1 COMMON COUNCIL MEETING Tuesday, March 13, 2012 A regular and open meeting of the City of New London Common Council was convened on Tuesday, March 13, 2012 at 7 p.m. in the Council Chambers of the Municipal Building. After the Pledge of Allegiance, roll was called. Presiding: Council President Romberg Members Present: Officers Present: Others Present: Tate, O Connell, Dean, Barrington, Steinhorst, Way, Herter, Morack, Besaw Excused: Mayor Henke Hager, Luaders, Tennie, Bodoh, Hoerth, Schlueter Excused: Thompson Chris Matheny, FVTC; Bill Fitzpatrick AGENDA: Steinhorst/Herter to adopt amended agenda. Carried [Add approve Capital Projects List] MINUTES: BILLS: Way/Steinhorst to approve the Council minutes of February 14, 2012 as written. Carried Morack/Herter to authorize the payment of invoices incurred during February 2012 in the amount of $571, Carried SPECIAL PRESENTATION: Chris Matheny, Vice President for Instructional Services for Fox Valley Technical College did a presentation concerning the upcoming referendum that will be voted on at the April 3, 2012 election. This referendum in the amount of $66,525,000. If passed, the monies will allow FVTC to implement their proposed facilities expansion project. STANDING & SPECIAL COMMITTEES: BOARD OF PUBLIC WORKS 1. Minutes of March 5, 2012 were read by Barrington. 2. Barrington/Steinhorst to approve the Sanitary & Storm Sewer System Mapping Phase 3 Consulting Agreement with AECOM Technical Services, Inc. in the amount of $13,360. Carried Barrington/Steinhorst to approve the Phase I Preliminary Design and Budgeting proposal from Keller for a cost of $1,500. Carried Barrington/Way to approve Preliminary Resolution declaring intent to exercise Special Assessment powers under Section WI Stats. Carried PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE SPECIAL ASSESSMENT POWERS UNDER SECTION WISCONSIN STATUTES RESOLUTION NO BE IT RESOLVED, by the Common Council of the City of New London, Waupaca Outagamie Counties, Wisconsin, as follows: 1. The Common Council hereby declares its intention to exercise its police power under Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improvement upon the following streets: CURB AND GUTTER REHABILITATION: All property fronting upon both sides of North Water Street from the intersection of Shawano Street to the intersection of Pearl Street. All property fronting upon both sides of Robin Street from 200 feet east of the intersection of Cardinal Street to 200 feet west of the intersection of Oriole Street.

2 2. Said public improvements shall include rehabilitation of curb and gutter within the rightof way of the above mentioned streets. 3. The total amount assessed against the above property shall not exceed the total cost of the improvements. The Common Council determines that the property abutting upon the above mentioned streets will be benefited by said improvements and further determines that said improvements shall be made under the police power, and the amount assessed against each parcel shall be based on the following, which in the judgment of the Common Council is reasonable. The replacement curb and gutter shall be assessed in accordance with Section 8.02(8)(a) of the Municipal Code. This construction within the right of way of the abovementioned streets shall be assessed on the basis of 50% of the total project cost to the abutting property owners. 4. That the assessments against any parcel may be paid in cash or in three (3) annual installments, the unpaid balance to draw interest at 8% per annum. 5. The Director of Public Works is directed to prepare a report consisting of: (a) Specifications for said improvement. (b) An estimate of the entire cost of the proposed construction. (c) A schedule of the proposed assessments. Upon completing the above report, the Director of Public Works is directed to file a copy thereof in the office of the City Clerk Treasurer for public inspection. 6. Upon receiving the report of the Director of Public Works, the City Clerk Treasurer is hereby directed to give a Class I Notice of Public Hearing on such report as specified in 66.60(7) Wisconsin Statutes, and to mail a copy of this Notice at least ten (10) days before the hearing to every interested person whose post office address is known or can be ascertained with reasonable diligence. The hearing shall be held in the City Council Chambers at the Municipal Building at a time set by the City Clerk Treasurer in accordance with Section 66.60(7) Wisconsin Statutes. 7. In lieu of giving a Class I Notice of Public Hearing, as specified in 66.60(7) Wisconsin Statutes, as mentioned in Section Six (6), a Waiver of Hearings, Notices, etc. may be executed by one or all interested property owners whose property abuts said improvement and is to be assessed for same. If all interested property owners or their agents, execute said waiver or waivers, the City Clerk Treasurer shall not be required to give a Class I Notice of Public Hearing, Notices, etc. Adopted this 13 th day of March, BY: John Romberg, Council President Attest: Susan Tennie, City Clerk FINANCE & PERSONNEL 1. REPORT OF OFFICERS on recent events and announcements to the Public Council President Romberg: Please don t buy donuts! Reminded candidates that were on the Spring ballot to City Administrator 1. Kent announced that there will be a joint meeting of the Economic Development Committee and Plan Commission on Thursday, March 22 nd to review the three Development proposals for the City s property on West Wolf River Avenue. The public is invited to attend or contact Kent for a disk to review the proposals at your home. 2. Work on the Chamber building is progressing well. This is a Chamber funded project, no taxpayers dollars are being spent for this project other than for minor repairs to the parking lot. City Clerk 1. There will be a Spring election in the City of New London on April 3 rd. Polls are open from 7 am to 8 pm. Absentee ballot will be available as of Monday, March 19 th.

5 Due to redistricting some voters may now be voting at a different polling place. Clerk s office will be sending out post cards with this new information. City Attorney: Nothing specific to report. Director of Public Works 1. Bodoh reminded citizens that Spring has sprung and the City s yard waste pickup will take place the end of April; otherwise it may be taken directly to the compost sites at the Cemetery or Waste Water Treatment Plan. Anniversary: Jeremy Helser 7 yrs. Parks & Recreation Department 1. Boat Launch stickers are available at the Parks/Recreation office or at Cash s Bait Shop at Riverside Park. 2. Registration for co ed and women s softball and adult soccer is open. 3. Our summer program guide will be available within the next month with most registrations opening up on April 9 th. Chief of Police 1. Anniversaries: Mike Harlow 6; Ryan Denu 4; Chase Schroeder 1; 2. Reminded everyone that pets are not allowed at the St. Patrick s Day festivities; open intoxicants are not allowed on the streets, and the parade route will be shut down at 12:15 p.m. to allow for the run.
