1 THE UNIVERSITY OF OKLAHOMA STUDENT GOVERNMENT ASSOCIATION Session XCV UNDERGRADUATE STUDENT CONGRESS Session XCV General Body Meeting 7:00 pm, April, 5th, 2016 Devon Hall 120 Roll Call - Flag Salute: Rep James Approval of Minutes: Elliot sec Byron Chair s Report- Our normal sec is not here so Ryan is filling in for her. Also, we have food, please get more food, just don t walk in front of people while talking. New members, we have to finish session 95. If you are new, you can t vote in session 95. We follow a procedure, if you are confused raise your hand and say on information. I ll call on you and answer your question. We have info up here for you to use. No motions or voting till we switch sessions. This is our final meeting of 95. If you are a graduating senior and have 10 dollars, come get your honor cord. Committee membership ends tonight along with all associate positions. The exec committee will still stand. We can still see legislation in exec. We are having our meetings on Mondays to make things easier. Nominations will be next week, elections on the 19 th. The GSS is working with gender and equality center for an event where you can bring extra clothes to their center in the union, or the residence halls. On the 13 th at 9am there will be a clothing swap, and were excited. I m Emily Sample. Vice Chair s Report- My name is Chelsea Brown and I am a sophomore. I m happy that everyone s here. Please don t hesitate to ask questions. Secretary s Report- Hi everyone. First off, I want to apologize in advanced for my absence tonight. I am attending a funeral out of state and could not make it. Secondly, I am so excited to meet all of our new members! Congratulations to everyone who won your election. One hour of constituent service and one office hour is due for the month of April. You only have to do one office hour this month since it is getting into a high volume time for school and classes! For all of you new members, please me any questions you have about what that entails. I hope you have a great meeting and I will see you all next week J Committee Reportso Academic Affairs: Hey everybody, I want to thank everyone for such a great semester. We had a few projects that weren t finished but we will work on them over the summer. Looking forward to next session. o o o Congressional Administration: External Affairs: I am Kara. I thought we had a really productive semester. I thought my committee did a great job. We have projects coming up for coming elections like the mayoral one just recently. Human Diversity: Hello and congratulations! I m Morgan, awesome semester. We further discussed our hate speech campaign which will heat up in the fall semester.

2 o Problems and Projects: I m Taylor, thanks committee! I was unable to attend Sunday, but the flags for the parking have been placed. Thanks MJ. Were done with water fountains, all have been installed. Our one bill was tabled. o Public Relations: Thanks committee, you are still able to get service by handing out pamphlets in the Conoco. We didn t meet last week for anything especially, follow us on social media! o Ways and Means: Matt Cramm, emergency allocation 12 and another coming up. Liaison Reports: Mazeitis: crimson cords are having a concert on 23 rd Kelling: just got from intercollegiate legislature, it was awesome. If you re interested come talk to me! Moore: OU Rotaract is having a benefit for polio tomorrow at 630 Williams: BSA is having a stomp down the 16 th at 6pm, also exec applications are out Byron: CORE consulting applications are out, it s a sub-branch that works with RSOs for a project, getting new members and transferring appropriately, addressing issues and whatnot. Special Orders Student Concerns Old Business Items to Be Considered State of the SGA Update Act (Sample/Tadlock) (Rec of do pass) Nguyen sec Chun Sample: this bill simply moves state of the SGA out of the final meeting so more students can come. That final meeting is very important and is an opportunity for SGA to update the student body on our work. Echols: friendly amendment? Sample: no, this is about moving outside of our congress meetings. I would like it to be held similarly to inauguration. I don t want to say this is for congress. Reid: Scriveners error? Kelling: open to adding a member of congress must be present? Shouldn t congress be there? Sample: no, we changed this last year because it was supposed to be a joint session and that wasn t happening. We put it in the last meeting but that took 3.5 hours