1 FAIRFIELD TOWNSHIP COMMITTEE REGULAR ACTION MEETING JANUARY 20, 2016 CALL TO ORDER Mayor Byrd called the meeting to order at 7:00 p.m. OPEN PUBLIC MEETINGS ACT STATEMENT Mayor Byrd read the following OPMA Statement into the record as follows: This meeting of the Fairfield Township Committee shall come to order. The New Jersey Open Public Meeting Law was enacted to insure the right of the public to have advanced notice of and to attend the meeting of the public bodies at which any business affecting their interests are discussed or acted upon. This meeting held on this 20 th day of January, 2016 at the Fairfield Municipal Building in Fairton New Jersey is held pursuant to notice of date, time and place of same having been submitted to South Jersey Times, The Daily Journal, and The Press of Atlantic City and also duly posted on the bulletin board in the lobby of the Township Hall. SALUTE TO THE FLAG / MOMENT OF PRAYER Mayor Byrd led the flag salute followed by a moment of prayer given by Committeeman Clark. Roll Call Vote: RESOLUTION NO A RESOLUTION TO PUT OUT TO BID A HAZARD MITIGATION GRANT PROGRAM PROVISION OF EMERGENCY GENERATOR AND INSTALLMENT SERVICES PURSUANT TO A HAZARD MITIGATION GRANT Mayor Byrd requested that the Township Committee to table this resolution at this time for the specifications to be drawn up by the Township Engineer. 3 RESOLUTION NO A RESOLUTION BY THE TOWNSHIP COMMITTEE OF FAIRFIELD TOWNSHIP IN SUPPORT OF THE USE OF A NO PASSING ZONE ALONG ROUTE NJ 49 AS RECOMMENDED BY THE NEW JERSEY DEPARTMENT OF TRANSPORTATION Committeeman Pitts moved to adopt Resolution No seconded by Committeeman Manson. Roll Call NEW BUSINESS A RESOLUTION REQUEST APPROVING THE MUNICIPAL ALLIANCE STRATEGIC PLAN FOR FISCAL YEAR JULY 1, JUNE 30, 2017 Said item deferred to the next scheduled meeting for further review. OLD BUSINESS None DEPARTMENT REPORTS The following reports were provided to the Township Committee for their review and information: Tax Collector, Fairfield Volunteer Fire Company No. 1 Fairton and the Township Clerk. The report from the Township Clerk indicated the following: An application for a Business License from applicant, Otis E. Hannah, Jr. - No action taken Notification of TRICO JIF Risk Management Consultant Resolution and Agreement expiration date. Said matter was deferred for the next scheduled meeting. Free rabies vaccination clinic scheduled hosted by the Cumberland County Health Department. Mayor Byrd requested that we post the free rabies vaccination clinic schedule for the public at the Post Office and at the Sunoco Station. Township Solicitor Carr reported on his Solicitor s Report provided to the Township Committee for their review and information. In his report dated January 5, 2016, he discussed correspondence relating to the State of New Jersey Abandoned Property Act; Article from the New Jersey League of Municipalities Magazine relating to OPRA requests, denials, expenses and a recommendation from the contributing author. The Solicitor advised that we cannot afford an error in OPRA responses given that the dollar potential of the awards are significant based upon the fee shifting element; Payment for Sensitivity Training; Updated Model Employment Practices Policies and Procedures. The Solicitor indicated the rest of his report be discussed in Closed Session. PUBLIC COMMENT Mayor Byrd read the following Public Comment into the record as follows: The Committee welcomes participation of interested organizations and individuals during work session/action regular/action and special meetings. However, in order to conduct the business of the Township in the most productive manner possible, attendees will be given five (5) minutes, all inclusive, including all dialogue, questions, and responses from both the speaker and the Committee for the designated public portion of the meeting. There may be no transference of a speaker s time to other attendees. Please step up to the microphone at the appropriate time, and state your name and address for the record. Mayor Byrd asked for a motion to open the meeting to the public. Deputy Mayor Pierce moved to open the meeting to the public seconded by Committeeman Pitts. All members voted in the affirmative. Clarence Dixson, 27 Walden Drive appeared with a concern regarding residents