1 WRIGHTSVILLE BOROUGH COUNCIL MEETING Regular Meeting MONDAY, SEPTEMBER 9, 2013 Borough Hall 601 Water Street In attendance: President Shannon Councilman Sipes Councilwoman Bolton Councilman Nelson (arrived 7:20pm) Solicitor Baranski Engineer Craddock Vice-President Scritchfield Councilwoman Abel Secretary Wirls Mayor Habecker Chief Hege Treasurer Brenner Absent: Engineer Klinedinst President Shannon called the September 9, 2013 regular meeting of the governing body to order at 7:01 pm and led the Pledge of Allegiance. PATRONS: Maureen Lawrence: Very displeased with the bike criterium that occurred in June. Showed the governing body multiple papers with different times of road closures for the bike race. Explained that her vehicle was towed and she was forced to pay $100 in order to get her vehicle back and demands a refund. The bike criterium is not wanted in her neighborhood. The event does not bring money into the Borough and the spectators that come to watch the race are disrespectful and rude. Chief Hege responded by informing those in attendance that No Parking signs with the time of the road closure were posted around the neighborhood 48 hours in advance of the race. Solicitor Baranski explained that the Road Closed signs placed by Borough employees were the official postings and the stipulations to abide by. The letter sent by the bike race coordinators is not an official document. Jim Sharm: He had filed a complaint form with the Borough office in regards to the property located at 302 South Front Street due to the lack of property maintenance by the bank that owns the property. The former Riverfront Bar has an issue with property maintenance as well. Mayor Habecker explained that the property is in foreclosure and we are not able to obtain owner information for the property. 1

2 Solicitor Baranski stated that the Borough could only mow a property after a notice to the property owner was sent and received; however, in this case, the Borough is not knowledgeable of an owner and cannot provide notice until an owner is found. Chad Lutz: Inquired about the status of the Zoning Ordinance. The bike race is an inconvenience to the residents living in that neighborhood. Mel McDonald: Wrightsville is still a small town and Council should help the people in the town and should refund Ms. Lawrence the $100. The property located at 302 South Front Street looks horrible. Betty Lighty told her that usually the Borough donates a porta potty for the Olde Time picnic but did not this year. Borough Council needs to get it together and the town is going to hell. No offense to the Borough Secretary but she received a large raise; however, former employee Jason Livelsberger never received a raise while he worked for the Borough. Two girls were walking down the street in town and were arrested for not walking on the sidewalk. There is a bat problem on Hellam Street. The residents affected by the bats were going to come to the meeting but were just tired of the situation. Mary Boswa was told by Neil to simply throw Clorox into her pond to fix it. Why couldn t the governing body fix the issues on Hellam Street? MINUTES Councilman Sipes made a motion to approve the July 1, 2013 Regular Meeting Minutes. The motion passed with a unanimous vote, 5-0. Councilman Sipes made a motion to approve the July 15, 2013 Recessed Meeting Minutes. Councilwoman Abel seconded the motion. All in favor. 3 REPORTS Fire A written report was provided with the monthly meeting materials. 4 Ambulance A written report for August 2013 was provided with the monthly meeting materials. Jim Arvin relayed that Wrightsville Borough shouldn t be affected by the ALS and BLS changes as indicated in the letter from Well Span. Councilwoman Bolton asked Mr. Arvin to provide more details about the changes in services by Well Span. Mr. Arvin explained that York Hospital and York Memorial Hospital began an ALS in the early 1980 s. Because the ALS was costing over one million dollars to maintain, the service is being discontinued. A lot of ambulance companies do not have the extensive staffing required to maintain ALS. Mr. Arvin relayed that he was not sure how it was all going to work out. 5 Police A written report was provided with the monthly meeting materials. The governing body reviewed the financial report as provided by Treasurer Brenner. The following was relayed: Council Vice-President Scritchfield made a motion to approve the July 2013 check register. Councilwoman Abel seconded the motion. All in favor. 6 Treasurer Brenner relayed the following: Low revenue in August which is typical of this time of the year. Released a substantial tax check to the Fire Department which accounts for approximately 90% of tax money that goes to the Fire Department. Changes and adjustments will need to be made to the 2013 budget. Cash balances looks well at this point. Annual insurance meeting with Glatfelter which showed that the Borough will see a substantial decrease in E&O insurance and Workers Compensation insurance. Councilman Sipes made a motion to release the remaining funds totaling $ in the Northwest account to the Recreation Commission. Engineer A written report was provided with the monthly meeting materials. The governing body reviewed the engineering report as provided by Engineer Craddock. The following was relayed: The Public Hearing for Zoning will occur on September 16, Weekly updates on Locust Street are being sent to residents and Borough staff. Stormwater pipe being installed to be followed by curb and sidewalk. Columbia Gas expressed interest in replacing their main on Locust Street. The Borough could postpone the milling and paving until next spring. The Spring Alley damage would potentially cost $3,000. Council Vice-President Scritchfield made a motion to obtain quotes to fix Spring Alley with the total amount not exceeding $3,500 for the repairs. Discussion ensued. Councilman Sipes seconded the motion. All in favor. It was determined that Engineer Craddock would obtain 3 quotes for the Spring Alley repair. Discussion: Stormwater Authorities Discussion: MS4 requirements Discussion: Subdivision proposal for 306 Cherry Street 6

