. 1

Gabe Simon seconded the motion. It was carried unanimously with aye votes: Gayle Garbolino- Mojica, Gary Yee, Shannon Jacinto, Kathi Daugherty, Steve Schaumleffel, George Sziraki, Derk Garcia, Ron Severson, Robert Leri and Scott Leaman. 4

5 3.2 Allocation Plan Review The Executive Committee of the Council of Superintendents (ECCOS) and the Program/Business Review Committee (PBRC) began discussion on potential changes to the Allocation Plan. Both committees as well as the Special Education Administrators Committee (SEAC) have reviewed several spreadsheets which were included for COS discussion. These included seven documents that provided basic revenue and allocation figures by Local Education Agency (LEA) for school years through The figures did not include additional revenue such as the Preschool Grant, Low Incidence (LI) and Out-of-Home- Care (OOHC) funds. The next spreadsheet showed the Maintenance of Effort (MOE) figures for It also includes the percentage of expenditures for the 5 specific Standard Account Code Structure (SACS) goals required for MOE which are paid for out of each LEA s AB 602 allocation. The last spreadsheet contained additional information on special education identification percentages, English Language Learners (ELL), Low Incidence (LI) and Foster Youth. In 2007 SELPA governance committees designed and adopted a blended allocation model. A portion of the total allocation is distributed based on Average Daily Attendance (ADA) and the rest is allocated based on Severely Handicapped (SH) students as defined by law. For independent study, the ADA portion was reduced to 20% based on the time students spend in class. One factor under consideration is whether to amend the SH rate for students who meet the autism criteria for services. It was included in the current plan because the state has defined Autism as a severe handicap. One PBRC member asked that an ADA-only model be adopted but the other members felt more data was needed before recommendations can be made. Spreadsheets showing an ADAonly model will be brought to the March PBRC meeting when PBRC will continue to review the Allocation Plan and collect more data to decide if revisions should be recommended. 3.3 Approval of Executive Committee of the Council of Superintendents (ECCOS) Due to impending retirements there is an opening for a K-8 and a small district superintendent on ECCOS. ECCOS recommended Derk Garcia of Roseville City School District (RCSD) and Shannon Jacinto of Foresthill Union School District (FUSD) to fill these vacancies. Kathi Daugherty moved to approve Derk Garcia and Shannon Jacinto to serve as the new ECCOS members. Gary Yee seconded the motion. It was carried unanimously with aye votes: Gayle Garbolino-Mojica, Lisa Graham, Shannon Jacinto, Gabe Simon, Steve Schaumleffel, George Sziraki, Derk Garcia, Ron Severson, Robert Leri and Scott Leaman. 4.1 Regional Program Update Placer County Office of Education (PCOE) reported letters have been sent to all LEAs requesting information on plans to take back or expand existing programs. Presently, there are no requests to take back any PCOE regional programs. Rocklin Unified School District is planning to expand their middle school Autism Spectrum Disorders (ASD) program. Auburn Union School District plans to operate a 3 rd grade ASD program. Roseville City School District will be opening an ASD middle school program. PBRC advised PCOE not to operate an ASD preschool in the south county. The need involves students from only one district and PBRC recommended adhering to current local guidelines which support PCOE in only opening new programs when more than one LEA exhibits a need. 5

6 PCOE provided a regional cost update in regard to an increase in the number of Deaf and Hard of Hearing (DHOH) students that are entering preschool in the fall when students are expected. DHOH students are housed at Ophir Elementary School. PCOE staff has explored moving this program to the south county where a majority of these students live, but has received resistance from the parents. Continued discussions are planned. Thomas Jefferson Elementary in RCSD does not currently have space but may be able to arrange something in the future. Del Oro High School DHOH students are participating in after school and weekend activities which has increased the demand for translators from Eaton Interpreting and caused PCOE to exceed their budget. 4.2 Charter School Update CORE Charter School notified the SELPA in June 2014 that it is exploring the option of exiting the SELPA to join El Dorado County Charter SELPA. Their application is under review. Fiscal sanctions were imposed on Horizon Charter School (HCS) beginning in December In January SELPA received a letter from the California Department of Education (CDE) stating HCS had not corrected all of its systemic non-compliance. The letter contained specific detailed instructions and stated 50% of the Individual Education Plans (IEPs) submitted remained out of compliance. There were 30 pages of corrective actions. CDE visited HCS again in February and stated HCS had made improvements, but still has 2 systemic noncompliant items. CDE plans to visit HCS again in March or April. ECCOS must decide on criteria to remove the sanctions and members decided to have that discussion once HCS is no longer systemically non-compliant. 4.3 Mental Health Update The governor s proposed budget does not include rolling the state mental health funds into the AB602 funding. SELPA is seeking an updated legal opinion on the use of mental health funds from Fagen, Friedman and Fulfrost as discussed at the last meeting. The opinion is expected in mid-march. 4.4 Non-Public School (NPS)/Non-Public Agency (NPA) Update SELPA was contacted by CDE regarding two students in the SELPA who are receiving Lindamood-Bell services as CDE staff is conducting a state-wide review of the Lindamood- Bell non-public agency (NPA). NPAs are not authorized to provide Specialized Academic Instruction (SAI) and are limited to providing only Related Services. CDE has indicated compensatory services may be required of any LEA that offered Lindamood-Bell services during the school day which would interfere with core instruction. That was attached for review. Sierra Foothills Academy (SFA) opened a non-public school (NPS) in Loomis last spring. LEAs are now hesitant to send students to SFA as the staff make numerous requests for oneto-one aides, fail to provide adequate progress reporting and appear to lack sufficient behavior support. SELPA will conduct a program review at SFA this spring. Sierra School at Eastern is currently serving 14 Placer County students and is interested in opening an NPS in Placer County. SEAC was supportive and SELPA will pursue this option with the support of COS. 6

