1 WRIGHTSVILLE BOROUGH COUNCIL MEETING Regular Meeting MONDAY, MAY 7, 2012 Borough Hall 601 Water Street In attendance: Council Vice President Scritchfield Councilman Nelson, Councilwoman Bolton, Councilman Sipes, Councilwoman Abel, Mayor Habecker, Secretary Wirls, Solicitor Ehrhart, Treasurer Brenner (arrived 7:02pm), Engineer Klinedinst, and Police Chief Pearson. Council President Hobbs was absent. Vice President Scritchfield called the regular meeting of the governing body to order at 7:00pm and led the Pledge of Allegiance. Vice President Scritchfield called for Public Comment. PATRONS: Ruth Myers (business owner) - Questioned Borough Council on the Open Container Ordinance. Felt the governing body was showing preferential treatment in regards to the businesses that were exempt from the Open Container Ordinance. Bob Holtzinger (resident) Inquired as to the status of his inquiries at the April Borough Council meeting Deb Holtzinger (resident) Reiterated what she relayed at the April Borough Council meeting in regards to the loud trash removal process occurring at the Royal Farms store and the people that congregate at the store. Mel McDonald (resident) Commercial trash removal was not permitted before 6am. If one business was given exemption from the Open Container Ordinance, it should then apply to all businesses. Inquired as to the amount and procedure for the Borough Secretary s salary. The governing body should not send out Property Maintenance letters to residents when their own properties are in violation. Annie McDonald (resident) Would like to see bicycle safety in town. If she must control her dogs, then everyone in the town should. People were throwing trash onto the Willow Street side of the Quarry. Borough Council should grant Ms. Myers exemption from the Open Container 1

2 Ordinance. Jim Markley (resident) Problems with his neighbor s fence Stormwater issues originating from his neighbor s property. Grateful to the Police Department for apprehending a recent suspect. Councilman Sipes made a motion to approve the May 2012 Regular Meeting Minutes. Councilman Nelson seconded the motion. All in favor. Councilman Sipes made a motion to approve the March 2012 Planning Meeting Minutes. POLICE - Chief Pearson presented the February 2011 police report which consisted of: 25 Calls for service 19 Traffic Citations 2 Non-Traffic Citations, Public Drunkenness, Disorderly Conduct 8 DUI Arrests 2 Motor Vehicle Accidents 2 Warrant Services TREASURER Treasurer Brenner presented Borough Council with the Treasurer s report. Councilwoman Bolton made a motion to approve the April 2012 check register. The motion carried with a unanimous vote, 5-0. Councilwoman Bolton made a motion to approve the April 2012 financial report. Councilman Nelson seconded the motion. All in favor. The motion carried with a unanimous vote, 5-0. ENGINEER Engineer Klinedinst provided and commented on his report for May 2012 which consisted of: Royal Farms Wearing course has been placed, without notification to C.S Davidson. As a result, the placement of the wearing course was not inspected for compliance to plan or Borough specifications. Royal Farms is not responding regarding fence issues with owners. Security release request pending. Engineer does not recommend releasing the surety money. 2

3 Waterfront Master Plan Participating in meetings with SGHA Project Manager Cynthia Fuhrer, funding and permitting agencies as notified. Zoning Ordinance Committee meeting held on 4/16; Zoning districts and Zoning Map reviewed and discussed; next meeting scheduled for 5/21. Safe Routes to School Notice to Proceed issued for a Construction start date of June 11, MS4 Application due 9/14. Working on required mapping of BMPs Street Maintenance Program Contracts have been returned for signature. SOLICITOR The governing body reviewed the confidential report provided by Solicitor Ehrhart. MAYOR - Mayor Habecker suggested a traffic study for the 8 th Street/South Alley area and explained to those in attendance the procedure for traffic studies and im0lementation of the studies. COMMITTEE REPORTS Administration & Finance: Councilwoman Bolton made a motion to approve a waiver of the $50 Entertainment Permit fee cost for the American Legion Post 469 Memorial Day Parade on May 28, Councilman Sipes seconded the motion. All in favor. Councilwoman Bolton addressed the proposed meeting guidelines and it was determined the topic would be discussed during the Planning Meeting on the 21 st. Public Works: Borough Council reviewed the Streets Department report. Councilman Nelson: Asked Council to consider the hiring of a temporary Part Time employee to assist in road patching. 4 th and Cherry Street sidewalk permit was reviewed and approved. Councilman Nelson made a motion to request a traffic study for the East and West bound directions on 8 th Street and South Alley. Councilman Sipes seconded the motion. All in favor. 3

4 Public Safety: Firefighter Chad Livelsberger read the Fire Department report which consisted of: Hellam Township: 22 Wrightsville Boroughs: 15 Lower Windsor Township: 4 Hallam Borough: 4 East Donegal: 4 Columbia Borough: 11 Springettsbury: 3 Marietta: 1 York Township: 1 Manor Township: 0 West Hempfield Township: 0 Medical Assist: 14 Auto Accidents: 8 1 with Entrapment Structure Fires: 11 4 of the 11 working fires Automatic Fire Alarms: 2 Brush Fire/Woods/Mulch /Trash/Controlled Burn: 7 Stand By/Transfers: 4 Vehicle Fires: 1 Co/ Gas Incident/Alarms: 1 Investigations: 4 Fire Police: 0 Transformer/Wires Down: 0 Debris Removal: 3 Public Service: 2 Average Crew Size: 13 PERSONNEL Average Fire/Rescue Response Time: 1 minute 15 Seconds QRS Response Time: 1 minute Firefighter Chad Livelsberger thanked the governing body for the job they do and for their support of the Fire Department. Vice President Scritchfield relayed to those in attendance that the Emergency Operations Plan was in hand and will be forwarded to all of the governing body via . Vice President Scritchfield relayed he would like to see adoption of the EOP in June at the regularly scheduled meeting. 4

5 Discussion regarding Children at Play signs. Discussion regarding Borough wide traffic study. Councilwoman Bolton made a motion to approve Solicitor Ehrhart to draft an Ordinance in accordance to the results from a speed limit traffic study performed on the town. Councilman Sipes made a motion to approve the 2012 SPCA contract. Councilwoman Bolton seconded the motion. All in favor. Community & Economic Development: Councilman Sipes made a motion to approve and adopt Resolution , a Resolution supporting the application submission for the Chesapeake Bay Local Government Assistance National Fish and Wildlife Grant. Councilwoman Bolton seconded the motion. All in favor. Councilman Sipes made a motion to approve and sign the SALDO Ordinance update amendatory contract between the York County Planning Commission, acting on behalf of the County of York and Wrightsville Borough to allow for project completion, with an extension until December Councilwoman Bolton seconded the motion. All in favor. Parks & Recreation: Councilman Sipes made a motion to close South 2 nd Street from Orange Street to Hellam Street and 6 th Street from Orange Street to Hellam Street from 11:30am until 3:30pm on Memerorial Day, May 28, 2012 for the Memorial Day Parade. Councilman Sipes relayed the following: The Senior Center would be holding a yard sale/bake sale on June 15 th and 16 th and were seeking donations. The Recreation Board made a profit of $250 for the car wash. The Recreation Board was holding a sub sale. There were five teams in total in baseball. 6 It was relayed to those in attendance that an Executive Session would take place after the Borough Council meeting for legal and personnel purposes. Councilman Sipes made a motion to adjourn the May 7, 2012 Regular Borough Council meeting. Councilman Nelson seconded the motion. All in favor.
