1 THE UNIVERSITY OF OKLAHOMA STUDENT GOVERNMENT ASSOCIATION Session XCIII UNDERGRADUATE STUDENT CONGRESS Session XCIII General Body Meeting 7:00 pm, Tuesday, February 3, 2015 Devon Hall 120 Roll Call 7:07 Flag Salute Approval of Minutes Pae, sec Crisp Chair s Report- Secretary is sick, be nice to her. If you get confused, call on information, and I will clarify, this is a question directly to chair. On the agenda, is the Campaign Reform Act, and is The Department of Special Communities Renaming Act. Vice Chair s Report- Thanks for coming to Orientation; it was fun, and informative. Parli Pro and skipping roll call at end is your friend. If you have questions, please ask. If you want a break, motion for a recess. Come see me if you want to talk about legislation. I m working on adviser reform, come talk to me, I m looking at it. Secretary s Report- Look at the sga.ou.edu website for resources. Attendance is up to date. Please take a look and let me know if you think something is incorrect. Also, some of you are approaching the four absences mark; please talk to me about it. RSO Lists are due on the 7 th. I extended the deadline. Feel free to start visiting RSO s. You need to visit two by the 28 th of February. You introduce yourself and give people the opportunity to talk to you about complaints they have, but also talk to them about RSO Funding! Committee Reportso Academic Affairs- Thank you Vice Chair for orientation. We introduced ourselves and talked about ideas, Carl Berry is Vice Chair and Michael Balangue is Secretary. Tonight may be the most important meeting of the semester. Keep in mind three things: 1. Ask questions candidly and respectfully. 2. We can debate passionately and civilly. 3. Once you vote, don t vote out of intimidation. Vote based on your conviction and constituents. We aren t here to play politics or grandstand. We serve OU and its student body. We humbly and diligently serve the student body, and let s remember who and why we serve. o Congressional Administration- We met for second time. We saw 4 pieces of legislation. 2 resolutions, 2 acts. o External Affairs-We saw a piece on Sally Kern, we gave it a rec of Do Pass. We are working with Aspen on Higher Ed. Day, check your s about it. o Problems and Projects- Resolution for Emergency Protocols to go on Website, rec of Do Pass. We have lots of projects we are working on for the semester. o Public Relations-Orientation was fun. I will assign different positions in committee this week. Are you interested in T-Shirts, SGA cannot fund, but need people to buy? We will settle on a design. o Ways and Means-Reminder Primary Apps are due February 19 th. Talk to RSOs. Tyler just redid the quiz; we are going to have two workshops one week from Thursday at noon and three.

2 Liaison Reports Special Orders Student Concerns Old Business Items to Be Considered Campaign Reform Act (Naik/Thompson) (No Rec-ConAd) Bourland, sec Johnson Thompson: The purpose is to reform campaign spending, and this is designed to emulate TCU. Currently our cap is $2000, which can inherently exclude people without institutional backing or any chance to raise that money. We think $500 would prevent that exclusion and would be enough to successfully campaign. Crisp: What is money used for in these campaigns? Is $500 enough or is $1000 better? Thompson: $500 was more than enough for a graphic designer and advertising on campus. It s enough to get the name out and provide information about the platform. Byron: Our campaign spent nowhere close to $500, but that was uncontested. The most recently contested election was with Ernest. We spent money on graphics, website domain $60, the basic setup, and tacked on a couple hundred more for paper. Using this calculation, $500 seemed good; it seems doable to me if I couldn t get outside funding, and it wouldn t knock me out of the race, but $1000 would exclude me from running if I could not get funding from other sources. Bourland: Would you accept a friendly amendment to change $500 dollars to $1000. Byron: No Bourland: Hostile then. Hueffed: How does this compare to other Big 12 schools beside TCU? Byron: Depends on the groups, from when we talked to others at the SGA conference in Iowa, some had tickets and caps, and others have party systems. Others have no limits, or even a $5000 cap. We wanted to hash out different issues at play, and we were concerned about exclusions inherent in the $2000 value. TCU has a very active student body, and a fairly diverse government. They were happy with their system. Hueffed: How strictly is this overseen? Byron: Election spending is the responsibility of the Election Chair and Board, Taylor Petersen. If you were elected, you filled out a campaign spending report, both primary and a final that was due within 24 hours of the end of the election. Depending on the infraction you can be fined or removed from the race. Garfinkle: TCU has 8000 students, and since we are much larger, will this still be sufficient? Byron: Good point, right now, our system gears to very certain group of students who don t raise funds themselves and it excludes other students who may find themselves without external backing. Crisp: