1 II ORDINANCE NO /t/t' AN ORDINANCE REZONING PROPERTY IN THE GENERAL VICINITY OF 3801 WEST OBISPO STREET, IN THE CITY OF TAMPA, FLORIDA, AND MORE PARTICULARLY DESCRIBED IN SECTION 1, FROM ZONING DISTRICT CLASSIFICA TION(S) RS-60 (RESIDENTIAL SINGLE-FAMILY) TO PD (PLANNED DEVELOPMENT, OFFICE, BUSINESS AND PROFESSIONAL, SPECIALTY RETAIL AND/OR STOREFRONT RESIDENTIAL (SPECIALTY RETAIL/OFFICE, BUSINESS/PROFESSIONAL); PROVIDING AN EFFECTIVE DATE. 14 WHEREAS, a public hearing as required by law was held in City Council 15 Chambers, Third Floor, City Hall, 315 East Kennedy Boulevard, in the City of 16 Tampa, Florida, relating to the rezoning of the real property described in Section I 17 of this ordinance under the terms and provisions of Chapter 27, City of Tampa Code NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL 22 OF THE CITY OFT AMP A, FLORIDA: Section 1. That the Zoning District Classification upon the following 25 described real property, situate, lying and being in the City of Tampa, County of 26 Hillsborough and State offiorida, more particularly described as follows: 27 (Attached hereto and made a part hereof as Exhibit LEGAL DESCRIPTION: A), 31 which is presently zoned RS-60 (residential single-family) under City of Tampa 32 Code Chapter 27, be changed to ZONING DISTRICT CLASSIFICATION PO 33 (planned development, office, business and professional, specialty retail and/or 34 storefront residential (specialty retail/office, business/professional), as provided 35 for in Chapter 27, City of Tampa Code, and that the zoning map be amended to 36 reflect said change on the above-described legal description and all information 37 shown thereof shall be as much a part of this ordinance as if such information set 38 forth on said zoning map of the City of Tampa was all fully described and set out 39 herein Section 2. That said Zoning District Classification is hereby amended 42 and to be controlled by the approved, certified site development plan, a copy of 43 which is attached hereto and by reference made a part hereof as Exhibit B Section 3. That approval of this rezoning shall not release the 46 Petitioner/Owner from meeting the requirements of the City of Tampa's 47 Concurrency Management System Ordinance at the time of actual permitting and 48 development of the rezoned site, if applicable Section 4. That the approval of said rezoning shall not release the Petitioner/Owner from meeting all other applicable sections of the City of Tampa REZI5-44 VI -I-

That, pursuant to Florida Statutes Section , the 5 issuance of this approval does not in any way create any right on the part of an 6 applicant to obtain a permit from a state or federal agency and does not create any 7 liability on the part of the City for issuance of the permit if the applicant fails to 8 obtain requisite approvals or fulfill the obligations imposed by a state or federal 9 agency or undertakes actions that result in a violation of state or federal law Section 6. That, pursuant to Florida Statutes Section , all other 12 applicable state or federal permits must be obtained before commencement of the 13 development Section 7. That all ordinances in conflict herewith are repealed to the 16 extent of any conflict Section 8. 16 ORDINANCE NO /tj AN ORDINANCE OF THE CITY OF TAMP A FLORIDA RELATING TO AN AREA REZONING, THE GENERAL LOCATION OF WHICH ls 4712 WEST PEARL A VENUE, IN THE CITY OF TAMPA, FLORIDA; FROM ZONING DISTRICT CLASSIFICA TlON PD (PLANNED DEVELOPMENT, MULTIPLE F AMIL Y RESIDENTIAL) TO ZONING CLASSIFICATION RS-50 (RESIDENTIAL SINGLE-FAMILY); PROVIDING FOR NOTICE; PROVIDING AN EFFECTIVE DATE. 12 WHEREAS, a public hearing as required by law was held in City Council 13 Chambers, Third Floor, City Hall, 315 East Kennedy Boulevard, in the City of 14 Tampa, Florida, relating to the rezoning of the real property described in Section I 15 of this ordinance under the terms and provisions of Chapter 27, City of Tampa Code NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL 21 OF THE CITY OF TAMPA, FLORIDA: Section 1. That said Zoning District Classification is hereby amended 25 and is to be controlled by the approved, Zoning Atlas page M-8, a copy of which is 26 attached hereto and by reference made a part hereof as Exhibit "A" Section 2. That approval of this rezoning shall not release the 29 Petitioner/Owner from meeting the requirements of the City of Tampa's 30 Concurrency Management System Ordinance at the time of actual permitting and 31 development of the rezoned site, if applicable Section 3. That the approval of said rezoning shall not release the 34 Petitioner/Owner from meeting all other applicable sections of the City of Tampa 35 Code, as such sections relate to the actual permitting and development of the 36 rezoned site Section 4. That, pursuant to Florida Statutes Section , the 39 issuance of this approval does not in any way create any right on the part of an 40 applicant to obtain a permit from a state or federal agency and does not create any 41 liability on the part of the City for issuance of the permit if the applicant fails to 42 obtain requisite approvals or fulfill the obligations imposed by a state or federal 43 agency or undertakes actions that result in a violation of state or federal law Section 5. That, pursuant to Florida Statutes Section , all other 46 applicable state or federal permits must be obtained before commencement of the 47 development Section 6.
