1 ORDINANCE NO AN ORDINANCE OF THE CITY OF TAMPA, FLORIDA, MAKING REVISIONS TO CITY OF TAMPA CODE OF ORDINANCES, CHAPTER 14 (OFFENSES); AMENDING SECTION , HOURS OF SALE FOR CONSUMPTION ON AND OFF PREMISES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tampa directed the Legal Department to revise Chapter 14, Section , Code of Ordinances; and, WHEREAS, the City Council of the City of Tampa has determined that it is important to regulate the alcoholic beverage hours of sale in the City; and, WHEREAS, the City Council of the City of Tampa has determined that the following amendment promotes and protects the general health, safety, and welfare of the residents of the City of Tampa; and, WHEREAS, a duly noticed public hearing as required by law was held by the City Council of the City of Tampa, at which public hearings all residents and interested persons were gwen an opportunity to be heard. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMPA, FLORIDA: Section 1. That "Sec Hours of sale for consumption on and off premises." is hereby amended by adhng the underlined language and deleting the stricken language as follows: "Sec Hours of sale for consumption on and off premises. (a) - All places within the city licensed by the state to sell alcoholic beverages may be open for business and may sell and serve alcoholic beverages in accordance with the alcoholic beverage zmkg classification granted to them by the city only during the following hours (unless otherwise more limited by special conhtions imposed by the city when granting the authority to sell alcoholic beverages GI'--, - in which event the permissible hours for the sale and service of alcoholic beverages allowed bpwh.. shall be as set forth in +'.P the special conhtions):

2 (1) Between the hours commencing at 7:00 a.m. on 1 each day, Monday through Saturday, and ending at 3:00 a.m. of the following 2 day; (b) (c) (d) (2) Between the hours commencing at 11:00 a.m. on3sunday and ending at 3:00 a.m. of the following day. Anything herein to the contrary notwithstanding, establishments 5 located in the passenger terminal complex at Tampa International Airport, 6 and holding a beverage license issued by the state authorizing the sale and 7 service of alcoholic beverages for consumption on premises, shall be permitted 8 to sell and serve alcoholic beverages for consumption on premises between9the hours commencing at 7:00 a.m. on each day and ending at 3:00 a.m. of the 10 following day, including Sunday. It is unlawful: for any person to consume any alcoholic beverages on the premises of any place of business licensed or zoned for the sale of alcoholic beverages other than the hours set forth in subsection (a) or (b) of this section and, provided further, it is unlawful for any establishment licensed or zoned for the sale of alcoholic beverages to permit or allow any person to consume any alcoholic beverages on the premises, or to be or remain open for the transaction of any business of any kind whatsoever at any time other than during the hours set forth in subsection (a) or (b) of this section. (1) for any person to consume any alcoholic beverages on the premises of any place of business licensed or approved for the sale of alcoholic beverages other than the hours set forth in subsection (a) or (b) of this section; (2) for any patron to possess any alcoholic beverages on the premises of any place of business licensed or approved for the sale of alcoholic beverages other than the hours set forth in subsection (a) or (b) of this section; (3) for any business owner, manager, or employee of any establishment licensed or approved for the sale of alcoholic beverages to permit or allow any person to consume any alcoholic beverages on the premises, or to be or remain open for business of any kind whatsoever at any time other than during the hours set forth in subsection (a) or (b) of this section; (4) for any business owner, manager, or employee of any establishment licensed or permitted for the sale of alcoholic beverages to permit or allow any patron to possess any alcoholic beverages on the premises, or to be or remain open for business of any kind whatsoever at any time other than during the hours set forth in subsection (a) or (b) of this section.. Hotels, motels, and retail stores selling convenience goods 37 and shoppers' goods shall be excepted from the provisions of subsection (a) and 38 (c) of this section to the extent that nothing contained in subsection (a) and 39 (c) shall prevent hotels, motels, and retail stores selling convenience goods and 40shoppers' goods from 2

3 (e) remaining open for business during those hours that the 1 sale and service of alcoholic beverages are prohibited provided that hotels, motels 2 and retail stores selling convenience goods and shoppers' goods shall not3sell or serve alcoholic beverages during any hours other than those set forth in4 subsection (a) of this section and further provided that hotels, motels, and5 retail stores selling convenience goods and shoppers' goods shall not conduct6any activity other than that which is authorized by their respective classified use. For purposes of this section, the terms "hotel"; "motel"; 8 "retail stores selling convenience goods"; "retail stores selling shoppers' goods"; 9 and, "classified use" shall have the following meaning: (1) Hotel or motel: A building or group of buildings 11 containing in combination ten (10) or more lodging units intended 12 primarily for rental or lease to transients, by the day or week, as13distinguished from a roominghouse, in which occupancy is generally 14 by residents rather than transients. Typically, accessory uses to a hotel15or motel include such things as restaurant, bar/lounge, meeting rooms and 16 outdoor recreational areas. (2) Retail stores selling convenience goods: Commercial 18 establishments that generally serve day-to-day commercial needs 19 of a residential neighborhood, including but not limited to drugstores, 20 tobacco shops, newsstands, bakeries, confectioneries, delicatessens, 21 meat and produce markets, and food stores with less than ten thousand 22 (10,000) square feet in floor area. Specifically excluded from this class 23of uses is retail sale of spirits and liquors, as well as sale of alcoholic 24 beverages regardless of alcoholic content for consumption on premises. (3) Retail stores selling shoppers' goods: Commercial 26establishments that, in addition to serving day-to-day commercial needs 27of a community, also supply the more durable and permanent needs 28 of a whole community, including but not limited to supermarkets, department 29 stores, discount stores, variety stores, hardware and garden supply 30 stores, apparel and footwear stores, florists, gift shops, jewelry stores, 31 book and stationary stores, specialty shops, sporting goods stores, 32 furniture and home furnishing stores, automotive supply stores and appliance 33 stores. (4) Classified use: The use prescribed under Table of Chapter 27, City of Tampa Code." Section 2. That should a court of competent jurisdiction 36 declare any part of this Ordinance invalid the remaining parts hereof shall not, in 37 any way, be affected by such determination as to the invalid part. Section 3. That all ordinances or parts of ordinances39 conflict herewith are hereby repealed to the extent of any conflict. 3