before the state even took place. Everybody left and it was inappropriate. We want the state of the SGA should mimic the inauguration. We want this to be independent of quorum. It is up to the chair to encourage attendance. CAC needs to be there. Kelling: line about chairs make effort to ensure that members attend? Sample: there s no need and we can t force it so no Owings: When would this be? Sample: it s supposed to be after spring election but before finals. This is at the discretion of the interior. It is currently planned for the last week of April. We need our new CAC chair to be elected before a certain date is selected. Reid: Couldn t this be circumvented by moving out of standard rules and moving this into special orders. Sample: It was last night, but we wanted to see all of our legislation. We need a chair for the state of the SGA to be delivered. Motion to extend time for questions by 2 minutes Chun sec Williams Sample: I had to present immediately after being elected. The process wasn t working. Reid: This is a solution to people not showing up to see them, how does this guarantee? Sample: It doesn t, but it does allow for publication Byron: does the CAC still have state of the CAC? Sample: yes Byron: has there been talk about setting them at the same time> Sample: not yet Echols: how is this any different than informal presentation Motion to extend time for questions by 5 minutes Zahra sec Reid

3 Sample: this one is mandated and has to happen. We can t get rid of it without referendum. I think it should continue. The student body needs to know what s going on. Echols: Is it counterintuitive to remove congress? Sample: no, the point is for the student body to be informed, congress can still be involved. The Chair will be there and exec will be involved. That s up to their discretion. This is only moving its setting. Owings: friendly amendment? Sample: no, I don t think that if it s long, I don t want to read it aloud. It could get lost, but that s a good recommendation. WE should make it readily available to the bodies. Reid: Could we make it a requirement? Sample: That s outside the scope of this legislation. That would be in the bylaws. The secretary is not here. Debate Echols hostile amendment Motion to recess for 5 minutes Elliot sec Chun Brown: hostile amendment? He proposed a hostile amendment, there has to be a second Echols sec Israel Echols: I think our important job is government oversight. I think that it s important at the state of the SGA that we know what is going on in the executive. It s very important and were a important part of that. We represent the student body. This is based on the state of the union, which is delivered before congress. I think for that reason it should stay with us. Sample: there will be media presence, is that not sufficient? Many members may be unable to attend. Echols: no simply because the edits that can be introduced Sample: Why is the senate being ignored? Echols: why did you leave them out? Reid: without this language, is there anything barring members from going to this event Echols: no, but it needs to be delivered to us, the confirmation is why its important Reid: this language is based solely on keeping the address to the congress? Echols: It is principle and practical Sample: what does it mean? Echols: direct delivery as it has been Williams: do you mean in this room or anywhere on campus. Echols: theoretically wherever. Sample: does by delivering to congress mean to stay in the congress Echols: I think that it s important but in this bill Benjamin: How important is non congressional attendance? Echols: I think if this was a general address, there would be less of a need, but this is vital Objection- Reid Motion to extend time for question to the end of the list Owings sec Kelling Watts: how would it be determined if it was delivered to the congress? Echols: it is self explanatory. James: are you concerned if congress will be there for oath of office or state of the SGA? Echols: more concerned with verifying the oath Benjamin: How important is it for non-congress members to attend? Echols: while state of SGA talks about the whole, it largely concerns the executive, and congress needs to hear that Watts: If someone says it has to be delivered to quorum, would that have to be at a meeting? Is that overly complicated? Echols: no, we have avenues to deal with that Kelling: Would a written copy be sufficient? Echols: that would be beneficial, but like Sample said, there could be issues.