The Election Chair even stated that $1000 would be better, have we considered SGA providing money for the elections themselves, and avoid the cap, by having us fund all elections? Byron: We have only begun to discuss it, if we think we could afford it, we would like to, but we have CAC elections coming up, and we wanted to change it before the election by removing the extreme caps, and reform later. DEBATE Move to see hostile amendment changing $500 to $1000: Bourland, sec Johnson Bourland: I think that since we are over twice the size of TCU, and because of our size, while we can emulate them, we shouldn t copy exactly. I understand the decrease to prevent exclusion, but we are bigger, so $1000 would be better and compromising for half. If we still have issues we can cut it again. I think it is more difficult to do it now, and it could limit the elections we are about to have for printing and shirts, and $1000 is more fair. Nigh: This will change $500 to $1000 for all these elections, but are you still comfortable with $250 for each congress election? Bourland: Yes. Cramm: Do you think this will limit those who cannot get $1000 from running? Bourland: You don t have to spend $1000; I don t think we should prohibit abilities to do promotional items like t-shirts this way.

3 Crisp: Based on TCU s size and its Christian university status with private funding, what is the economic status here at OU prohibiting the overall student body from running as a result of economic status? Bourland: I cannot say, because I do not know. Crisp: Should we not table until we can find this information out? Bourland: I think that is outside of the scope of amendment. Hueffed: TCU is smaller, but OU has one of the smallest campuses in the Big 12, and lots of advertising goes digital, so why would size impact an additional $500, why do you think that boost is necessary? Bourland: If you advertise on Facebook, they can calculate how many people it will reach out to. Reaching out to more people means spending more dollars, just like SuperBowl ads cost more than regular Primetime. It costs more money to advertise even digitally; we have more post-able ground-we are 1.25 miles in straight line from Sarkey s to Couch, and mile wide, lots of places to post and housing rooms to post at and apartment complexes, which supports $1000. Tran: You brought up studies, could we push back and do more research? Bourland: It is possible, but still out of scope of the amendment, nor do I think a survey will be representative of the students who may run and that average status will not be very representative, very few even consider to run. The average student doesn t think I really need to run for government. Cramm: How much was used in the last contested SGA election? Byron: All $2000, more in depth on that later. Bellafiore: If you were not uncontested, how would you have changed your tactics? Byron: We probably would have used more paper, few more Facebook ads, and some yard signs. In regards to t-shirts, we talked about them and it comes down to how we would have felt about the field. No real answer for that. Failed roll call vote on hostile amendment Debate Objection Previous Question Bourland, sec Berry Byron: We also want to limit campaign spending and change the playing field, it is an unsung rule that funding comes from your Greek organization. That is why in the last contested election, both tickets paid the max $2000. If you don t have the option of having your organization fund the campaign, it eliminates your ability to raise such funds, which isn t fair or representative of campaigns. It is about changing the playing field for those running to be able to successfully campaign. I think people shouldn t spend most of their money on promotional items, but the most genuine is encouraging people, and getting your name out there face to face. Motion to table for 1 week, Bourland, sec Crisp, OBJECTION Withdraw Passed by Roll Call Vote Department of Diversity Act of 2015 (Naik/Thompson) (No Rec-ConAd) Bourland, sec Crisp Thompson: This changes the title of the Department of Special Communities to the Department of Diversity, we think this title better fits the role outlined in the Bylaws. The Department of Special Communities suggests something separate, while the Department of Diversity suggests that they are valuable to this community, which leads to better representation. Echols: Why are you getting rid of the office of the International Association of Students? Byron: We got rid of already last year in the piece of legislation that created the Department of Special Communities. Consent w/o objection A Resolution Requesting Emergency Protocols on the OU Website (Sample) (Do Pass-P&P) Bourland sec Pae Sample: Started working on this last semester in light of the Moore tornado when we found out half of our buildings were not tornado safe. In light of the lack of knowledge of the emergency protocols, this legislation lists the information by building on the OU website so you can go online and read the emergency protocol per building. I spoke with OU administrators and they love the idea. Crisp: Have you discussed how the procedures will be formatted?