5 ORDINANCE NO AN ORDINANCE APPROVING A SPECIAL USE PERMIT (S-2) FOR ALCOHOLIC BEVERAGE SALES - RESTAURANT (CONSUMPTION ON PREMISES ONLY) AND MAKING LAWFUL THE SALE OF BEER AND WINE AT OR FROM THAT CERTAIN LOT, PLOT OR TRACT OF LAND LOCATED AT WEST BAY TO BAY BOULEVARD, UNIT #3409B, TAMPA, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN SECTION 3; THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT ARE REPEALED; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to City of Tampa ("Tampa") Code Section (b)(2) requests for certain specified uses and occupancies involving matters deemed to be of city-wide or area-wide importance must be submitted to the City Council for consideration and approval as a Special Use Permit (S-2); and, WHEREAS, a public hearing as required by law was held in City Council Chambers, Third Floor, City Hall, 315 E. Kennedy Boulevard, Tampa, Florida, relating to approval of the special-use permit for the real estate described in Section 1 of this ordinance under the terms and provisions of Chapter 27, City of Tampa Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMPA, FLORIDA: Section 1. That the recitals set forth above are hereby incorporated as if fully set forth herein. Section 2. That a Special Use Permit (S-2) for the real estate situate, lying and being in the City of Tampa, and as more particularly described as follows: LEGAL DESCRIPTION: hereof as Exhibit "A"), (Attached hereto and made a part is hereby approved to allow alcoholic beverage sales - restaurant (consumption on premises only). Section 3. That the sale of beverages containing alcohol of more than one-half (%) of one percent (1%) by weight and not more than fourteen percent (14%) by weight and wines regardless of alcoholic content - beer and wine - in association with a restaurant (consumption on premises only), shall be permitted and is hereby made lawful at or from that certain lot, plot or tract of land located at West Bay to Bay Boulevard, Unit #3409B, Tampa, Florida, and as more particularly described in Exhibit "A", attached hereto and incorporated herein by reference, as if fully set forth herein.

6 Section 4. That said Special Use Permit (S-2) and all construction and use of the above-described property shall be controlled by the approved, certified site development plan, including any waivers provided therein, a copy of which is attached hereto and by reference made a part hereof as Exhibit B. Section 5. That said Special Use Permit (S-2) is subject to a build-out deadline of two years from the effective date hereof. Failure to meet this deadline shall result in cancellation of this Special Use Permit. Section 6. That approval of this Special Use Permit (S-2) shall not release the Petitioner/Owner from meeting the requirements of the City of Tampa's Concurrency Management System Ordinance at the time of actual permitting and development of the above-described use site. Section 7. That the approval of this Special Use Permit (S-2) shall not release petitioner from meeting all other applicable sections of the City of Tampa Code, as such sections relate to the actual permitting and development of the abovedescribed site. Section 8. Based on the evidence contained in the record of the proceedings, it is hereby found that the proposed special use herein approved will ensure the public health, safety and general welfare, complies with all required regulations and standards of Chapter 27, is compatible with contiguous and surrounding property or is a public necessity, is in conformity with the Tampa Comprehensive Plan, and will not establish a precedent of, or encourage, more intensive or incompatible uses in the surrounding area and complies with all required regulations and standards of Chapter 27, City of Tampa Code. Section 9. That if any part of this ordinance shall be declared unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions, at the City of Tampa's election, shall remain in full force and effect. Section 10. That all ordinances or parts of ordinances in conflict herewith are, and the same are hereby repealed. Further, all prior alcoholic beverage sale approvals inconsistent with this approval are hereby repealed and void. -2-

WHEREAS, a public hearing as required by law was held in City Council Chambers, Third Floor, City Hall, 315 East Kennedy Boulevard, in the City of Tampa, Florida, relating to the rezoning of the real property described in Section 1 of this ordinance under the terms and provisions of Chapter 27, City of Tampa Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMPA, FLORIDA: Section 1. That said Zoning District Classification is hereby amended and to be controlled by the approved, Zoning Atlas pages D 12, El 1 and E 12, copies of which are attached hereto and by reference made a part hereof as Exhibit "A. Section2. That approval of this rezoning shall not release the PetitionerIOwner fiom meeting the requirements of the City of Tampa's Concurrency Management System Ordinance at the time of actual permitting and development of the rezoned site, if applicable. Section 3. That the approval of said rezoning shall not release the PetitionerIOwner from meeting all other applicable sections of the City of Tampa Code, as such sections relate to the actual permitting and development of the iezoned site. Section 4. extent of any conflict. That all ordinances in conflict herewith are repealed to the Section 5. That if any part of this ordinance shall be declared unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions shall remain in fill force and effect.