7 4.5 Executive Director Report The Special Education Task Force will be releasing their recommendations soon. 4.6 Comments/Reports from Committee Members 5.0 Adjournment 5.1 The meeting was adjourned at 9:49am. The next COS meeting is scheduled for May 21,

REQUEST FOR ACTION: Staff requests approval of the proposed meeting dates for the school year.... BACKGROUND AND SUMMARY: COS holds regular meetings on the 3 rd Thursday quarterly starting in September. A tentative meeting schedule is attached for discussion and review. The dates have been proposed in order to keep members apprised of current issues as well as to address Local Plan requirements for budget review and potential program transfer requests. 8

The ABP for fiscal year is attached for review. It is in the format provided by CDE and includes only those Standardized Account Code Structure (SACS) categories required by CDE. 10

REQUEST FOR ACTION: Staff requests approval of the Annual Service Plan (ASP) for BACKGROUND AND SUMMARY: Annually each SELPA is required to hold a public hearing and approve SELPA-wide special education services offered across the SELPA as documented in the ASP. Included for review are services available in incarceration facilities, as well as explanations for Code 900, or Other which if used, must be used only for one particular service across the LEA. Also included is an At-A-Glance document showing all services offered in the SELPA as reflected on IEPs on December 1,

AGENDA ITEM SUBMITTED FOR: Public Hearing SUBMITTED BY: Reports/Presentations X DISCUSSION PRESENTING TO COUNCIL: Discussion BACKGROUND AND SUMMARY: The Executive Committee of the Council of Superintendents (ECCOS), the Program Business Review Committee (PBRC) and the Special Education Administrators Committee (SEAC) have continued to review data and discuss potential changes to the current Allocation Plan. In March and April PBRC and SEAC discussed the Philosophy Statement and reviewed data for a proposed Average Daily Attendance (ADA) only model. PBRC members also discussed special factors identified by Local Education Agencies (LEAs) which include small district consideration, preschool students, geographic location and independent study. PBRC meets again on May 22 nd and will review additional data and proposals. Two spreadsheets are included for COS member review. The first is a summary of potential gains and losses should an ADA only model be adopted and the second shows current special education allocations by LEA and the amount each LEA receives per special education student. 22

AGENDA ITEM SUBMITTED FOR: Public Hearing SUBMITTED BY: Reports/Presentations X INFORMATION PRESENTING TO COUNCIL: Information BACKGROUND AND SUMMARY: A graphic showing CDE Verification Review site visits is included for review. Horizon Charter School (HCS) hosted CDE staff for another on-site review where 3 remaining items were reviewed. HCS was found to be in compliance and ECCOS will consider criteria to remove sanctions at their next meeting, or when official notification is received from CDE. CORE Charter School was denied membership in El Dorado County Charter SELPA and applied for membership in Desert Mountain SELPA in southern California. SELPA received a letter dated April 28, 2015 stating CORE would remain in Placer County SELPA for the school year but will apply to a charter SELPA for the school year. 38

AGENDA ITEM SUBMITTED FOR: Public Hearing SUBMITTED BY: Reports/Presentations X INFORMATION PRESENTING TO COUNCIL: Information BACKGROUND AND SUMMARY: CDE is conducting several compliance reviews which include Data Identified Non-Compliance (DINC), California Longitudinal Pupil Achievement Data System (CALPADS)/California Special Education Management Information System (CASEMIS) alignment, Disproportionality and Individualized Education Program (IEP) Delays. SELPA staff members are providing support to all LEAs and CDE staff has stated they expect that several more LEAs across the state will be identified in one or more of these categories in the future. 40