raking leaves from their lawn into the street. He indicated that the Township does not have a leaf collection program therefore he recommended that enforcement needs to be addressed with this issue as it causes the storm water drains to be clogged and not flowing properly and also with the anticipated snow storm arriving that those leaves being put out into the street will be carried by the snow plows onto someone else. Mayor Byrd advised Mr. Dixson that he would have our Code Enforcement Department to look into this matter. Ed Kimley, Seabreeze Road appeared and talked about the Wayne Byrd lawsuit. He advised that if the Township Committee members care about this Township and the taxpayers that they should really look closely into this lawsuit. Nancy Ridgway, 582 Irving Avenue appeared and welcomed the new members of the Township Committee. Ms. Ridgway indicated that she would like to know if the Township is going to restart the Environmental Commission. She advised as the resident spoke of the concern regarding the leaves being raked out into the street. She advised that there is a law from the New Jersey Department of Environmental that no leaves are allowed to remain in the street more than 48 hours. Ms. Ridgway indicated that she really believes that we need to restart our Environmental Commission as we do have not had one in over a year now and that we do have some environmental issues in the Township to address. 4 Ernest Zirkle, 24 Back Neck Road appeared and indicated that when Mayor Byrd appointed him to the Delaware Bay Seashore Counsel that he promised to bring back reports from the meetings. He advised that they did have their first meeting after the Reorganization Meeting on January 14, He advised that they talked about goals and directions. He advised on the short term goals raising public awareness regarding value of the area, identify and secure funding opportunities, advanced restoration projections and change FEMA designations. Mr. Zirkle stated on the long term goals were sustainable economic opportunities for the residents, a voice in Trenton and Washington, as the Bay Shore area has not had a voice in the past, maintain quality and value of natural resources, foster of better permitting processes, study of sand movement and testing so that it can be used for strategic purposes when the sand is removed in future storms and restore pilot payments to the 2011 levels. Mr. Zirkle indicated that those goals would be addressed. Mayor Byrd thanked Mr. Zirkle for his report. There were no further comments to be received. Mayor Byrd asked for a motion to close the public comment. Committeeman Pitts moved to close the public comment seconded by Committeeman Manson. All members voted in the affirmative. Mayor Byrd announced that the Township Committee will now convene into Executive Session. RESOLUTION NO A RESOLUTION AUTHORIZING THE TOWNSHIP COMMITTEE TO ENTER INTO EXECUTIVE SESSION NOT OPEN TO THE PUBLIC UNDER N.J.S.A 10:4-12 MATTERS RELATING TO THE ATTORNEY-CLIENT PRIVILEGE - N.J.S.A. 10:4-12(b)(7) GRINER VS FAIRFIELD TOWNSHIP HULITT VS FAIRFIELD TOWNSHIP UNFAIR LABOR PRACTICE WILDLIFE PRESERVES, INC. VS NJDEP AND FAIRFIELD TOWNSHIP MATTERS RELATING TO THE EMPLOYMENT RELATIONS - N.J.S.A. 10:4-12(b)(8) COLLECTIVE BARGAINING FILLING OF EMPLOYMENT POSITIONS Committeeman Pitts moved to adopt Resolution No authorizing to enter into Executive Session seconded by Committeeman Manson. Roll Call The Township Committee adjourned into Executive Session at 7:32 p.m. The Township Committee convened into Open Session with all members present from the Executive Session at 8:00 p.m. Township Solicitor announced that the Township Committee is now in Open Session and the doors are now open after having discussed the matters of Griner vs Fairfield, Unfair Labor Practice, Wildlife Preserves, Inc. vs NJDEP and Fairfield Township; Hulitt vs Fairfield Township, Personnel Issues Collective Bargaining and Filing of Employment Positions. Mayor Byrd announced as a result of the Executive Session, he asked for a motion to adopt Resolution No as follows: RESOLUTION NO A RESOLUTION APPOINTMENT OF MAYOR S DESIGNEE FOR THE FAIRFIELD TOWNSHIP PLANNING AND ZONING BOARD (RAY CUFF) Committeeman Pitts moved to adopt Resolution No seconded by Deputy Mayor Pierce.
