EXECUTIVE SUMMARY (General Business): The text amendment will provide drive-through sign regulations that are consistent with current development standards and business friendly. PRESENTATION INFORMATION: Staff may provide a presentation. STAFF RECOMMENDATION: The Planning and Zoning Department finds the proposed amendment to Chapter 155, the Sign Code, to be consistent with the direction and intent of the City's Comprehensive Plan and recommends approval. Move that the Council adopt the ordinance as recommended by the Planning and Zoning Board. ALTERNATE RECOMMENDATIONS: 1. Move that the Council amend the recommendation and adopt the ordinance. 2. Move that the Council not approve the ordinance and provides staff direction. BACKGROUND: On February 6, 2018, the Planning and Zoning Board recommended approval of the proposed amendment. ISSUES/ANALYSIS: See attached staff report. 3 COUNCIL ITEM 1 OE DATE ORDINANCE AN ORDINANCE AMENDING TITLE XV "LAND USAGE", CHAPTER 155, "SIGN CODE" OF THE CODE OF ORDINANCES OF THE CITY OF PORT ST. LUCIE BY AMENDING SECTION "REGULATIONS FOR PERMANENT IDENTIFICATION SIGNS REQUIRING PERMITS"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Port St. Lucie, Florida adopted amendments to the City of Port St. Lucie Comprehensive Plan by Ordinance (the "Comprehensive Plan"); and WHEREAS, Section , Florida Statutes, provides for the amendment and enforcement of land development regulations that are consistent with and implement the adopted comprehensive plan; and WHEREAS, Section (4)(C), Florida Statutes, provides that the Local Planning Agency shall review proposed land development regulations and make recommendations to the governing body as to the consistency of the proposed land development regulations with the adopted Comprehensive Plan; and WHEREAS, this City initiated Code amendment, P17-238, proposes to amend Chapter Sign Code as outlined in Exhibit "A" with additions shown as underlined and deletions shown as strikethrough; and WHEREAS, the City of Port St. Lucie Planning and Zoning Board having been duly designated as the local planning agency pursuant to Section (4)(C), Florida Statutes, and having held a public hearing thereon, has considered this proposed amendment to the Code of Ordinances and submitted its recommendations thereon to the City Council; and WHEREAS, having considered the recommendations of the Planning and Zoning Board, The Port St. Lucie City Council has found and determined that the adoption of amendments to Page 1 of 3 P City of PSL - Chapter 155 Sign Code Text Amendment

4 ORDINANCE Chapter Sign Code will foster and preserve the public health, safety and welfare; improve and protect the environment and value and character of the community; and implement the adopted comprehensive plan. NOW, THEREFORE, THE CITY OF PORT ST. LUCIE HEREBY ORDAINS: Section 1. The City of Port St. Lucie Chapter Sign Code of the Code of Ordinances is hereby amended as shown in Exhibit "A", attached hereto and by reference incorporated herein. Section 2. All remaining provisions of Chapter Sign Code of the Code of Ordinances shall remain in full force and effect. Section 3. The provisions of the Ordinance are severable and, if any section, sentence, clause or phrase is for one reason held to be unconstitutional, invalid or ineffective, this holding shall not affect the validity of the remaining portions of this Ordinance, it being expressly declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without inclusion of any invalid portion or portions. 7 ITEM #7(A)(1) City of Port St. Lucie Planning and Zoning Department A City for All Ages TO: PLANNING AND ZONING BOARD - MEETING OF FEBRUARY 6, 2018 FROM: DANIEL ROBINSON, PLANNER yes RE: P CITY OF PSL CHAPTER 155 SIGN CODE TEXT AMENDMENT APPLICATION DATE: JANUARY 30, 2018 BACKGROUND:This application proposes to amend Section of the Sign Code. Drive-throughs are being designed with more than one ordering lane. The current code regulations only permitting two menu or pre-sell boards per drive-through, regardless of the number of ordering lanes, and requires the signs to be within 25 feet of the primary structure. The amendment proposes to permit each ordering lane to have 2 signs with a cumulative total square footage for each ordering lane to be fifty (50) square feet and permit one (1) square foot for an order screen to be digital. The amendment will remove the requirement that all drive-through signs shall be a maximum of twenty-five (25) feet from the principal structure. The proposed changes are shown in the attached Exhibit A with additions shown as underlined and deletions as ctrikethrough. STAFFRECOMMENDATION: The Planning and Zoning Department finds the proposed changes to the Sign Code to be consistent with the City's Comprehensive Plan and recommends approval.
