2 Congressional Voting Record 113 th Congress, 1 st Session January 2013 December 2013 This past year we saw a new Congress come to Washington. Unfortunately, it continued the unproductive ways of the previous one. Using several measures of analysis, the First Session of the 113th Congress was the least productive congressional session in memory. It enacted just 55 substantive pieces of legislation, the fewest in decades. The House Speaker suggested that Congress should be judged on how many laws it repeals. In fact, it repealed none, which in itself would count as a substantive legislation. The House was only in session for 942 hours, the lowest nonelection year since 2005, when data first became available. Yet, the House voted repeatedly to repeal the Affordable Care Act, even after the U.S. Supreme Court ruled on its constitutionality. In the Senate, modest reform has allowed presidential appointees to avoid filibuster threats. All the while, hard core House and Senate tea party factions forced a 15 day government shutdown, which took $24 billion out of a recovering economy. The nation deserves better. In addition to the dysfunction, many in Congress continued to attack our core retiree programs of Social Security, Medicare, and Medicaid as well as the pro-retiree provisions of the Affordable Care Act. Many in Congress voted to privatize Medicare and create a voucher-like system in its place. Many, too, voted to turn Medicaid into a block grant system, which would undercut its ability to provide care for millions of older Americans. Votes were taken to limit voting rights and cut key seniors services such as food and energy assistance. In contrast, while attacks on core retiree programs continued, income inequality grows larger. For more than a decade, the wealthiest Americans have received trillions in tax breaks while older Americans have seen rising drug, health care, food, and energy costs. It is up to us to advocate for those issues on which older Americans depend for a respectable quality of life in retirement. This Voting Record reflects how committed our elected representatives are to retirees and older Americans. Use it to educate yourself on where your elected representatives stand. 3 SENATE VOTES The following is a list of ten key votes selected as representative of the votes of critical importance to retirees taken by the U.S. Senate: 1 Seniors Programs Cuts 6 Limit Victims Rights Senator Sessions, R-AL, moved to send the 2014 budget resolution back to committee and require a balanced budget by To achieve that result without new revenues would require deep, automatic cuts to many vital seniors programs. S.Con.Res. 8, Roll Call No. 45, March 21, Senator Portman, R-OH, offered an amendment to the budget resolution that would cap medical malpractice awards. Seniors, who use the medical system more than any other age group, would have their rights to redress medical errors curtailed. The amendment failed A NO vote is the pro-retiree vote. S.Con.Res. 8, Roll Call No. 78, March 23, Health Care Repeal Senator Cruz, R-TX, offered an amendment to the budget resolution that would repeal the Affordable Care Act. The 2010 law included several pro-retiree provisions including the elimination of co-pays and deductibles for preventive care screenings and an annual wellness checkup. The law also included the closing of the Part D doughnut hole coverage gap and the phasing out of overpayments to Medicare Advantage insurance companies. The amendment failed A NO vote is the pro-retiree vote. S.Con.Res. 8, Roll Call No. 51, March 22, Estate Tax Repeal Senator Thune, R-SD, offered an amendment to the budget resolution that would repeal the federal estate tax. Estate tax repeal benefits only the wealthiest Americans. The loss of estate tax revenues further skews income inequality and adds to the national debt. S.Con.Res. 8, Roll Call No. 67, March 22, Limit Voters Rights Senator Vitter, R-LA, offered an amendment to the budget resolution that would require a photo ID for voters in all federal elections. Many seniors, especially those without a driver s license, do not have a photo ID. It is often difficult and expensive for older voters to obtain an ID. The result would limit citizens ability to vote. The amendment failed A NO vote is the pro-retiree vote. S.Con.Res. 8, Roll Call No. 83, March 23, Cut Emergency Phone Service Senator Vitter, R-LA, offered an amendment to the budget resolution that would eliminate