No. L-2/BPLON/41/ T he Employees Provident Fund Organisation (EPFO) on Wednesday said it has discontinued services provided through Common Service Centre (CSC) amid reports of leakage of data of over 2 crore members. The EPFO said the services have been discontinued pending vulnerability checks, but ruled out any leakage of subscribers data Ṫhe EPFO is in possession of Aadhaar details of over 2 crore members, who had linked their PF accounts to their Aadhaar numbers. In a statement, the EPFO said such warnings regarding the vulnerabilities data or software is a routine administrative process based on which services rendered through common service areas have been discontinued effective March 22, The EPFO statement said, It has been taking all necessary precautions and measures to ensure that no data leakage takes place and it will continue to be vigilant about it in future day after Lieutenant AGovernor Anil Baijal held a review meeting with the Delhi Metro and the Delhi Traffic Police officials about Chirag Delhi and Greater Kailash (GK) Metro stations of the Magenta Line, Delhi Police top brass inspected the two stations on Wednesday to see the traffic flow and possible bottlenecks. A total of 5,152 cases of fraud, up from over 5,000 cases in , were reported in banks from April, 2017, to March 1, 2018, it said in reply to an RTI query filed by this correspondent. The highest ever amount of 28,459 crore is said to have been involved in these cases of fraud reported from April, 2017, to March 1, 2018, the central bank said. In , banks had reported 5,076 cases of fraud involving 23,933 crore. From 2013 to March 1, 2018, as many as 23,866 cases of fraud, of 1 lakh or above in each case, were reported. A total of 1,00,718 crore was involved in all the cases put together, according to the RTI reply. Giving the breakup, the RBI said 4,693 such cases (involving 18,698 crore) and 4,639 cases (involving 19,455 crore) were reported in and respectively. The Bench observed, If you (Unitech) do not get 100 crore by next date, we will send all your directors to jail. Unitech counsel argued that the company had given possession to 996 homebuyers and was even depositing its liability towards orders passed by Commission. The Bench made it clear this should not be a ruse for not depositing the money. Meanwhile, a company that coowned land with Unitech in a Haryana housing project deposited 40 crore with the court that would go into refund to homebuyers. However, in a setback to the beleaguered real estate firm, a company, which promised to pay 40 crore for buying out a Bengaluru property of Unitech, complained that till date, the papers pertaining to the land in question had not been shared. Senior advocate Sajan Poovayya who appeared for the said company said they were not consulted before Unitech promised the court to bring 40 crore as sale consideration of the Bengaluru property. The Kerala High Court is the parent High Court of Justice Joseph, who is ranked number 45 in the inter-seniority among judges on all-india basis. The Centre pointed out that already the Kerala HC is represented in the apex court while many High Courts are unrepresented. Regional representation was another reason for the Centre to seek reconsideration of Collegium s decision. All the five judges including Chief Justice Dipak Misra and Justices J Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph took part in the meeting held a little while after normal business of the court ended at 4 pm. Justice Chelameswar did not hold court but was present in the Collegium meeting. The Collegium discussed threadbare the note sent by the Union Law Ministry on April 26 and April 30 while returning the file relating to the recommendation to elevate Justice Joseph as apex court judge. The judges could not come to any conclusion and decided to defer its decision to the next date. In addition to Justice Joseph s name, the Collegium also considered names of Judges from Calcutta, Rajasthan, and Telangana and Andhra Pradesh High Courts for elevation as Judges of the Supreme Court, in keeping with the Centre s assertion to have fair representation of all regions in the top court. The Law Ministry had even stressed on SC/ST representation in the top judiciary that did not figure in the discussions held on Wednesday. Justice Joseph s name was sent along with that of senior advocate Indu Malhotra on January 10 for elevation to the Supreme Court. The Centre segregated both names, declined the recommendation of Justice Joseph and sought a probe into the incident which took place on Tuesday. Police said that the deceased Isha Upadhyay failed to clear JEE exam, she was preparing for the examination for the past one and was depressed over her results which was declared on Monday. The deceased after having dinner at around 11 pm went to her room and was later found hanging in the morning. The family members found her hanging at around 8 am after she failed to respond when they checked her in her room. In the preliminary investigation police have found the reason of the suicide could be the failure to clear exams but it could be ascertained in the further investigation said police. The statements of the family and friends are yet to be recorded. Meanwhile, a 22-year-old youth committed suicide by hanging with the ceiling at Dwarka Nagar under Bajaria police station area on Wednesday. The deceased identified as Lokesh Bhore was found hanging and was rushed to a nearby hospital where he was declared dead. The deceased used to work with a contractor at Hoshangabad government paper mill and used to live with his mother and brother. Police said that the reason behind the suicide remained unknown and would be investigated.body was sent for the post mortem after the preliminary investigation. The police have registered a case under section 174 of the IPC and have started further investigation.