4 Sample: On the OU safety page, the buildings will be listed and the protocols will be listed under each specific building. They are long because of federal mandates. There will be links taking you where you need to go. Marhanka: Is is possible to add to this to be included in the emergency alert system? Sample: It might be possible; we would need to talk to Lisa Teel. Baker: So this is saying that we, as students, would like emergency protocol to be more available online? Sample: Yes, this is very beneficial. Cramm: Would you be willing to accept friendly amendments adding me as a co-sponsor and the Sooner Emergency Response Team to the distribution? Sample: Yes. Crisp: Would you accept a friendly amendment making me a Co-sponsor? Sample: Yes, anybody else? Consent w/o objection A Resolution Requesting an Impeachment Inquiry (Echols/Bourland) (No Rec-ConAd) Bourland, sec Skelton Bourland: This is a formal impeachment inquiry; we are requesting that Congressional Administration meet with Kunal to determine if his actions require articles of impeachment. They will meet with him, invite others, and hear from others. I don t think that ConAd will even write articles of Impeachment, and if they do, I doubt the Senate will hold him impeachable. I think this is one way to take action and hold him accountable. Whether or not you are in favor of impeachment, that is not this vote, this is just if you think we should launch an investigation. We must do something, even if it is just a censure or this, especially since we just tabled the censure. It is our job to hold Kunal accountable. Cramm: Could you explain the fifth whereas clause stating that Kunal represents the SGA on all official occasions? Echols: In the Constitution, nothing describes what an official occasion is, and combined with some of the questions asked and responses provided may violate that. He said in everything he does, he represents the SGA. Hueffed: The OU Daily poll is not scientific and is a straw poll and in light of that, how much weight has been given to the poll? Bourland: This resolution was drafted before the poll; I think any statement of student opinion is important, and written to an act. Aragon: Do you think that this will be a waste of time, especially since we don t think anything will come of it? Bourland: As much as a censure. Aragon: How would it be the same statement when one takes two weeks and the other doesn t? Bourland: If they have articles to draft, I think it is still congress acting even if the Senate doesn t find him impeachable. Skelton: You said you doubt they will draft, and that we must act so why this and not the censure? Bourland: Since there are issues with the censure that we tabled, this is still acting, if something comes from it great. If ConAd finds something, well, we can t do anything about that without this. This allows us to carry the process further. Thompson: Regarding official occasions, in what way could what he was doing that led to his arrest be considered an official occasion and could it be considered unconstitutional? Bourland: Since it is vague and silent, his response that he represents SGA in all things, and we will use the IFC definition of 3 or more people. Watts: Is there any inherent value in expressing concern regardless of effect? Bourland: I think so here. Crisp: Would an inquiry give the students more voice than a censure would? Bourland: Yes Aragon: How do you think that they will have a voice in this inquiry? Bourland: We should consult them and bring them forward, a poll is great, but one on one is even better. Move to extend questions by 5 minutes: Elwick, sec Witt

5 Elwick: What are you expecting to find, given that most of the information has already been publicized? Bourland: I would have to think about it and what real questions we want to see answered and maybe get details about what happened and what is an official occasion in his opinion. Cramm: Please explain the logic of acknowledging the impeachment inquiry would cut out the moderate voice of the body that wants censure; how will it increase student voice? Bourland: Impeachment was in the middle, more are asking as such for they are asking us to do something. Garfinkle: Would you say a majority did not know what censure was? Most of the people I talked to didn t know. Bourland: I didn t write the survey or the censure resolution; I cannot comment, it is tough to speculate if it had been defined. Park: Would you be willing to accept a friendly amendment dropping Conor Park from the Co-Sponsors list. Crisp: Based on the poll, and that you could vote multiple times, would you say that we should hold an actual