the federal Lifeline Program that provides a small basic phone service subsidy to low income Americans. Many seniors, who otherwise cannot afford regular phone service, use this program to have emergency call access. The amendment failed A NO vote is the pro-retiree vote. S.Con.Res. 8, Roll Call No. 84, March 23, Anti-Retiree Budget Senator Paul, R-KY, offered a substitute to the budget resolution. The substitute would raise the Social Security retirement age, privatize Social Security and Medicare, turn Medicaid into a block grant program, and severely cut vital seniors programs like food and energy assistance. The amendment failed A NO vote is the pro-retiree vote. S.Con.Res. 8, Roll Call No. 69, March 22, Mandatory Benefits Cuts Senator Johnson, R-WI, offered an amendment to the budget resolution that would require 75 years of Social Security and Medicare solvency into the annual 10 year budget plans. Such a mandate ignores the separate trust fund structures of Social Security and Medicare in relation to the federal budget process and could result in automatic benefit reductions. The amendment failed A NO vote is the pro-retiree vote. S.Con.Res. 8, Roll Call No. 74, March 22, Pro-Retiree Budget The Senate passed the budget resolution, introduced by Senator Murray, D-WA, which did not cut Social Security or Medicare benefits or increase costs to beneficiaries. In addition, it repealed the 2011 spending sequester process, which contained automatic cuts to many seniors programs. The resolution passed A YES vote is the pro-retiree vote. S.Con.Res. 8, Roll Call No. 92, March 23, Cut Nutrition Programs Senator Roberts, R-KS, introduced an amendment to a farm bill that would have reduced eligibility for the Supplemental Nutrition Assistance Program (SNAP) only to beneficiaries of other federal and state cash assistance programs. 6 1 Legal Services Cuts 6 Rep. Duncan, R-SC, offered an amendment to a disaster relief bill that would cut Legal Services Corporation (LSC) funding by $1 million. Many seniors rely on the LSC for vital help in areas such as eligibility for benefits and housing. The amendment failed A NO vote is the pro-retiree vote. H.R. 152, Roll Call No. 18, January 15, Anti-Retiree Budget Plan The House debated a bill, introduced by Rep. Price, R-GA, that required the president to submit a second budget if the first 10 year plan showed deficits, even though they were declining in every year. Ironically, recent House-passed budgets did not purport to achieve balance until after The result of this plan would have been deep, automatic cuts to many vital seniors programs. H.R. 444, Roll Call No. 38, February 6, Senate Budget Resolution The House voted on the Senate-passed budget resolution, which did not cut Social Security or Medicare benefits or increase costs to beneficiaries. In addition, it repealed the 2011 spending sequester process, which contained automatic cuts to many seniors programs. The resolution failed A YES vote is the pro-retiree vote. H.Con.Res. 25, Roll Call No. 83, March 20, Pro-Retiree Budget Rep. Van Hollen, D-MD, offered a substitute to the House budget resolution. The substitute proposed to raise revenues by closing tax loopholes for high income earners and create Medicare savings by requiring pharmaceutical companies to pay rebates for low-income beneficiaries. The measure did not cut Social Security, Medicare or Medicaid benefits. The amendment failed A YES vote is a pro-retiree vote. H.Con.Res. 25, Roll Call No. 87, March 20, Medicare Privatization The House passed a budget resolution, introduced by Rep. Ryan, R-WI, that replaces the guaranteed benefits of Medicare with a privatized system. Under the Ryan plan, Medicare would be privatized, voucher-like payments would go to insurance companies and seniors would have significantly higher out of pocket costs. Roby, R-AL, that would permit employers to institute compensatory time instead of cash under the Fair Labor Standards Act. H.R. 1406, Roll Call No. 137, May 8, Health Care Repeal I The House passed health care reform repeal legislation, introduced by Rep. Bachmann, R-MN. The 2010 Affordable Care Act included several pro-retiree provisions including the elimination of co-pays and deductibles for preventive care screenings and an annual wellness checkup beginning in The law also included the closing of the Part D doughnut hole coverage gap and the phasing out of overpayments to Medicare Advantage insurance companies.
