Welcome Mr. Morgan welcomed the members of the committee and provided several handouts (attached below). Mr. Morgan notified members about a workshop being held by the Chesapeake Bay Foundation and Virginia Municipal league on stormwater management in Virginia Beach on June 17 th. The topic will be Single Investment, Multiple Outcomes: Stretching Stormwater Funds to hear how water resources professionals have stretched limited funding to comply with MS4 permits and Bay TMDL reductions as cost efficiently as possible. While no one from the committee said they would attend, the attached outline of speakers and issues relates to the WRAC s work. Mr. Morgan notified members of an article in Environmental Compliance Alert article that Ms. Comanor sent, which highlights that new EPA policy on the Five-Year Construction General Permit will lead to fines for buildings, contractors, and site owners. When building, developing, or in any other way disturbing one or more acres of land, all parties must abide by terms. The 2017 CGP should go into effect on Feb 17, 2017 and cover the next five years. Members agreed to monitor the regulations moving forward. 2.) Update on Agricultural and Forestal District Renewal Process 3
4 Mr. Morgan notified members about the results of the 2015 Agricultural and Forestal Districts renewals; walking members through the attached presentation which was given to the Planning Commission on June 2, Ms. Comanor commended Mr. Morgan on his work tracking down landowners who did not respond to the first points of communication. Mr. Morgan also provided his redesign of the Agricultural and Forestral District Quick-Reference Summary sheet that will be used as part of the renewal process moving forward. Mr. Morgan stated that the 2016 Renewal of the Ridgely Agricultural and Forestal District Total Acreage 583 will commence at the end of June or beginning of July. 3.) Update on County Wide Recycling Initiative Mr. Morgan notified members that the County wide recycling initiative is still underway. A progress update will be provided in full at the August WRAC Meeting. 4.) Explanation of the elimination of Conservation Easement Authority funding. Mr. Morgan presented a high-level overview of the Board s decision to rescind the current and future funding for the Conservation Easement Authority. He discussed what may happen, particularly in terms of protecting riparian areas and other hydrological features, when and if opportunities arise where public funds were request to offset various costs (which would require Board approval). Many, though not all easements in the area, have hydrological components. Chairman Lantz asked about the rationale behind the Board s decision. Mr. Morgan referred the question to Supervisor Shruntz to elaborate. Members then entered a discussion about the relationship between easements and water resources. Mr. Eckman asked Supervisor Shruntz if she believed there was an ideological opposition to spending public money on the purchase of development rights. Supervisor Shruntz agreed with Mr. Eckman. s 5.) Update from Members on Current Projects and Regional Concerns Joan Comanor provided updates on three items. 1.) Stormwater Exclusion: Ms. Comanor notified committee members that the General Assembly has provided 2 separate funding streams for next fiscal year to Districts, one of which will be used exclusively for stream exclusion backlog projects and the other portion may be used by districts for new projects and/or additional funding for backlog stream exclusion. Once Lord Fairfax SWCD receives its funding allocations, we will determine how much of our current backlog can be addressed. As of now, the Lord Fairfax SWCD has 24 stream exclusion backlog projects in with an estimated cost of $1.1 million. 2.) Ms. Comanor also provided an update on legislation recently passed by the Virginia House of Delegates and signed into law by the Governor pertaining to proffers. The legislation says in part that a locality is prohibited from requesting or accepting any unreasonable proffer that is linked to the rezoning or overall approval of a proposed residential development. This new bill places a substantial burden on localities to account for the short and long term costs of servicing 4
5 additional development, and may be particularly acute in Counties like Shenandoah where development is limited. Ms. Comanor also distributed a letter to the editor features in the Free Lance-Star, which is attached. Members discussed holding a meeting in August in order to keep abreast to the changes to the various policies and programs being developed and implement by the County and State. Mr. Morgan will notify all committee members in July as to the status of the August meeting. 6.) Adjourn: 6:00 pm 5
