1 PAGE 1 1. Meeting Called to Order Mayor Walsh called this meeting to order at 6:30 PM. Opening Statement and Roll Call Deputy Township Clerk Wollman read the opening statement. Roll Call: Present: Mayor Robert F. Walsh, Deputy Mayor Angela W. Dalton, Councilwoman Susan S. Clark, Councilwoman Pauline M. Smith. Also present: Township Manager Helene Schlegel, Township Attorney McKenna Kingdon, Deputy Township Clerk Penny Wollman, Chief Financial Officer Jeffrey Filiatreault, Township Engineer Bill IVunziato. Absent: Councilman William J. Gotto. 2. Executive Session There is a need to go into executive session for subjects to be discussed per N.J.S.A. 10:4-12, specifically under Litigation- Fox and Hurley vs Township of Howell, Docket No. MON-L ; Personnel- SOA & PBA Negotiations. The Township Council will reconvene in public session thereafter. Councilwoman Smith made a motion, seconded by Deputy Mayor Dalton. Roll Call: Ayes: Mrs. Clark, Mrs. Smith, Mrs. Dalton, Mayor Walsh. Meeting reconvened 7:40 P.M. 3. Pledge ofallegiance. Moment of silence to recognize soldiers overseas. 4. Acceptance of Minutes of Previous Meetings * March 2, Workshop Meeting + Executive Session * March 16,201 0 Regular Meeting + Executive Session Executive Session Minutes for Public Release * March 2, 2010 * March 16,20 10 Deputy Mayor Dalton made a motion to accept the above referenced minutes. seconded by Councilwoman Clark. Roll Call: Ayes: Mrs. Clark, Mrs. Smith, Mrs. Dalton, Mayor Walsh. 5. Reports of Township Officials Township Engineer Nuniato reported that the Ford Road project is complete; topping will begin the first week in June. The next phase will go out to bid. Mr. Nunziato stated that there are two upcoming NJDOT projects - 1) Entire length of Route 9 in Howell: 2) Shoulder work on Route 33 and 34, further details will be provided to the governing body when they are available. CFO Filiatreault reported that the Township had a TAN (tax anticipation note) sale for cash flow borrowing,.82% interest rate.

2 PAGE 2 Councilwoman Clark stated that she had attended a benefit for the Child Advocacy Center, a center based in Freehold to help children who have been abused and neglected. Further information can be found at their website, Friends of the Child Advocacy Center. Councilwoman Smith stated that the Mo~lrnouth County Historical Commission hosts a tour around Monmouth County on Saturday, May 1 st from 10:OO AM - 5:00 PM and Sunday, May 2"d from Noon to 5:00 PM. Local Historical Societies participate and will include the MacKenzie House and Ardena School Museum. Councilwoman Smith commented on the Howell Dog Park stating that she has read all the information provided including letters and s from a resident. Councilwoman Smith stated that there are several questions she had about the Dog Park that were asked as well in an such as: Who is going to monitor that dogs are all licensed and have had their shots? Monitor that owners pick up the dog's excrement? Who will police the aggressive dogs from the submissive dogs? Medical care if there is a dog fight - or dog attacks person? Who will fill in holes that the dogs dig / insurance if someone gets hurt. Will children be allowed in the dog park? Questioned the perimeter / policy of the dog park. Councilwoman Smith asked that the dog park be put on hold until all questions are answered. Councilwoman Smith stated that she has not seen an Environmental Report or any Plans for the property. Comment that property was paid for with Green Acres money. Councilwoman Clark suggested that Councilwoman Smith attend the next Recreation Advisory Committee meeting on Thursday, May 13 at 7:30 - Dog Park plans would be available there. Recogrzition - Naming of Park Contest, Soldier Memorial Park, Shawn Drew Pr*oclamation - Arbor Day on Friday, April 30,2010 Pr*oclamation - National Day of Prayer on Thursday, May 6,2010 Preserztation - Metedecon k Watershed Protection Alliance, Barbara Dixel, Representative. Mrs. Dixel reported on the Preliminary Watershed Plan Goals and Objectives. The Stakeholder Advisory Committee Kickoff Meeting was held on January 13, The over-riding goal is to preserve the Metedeconk River as a viable water supply source for the region, protect the health of the Bamegat Bay Estuary, eliminate water quality impairments and attain compliance with the surface and water quality standards throughout the watershed. Mrs. Dixel asked that the governing body consider hosting the June Metedeconk Watershed Protection Alliance meeting at Town Hall. Mayor Walsh stated that the governing body will discuss this request later in the meeting.