Seoni's Superintendent of Police (SP) Tarun Nayak said the Border Security Force (BSF) officials informed him that Arjunwar is likely to reach India through the Wagah border on Thursday. He is expected to be handed over to the Indian authorities later, Additional Superintendent of Police Gopal Khandel said. An assistant sub-inspector of the Seoni police has been sent to the Wagah border along with Arjunwar's younger brother to receive him, the police said, adding that the man would initially be taken to Amritsar in Punjab. Last month, Nayak said that the Ministry of External Affairs (MEA) had confirmed to the Pakistan authorities that Arjunwar is an Indian citizen. The Seoni police had then sent documents related to his citizenship as demanded by the MEA and the Ministry of Home Affairs, the SP said. Trivialising sexist comments, in which arguing boys call one another little girl, to deign the other clearly objectifies and patronises women. Not only that, people also have the audacity to justify rape by assuming that only promiscuous women get raped. Rape cannot be normalised as a crime of passion; neither is it a matter of a stupid decision or frenzied desire. Not talking about rape does not mean that it does not exist. There are countless rape jokes thrown around; and rape is often used as a verb to describe excelling at something. One can often hear a man saying we raped the game, depicting his powerful victory in a game. Our language is systematically desensitised to the severity of sexual violence, which is evident in the casual use of the term rape. This victimises women to male aggression and intimidation. We must realise that there is a fundamental error in our thought process if narratives around incidents of rape are taken lightly. For instance, West Bengal Chief Minister Mamata Banerjee believes that rape cases are on a rise in the country because men and women interact with each other more freely. The United Kingdom has campaigned for initiatives for relationship change. The Southampton Talking About Relationships (STAR) initiative is a rape preventive intervention in the UK that targets young people. STAR aims to prevent rape by educating and empowering young women and men to choose gendered cooperation relationship models which are respect-based and comply with the principles of consent. Even in the international arena, rape is treated as human rights violation. The United Nations treats violence against women, including rape, as a form of gender-based discrimination as well as a violation of women s human rights. Rape is a consequence of both gender inequalities in power and also of an absence of effective state power to sanction offenders. The purpose of the criminal justice system is to deter people from committing crime by deterrence, punishment and rehabilitation. But most rapists are not convicted. The deterrent effect of potential punishment is only likely to occur if rapists were to be convicted in the courts. This would require reforms of the criminal justice system so that rapists are more usually convicted than not. According to the National Crime Records Bureau (NCRB) report, 11 per cent of all crimes committed against women in India was rape. Out of all these cases, a minuscule percentage ends up in conviction. Therefore, even in India, we need practices that intervene in the causal pathways leading to rape, which can have a reformist effect on our patriarchal behaviour. The prevention of rape also requires changing the minds of men so that they do not want to rape. Therefore, in order to achieve our goal of a safe society for women, punitive laws do play an important role, but to eliminate the root cause of a single gender dominating mindset needs to be addressed through long-term interventions in education, awareness and media. The fact that all of India s nearly 600,000 villages are electrified, is an achievement worth celebrating. However, celebrating over just a piece of statistic like the last inhabited village of India getting electrified is celebrating a bit too early, not unlike the BJP s misfired 2004 general election slogan of India Shining and not unlike a cricketer celebrating a batsman getting clean bowled on a no ball. 7 T he spectre of water crisis, akin to the one faced by Cape Town, South Africa, recently seems where India is headed to as well. While the Government is doing a commendable job in electrifying the last village in India, water a basic requirement that is exceedingly becoming a scarce resource is now all set to pose a greater challenge to the Government. This hurdle might, in fact, prove to be difficult to resolve than the issue of scarce electricity as people can survive without electricity but when water dries up, life simply ends. Pointers also indicate the looming crisis ahead. Year-after-year, healthy monsoons are giving India a slip and it has been a long while since the couuntry has had its fill of satiating spell of rains. The much-look-forward monsoons this year are a welcome respite after a gruelling summer, but the Indian Meteorological Department has already spilled water on the collective hopes of a parched nation by forecasting a 44 per cent possibility of a mediocre monsoon. Rapidly dwindling groundwater levels are only adding to the criticality of the situation. In fact, successive droughts and erratic rainfall have led to excess extraction of groundwater. This in turn has led to a 61 per cent decline in groundwater level in wells between 2007 and Traditionally, groundwater levels used to compensate for inadequate monsoon but successive spells of below normal monsoons have wreaked havoc on the ground water table which is now unable to get replenished. Add to this the human exploitation of the groundwater, which means that we are extracting more than the rains are able to replenish. Moreover, the inability of the Recent bank scandals have