7 Solicitor Council Vice-President Scritchfield made a motion to advertise Ordinance , an Ordinance repealing the Building Ordinance in the Wrightsville Code of Ordinances for action at the next meeting. Councilman Sipes seconded the motion. All in favor. Discussion: School Crossing Guards Discussion: Vine Street washout Discussion: Habitat for Humanity Discussion: Vine Street parking Discussion: Motor Vehicle Ordinance amendments Council Vice-President Scritchfield made a motion to advertise Ordinance , an Ordinance amending the Motor Vehicle Ordinance. Councilman Nelson seconded the motion. All in favor. Discussion: South East corner of 3 rd & Chestnut creating difficulties for the school bus drivers to safely turn. Possible extension of the painted yellow lines to give the bus drivers a better turning radiance. Discussion: Locust Street project and sidewalk agreements. Councilwoman Bolton made a motion to advertise Ordinance , an Ordinance authorizing the execution of a cable franchise agreement between Comcast and the Borough of Wrightsville. Mayor A written report was provided with the monthly meeting materials. The governing body reviewed the mayoral report as provided by Mayor Habecker. The following was relayed: The EYCEMA (Eastern York County Emergency Management Agency) has officially been formed. Engineer Klinedinst, Secretary Wirls and Mayor Habecker are working on requesting seed money to assist the Borough in revitalization efforts. Questions relating to the messy properties around town are welcome. The biggest problems we are seeing are the properties in foreclosure and the process is extremely lengthy. The Borough is doing everything they legally can in order to address the properties with property maintenance issues. There are problems with the Borough maintaining the properties that need attention such as time, staffing restrictions, and legalities such as trespassing.. 7

8 In relation to the person Ms. McDonald referred to earlier in the meeting, Mayor Habecker, as a resident, has personally cleaned up trash, etc for that resident. Private citizens can take care of surrounding properties with high grass or refuse strewn about; however, the Borough is restricted by the Constitution to go onto these properties. These properties eventually sort themselves out but it will always take time in order for it to be remedied. Patron Ms McDonald asked who will take care of the snow on the properties without a visible property owner. Mayor Habecker responded by saying that the Borough is not the problem but rather, the bad property owner is. People that are leaving the Borough are those that are in foreclosure or have lost a job and not because the town is in bad shape. Patron Ms McDonald also asked about the tree limbs hanging in the alley by Ms. Boswa s home. It was relayed to Ms. McDonald that the adjoining neighbors can cut it if they so choose. Chief Hege stated that he looked at the sight distance in the area Ms McDonald was referring to and it appeared to be fine. Executive Session: 9:34pm-10:42pm for personnel purposes. No action taken. COMMITTEE REPORTS Administration & Finance Committee: Councilwoman Bolton made a motion to hire Don Keller as a Crossing Guard contingent upon training, a drug test and a physical. Discussion: Clarification is needed on #5 of the draft of the Intergovernmental Agreement with the Wrightsville Borough Municipal Authority. Discussion: Budget Workshop to occur on Monday, October 21 st at 5pm in Council Chambers. Public Works Committee: The governing body reviewed the Street Department report as provided by Eliseo Cruz. Public Safety Committee: Council Vice-President Scritchfield made a motion to appoint resident Douglas Bailey as a Civil Service Commission member. Councilman Sipes seconded the motion. All in favor. Community & Economic Development Committee: Councilman Sipes made a motion to appoint the following residents as members of the Zoning Hearing Board: 8

9 Charles Krotzer Sherri Bailey Lazure Estel Councilman Sipes made a motion to appoint the following residents as alternate members of the Zoning Hearing Board: Dawn Lindeman Irvin Sholl Council Vice-President seconded the motion. All in favor. Councilman Sipes made a motion to appoint Gavin Markey as the Solicitor for the Zoning Hearing Board. Council Vice-President seconded the motion. All in favor. Parks & Recreation Committee: Councilman Sipes made a motion to approve the placement of the Wrightsville Recreation Commission food stand at the end of the 462 Bridge on Saturday, October 5, 2013 during Bridge Bust. Councilwoman Bolton made a motion to designate Thursday, October 31 st from 6pm-8pm as the official Trick or Treat date and time for Wrightsville Borough. Councilman Sipes mentioned that Museum Day would be on September 28 th. Personnel Committee: Council Vice-President Scritchfield made a motion to change employee Eliseo Cruz s status from Part-Time to Full-Time with an hourly increase to $11 effective immediately. Councilman Nelson seconded the motion. All in favor. Council Vice-President Scritchfield made a motion to hire Michael Gromling as a Full-Time employee, as a Maintenance Technician at an hourly rate of $16. Councilman Sipes seconded the motion. All in favor. Councilman Sipes made a motion to hire Shawn Wilson as a Part-Time Police Officer at a rate of $18 per hour effective immediately. ADDITIONAL BUSINESS: Council Vice-President Scritchfield made a motion to approve the advertising of Ordinance , an Ordinance increasing Refuse rates from $21.50 to $23 per month. 9

10 Councilman Sipes seconded the motion. All in favor. Council Vice-President Scritchfield stated, for the record, that former employee Jason Livelsberger received yearly raises and reviews and was never mistreated by the Borough. ADJOURNMENT: Councilwoman Bolton made a motion to recess the September 9, 2013 Regular meeting of the governing body to Monday, September 16, 2013 at 7pm.