4 Kovach: You think that timeliness of us being there rather than affirming later may alleviate complications at another time/ Echols: yes Williams: You have secretary, if she was there, and ed it out, wouldn t that be sufficient. Echols: the minutes are not word for word and are not perfect, and it is tough to keep up with someone who s talking, we need to be there Sample: friendly amendment to hostile amendment, Echols: if you include that it needs to be in our meeting, not in current wording Motion to move to recess Kelling sec Reid Echols: no, it s important for us to be there Reid: Is the congress required at CAC swearing in to increase validity? Echols: nothing to do with validity, being there for the oath is our job. We are charged with oversight. Benjamin: Would it be more effective for SGA members to get a summary? Why? Echols: I have no problem with getting a copy of the address, but I do believe it imperative that the oath and swearing in are presented to the body Motion to move to a roll call vote Reid sec Pham Motion to suspend the rules and go back in time for questions to the author Kelling sec Owings Kelling: friendly amendment? This is meant to facilitate better communication between our groups. We want to communicate about what we are communicating to the student body. It would allow for crossover between terms and collaboration. Our counterparts can help out in this department moving forward. I want to see what you think. Israel: why is CAC given the option? Reid: CAC in the past operates on their own, while GSS and exec and congress are analogous. The others believed that they should be allowed but not compulsory Echols: Did you actually speak to CAC? Reid: We have not, it was an initiative by GSS, congress, and exec Sample: Pavlov has been made aware Echols: Would it be better to strike and add more concrete wording? Reid: I m open but I think the language allows the legislative body to move on their own way. CAC can be a part if they wish, but we should not require it. Cramm: with CAC wording may create a divide between us and CAC? Reid: I think it encourages to come, forcing them to come would be unnecessary. They will come when events concern everyone. I have faith. Cramm: Doesn t this cause a divide instead of building up communication by rendering CAC other? Reid: if there was another system that did not require a vote, that may be agreeable. Motion to extend time for questions by 5 minutes Williams sec Echols Byron: why is this all in director s section? Reid: Chair? Sample: There wasn t a good spot for it under titles and did not want to put it in the bylaws. We also didn t want to give it its own heading. Byron: that is only explained under director duties?

5 Sample: yes Israel: friendly amendment Reid: yes Owings: Does the vote have any power or is it a forum? Reid: this is more a forum, votes are for SGA as a whole to promote something Williams: will the members have voting privileges in both bodies? Reid: they will not have voting rights in any other context, only in department. No jurisdiction over committees, only within the department. Motion to extend time for question to the end of the list Mee sec Pham Reid: they (members) have no jurisdiction over my committee PR for congress, this is only for SGA as a whole PR Watts: in I, they shall meet? Is there any enforcement there? Reid: you re not fulfilling your duty Sample: that means you can dismiss your committee chair Owings: in I is CAC not joining interfere with seats being filled? Friendly amendment? Reid: I didn t notice that, Sample: the CAC chair can opt out, we wouldn t have to include them in majority. This meeting isn t based on quorum. Up to the author. Reid: If they fall through, I think it s important for other meetings to be there, do not accept friendly amendment. If one position is not filled, VC takes their seat. It was agreed upon by the authors. Byron: department only oversees accounts corresponding to entire SGA, is that giving them signing power necessary for that account. Reid: no monetary accounts, only social media, don t want to limit people to Facebook Watts: friendly amendment? Reid: yes Williams: back to voting, what do they vote on? Reid: they vote on things like promotion as a whole, for all of SGA. The exec right now promotes as SGA, this department makes this an agreement. Holding events, we can all decide together. Brown: why are we creating another forum or committee? Reid: this is supposed to make it easier to publicize as SGA, not as executive. Echols: CAC does not refer to itself as SGA? Reid: they are a branch of SGA under our logo, they may not always promote themselves as CAC only Watts: is this the same as department of communications? Reid: no, one is for the executive branch solely Williams: Do the PR chairs have to go through anyone? Reid: no, this is meant to encourage communication between the branches. It s up to the department. When we met, we discussed how this was an opportunity to get feedback Sample: the heads of all of the branches will know what they re holding, it will be de facto cleared by bodies Watts: in 2, a long term vacancy indicates department does not exist? Reid: if the senate doesn t have a PR chair, or the department is not appointed, this would allow VC to fill vacancy Williams: building communication, if the CAC chair doesn t join, the idea becomes void? Reid: I don t think so, communication between 3 or 2 branches is beneficial. We would still like to meet to discuss even in such circumstances. Watts: friendly amendment? Reid: no, but I would accept something else Brown: If this department oversees everything, why can t there just be a meeting? Reid: this formalizes everything. I had no one who suggested that I should communicate with the other branches. I believe that this urges that communication better, and clarifies responsibility. Watts: friendly amendment?

