King, AICP Name: The Reefs Waterfront Restaurant, LLC Procedures: None Principal Planner EXECUTIVE SUMMARY: The existing restaurant at 4290 SE Salerno Road has reopened as The Reefs Waterfront Restaurant with the new owner and manager, Gregory Flewelling, receiving a beer and wine, on and off premises, 2COP license on January 29, He is now requesting Board approval, in accordance with Section 5.1.A, Code of Ordinances, Martin County Code, a State of Florida 4COP-SRX license to sell liquor for on-site consumption at the existing restaurant, formerly known as Finz. 2 BACKGROUND/RELATED STRATEGIC GOAL: The application documents that the dining area has a total dining food preparation and service area of 8,182 square feet, providing for both inside and first floor or upper patio dining. The two dining areas include seating for at least 248 patrons at tables not including bar/lounge area and outside tiki bar. The full service menus for lunch and dinner include full restaurant service area and seating minimums within the Port Salerno CRA as required by Section 5.1.A, Code of Ordinances, Martin County Code. Staff has evaluated the provisions of the WGC Zoning District and the underlying Waterfront Commercial designation on the FLUM. The existing restaurant is removed from any residences and the surrounding properties are zoned for non-residential uses. The conversion of the Finz license to the new operator, The Reefs Waterfront LLC is in compliance. The requirements of the Code of Ordinances are met for the sale of alcoholic beverages for on-site consumption under the provisions of the State of Florida, 4COP-SRX license. This type of license is not transferable and does not allow package sale of alcohol. ISSUES: There are no unresolved issues to allow the Board action in accordance with Section 5.1.A, Code of Ordinances, Martin County Code. RECOMMENDED ACTION: RECOMMENDATION The Board is advised that the existing restaurant use at 2490 SE Salerno Road in Port Salerno is in compliance with all requirements and qualifies for an action of approval of the request for a 4COP-SRX, Special Alcoholic Beverage License through the State of Florida. ALTERNATIVE RECOMMENDATIONS Based on findings that additional information is required from the applicant or staff, the Board has the option to continue the request to a future meeting. FISCAL IMPACT: RECOMMENDATION The applicant paid the $ review fee for this request. ALTERNATIVE RECOMMENDATIONS Same as the recommended action.
