3 3 ETS 143 Archeologcl Hertge (revsed), 16.I.1992 Defnton of the rcheologcl hertge Artcle 1 1 The m of ths (revsed) Conventon s to protect the rcheologcl hertge s source of the Europen collectve memory nd s n nstrument for hstorcl nd scentfc study. 2 To ths end shll be consdered to be elements of the rcheologcl hertge ll remns nd objects nd ny other trces of mnknd from pst epochs: the preservton nd study of whch help to retrce the hstory of mnknd nd ts relton wth the nturl envronment; for whch excvtons or dscoveres nd other methods of reserch nto mnknd nd the relted envronment re the mn sources of nformton; nd whch re locted n ny re wthn the jursdcton of the Prtes. 3 The rcheologcl hertge shll nclude structures, constructons, groups of buldngs, developed stes, moveble objects, monuments of other knds s well s ther context, whether stuted on lnd or under wter. Identfcton of the hertge nd mesures for protecton Artcle 2 Ech Prty undertkes to nsttute, by mens pproprte to the Stte n queston, legl system for the protecton of the rcheologcl hertge, mkng provson for: the mntennce of n nventory of ts rcheologcl hertge nd the desgnton of protected monuments nd res; the creton of rcheologcl reserves, even where there re no vsble remns on the ground or under wter, for the preservton of mterl evdence to be studed by lter genertons; the mndtory reportng to the competent uthortes by fnder of the chnce dscovery of elements of the rcheologcl hertge nd mkng them vlble for exmnton. Artcle 3 To preserve the rcheologcl hertge nd gurntee the scentfc sgnfcnce of rcheologcl reserch work, ech Prty undertkes: to pply procedures for the uthorston nd supervson of excvton nd other rcheologcl ctvtes n such wy s: to prevent ny llct excvton or removl of elements of the rcheologcl hertge;

4 4 ETS 143 Archeologcl Hertge (revsed), 16.I.1992 b to ensure tht rcheologcl excvtons nd prospectng re undertken n scentfc mnner nd provded tht: non-destructve methods of nvestgton re ppled wherever possble; the elements of the rcheologcl hertge re not uncovered or left exposed durng or fter excvton wthout provson beng mde for ther proper preservton, conservton nd mngement; to ensure tht excvtons nd other potentlly destructve technques re crred out only by qulfed, speclly uthorsed persons; to subject to specfc pror uthorston, whenever foreseen by the domestc lw of the Stte, the use of metl detectors nd ny other detecton equpment or process for rcheologcl nvestgton. Artcle 4 Ech Prty undertkes to mplement mesures for the physcl protecton of the rcheologcl hertge, mkng provson, s crcumstnces demnd: for the cquston or protecton by other pproprte mens by the uthortes of res ntended to consttute rcheologcl reserves; for the conservton nd mntennce of the rcheologcl hertge, preferbly n stu; for pproprte storge plces for rcheologcl remns whch hve been removed from ther orgnl locton. Integrted conservton of the rcheologcl hertge Artcle 5 to seek to reconcle nd combne the respectve requrements of rcheology nd development plns by ensurng tht rcheologsts prtcpte: b n plnnng polces desgned to ensure well-blnced strteges for the protecton, conservton nd enhncement of stes of rcheologcl nterest; n the vrous stges of development schemes; to ensure tht rcheologsts, town nd regonl plnners systemtclly consult one nother n order to permt: the modfcton of development plns lkely to hve dverse effects on the rcheologcl hertge;

Fnncng of rcheologcl reserch nd conservton Artcle 6 to rrnge for publc fnncl support for rcheologcl reserch from ntonl, regonl nd locl uthortes n ccordnce wth ther respectve competence; to ncrese the mterl resources for rescue rcheology: b by tkng sutble mesures to ensure tht provson s mde n mjor publc or prvte development schemes for coverng, from publc sector or prvte sector resources, s pproprte, the totl costs of ny necessry relted rcheologcl opertons; by mkng provson n the budget reltng to these schemes n the sme wy s for the mpct studes necesstted by envronmentl nd regonl plnnng precutons, for prelmnry rcheologcl study nd prospecton, for scentfc summry record s well s for the full publcton nd recordng of the fndngs. Collecton nd dssemnton of scentfc nformton Artcle 7 For the purpose of fclttng the study of, nd dssemnton of knowledge bout, rcheologcl dscoveres, ech Prty undertkes: to mke or brng up to dte surveys, nventores nd mps of rcheologcl stes n the res wthn ts jursdcton; to tke ll prctcl mesures to ensure the drftng, followng rcheologcl opertons, of publshble scentfc summry record before the necessry comprehensve publcton of speclsed studes.

Promoton of publc wreness Artcle 9 to conduct eductonl ctons wth vew to rousng nd developng n wreness n publc opnon of the vlue of the rcheologcl hertge for understndng the pst nd of the threts to ths hertge; to promote publc ccess to mportnt elements of ts rcheologcl hertge, especlly stes, nd encourge the dsply to the publc of sutble selectons of rcheologcl objects. Preventon of the llct crculton of elements of the rcheologcl hertge Artcle 10 v to rrnge for the relevnt publc uthortes nd for scentfc nsttutons to pool nformton on ny llct excvtons dentfed; to nform the competent uthortes n the Stte of orgn whch s Prty to ths Conventon of ny offer suspected of comng ether from llct excvtons or unlwfully from offcl excvtons, nd to provde the necessry detls thereof; to tke such steps s re necessry to ensure tht museums nd smlr nsttutons whose cquston polcy s under Stte control do not cqure elements of the rcheologcl hertge suspected of comng from uncontrolled fnds or llct excvtons or unlwfully from offcl excvtons; s regrds museums nd smlr nsttutons locted n the terrtory of Prty but the cquston polcy of whch s not under Stte control: to convey to them the text of ths (revsed) Conventon;