shaken India Inc to the core and have raised several questions regarding the governance of these banks and other corporates. The board plays a key role in providing direction to the management in terms of strategy and also ensuring that the companies operate in the best interests of shareholders and other stakeholders. Board independence is seen as a cornerstone of accountability and the presence of independent directors in the boardroom has been hailed as an effective deterrent to fraud, mismanagement, inefficient use of resources, inequality and unaccountability of decisions. Regulators in India have taken several steps over the years; and after several committee recommendations, they amended the corporate governance norms to give more importance to nonexecutive directors. But clearly, much more has to be achieved and the change has to be more qualitative in nature rather than being quantitative. Corporate governance norms in the international arena were triggered by scams such as Enron, WorldCom, Qwest, Global Crossing and the subsequent milestone Sarbanes-Oxley Act of India also followed the global cues and made the definition of an independent director more precise under the leadership of the finest policy-makers and industry stalwarts like Naresh Chandra and NR Narayana Murthy. Although independent directors do not take part in day-to-day operations of the company, they are expected to raise appropriate red flags, by asking right questions at the right time and, therefore, playing a fundamental and critical role in bringing transparency, accountability and credibility to the board process and practices. However, recent scams show that independent directors may not be performing and taking their monitoring roles to the hilt. So, why are independent directors assuming that they are committed to ethical practices not effective in their responsibilities? The answer is isolation. Independent directors may not play an effective role to stop fraud at the highest level. However, collectively, they can form a voice that is hard to stop and can make a huge difference by identifying the signals of fraud and mismanagement; and then try stopping them. These directors will get more teeth and their collective strength will enhance if their number is increased in the board. At present, one-third of the board members in Indian public listed companies are independent or non-executive directors but it should be increased to at least half of the board members. The role of an independent director has to be much more qualitative in nature, with more emphasis on offering strategic, specific and objective advice at board meetings. They should help in providing long-term vision and also act as mentors to the senior staff. They should be networkers looking for new opportunities and useful contacts; and must act as relationship builders, in and outside the company. To be a part of the solution, instead of being a part of the problem, boards must exercise real power, they must have more power to say no more and provide tough oversight. Since knowledge is power, independent directors can become more powerful by possessing enough knowledge to exert their power effectively on essential issues. An independent director should invest time in understanding intricate issues of today s business, like complex acquisitions, especially those in new product markets or into new and unfamiliar territories; major expansions in either existing or newer businesses; and understanding the compensation structure of a senior executive, to name a few. At present, this important role is performed by non-executive directors, at best on a part-time basis; and due to this, it risks the loss of some of its cachet. How can one expect the non-executive directors, who visit the company during the board meetings, to stand up to tall expectations? At present, a person is serving as an independent director in maximum seven listed companies with maximum directorships in aggregate (including alternate directorships), being 20 companies. In addition, an independent director can be a member of a maximum 10 committees or act as a chairman of more than five committees across all people to quickly adopt rain-harvesting measures in large-scale also translates to a lost opportunity wherein groundwater could have got some compensation through diversion of rainwater. These factors are now culminating into a disaster of sorts and posing a serious problem of acute water shortages. The beleaguered condition of ground water table can be attributed mainly to the rampant drawing of companies in which he is a director. This practically gives no time to the independent directors to be effective monitors and get an in-depth understanding of the functioning of the company, which in turn defeats the very purpose of having them in the first place. To contribute more significantly, the directorship of these directors should be limited to about three or four companies. Another precarious situation is that the board of directors is headed by a chairman, who has a significant influence over the direction of the board. In many companies, the CEO/MD, who holds the top management position, also serves as the chairman of the board. This is often the case with companies that have grown rapidly and still retain the initial founder in those roles. It is a debatable topic which suggests that nonseparation of both these positions can reduce the overall effectiveness of the board and can compromise on the overall integrity of the company. According to the recommendation of the Uday Kotak Committee, the time is right for India to introduce a separation of roles of a chairperson and a CEO/MD for listed companies. The committee observed that such separation may be more relevant where public shareholders constitute a large portion of shareholding of a company. In this regard, the committee considered various