poll to avoid duplicates? Bourland: Yes, we could get it up Yoo: Since D2L reaches more students, would you want to put the web poll there? Bourland: Yes, we could. Carter: You said we should vote on what our constituents want last week, and this week you are arguing that we are acting. If you knew what your constituents wanted, is it about what they want or about taking action? Bourland: We owe the whole body an action, this is it. If they want impeachment, that would make me aware of what constituents want. We are holding him responsible. Aragon: Would failing this bill, also be an action? Bourland: It would be an inherent lack of action. Crisp: Based on inherent idea to pass this bill for action, do you think people would be more apt to impeach if they found there were and could find things in the inquiry? Bourland: Yes, if ConAd finds nothing worth writing articles of impeachment, they at least make that educated decision, and they fulfill their obligation. Motion to continue questioning until the end of list Bourland, sec Johnson Sample: In what way is returning to one s home an official occasion of the SGA? Bourland: Everywhere he is, based on his answer given last week. Witt: Would you be willing to accept a friendly amendment adding an open records request? Bourland: Yes Objection that needs to be an act, not a resolution Thompson: A majority of votes were in favor of those wanting action than not, but how does this represent those that requested censure as opposed to impeachment? Bourland: Not sure that it would, however, the distinction between acting and not, most want some kind of action, and same could be asked of censure. Since we are seeing this today, some action is better than none. We have responsibility and owe it to the body and Congress to act. Skelton: Since you are uncertain of the outcome, why help author? Bourland: We have to do something, and I didn t think censure was enough. I don t know what it does, I m not sure if I would vote to pass impeachment. I wanted to put name to an action. Aragon: Did you not hear about censure when placing it on agenda on Thursday? Bourland: Yes, but I didn t know what it was, nor did I see it before Sunday. Watts: Due to lack of knowledge, and that supporting doing nothing has cut in half in the poll, do you think the poll was reliable? Bourland: I m not a statistician; I cannot say Pae: You mentioned the importance of one on one conversations; what kind of feedback did you hear from your constituents? Bourland: Mixed, not as mixed as others have reported, I m in favor of inquiry, it is possible my questions may have led, but I believe I gave facts, and a majority of students and a majority of my constituents were in favor of impeachment. Nigh: While tabling would be an action, would it not be more prudent to wait one week to see this with the censure as well?

6 Bourland: That may be, but we tabled censure due to incorrect facts, this one doesn t have any incorrect facts, and I think we need to do something and tabling would drag it out unnecessarily. Let s do, let s act, let conad do its job, alright, we can rest easy for doing our duty, and we are not kidding around, and we doubt he will do this again and he will fully understand the consequences of his actions. Kirby: I am having a hard time understanding what is lost by not going through with it. If we go through, it seems reasonable to go through with it? Bourland: I agree, we are doing our due diligence this way, and this is the only way to really do our diligence as per the resolution passed in the Code Annotated and the past; this is the only way to do this. We would like to table it, because some of the whereas clauses are now incorrect, specifically for the poll which was not closed. Motion to table for one week, Bourland, sec Elwick A Resolution Responding to HB 1598 (Aragon/Sample) (Do Pass-EA) Elwick, sec Crisp Aragon: The Oklahoma State Legislature is now in session, a lot of the bills are silly; this is one of them. HB 1598 allows any parent to put their child into conversion therapy without their consent. Conversion therapy has been proven not to work, results in a lot of negative consequences to the child, and as such, we ask that this be failed because the children should have consent, and three states have already outlawed it. Benjamin: Is conversion therapy conducted by the state or by private doctors? Aragon: While it is often done in the private sector, you don t have a very sophisticated license, it is very low grade therapy. Benjamin: We wouldn t be paying for it with our taxes? Aragon: No. Skelton: Would you accept a friendly amendment adding me as a co-sponsor?

