1 ORDINANCE NO AN ORDINANCE OF THE CITY OF DUNCANVILLE, TEXAS, ADOPTING THE 1991 EDITION OF THE "UNIFORM BUILDING CODE" AND THE 1991 EDITION OF THE "UNIFORM BUILDING CODE STANDARDS", AS AMENDED HEREIN; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF ALL BUILDINGS OR STRUCTURES IN THE CITY OF DUNCANVILLE; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; PROVIDING FOR PENALTIES FOR VIOLATION THEREOF BY PROVIDING FOR A FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE; REPEALING ALL ORDINANCES IN CONFLICT; CONTINUING IN EFFECT THE UNIFORM BUILDING CODE, 1988 EDITION, FOR ALL BUILDINGS FOR WHICH PLANS HAVE BEEN APPROVED AND/OR FOR WHICH BUILDING PERMITS HAVE BEEN ISSUED; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUNCANVILLE, TEXAS: SECTION 1. That Ch~apter 5, Article II of the Code of Ordinances, City of Duncanville, Texas, be, and the same is hereby, amended so that the hereafter designated sections shall provide as follows: "ARTICLE II. BUILDING CODE

2 DIVISION 1. GENERALLY Sec ADOPTED There is hereby adopted by the city, for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, the Uniform Building Code, 1991 Edition, published by the International Conference of Building Officials, and the Uniform Building Code Standards, 1991 Edition, published by the International Conference of Building Officials, and the provisions thereof shall be controlling in the construction of all buildings and other structures therein contained within the corporate limits of the city. A copy of such Uniform Building Code and Uniform Building Code Standards shall be maintained at all times in the office of the city secretary and in the office of the building inspector. Sec BOARD OF ADJUSTMENT AND APPEALS The zoning board of adjustment of the city shall serve as the board of appeals as provided for in Section 204 of the building code adopted by this article, and shall perform the duties and responsibilities of such board of appeals. Sec SECTION 30l(b) AMENDED Section 301 is amended by deleting in its entirety Subsection 301(b). Sec SECTION 304(a) AMENDED Section 304(a) is amended to provide as follows: ' "On all buildings, structures or alterations requiring a building permit, as set forth in Section 301(a), the fee shall be paid as required at the time of filing application, in accordance with the following schedule:" (Balance of Section 5-27 to remain unchanged.) -2-

3 Sec SECTION 304(b)(c) AMENDED Section 304(b) be deleted. Section 304( c) be amended to provide as follows: "Section 304( c) Plan Review Fees. When the evaluation of the proposed construction exceeds two thousand dollars ($2,000.00) and a plan is required to be submitted by Section 301(a), a plan review fee shall be paid to the office of the city building official at the time of submitting plans and specifications for checking. The plan review fee shall be established by resolution of the city council as it may determine from time to time." Sec SECTION 504(b)(3) AMENDED BY ADDING Section 504(b )(3). (Balance of Section 5-30 to remain unchanged.) Sec SECTION 3802(a)(l) AMENDED BY ADDING Section 3802(a)(l), Scope, is hereby added to provide as follows: "These requirements shall apply to all Group R-Residential and Group B-Business buildings having floors used for human occupancy three (3) or more standard stories. Such buildings shall be provided with an approved automatic sprinkler system in accordance with this Section. (Balance of Sec.tion 5-31 to remain unchanged.) Sec ~ SECTION 3203(a) AMENDED Section 3203(a) of the City of Duncanville Building Code be, and the same is hereby, amended by adding to said Section 3203 the following: (Balance of Section to remain unchanged.) -3-

4 Sec SECTION 3802(a)(2) AMENDED BY ADDING SUBSECTION (2) "(2) An automatic fire-extinguishing system shall be installed in any building or structure including residential three (3) or more stories in height including all areas and floors. Furthermore, any area 10,000 square feet or more for same occupancy unless more restrictive by written code." (Balance of Section 5-33 to be deleted.) Sec SECTION 3805(b) AMENDED Section 3805(b) hereby provides as follows: "Buildings shall be equipped with standpipes as follows: (1) Buildings three (3) stories or more in height." Sect SECTION 250l(a) AMENDED Section 2501(a) is hereby amended by adding the following: "Section 2501(a)(l). All framing lumber, decking and subfloor shall be a minimum of #3 Southern Pine or Utility Grade West Coast." Sec SECTION 2517(h)3 AMENDED Subsection (h) of Section 2517 is amended by adding Subsection (h)3(1) to provide as follows: "(h)3(1). Hip rafter may be single members. Valley and hip rafters shall be two (2) inches greater than jack rafters." Sec SECTION 2510(c) AMENDED Section 2510(c) is hereby amended by adding the following: "When common nails are referred to in such table either common nails or box nails shall be permitted." -4-

5 Sec SECTION 3806(b) AMENDED The reference in Section 3806(b) to six ( 6) stories is hereby amended to read three (3) stories. Sec SECTION 5103(e) AMENDED Section 5103( e) is hereby amended to provide as follows: "( e) In all structures two (2) or more stories in height where an elevator is installed, at least one elevator in the structure shall be capable of containing a standard stretcher (minimum size twenty-two (22) inches by seventy-eight (78) inches) in the open position with attendants." Sec APPENDIX & INDEX ADOPTED Appendix & Index of the Uniform Building Code, 1991 Edition, are hereby adopted as parts of the building code. Sec SECTION 503(d)(l) AMENDED Section 503(d) is amended by adding Subsection 503(d)(l) to provide as follows: "All dwelling units for single families shall be separated with one (1) hour fire resistive construction. All apartments within multiple dwellings shall be separated with two (2) hour fire resistive construction." Sec Sec DELETED SECTION TABLE 33-A AMENDED Table 33-A be amended by adding Footnote No. 5 to provide as follows: "5. There shall be provided not less than two (2) approved independent exits accessible to each tenant area, serving every story, for all residential occupancies, except in one (1) and two (2) family dwellings. -5-

6 Sec SECTION 3701 AMENDED That Section 3701 be amended by adding Subsection (a) to provide as follows: "(a) Wood burning fireplaces within any apartment dwelling unit are prohibited." SECTION 2. That Chapter 5, Article Il of the Code of Ordinances, City of Duncanville, Texas, be, and the same is hereby, amended so that the hereafter designated subsections are deleted and removed from said Code: Sec SECTION 3. That the first paragraph in Section 104( e ), Uniform Building Code, 1991 Edition, be, and the same is hereby, deleted from said section. SECTION 4. That should any word, phrase, sentence, section, paragraph or portion of this ordinance or of the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 5. That the Uniform Building Code, 1988 Edition, shall continue in effect for all buildings for which plans have been approved and/ or for which building permits have been issued prior to the effective date of this ordinance, and to that extent said Uniform Building -6-

7 Code, 1988 Edition, shall continue in full force and effect. SECTION 6. That all ordinances of the City in conflict with the provisions of this ordinance be, and the same is hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 7. That any person, firm or corporation violating any of the provisions of this ordinance or of the Code of Ordinances, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of Duncanville, Texas, shall be subject to a fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense and each and every day such violation continues shall constitute a separate offense. SECTION 8. That this ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide.
