1 Constitution Committee Meeting Agenda for the Fifteenth Formal Meeting The Fifteenth formal meeting will be held on February 23 rd 2016 from 12:30-2:00 pm from the MVC SLDP office with a Skype link to the SJC SLDP office and then from the SJC SLDP office on Wednesday February 24 th 2016 from 12:30-2:00 pm Call to Order: Opening Business Roll Call Tuesday: Absent: Roll Call Wednesday: Absent: Acting Chair: Anthony Raya Advisor: Maya Cardenas Approval of Minutes The Constitution Committee may approve the minutes for the meeting held on 1/27/16 and also those for the meeting held on 2/2/16 through 2/3/ Public Comment This is a time for students or members of the public to voice their concerns. Unfinished Business Revise Working Priorities and Working Goal schedule New information has come to light that may impact the suitability of our current working priorities and goal schedule. The body may re-divide the Constitution revision workload, re-prioritize different workload components and, set a new schedule for when each workload component should be completed Submit A Second Section of Constitution for Ratification by the Senate The Constitution Committee may decide to submit draft section or sections for ratification by the SGA Senate. 2 Proposed Draft Language Outlining the New Organization Design Section 3 OFFICERS The Elected offices of this organization will be: a) SGA President b) SGA MVC Vice-President c) SGA SJC Vice-President d) Commissioner of Institutional Effectiveness e) Commissioner of Financial Affairs f) Commissioner of Campus Activities g) Commissioner of Campus Relations h) Commissioner of Campus Organizations i) Commissioner of Special Projects (Student Services) j) Three (3) Senators of Institutional Effectiveness k) Three (3) Senators of Financial Affairs l) Three (3) Senators of Campus Activities m) Three (3) Senators of Campus Relations n) Three (3) Senators of Campus Organizations o) Three (3) Senators of Special Projects (Student Services) The Appointed officers of this organization will be: a) Member at Large b) Volunteer at large LEGISLATURE Legislative authority in the Student Government Association will be vested in the SGA Legislature. Voting membership in the SGA Legislature will consist of SGA President, two (2) SGA Vice Presidents, six (6) SGA Commissioners and eighteen (18) Senators as listed above. The powers and duties of the SGA Legislators will be to: a) Approve all funds and appropriations; b) Pass legislation (bills, resolutions, and recommendations); c) Send all legislation that is passed to the President for approval; d) Propose amendments to the SGA Constitution and all other founding documents, SGA Codes, and SGA Bylaws; Constitution Committee Agenda for the Fifteenth Formal Meeting 2

3 e) Vote on SGA Executive Council appointment recommendations for all vacant SGA offices and Shared Governance Committee positions; f) Override an SGA Presidential veto by a two-thirds (2/3) vote; g) Serve as representatives for the student body; h) Serve on at least one (1) College Shared Governance Committee (each member); i) Uphold the laws of the Student Government Association as prescribed in the SGA Constitution, SGA Bylaws, SGA Election Code, SGA Finance Code, and Inter-Club Council (ICC) Bylaws; j) Conduct impeachment proceedings against any elected or appointed officers of the SGA by a two-thirds (2/3) vote. Section 5 Section 3 Quorum in the SGA Legislature is defined as fifty percent (50%) plus one (1) of voting members. The SGA Legislature will meet at least once a week during the Spring and Fall semesters. EXECUTIVE COUNCIL Executive Authority in the Student Government Association will be vested in the Executive Council. Voting membership in the SGA Executive Council will consist of the SGA President, two (2) SGA Vice Presidents and Six (6) SGA Commissioners as listed above. The powers and duties the membership of the SGA Executive Council will be to: A. Submit appointment recommendations to the Legislature in regards to any vacant SGA offices or Shared Governance Committee positions; B. Advise the Senate changes to the SGA Constitution, SGA Bylaws, SGA Election Code, SGA Finance Code, and Inter-Club Council (ICC) Bylaws. C. Delegate Tasks to Standing committees as needed to carry out legislative directives. D. Draft and submit to the senate a set of organization wide goals and priorities each semester. E. Encourage cooperation and coordination between the various SGA standing committees. Quorum in the SGA Executive Council is defined as fifty percent (50%) plus one (1) of voting members. 4 Section 5 Section 6 The Executive Council will meet at least once a week during the Spring and Fall semesters, and will meet at least twice a month during the summer intersession. The SGA Executive Council will have the authority to conduct all official SGA business when the SGA Legislature is not in session (Winter and Summer intersessions). However, the Executive Council cannot, without the approval of the SGA Legislature, make any changes to the SGA Constitution, SGA Bylaws, SGA Election Code, SGA Finance Code, and Inter-Club Council (ICC) Bylaws. Section 3 Section 5 Section 6 STANDING COMMITTEES The Legislature will have and maintain the following Standing Committees. a) Institutional Effectiveness Committee (IEC) b) Financial Affairs Committee (FAC) c) Campus Activities Committee (CAC) d) Public Relations Committee (PRC) e) Campus Organizations Committee (COC) f) Special Projects Committee (SPC) (Student Services) Voting membership in each Standing Committee will be limited to the appropriate SGA Commissioner and corresponding three (3) SGA Senators. Quorum in Standing Committee meetings will be set to at least two voting members, unless only one voting member sits on that Standing Committee. Each SGA Standing Committee will meet at least once a week during the Spring and Fall semesters. Approved volunteers may be assigned a Standing Committee under the recommendation of the appropriate SGA Committee and the approval of the SGA Legislature (simply majority vote). As new senators are appointed; all Standing Committees must have at least two Senator seats filled before the third Senator seat on any standing committee may be filled. 