1 NOTICE OF REGULAR MEETING October 20, 2015 SHENANDOAH PLANNING AND ZONING COMMISSION STATE OF TEXAS COUNTY OF MONTGOMERY CITY OF SHENANDOAH AGENDA NOTICE IS HEREBY GIVEN that the Regular Meeting of the Shenandoah Planning and Zoning Commission will be held on Tuesday, October 20, 2015 at 7:00 p.m. at the City of Shenandoah Municipal Complex, IH-45 North, Shenandoah, Texas for the purpose of considering the following: 1. CALL TO ORDER 2. CALL OF ROLL CITIZEN S FORUM 3. CITIZENS FORUM Citizens are invited to speak for three (3) minutes on matters relating to city government that relate to agenda or non-agenda items. Speakers are asked to stand up to address the Planning and Zoning Commission and give their name and address before expressing their concerns. Responses to inquiries are limited by state law to a recitation of existing policy or a statement of specific factual information given in response to the inquiry. Any deliberation or decision by the Planning and Zoning Commission shall be limited to a proposal to place the subject on the agenda of a future meeting. INDIVIDUAL CONSIDERATION 4. Presentation of a Planning and Zoning Commission preliminary report regarding the proposed zoning amendment from Retail Commercial RC to Commercial Corridor CC. The proposed zoning amendment is for 11.3 acres in Montgomery County School Land Survey, Abstract 350, being out of The Woodlands Metro Center Section 33 Montgomery County Map Records. 5. Public hearing regarding the proposed zoning amendment from Retail Commercial RC to Commercial Corridor CC. The proposed zoning amendment is for 11.3 acres in Montgomery County School Land Survey, Abstract 350, being out of The Woodlands Metro Center Section 33 Montgomery County Map Records. 6. Consideration and possible action to elect the Planning and Zoning Commission officers for Review of the Tuscan Estates final plat with parking addition. 8. 11 MINUTES OF SPECIAL MEETING September 15, 2015 PLANNING & ZONING COMMISSION 1. CALL TO ORDER The meeting was called to order by Chairman Ash at 7:00 p.m. 2. CALL OF ROLL Commissioners present, Chairman David Ash, Mr. Charlie Bradt, Mr. Ritch Wheeler, Mr. Dean Gristy, and Mr. Wally Westbrook. Also present were Kathie Reyer and Officer John Ferrand. 3. CITIZENS FORUM Responses to inquiries are limited by state law to a recitation of existing policy or a statement of specific factual information given in response to the inquiry. Any deliberation or decision by Planning and Zoning Commission shall be limited to a proposal to place that subject on the agenda of a future meeting. Chairman Ash stated for the record that there were no citizens wishing to speak. 4. Presentation of a Planning and Zoning Commission preliminary report regarding the proposed zoning amendment to allow for a special use permit for mixed alcoholic beverage sales and late hours permit (on premise). The proposed special use permit is for the Holiday Inn Suites, located at David Memorial Drive, Shenandoah, Texas Ms. Reyer advised that this is a request to renew the special use permit for mixed alcoholic beverage sales that was approved previously. She said that due to construction delays, the original SUP expired. She said the late hours permit was not approved originally. 5. Public hearing regarding the proposed zoning amendment to allow for a special use permit for a mixed alcoholic beverage sales and late hours permit (on premise). The proposed special use permit is for the Holiday Inn Suites, located at David Memorial Drive, Shenandoah, Texas Chairman Ash opened the public hearing at 7:02pm. There being no citizens wishing to speak, Chairman Ash closed the public hearing at 7:03pm. 6. Consideration and possible action to recommend approval or denial to the City Council regarding the proposed zoning amendment to allow a special use permit for a mixed alcoholic beverage sales and late hours permit (on premise). 12 TO ALLOW A SPECIAL USE PERMIT FOR A MIXED ALCOHOLIC BEVERAGE SALES PERMIT (ON PREMISE) WITH NO LATE HOURS FOR THE HOLIDAY INN SUITES, LOCATED AT DAVID MEMORIAL DRIVE, SHENANDOAH, TEXAS COMMISSIONER GRISTY SECONDED, THE MOTION CARRIED UNANIMOUSLY. 7. Presentation of the Planning and Zoning Commission Preliminary Report regarding the proposed zoning amendment for a special use permit for mixed alcoholic beverage sales until 12:00 a.m. (on premise). The proposed special use permit is being requested for Fielding s Wood Grill Restaurant located at 1699 Research Forest Drive #130, Shenandoah, Texas Ms. Reyer advised that Fielding s Wood Grill is changing the name of the license holder, similar to other restaurants that have done so recently. She said the IDC provides for a Zoning Alcohol Permit which requires only one public hearing with Planning and Zoning and one public hearing with City Council. She said there is no request for late hours. 8. Public Hearing regarding the proposed zoning amendment for a special use permit for mixed alcoholic beverage sales until 12:00 a.m. (on premise). The proposed special use permit is being requested for Fielding s Wood Grill Restaurant located at 1699 Research Forest Drive #130, Shenandoah, Texas Chairman Ash opened the public hearing at 7:04pm. There being no citizens wishing to speak, Chairman Ash closed the public hearing at 7:05pm. 9. (ON PREMISE) FOR FIELDING S WOOD GRILL RESTAURANT LOCATED AT 1699 RESEARCH FOREST DRIVE #130, SHENANDOAH, TEXAS COMMISSIONER GRISTY SECONDED, THE MOTION CARRIED UNANIMOUSLY. 10. Approve the minutes from the July 21, 2015 regular meeting and the August 18, 2015 regular meeting. COMMISSIONER GRISTY MOVED TO APPROVE THE MINUTES FROM THE JULY 21, 2015 REGULAR MEETING AND THE AUGUST 18, 2015 REGULAR MEETING. COMMISSIONER WHEELER SECONDED, THE MOTION CARRIED UNANIMOUSLY. 11. Chairman Ash said there is still an old Entergy light pole in his yard and asked when it would be removed. Commissioner Westbrook said there is a roll of cable on the fence behind his house, left there by Charter. Commissioner Gristy said there is another one further down the fence. Commissioner Westbrook said he has contacted Charter several times and they have promised to pick it up and they never do. He asked if someone at the City could get involved and help resolve this problem.
