1 ex United Nations Educational, Scientific and Cultural Organization Executive Board Hundred and fifty-fifth Session 155 EX/47 PARIS, 2 August 1998 Original: French Item 9.2 of the provisional agenda REPORT BY THE DIRECTOR-GENERAL ON THE FOLLOW-UP TO THE ADOPTION OF THE STATUTES OF THE INTERNATIONAL BIOETHICS COMMITTEE: ELECTION OF MEMBER STATES CANDIDATES FOR THE INTERGOVERNMENTAL COMMITTEE SUMMARY In accordance with 154 EX/Decision 8.4, paragraphs 4(b) and 5, adopted by the Executive Board at its 154th session, the Director- General submits to the Executive Board the list of Member States which have put themselves forward as candidates for the Intergovernmental Committee established by Article 11 of the Statutes of the International Bioethics Committee (IBC). On the basis of the candidatures submitted, it is for the Executive Board to elect the 36 members of the Intergovernmental Committee. Decision required: paragraph 9.

2 155 EX/47 I. INTRODUCTION 1. The Executive Board, by 154 EX/Decision 8.4, paragraph 3, adopted on 7 May 1998, approved the Statutes of the International Bioethics Committee of UNESCO (IBC). Under Article 11 of these Statutes: An Intergovernmental Committee, hereafter referred to as the Intergovernmental Committee, is hereby established within the United Nations Educational, Scientific and Cultural Organization (UNESCO). 2. This Intergovernmental Committee is to be composed of 36 representatives of the Member States of UNESCO elected by the General Conference. However, the interim provision in paragraph 4 stipulates that The Executive Board, at its 155th session, as an interim measure, shall elect the first members of the Intergovernmental Committee to hold office until the next succeeding General Conference. When electing these members, the Executive Board shall take into account cultural diversity, balanced geographical representation and the need to ensure appropriate rotation. 3. In compliance with this provision, the Member States of UNESCO were invited, if they so wished, to submit their candidature for the Intergovernmental Committee before 26 June By 10 July 1998, the following 24 Member States had informed the Secretariat that they intended to put themselves forward as candidates for the Intergovernmental Committee: Australia, Azerbaijan, Bangladesh, Belgium, Canada, Chile, Côte d Ivoire, Egypt, Finland, Germany, Indonesia, Israel, Italy, Japan, Netherlands, Peru, Poland, Republic of Korea, Russian Federation, South Africa, Spain, Tunisia, United Kingdom and Venezuela. In addition, some states informed the Secretariat that the matter was under study in their respective countries. II. PROCEDURES FOR THE ELECTION OF THE MEMBERS OF THE INTERGOVERNMENTAL COMMITTEE 4. The Director-General reminds the Executive Board of the terms of the IBC Statutes which lay down the principle of balanced geographical representation within the Intergovernmental Committee. In this respect, the expression balanced geographical representation may be understood in two ways: (a) (b) either to distribute the 36 seats equally among the electoral groups I, II, III, IV, V(a) and V(b); or to distribute the 36 seats among the electoral groups according to the number of states making up these groups. 5. In this context, the Director-General reminds the Executive Board that the General Conference, at its 28th session, decided on a method for the distribution of seats among the electoral groups within the Organization s intergovernmental committees and councils (28 C/Resolution 22). Accordingly, since the Intergovernmental Committee, like the Intergovernmental Council of the General Information Programme (PGI) and the Intergovernmental Council of the International Hydrological Programme (IHP), is composed of 36 members, the Executive Board may wish to refer to the distribution of seats within those bodies for the purpose of determining the distribution of seats within the Intergovernmental Committee.

In the light of the two options set out above, the distribution of seats might be as follows: Option 1: Elections based on six seats per Group Group I Western Europe (26) Group II Eastern Europe (24) Group III Latin America and the Caribbean (33) 6 Group IV Asia and the Pacific (39) 6 Group V(a) Africa (47) 6 Group V(b) Arab States (17) Option 2: Election in accordance with 28 C/Resolution 22 (same distribution as for PGI and IHP) Group I Western Europe (26) Group II Eastern Europe (24) Group III Latin America and the Caribbean (33) 7 Group IV Asia and the Pacific (39) 4 Group V Africa and the Arab States (64) The ballot papers will be prepared on the basis of the list of candidates drawn up by the Secretariat, having regard to the Executive Board s decision concerning the distribution of seats among the electoral groups. 8. The election will be held in plenary meeting and will take place in accordance with the Rules of Procedure of the Executive Board. III. DECISION 9. In view of the foregoing, the Executive Board may wish to adopt the following decision: The Executive Board, 1. Considering the Statutes of the International Bioethics Committee of UNESCO (IBC), 2. Having examined the list of Member States which have put themselves forward as candidates for the Intergovernmental Committee established by Article 11 of these Statutes,

This addendum informs the Executive Board of all the candidatures of Member States received by 4 September 1998.

On 29 July 1998, pursuant to Article 3 of the Statutes of the International Bioethics Committee (IBC), the Director-General appointed the 36 members of the Committee, the composition of which is given in the Annex. 3. In accordance with the interim provision set out in Article 6 of the Statutes of IBC, 18 members of IBC, whose term of office will expire at the 30th session of the General Conference, have been designated by lots drawn on 24 July 1998 in the presence of the representatives of the Chairpersons of Electoral Groups I and III. The term of office of each of the members of IBC is specified in the Annex.

This addendum informs the Executive Board of further candidatures that have been received since then. Since the distribution of document 155 EX/47 Add., the Libyan Arab Jamahiriya (Group V) and Mexico (Group III) have put themselves forward as candidates for election to the Intergovernmental Committee established by Article 11 of the Statutes of the International Bioethics Committee (IBC). As at 25 September 1998, 44 candidatures had therefore been received.
