1 Ligonier Township Supervisors Regular Meeting May 9, 2017 The Ligonier Township Supervisors met in regular session at 6:58 PM with the Pledge of Allegiance opening the meeting. Secretary/Treasurer, Bruce Robinson took roll call. Present were D. Scott Matson; Gary Thistlethwaite; Chairman, Wade Thomas; and Vice Chairman, Paul Knupp; and Secretary/Treasurer, Bruce Robinson. Supervisor Wade Thomas-asked what has been done with Everview Estates and Michael Korns reiterated what he stated in April 14, 2017 meeting adding that he checked last week on the start of the project with no action, he then asked township employees to check on it today and again still no action. Wade Thomas directed Engineer, Dorothy Boring; Manager, Terry Carcella; and Solicitor, Michael Korns to get onsite to get it spec. and have f bids at the next supervisor meeting. He also directed Ms. Boring and Mr. Korns to keep these bills separate. Wade Thomas asked Michael Korns if building permits were held for this property and he suggested that any building permits reviewed with him from Richard Bell. Terry stated that these are lots of record owned by somebody that purchased that lot that there could be some jeopardy in doing this. Public Comment 1. Nancy Stumpf Water issue on Singer Way from Everview Estates. She cannot use her yard, cannot mow. She has lost trees and her driveway and sidewalk is sinking. Do the supervisors have a Plan B and what is it. She was assured by Chairman, Wade Thomas that Markosky engineers is capable this. 2. Liz Ludwig Lives three doors down from Ms. Stump and her trees are dying due to the excessive water in the ground. Her basement was flooded three times, forcing her to remove her carpet. She would like to fix it up, but is holding off until the water issue is corrected. A motion was made by Wade Thomas and seconded by Bruce Robinson to direct the Manager, Engineer, and Solicitor to get onsite and proceed with the bid process to have bids or next Supervisor is meeting keeping bids separate. Motion carried. A motion was made by Paul Knupp and seconded by Scott Matson to approve the minutes of the March 14, 2017 meeting. Motion carried Staff Report Manager s Report Terry Carcella reported steps outlined in the memo are what is needed to create a new ACT 537 Plan. At the current time, he is not sure of time needed to complete the process, as LTMA and MWAC will need to be on board with the new plan. He stressed the importance of the plan for grants. He reported that the Commonwealth Court of Pleas denied Foxley Farm and they appeal within the proper timeframe. (See Attached for Outline).

The Ligonier Township and Ligonier Borough Police will be participating in the Kickball for a Cause with the Ligonier Valley Middle School on Saturday, May 13, 2017 at 9:00 AM at middle school athletic fields. Medical staff will be on site for the officers. The Police Department generated $2, in fines, etc. this reporting period. Public Works Report Russ Morgan, Director reported that people are placing household garbage in the aluminum can recycling bin. He stated that household garbage is not permitted in the recycling bins and asked if anyone sees it happening that they report it. He stressed that we have the recycling to benefit residents of the township, so please use it properly. Sealing and Chipping of roads are projected to start Mid-July through Mid-August. Engineer s Report- Dorothy reported the GP11 permit is ready to submit tomorrow for Clifford Woods Road Bridge. Questions on Everview Estates-are they to take the Westmoreland Conservation plans and do bids-yes. In addition, are the advertising guidelines something that can be adjusted-mike Korns is to look into. Solicitor s Report Michael Korns reported at the Planning Commission Meeting there was feedback in the SALDO and at their June meeting they will complete draft plans. Zoning/Code Enforcement Report Richard Bell reported: Total Income from Lien Letter Requests - $ Building Permits Issued Income 4 $ 2, Zoning Permits