6 Reid: yes Brown: what decision making power and authority would this group have? Reid: if we wanted to make pamphlets, this would allow us to decide design, layout, and we could take this to our respective departments. GS16-XX March 29, 2016 GRADUATE STUDENT SENATE SENATE SESSION GS-16 April 10, 2016 AS INTRODUCED An SGA Code Annotated amendment amending the procedure for State of the SGA; providing for codification; providing for a short title; and providing an effective date. BE IT ENACTED BY THE STUDENT GOVERNMENT ASSOCIATION: Section 1: Section 2: Section 2: TITLE: This Amendment shall be known and may be cited as the Making the State of the SGA More Public Act. PURPOSE: Amendatory. This Act shall amend the Code Annotated to move the time and location of the State of the SGA Address. Title III, Chapter 2, Section 8a of the SGACA shall be amended to read as follows: a. State of the SGA Address The State of the SGA Address shall be organized by the Executive Branch and be held after the Spring Election but before Pre-finals week of the Spring Semester held at the final meeting of the Undergraduate Student Congress before finals week each spring semester to deliver an address concerning the current state of Association. The address shall include, but is not limited to, an outline of the current administration s accomplishments up to that point. The chairs shall speak on the accomplishments of their branch and the upcoming goals of their respective branches. At this meeting the SGA President shall administer the Oath of Office to the CAC Chair. BE IT ENACTED BY THE STUDENT GOVERNMENT ASSOCIATION: Section 1: Section 2: Section 3: TITLE: This Amendment shall be known and may be cited as the Actually Communicating Bill of PURPOSE: Amendatory. This Act shall amend the Code Annotated to create an interdepartmental Public Relations effort on behalf of the Student Government Association as a whole. Title III, Chapter 10 of the SGACA shall be amended to read as follows: Title III The Executive Chapter 10 The Department of Communications 1 1. Departmental Purpose The Department of Communications shall promote the programs and positions of the SGA. 2. Director a. There shall be a Director of Communications, responsible for overseeing and coordinating the efforts of the Executive Branch pertaining to media relations, web communications, graphic design, photography, and other outreach initiatives. b. The Director shall have an automatic position in the SGA multi-branch Public Relations Department alongside the Public Relations Chairs of both the Congress and the Senate in order to coordinate with the other branches to facilitate communications on behalf of all of the SGA. 1 Added Chapter 10 on 10/22/14: Smarter Departments Act of 2014 CBN SBN GF14-02 Title III Chapter 6.

10 i. The Joint Public Relations Department shall meet every week of the academic semester where every member s position is filled, excluding the final two weeks of the semester. ii. In the event of a long-term vacancy in one of these aforementioned positions, the Vice President shall assume the role. iii. The Joint Public Relations Department shall oversee only the communication accounts associated with the whole SGA and each member would be responsible over their own respective branches as determined by each branch. iv. The CAC Public Relations Chair shall choose to be a member of the Joint Public Relations Department and shall have a vote. In the event of a tie vote, the Vice President of SGA shall have the tie-breaking vote. GS16-XX AS INTRODUCED A congressional act amending Title IV Chapter 4 of the SGA Code Annotated, providing for a short title, providing for codification, and providing an effective date. BE IT ENACTED BY THE UNIVERSITY OF OKLAHOMA STUDENT ASSOCIATION: Section 1: Title: This act shall be known and may be cited as the Student Parking Appeals Court Revision Act. Section 2: Purpose: The purpose of this act shall be to amend Title IV Chapter 4 of the SGA Code Annotated to elaborate on the responsibilities of Student Parking Appeals Court Justices and the procedures regarding Student Parking Appeals Court Hearings. Section 3: AMENDATORY. The following parts are to be amended to Title IV, Chapter 4 of the SGA Code Annotated. 43. Membership The Student Parking Appeals Court shall consist of two teams, each consisting of a chairperson Chief Justice and two judges three judges. 44. Selection The Judges of the Student Parking Appeals Court shall be appointed by the SGA President and approved by both houses of the legislature. Judges shall serve until they resign, or cease to be regularly enrolled students at the University of Oklahoma, or are impeached and convicted for cause Responsibilities The Chief Justices of the Student Parking Appeals court are responsible for the timely handling of Docket distribution, as well as the scheduling and handling of Inperson Hearings. They will also serve as the liaison between the SGA and Parking Services. All Judges are responsible for hearing and deciding both online parking appeals and in-person appeals. Judges are to remain active and must be able to judge online appeals during all holidays and intersession periods of the University. 46. Meeting Location