thresholds and concluded that at least 40 per cent of public shareholding would be at an appropriate threshold. Further, in view of the fact that this would require a significant transition from the existing requirements, the committee believes that the listed entities should be given sufficient time to undertake such a transition and recommended that from April 1, 2020, all listed companies that have public share-holding of 40 per cent or more, should have a chairperson who is a non-executive director. Once implemented, this will remain in effect even if the public share-holding of the company falls below the threshold level of 40 per cent. By investing more time in their important roles in corporate governance and ethics, understanding the multi-faceted and complex business issues of present-day business and by harnessing their collective power, independent directors can red-flag serious concerns, like reckless over-expansion, misguided acquisitions at foolish prices, shortterm strategies, unwarranted levels of executive compensation, cooking accounting books, outright fraud and bankruptcy and take steps to stop them before they spiral into major scams and scandals. Gaining an in-depth knowledge about the industry and company in this fast-moving world is extremely timeconsuming. So, the role of a non-executive or an independent director is changing from part-time to full-time in the future. Hence, tougher measures are needed to prevent corporate disasters that we are seeing around us. Is a fulltime chief governance officer, much like a CEO or a CFO, the need of the hour for India Inc? According to a study published in the International Journal of Advance and Innovative Research in March 2018, 67 per cent of the residents or nearly four million in 1,797 unauthorised colonies in Delhi drew underground water. Most unauthorised colonies are largely dependent on illegal bore-wells to meet their water requirement in the absence of piped supply. This state of affairs has, in fact, earned the national capital the dubious distinction of being the third highest groundwater exploited State in India. The first position in overexploitation of ground water is taken by Punjab with a rate of 76 per cent; followed by Rajasthan at 66 per cent. India needs to learn its lesson from global water debacles. The crisis at Cape Town has shown what unplanned urbanisation can do to water availability in the world s urban centers. Not only are our metropolises headed to a dry future, the scarcity will increase as people are migrating to urban areas at an unprecedented rate. According to a study published in Nature, about 54 per cent of the world, or 3.9 billion people, live in urban areas and they will grow between 60 and 92 per cent by the end of the century. This will exacerbate an already grim situation, as the urban water demand will increase by 80 per cent by The climate change stoked by man will further accentuate the problem as it will alter the timing and distribution of water. A study in the Global Environmental Change points out that this state of affairs exists when the average global temperature has not even risen by 1.5 C above pre-industrialisation levels. What will happen when it rises by 2 C is a really concerning question. These trying circumstances, coupled with pollution of remaining ground water, will result in the human race getting locked in an irrevocable path towards self-destruction as water becomes a precious commodity and subject of intense global conflicts. India currently has a dynamic leadership that is able to address issues of environment in an effective manner. It is crucial for the Government to see the implications if the current state of affairs pertaining to water resources are allowed to continue and take urgent corrective action. 10 ver 23,000 cases of fraud Oinvolving a whopping 1 lakh crore have been reported in the past five years in various banks, according to the Reserve Bank of India (RBI). A total of 5,152 cases of fraud, up from over 5,000 cases in , were reported in banks from April, 2017, to March 1, 2018, it said in reply to an RTI query filed by this correspondent. The highest ever amount of 28,459 crore is said to have been involved in these cases of fraud reported from April, 2017, to March 1, 2018, the central bank said. In , banks had reported 5,076 cases of fraud involving 23,933 crore. From 2013 to March 1, 2018, as many as 23,866 cases of fraud, of 1 lakh or above in each case, were reported. A total of 1,00,718 crore was involved in all the cases put together, according to the RTI reply. Giving the break-up, the RBI said 4,693 such cases (involving 18,698 crore) and 4,639 cases (involving Rs 19,455 crore) were reported in and respectively. In , banks reported 4,306 cases of fraud, involving 10,170 crore, the central bank said. The reported fraud cases are processed and action is taken according to the facts and circumstances of individual cases, the RBI said. So shifts in the composition of the broader asset pool will not have much bearing on our assessment of the banks asset quality, it said. Under the new rules for bad debt resolution that the RBI implemented in March 2018, banks can no longer resort to various loan restructuring schemes to delay the recognition of NPAs. Although banks have recognised many loans as NPAs following an extensive inspection of loan books by the RBI in 2015, they still hold large volumes of restructured loans, a large share of which will become NPAs in the coming quarters, it said. As banks reclassify these assets, it said, NPA ratios will gradually rise, but once this process is complete, they will stabilise and eventually decline substantially. Increased provisioning will hurt the banks profitability, and weaker public sector banks in particular will continue to report losses in the next fiscal year, adding pressure on their capital ratios, it said.