3 6 $ Sewage Permits 1 $ Demolition Permits 1 $ Sign Permits 3 $ No-Impact Home Based Business 2 $ Zoning Hearing Board Fees 2 $ Total Income Generated $ 4, This office has received two nuisance complaints this reporting period. These complaints were in reference to nuisance properties and are being investigated. Planning Commission The Planning Commission had met in April and discussed the upcoming SALDO (Sub-Division and Land Development Ordinance). Mr. Korns provided insight to the establishment of the ordinance and what it would mean to Ligonier Township. We will be meeting again in April to further discuss this issue. Zoning Hearing Board The Zoning Hearing Board reconvened on May 3, 2017 and rendered their decision on the McCall/Werner appeal. The Board upheld the decision of the Zoning Officer in regards to the issuance of a building permit to Mr. John Cramer for a building in Laughlintown. The Zoning Hearing Board will also meet on May 23, 2017 to hear the appeal of Mr. Todd Graham in reference to his request to expand his non-conforming use of the property located along Route 30, from five to (5) cabins to six (6). A motion was made by Bruce Robinson and seconded by Paul Knupp to approve Skoloda Minor Subdivision. Motion carried. Correspondence

4 1. Excela Health Notice on Ligonier Valley Ambulance Service Service to cease midnight June 30, 2017 with Mutual Aid taking over service. 2. Westmoreland County Letter on CDBG Participation No action. 3. Westmoreland County Re-Appointment of Carcella to SPC Public Participation Panel for twoyear term. 4. Laughlintown Community Letter Offering the Township playground and basketball court property for a nominal fee (EX: $1) with agreement to a list of terms provided. (See Attached) Treasurer s Report-Terry Carcella stated that the General Fund account balance is $651, the Act 13 account balance is $62,174.38, the K-9 account balance is $49,923.19, the Liquid Fuels account balance is $5, the Developer s account balance is $12,544.00, Liquid Fuels Investment Account is $391,366.70, the Equipment Fund $18,890.98, and the Capital Reserve CD s $416, for a total of $1,607, No action required. A motion was made by Bruce Robinson and seconded by Paul Knupp to approve payment of April 24, 2017 and May 8, 2017 Bill Payment lists. Motion carried. Old Business - None New Business A motion was made by Scott Matson and seconded by Bruce Robinson to table to next meeting the offer ownership of the Playground and Basketball Court by Laughlintown Community Center. Motion carried. (See Attached) A motion was made by Paul Knupp and seconded by Bruce Robinson to approve Resolution # Early Retirement Incentive Program for Public Works Employees. Motion carried with Scott Matson voting Nay.(See Attached) A motion was made by Wade Thomas and seconded by Bruce Robinson to table to next meeting the request to purchase Caterpillar 305 Mini Excavator from Cleveland Brothers with Co-Star Program at a cost of $68, Motion carried with Paul Knupp voting Nay. (See Attached) A motion was made by Gary Thistlethwaite and seconded by Paul Knupp to approve Glassmere Fuel Bid for onsite tanks at COG Advertised Bid. Motion carried. (See Attached) A motion was made by Paul Knupp and seconded by Gary Thistlethwaite to approve Employee Manual Amendment of three positions; Captain of Police, Administrative Assistant Part Time Casual, and Public Works Part Time Casual. Motion carried. (See Attached) A motion was made by Gary Thistlethwaite and seconded by Bruce Robinson to approve hiring of part time patrol officer, Shawn Knepper Supervisors Comments Supervisor Scott Matson Asked Terry about the 10hr. shifts for road crew and Terry responded that they are waiting on the Union Rep. Asked Glenn Kalp about the $200,000 missing from Ligonier Township Municipal Authority. Glenn responded that Ligonier Township Municipal Authority never had the money that it went to the Township and that is where it came up missing. When they questioned Bruce Robinson at an LTMA meeting in 2016 about the Whipkey investigation and the $200,000, they were told it was water

5 under the bridge. Wade Thomas explained that the audit that was performed was not a complete audit they only did pieces. Supervisor Paul Knupp No Comment. Supervisor Bruce Robinson No Comment. Supervisor Gary Thistlethwaite No Comment. Supervisor Wade Thomas Terry get roof contract to roofer and questioned what the status of the shutdown of the bridge on 711 and the sewage for Ligonier Camp and Conference. Terry stated no update waiting to hear back from Plenary Walsh and Representative Reese s Office.