3 PAGE 3 6. Hearing of Citizens Grace Abramov, 26 Glenmore Road. Ms. Abramov asked if the brush pick up zones are the same as the bulk pick up zones. DPW Director responded that the brush pick up started last month and stated that the schedules are available on the Township's website. Bill Hitzel, 5 Irene Boulevard. Mr. Hitzel expressed concern and asked for some clarification with the Ford Road construction. Mr. Hitzel stated that during the Ford Road construction project, his mature pine tree roots were exposed, and was concerned that the trees will be damaged in the future because of this. Mr. Hitzel also spoke of the subcontractor crushing his flowers and severing the invisible dog fence. Township Attorney Kingdon suggested that Mr. Hitzel file a Notice of Tort Claim with the Township Clerk's Office. Township Engineer Nunziato and DPW Director Jeff Cramer will visit the residence. Barbara Dixel, The Villages. Mrs. Dixel asked for an explanation of Resolution 7A.48 -NJDEP Forestry Grant, 2009 Business Stimulus Fund, for $7,000, and asked what type and where the trees are being planted. DPW Director Cramer responded that the trees will be planted along Cascades Avenue bordering Deenvood Park. Mrs. Dixel questioned Resolution 7A.38- Authorize Dedication of Rider, Gifts and Bequests - Construction of Dog Park. Township Attorney Kingdon responded that there was a discussion to have the Recreation Advisory Committee obtain donations for the dog park. This resolution authorizes the Township to set up an account to accept cash donations for the dog park. Mrs. Dixel requested the governing body pull Resolution 7A.38 stating that there have been bald eagles flylng at the dog park location and also questioned what precautions are being taken for run off of dog waste into streams. Councilwoman Clark stated that this information will be brought back to the Recreation Advisory Committee for discussion. Mayor Walsh suggested that Mrs. Dixel attend the May 13 Recreation Advisory Committee. Vince Laraia, 56C The Villages. Mr. Laraia questioned the impact that the Township's volunteer emergency services may have when the Township passes its budget. Mayor Walsh stated that the Township hasn't discussed the volunteer services during the budget session. Deputy Mayor Dalton stated that there is no proposal to reduce that line item. Discussiolz Defeated Sclzool Board Budgets Both Local and Freehold Regional High School District Budgets were defeated. Mayor Walsh stated he had a conference call with the 7 other Mayors yesterday regarding the FRHSD budget and will bring information back to this governing body. There is a meeting scheduled between the Freehold Regional High School District and constitueilt towns regarding the defeated school district budget on Wednesday, May 5th. Mayor Walsh stated that if the 8 mayors don't agree on the dollar amount to cut from the budget, it will go to the State. May 19 deadline for both FRHSD and Local Board of Education reviews and final cut resolutions. Mayor Walsh reminded the governing body that the Council does not have the final say on what the school districts cut, but can only recommend a dollar amount. The districts have the right to appeal it to the Commissioner.

9 PAGE 9 Township Manager Schlegel asked for direction if there will be two Council members meeting with the local Board of Education regarding their defeated school budget. Also, Mrs. Schlegel questioned the governing body on hiring an auditor for the school budget. Deputy Mayor Dalton and Councilwoman Clark will be the representatives for the review of the Local School Board Budget. Mayor Walsh will be the representative for the review of the FRHSD School Board Budget. Councilwoman Smith stated she would attend, with Mayor Walsh, the FRHSD meeting on May 5. Auditor to Review School Budget Councilwoman Clark made a motion to appoint an Auditor to Review the defeated Local School Board Budget, not to exceed $10,000.00, seconded by Councilwoman Smith. Roll Call: Ayes: Mrs. Clark, Mrs. Smith, Mayor Walsh. Nays: Mrs. Dalton. Special Meeting - Defeated School Budgets for the School Year Mayor Walsh called for a Special Meeting on Tuesday, May 18, 2010 at 6:30 PM for the purpose of reviewing the Defeated School Budgets for the School Year. Mayor Walsh asked the Township Clerk to see if Middle School North was available for this special meeting. Metedecon k Watershed Protection Alliance Meeting The Township Council agreed to host the next meeting at Town Hall for the Metedeconk Watershed Protection Alliance. Strategic Planning A dvisoiy Conznzittee Councilwoman Clark stated that a draft resolution has been provided to each Council member which establishes a Strategic Planning Advisory Committee. Councilwoman Clark stated that she felt this Committee should meet for 3 months, every 2 weeks. The Resolution provides general duties and principals for this committee and asked that this resolution be listed on the Township Council's next meeting agenda. Councilwoman Smith requested that Counciln~an Gotto be present for the discussion or action on this resolution. 10. Litigation Fox and Hurley vs Township of Howell, Docket No. MON-L Discussion. Township Attorney Kingdon reported that Donna Miller has been removed as AST's expert. The trial date was scheduled for May 17, 2010 but due to the expert being removed, the date may be changed. Action To Be Taken. No action to be taken by the governing body this evening. Personnel SOA & PBA Negotiations Discussion. Township Manager Schlegel stated that she is continuing negotiations with the SOA and PBA with regards to the $600,000 cut to the Police Budget and is optimistic that it may be settled by the end of this week.
