You reviewed Ordinance at your February 12th meeting, when you passed the Ordinance on first reading and without making any changes to the proposed fees. As the fees are part of the Land Development Regulations, a review is required by the Comprehensive Planning and Zoning Board. The Board did this at its February 20th meeting, when it recommended that: New subsection (e) be added under Penalties [page 2] that the fee for an after-the-fact permit for removal of trees shall not exceed $5, Attached as page B is a memo from the Board's secretary, Ms. Bonnie Miller, with the Board's motion and vote. ACTION REQUESTED It is that you hold the public hearing and pass Ordinance on second reading. Because the Ordinance amends the Land Development Regulations, a second public hearing and final reading will be scheduled for your April 2 nd meeting.

Passed on first reading by the City Commission at its February 12, 2018 regular monthly meeting Ordinance No amends Section of the City of St. Augustine Beach Land Development Regulations, to adopt fees related to building permits. The motion to recommend the City Commission approve passage of Ordinance No on final reading was made by Ms. Sloan, subject to amendment to add a new subsection, paragraph (e), under Penalties 1n Section , stating that the fee for after-the-fact removal of trees shall not exceed $ Ms. Sloan's motion was seconded by Ms. West. and passed 7-0 by the Board by unanimous voice-vote. AUGUSTINE BEACH; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DA TE. BE IT ENACTED BY THE ClTY COMMISSION OF THE CITY OF ST. AUGUSTINE BEACH, FLORIDA: Section 1. Chapter 13, Section Fees adopted, is hereby restated and amended to read as follows: See attachment 'A,, as attached hereto. Section 2. Lher Code Sections nchanged. Any section or sections of the Code of the City of St. Augustine Beach not specifically modified herein shall survive in full force and effect and remain unchanged unless a conflict arises in which case this Ordinance shall control. Section 3. verability. If any phrase clause, sentence, subsection, section, or provision of this Ordinance is held to be invalid3 or unconstitutional by a court of competent j urisdiction, such invalidity or unconstitutionality shall not be construed as to render invalid, or uncon litutional the remainjng phrases clauses, subsections or provisions of this Ordinance. Section 4. Codification. Attachment "A" hereto as Section I of the Code of the City of t. Augustine Beach Florida, shall be codified, and a copy of this Ordinance shall be maintained in the offices of the City Manager. Section 5. The estimated fees shall be deposited with the City at the time of application and any fees in excess of the estimated coasts shall be paid by the applicant prior to execution of the development order by the City. 5