7 Aragon: Yes. Pae: In the past, have representatives responded back when we send them legislation like this? Aragon: In the past there has been some, just in case it does make traction, we sent it to all the members of the two most likely committees that would see it. Nigh: Would you accept a friendly amendment adding me as a co-sponsor? Aragon: Yes. Thompson: Is there inherent value in this body expressing this concern to the state legislature, even if nothing happens? Aragon: I believe so, we are their constituents; it is still valuable for us to object. Benjamin: Where is it in session? Aragon: It has made it through the first reading, and has been referred to committee. Crisp: Does this bill make it so that children cannot choose to enter conversion therapy on their own? Aragon: Children can still choose to enter conversion therapy if they want, but we hope to ban Parents forcing their children into it. Hueffed: What is legal standard for parents being able to choose medical care? Aragon: This infringes on right of minors to choose their own therapy Bourland: Does Oklahoma Statues already have a law? Sample: As is the case with many states, the mental health guidelines are different than other instances of healthcare decisions for minors. In this case, their decisions become private from their parents before they turn eighteen, and this violates their own power to choose their treatment, as outlined in numerous sections of Oklahoma Statute 43a regarding Mental Health. Baker: Would the passage of HB 1598 be unlawful or unconstitutional? Aragon: It would be unlawful, but that doesn t stop the state legislature. Baker: If they passed, would it be unconstitutional or would be unlawful against another Oklahoma Statute? Aragon: Yes, it would be unlawful as there is no repeal clause. Passed by Roll Call Vote Motion for brief five minute recess, Bourland, sec Johnson Director Appointment Act of 2015 (Thompson) (No Rec-Exec) Cramm, sec Elwick Thompson: This bill appoints the acting cabinet directors to fill the positions they ve been acting as. They were interviewed and selected based on their qualifications by Byron and Naik. A large base of people applied, these were the most qualified. I hope you pass this bill, so that they may continue doing what they started. Bourland: Would the appointees please introduce themselves? Looney-Deparment of Communication Lutter-Department of Development Smith: Department of Student Organizations Real: Department of the Exterior Bailey: Department of Special Communities Byron: Department of the Interior is Kendall Burchard Scott: Can the candidates provide a brief description of the job? Looney: The Department of Communication is all about rebranding the SGA and making students aware of our efforts. Lutter: In the Department of Development, we are comparing OU s SGA to other SGA s to make improvements to ours. Smith: The Department of Student Organizations has been working with Matt for Primary Funding by spreading awareness about the process and overall being a resource. Real: The Department of the Exterior has been busy planning Higher Ed. Day, and once we conclude that event, we will work on the Good Neighbor Initiative. Bailey: The Department of Special Communities is addressing the interests and concerns of special organizations on campus. We are working to be proactive, rather than reactive, such as in the case of OU Unheard.