Artcle 11 Nothng n ths (revsed) Conventon shll ffect exstng or future blterl or multlterl tretes between Prtes, concernng the llct crculton of elements of the rcheologcl hertge or ther resttuton to the rghtful owner. Mutul techncl nd scentfc ssstnce Artcle 12 The Prtes undertke: to fford mutul techncl nd scentfc ssstnce through the poolng of experence nd exchnges of experts n mtters concernng the rcheologcl hertge; to encourge, under the relevnt ntonl legslton or nterntonl greements bndng them, exchnges of speclsts n the preservton of the rcheologcl hertge, ncludng those responsble for further trnng. Control of the pplcton of the (revsed) Conventon Artcle 13 For the purposes of ths (revsed) Conventon, commttee of experts, set up by the Commttee of Mnsters of the Councl of Europe pursunt to Artcle 17 of the Sttute of the Councl of Europe, shll montor the pplcton of the (revsed) Conventon nd n prtculr: report perodclly to the Commttee of Mnsters of the Councl of Europe on the stuton of rcheologcl hertge protecton polces n the Sttes Prtes to the (revsed) Conventon nd on the mplementton of the prncples emboded n the (revsed) Conventon; propose mesures to the Commttee of Mnsters of the Councl of Europe for the mplementton of the (revsed) Conventon's provsons, ncludng multlterl ctvtes, revson or mendment of the (revsed) Conventon nd nformng publc opnon bout the purpose of the (revsed) Conventon; mke recommendtons to the Commttee of Mnsters of the Councl of Europe regrdng nvttons to Sttes whch re not members of the Councl of Europe to ccede to ths (revsed) Conventon.

It s subject to rtfcton, cceptnce or pprovl. Instruments of rtfcton, cceptnce or pprovl shll be deposted wth the Secretry Generl of the Councl of Europe. 2 No Stte prty to the Europen Conventon on the Protecton of the Archeologcl Hertge, sgned n London on 6 My 1969, my depost ts nstrument of rtfcton, cceptnce or pprovl unless t hs lredy denounced the sd Conventon or denounces t smultneously. 3 Ths (revsed) Conventon shll enter nto force sx months fter the dte on whch four Sttes, ncludng t lest three member Sttes of the Councl of Europe, hve expressed ther consent to be bound by the (revsed) Conventon n ccordnce wth the provsons of the precedng prgrphs. 4 Whenever, n pplcton of the precedng two prgrphs, the denuncton of the Conventon of 6 My 1969 would not become effectve smultneously wth the entry nto force of ths (revsed) Conventon, Contrctng Stte my, when depostng ts nstrument of rtfcton, cceptnce or pprovl, declre tht t wll contnue to pply the Conventon of 6 My 1969 untl the entry nto force of ths (revsed) Conventon. 5 In respect of ny sgntory Stte whch subsequently expresses ts consent to be bound by t, the (revsed) Conventon shll enter nto force sx months fter the dte of the depost of the nstrument of rtfcton, cceptnce or pprovl. Artcle 15 1 After the entry nto force of ths (revsed) Conventon, the Commttee of Mnsters of the Councl of Europe my nvte ny other Stte not member of the Councl nd the Europen Economc Communty, to ccede to ths (revsed) Conventon by decson tken by the mjorty provded for n Artcle 20.d of the Sttute of the Councl of Europe nd by the unnmous vote of the representtves of the Contrctng Sttes enttled to st on the Commttee. 2 In respect of ny ccedng Stte or, should t ccede, the Europen Economc Communty, the (revsed) Conventon shll enter nto force sx months fter the dte of depost of the nstrument of ccesson wth the Secretry Generl of the Councl of Europe. Artcle 16 1 Any Stte my, t the tme of sgnture or when depostng ts nstrument of rtfcton, cceptnce, pprovl or ccesson, specfy the terrtory or terrtores to whch ths (revsed) Conventon shll pply.

In respect of such terrtory the (revsed) Conventon shll enter nto force sx months fter the dte of recept of such declrton by the Secretry Generl. 3 Any declrton mde under the two precedng prgrphs my, n respect of ny terrtory specfed n such declrton, be wthdrwn by notfcton ddressed to the Secretry Generl. The wthdrwl shll become effectve sx months fter the dte of recept of such notfcton by the Secretry Generl. Artcle 17 1 Any Prty my t ny tme denounce ths (revsed) Conventon by mens of notfcton ddressed to the Secretry Generl of the Councl of Europe. 2 Such denuncton shll become effectve sx months followng the dte of recept of such notfcton by the Secretry Generl. Artcle 18 The Secretry Generl of the Councl of Europe shll notfy the member Sttes of the Councl of Europe, the other Sttes prty to the Europen Culturl Conventon nd ny Stte or the Europen Economc Communty whch hs cceded or hs been nvted to ccede to ths (revsed) Conventon of: ny sgnture; the depost of ny nstrument of rtfcton, cceptnce, pprovl or ccesson; ny dte of entry nto force of ths (revsed) Conventon n ccordnce wth Artcles 14, 15 nd 16. v ny other ct, notfcton or communcton reltng to ths (revsed) Conventon. In wtness whereof the undersgned, beng duly uthorsed thereto, hve sgned ths revsed Conventon.