5 New Draft Duties of Standing Committees Section 5 Section 6 DUTIES OF STANDING COMMITEES Finance Committee Chaired by the SGA Vice President of Financial Affairs, the primary purposes of this body shall be to: a) Manage SGA finances, budgets and financial records in accordance with the SGA Finance Code; b) Advise the SGA Legislature and the Executive Council on financial matters; c) Recommend to the SGA Legislature revisions to the Finance Code; d) Report to the SGA Legislature on matters discussed in the SGA Finance Committee; e) Prepare and submit the annual Budget to the SGA Legislature for review, amendment, and/or approval and publication. f) Receive, review and archive Purchase Requests and Funding Proposals; g) Other duties as directed by the President or the Executive Council. Campus Activities Committee Chaired by the ASNC Vice President of Campus Activities, the primary purposes of this body shall be to: a) Set, publish and maintain an activities calendar each semester; b) Monitor, organize, and conduct all SGA Events and activities; c) Monitor, organize, and conduct graduation activities sponsored by the SGA; d) Monitor, organize, and conduct the SGA Banquet(s); e) Report to the SGA Legislature on matters discussed in the SGA Campus Activities Committee New Draft Terms of Office TERMS OF OFFICE The term of office for all SGA officers will be two (2) semesters, Fall (Including Summer) and Spring of the same academic year. 6 Section 3 No student may hold more than one (1) SGA office at a time. No student may concurrently be a member of the SGA Executive Council and also hold a leadership positon in any club or student organization receiving funding from MSJC at MSJC New Meetings Draft Language Section 3 MEETINGS Agendas, Minutes and any supplemental materials will be available to the public at least three (3) days [72 hours] prior to the start time of the meeting per its agenda. In any instances not covered by this SGA Constitution, SGA Bylaws, Codes, and standing rules, the SGA Legislature, SGA Executive Council, Inter Club Council and all other SGA bodies will refer to the most current edition of Robert s Rules of Order as their parliamentary authority. All proceedings at SGA meeting(s) must be conducted in accordance with the SGA Code of Ethics. The SGA Advisor(s) will serve as the advisor(s) to the SGA Legislature and SGA Executive Council, and Inter Club Council New Draft Code of Ethics Code of Ethics The Student Government Association of Mt San Jacinto College respects the diversity and dignity of all. a) We, the Mt. San Jacinto College Student Government Association, shall will recognize that every individual deserves respect, regardless of his or her cultural affiliation, ethnicity, race, religious beliefs, political philosophies, disabilities, sex, sexual orientation, age, or socioeconomic status. b) We will strive create an atmosphere where people are free to express themselves and where they can, when necessary and appropriate, challenge each other's actions or beliefs. 7 c) We will make every attempt to display sensitivity, preserve individual dignity, evaluate other positions with an open mind, and refrain from displaying unwanted personal attention. Honesty and Integrity and Decorum a) We will avoid abuses of power by refraining from exploitative behavior, extending preferential treatment or personal favoritism, and accepting gifts or favors that could be interpreted as bribery. b) We will be open, transparent, and honest in our student business, and maintain appropriate documentation of all of our actions and decisions. c) We will carry ourselves in a kind, courteous, and dignified manner while avoiding actions that jeopardize our character or reputation. d) We commit ourselves to excellence in all of our academic and extracurricular endeavors New Draft Heritage of Mt. San Jacinto College Section ARTICLE? Heritage of Mt. San Jacinto College Members of the Student Government Association of Mt. San Jacinto College will be known as the Eagles. The college colors will be red, white and black. The Eagle mascot will be known as Ernie Elections and Eligibility Requirements The Constitution Committee will discuss, revise, and potentially approve a constitutional article that enumerates the Eligibility Requirements of positions within SGA. The following draft language could be revised or approved. ARTICLE V OFFICE QUALIFICATIONS Qualifications for holding office: a. Any Student Government Association officer who does not maintain the following requirements will be immediately dismissed from office: 1) Be an Active Member of SGA; 2) Be registered in at least six (6) units at MSJC; 3 units for Members at Large 3) Have grade point average (GPA) of at least 2.25 for the previous semester, 2.5 for Executive Officers Council Members; 4) Has not held the same office for two (2) or more terms; 5) Must not be placed on any type of probation at MSJC. 8 Qualifications for candidacy or appointment to an executive or senate office: a. All candidates and appointees for SGA executive or senate office must meet the following requirements: 1) Be an Active Member of SGA; 2) Be registered in at least three (3) units at MSJC; 3) Have a grade point average (GPA) of at least 2.5 for the previous semester, 2.0 for Members at large; 4) Comply with all standards, rules, and regulations of the SGA Election Code, Administrative Regulations, the Student Handbook, College guidelines, and Board of Trustees/District polices. b. Candidates and appointees to the office of PR will meet the following additional requirements; 1) Have completed English 098 or equivalent with a grade of B or higher; 2) Have completed one transfer level course in Humanities or Social and Behavioral Science. c. A student who has been placed on any type of probation at MSJC will be eligible for candidacy one (1) semester after he/she is reinstated as being in good standing. d. First semester MSJC students, who do not have college level course work on their MSJC transcripts will be exempt from all grade point average (GPA) qualifications in article V. Closing Business Closing Announcements: This is a time for committee members to voice any general announcements they have Task Delegation: This is a time for committee members to reaffirm any tasks that have been delegated to them.