8 Byron: The Department of the Interior is probably closest to Congress P&P, they focus on creating and launching different initiatives and events like last semester s Turn Up for Transit. Benjamin: Would you be willing to accept a friendly amendment changing Bert Bailey to BerThaddeus M. P. Bailey? Thompson: Yes Droege: Would you be willing to accept a friendly amending correctly spelling Tory s name? Thompson: Yes Crisp: What are special communities? Bailey: We have African Americans, Latinos, LGBTQ, and other groups whose students have interests that require special attention. I ve been to 8, and this was the best ever. Nobody was bored, we all got to know each other, we learned a lot, and had yummy food. Baker: I would like to formally apologize for my inappropriate decorum comment during debate. Also, Reason to Live, which addresses mental health issues on campus is coming up, I encourage you all to go. Crisp: I will be putting out a box for cash/change in SGA office for a low-income school to send students to the Special Olympics for first time ever, please bring money. Echols: The School of Drama s Othello will take place February Bourland: Ryan Echols is in it Witt: UPB s CollegeCon will be on 2-27 for those who are interested. Francois: Big Event registration opens tomorrow! Bourland: After the vote on the impeachment inquiry, it is important to remember we are still one Congress; we are one body, one family. GS15-XX AS INTRODUCED An act amending Title VII of the SGACA, providing for a short title; providing for codification; and providing an effective date. BE IT ENACTED BY THE UNIVERSITY OF OKLAHOMA STUDENT ASSOCIATION Section 1: This act shall be known and may be cited as the Campaign Reform Act Section 2: The purpose of this act is to update the campaign spending limits. Section 3: AMENDATORY. The following parts are to be amended to Title VII Chapter 3 the SGACA: c. Campaign Spending i. There shall be an upper limit placed on all campaign spending. The spending limit shall be established at $2000 $500 for each SGA Presidential, CAC Chair, HCSA Presidential, and SBA Presidential ticket, and $250 for each Student Congress Representative candidate. GS15-XX AS INTRODUCED An act amending Title IX of the SGACA, providing for a short title; providing for codification; and providing an effective date. BE IT ENACTED BY THE UNIVERSITY OF OKLAHOMA STUDENT ASSOCIATION: Section 1: This act shall be known and may be cited as the Department of Diversity Act of 2015 Section 2: The purpose of this act is to update the Department of Special Communities title and responsibilities within the SGA Executive Branch Section 3: AMENDATORY. The following parts are to be amended to Title III Chapter 9 the SGACA: Title III The Executive Chapter 9 The Department of Special Communities Diversity 50. Purpose The Department of Special Communities Diversity shall provide assistance, services, and advocacy within the SGA executive branch for underrepresented students on campus. The Department shall address issues that affect international students, students with disabilities, as well as gender and sexual minority issues and multicultural issues. This list is not intended to be restrictive, and more offices may be appointed within the Department at the discretion of the President. 51. Director There shall be a Director of Special Communities Diversity, responsible for executing the provisions of this act, overseeing and coordinating the Offices in the Department, and managing and ensuring the execution of the Departmental Purpose. 52. Office of International Students a. Purpose The office of International Students shall communicate and interact with the International Student Services Office, International Advisory Committee and International Students to ensure that SGA is addressing their concerns. b. Coordinator The Coordinator of Exchange Programs shall be responsible for managing and ensuring the execution of the purpose of the Office of International Students 53.Other Offices The President shall appoint other offices to advocate for underrepresented groups at OU. These offices shall coordinate with appropriate student organizations and university offices to ensure that SGA is addressing the concerns of each community. Section 4: This act shall become effective, while in accordance with the SGACA, immediately following passage and approval.

House Bill 1598 would allow parents to obtain conversion therapy for those under 18 for unwanted sexual attraction without state interference; and Conversion therapy, or sexual orientation change efforts (SOCE) include any practices by mental health providers seeking to change an individual s sexual orientation or gender identity; and A 2009 report from the American Psychological Association found that conversion therapy techniques can include inducing nausea, vomiting or paralysis while showing the patient homoerotic images; providing electric shocks; using shame to create aversion to same-sex interactions; orgasmic reconditioning; and satiation therapy; and There has been no proof that conversion therapy is effective. The American Academy of Pediatrics has stated: Therapy directed at specifically changing sexual orientation is contraindicated, since it can provoke guilt and anxiety while having little or no potential for achieving changes in orientation; and California, New Jersey, and Washington D.C. have approved laws banning conversion therapy due to the harmful effects on children; and NOW, THEREFORE, BE IT RESOLVED BY THE UNDERGRADUATE STUDENT CONGRESS AND THE GRADUATE STUDENT SENATE CONCURRING THEREIN THAT: Section 1: Section 2: Section 3: Section 4: The student body of the University of Oklahoma opposes Oklahoma House Bill 1598, as it violates the human right to choose one s own therapy. Additionally, we believe it to violate the intent and integrity of multiple sections of Oklahoma Statute 43a, regarding Mental Health Statutes, particularly infringing upon the rights of minors.