12 Student Parking Appeals Courts shall meet in the conference room of the Conoco Wing of the Oklahoma Memorial Union or at a reasonable or convenient place of their own choosing Rules of Procedure The SGA Student Parking Appeals Court shall may establish and publish any additional internal rules and procedures that will be in line with the SGA Constitution, SGA Code Annotated, and University policy, and the University of Oklahoma Transit division s mission statement and polices for parking regulations. The SGA Student Parking Appeals Court shall ensure that the SGA Student Superior Court has the most up to date version of their rules. 312 a. Procedure for Electronic Appeals: Chief Justices shall collect the most recent Docket from Parking Services weekly and distribute the docket to two judges from their respective team. Judges must complete the delivered dockets by Thursday of the same week of the docket s delivery. Dockets are to be completed individually and electronically, and the deciding Judge must sign or initial each page of the docket. All information gathered from the data provided to the Student Parking Appeals Court is to remain highly confidential. Judges are to objectively and fairly judge each appeal, insuring that each student receives an impartial decision. Judges are to their completed work to the Chief Justice in charge of their team. In the occurrence of a difference in appeal decisions by the two judges completing the dockets, a Chief Justice shall serve as the tiebreaker. A Chief Justice shall then turn in the completed docket to parking services. b. Procedure for Personal Appeals: Chief Justices shall collect the most recent Docket from Parking Services weekly and distribute the docket to two judges from their respective team. Judges will meet in person to discuss cases where they see fit. All information gathered from the data provided to the Student Parking Appeals Court is to remain highly confidential. Judges are to objectively and fairly judge each appeal, insuring that each student receives an impartial decision. Judges are to their completed work to the Chief Justice in charge of their team. In the occurrence of a difference in appeal decisions by the two judges completing the dockets, A Chief Justice shall serve as the tiebreaker. A Chief Justice shall then turn in the completed docket to parking services. c. Procedure for In-Person Appeals Every Student is entitled to request a hearing before the Parking Appeals Court. i. Hearing Organization There shall be three judges present at every hearing requested by a student. A student can waive their right to three justices at their choosing if a justice fails to arrive. Failure for a justice to arrive for a pre-planned meeting time established by a Chief Justice, and agreed

13 on by a justice, are grounds for termination. All Hearings shall take place in the Conference room of the Conoco Leadership building, or any other location agreed upon by both the student and the Court. If a student is not contacted to schedule a meeting within a week of the Students request, the citation of the student shall be waived. If the student fails to appear, their citation shall be upheld. ii. The Hearing The meeting should be an informal discussion with the student in order to allow them to comfortably explain the reason for their parking violation. The Court may ask the students questions regarding their parking violation, but should refrain from interrogating the student. Meetings shall be scheduled for one hour, including time necessary for the judge s deliberation. Judges shall dismiss the student and discuss the case amongst themselves before reaching a decision. A Chief Justice shall then send the decision to Parking Services. All meetings will be voice recorded to prevent any fraudulent charges against a justice and to provide a layer of security to both parties. Section 4: This act shall become effective when passed in accordance with the UOSA Constitution. BE IT ENACTED BY THE UNIVERSITY OF OKLAHOMA STUDENT GOVERNMENT ASSOCIATION: Section 1: Section 2: Section 3: This act shall be known and may be cited as the Emergency Allocation #12 Act of PURPOSE. The purpose of this act is to appropriate the funds of the University of Oklahoma Student Government Association to the organizations mentioned within. APPROPRIATION.
