7 Rural Distribution Project (RD) - Dak Lak province SUMMARY... By the agreement ofevn, Central Power Corporation and World Bank (WB), Dak Lak province took part in the Rural Distribution project (RD) financed by the WB. The project aims at: (a) rehabilitating, improving and enlarging power system of Dak Lak province in order to meet the demand of supplying electricity for the socio-economic development in years later, up to 2020; (b) increasing reliability and quality of power network, reducing energy loss on the network; (c) and improving the efficiency of power sales. The Dak Iuak Rural Distribution project (RD) component's scope is (i) constructing 110kV power network implemented by EVN. The implementation of the construction of the power network will not cause any land acquisition and resettlement at the large scale. Resettlement plan (RP) is aimed at handling the compensation issue for the project relating losses of land/assets and restoring the living standards of project's displaced persons at Ea Kar district and Krong Pak district, Dak Lak province. 1. Policy Frameworks and Waivers: Resettlement plan (RP) of the project component in Dak Lak province was established based on the policies of preparing project on compensation, resettlement and living standard rehabilitation for project displaced persons. Displaced persons with eligible title will include: (a) Those that have formal legal rights to land or other assets; (b) those who initially do not have formal legal rights to land or other assets but have a claim to legal rights based upon the laws of the country; upon the possession of documents such as land tax receipts and residence certificates; or upon the permission of local authorities to occupy or to use the project affected plots; (c) Those who have no recognizable legal right or claim to the land they are occupying. Persons covered under (a) and (b) are compensated for the land and other assets they lose, and other assistance. 8 Rural Distribution Project (RD) - Dak Lak province resettlement assistance in lieu of compensation for the land they occupy so as to achieve the objectives set out in this policy, if they occupy the project area prior to a cut-off dates defined in RPs. Persons who encroach on the areas after the cut-off date defined in RPs are not entitled to compensation or any other form of resettlement assistance. Similar regulations will also be applied to DPs whose income is affected by the project. 2. Project impacts: The project will impact: Permanent land acquisition for tower foundations, substations and temporary access roads. Permanent impacts to trees, crops and other assets at the locations of foundations, substations and ROW. Assets at the temporary access roads. All trees, crops and other assets around the locations of foundations and substations. Temporary land acquisition when implementing the project. Results of collected data are as follows: + There are 84 affected households (418 people), in which: + 84 temporary and permanent affected households due to land, trees and crops lost. + There are 06 affected households in terms of houses and architectural materials. + No impact on cultural heritages, preservation area or sensitive ones. During Community participation and consultation period, project-affected households all agree on compensation by cash for affected assets based on market price or replacement price. 3. Compensation policies: The cut-off date is May 17 th, 20ll. Compensation price is based on the market price/replacement price. Compensation at the replacement price to land, houses and perennial trees; compensation at the market price to annual crops. 9 Rural Distribution Project (RD) - Dak Lak province (i) transportation assistance; (ii) resettlement assistance; (iii) training assistance or other restoration assistance. Those who lost more than 10% of total area of land-holding are provided with: (iv) assistance to living standard restoration and/or training courses. According to inventory of losses, among 84 project-affected households located in Dak Lak province, none of those shall be relocated. There is no affection caused to business (there are 03 households having houses and architectural materials affected in the ROW). Up to now, according to the preliminary Feasibility Study, the inventory of losses and survey results of losses show that there are no severe impacts to the majority of displaced persons, community and common assets so that there is no need to have development of economic restoration program. However, during the stage of project implementation, if there are any severe impacts to displaced persons, the related partners must correspondingly be responsible for ensuring that displaced persons can achieve full restoration of income standard and productive capacity to the pre-project levels. 4. Community participation and consultations: Implementation of participation and consultations will limit conflicts and delay of the project implementation. Resettlement plan will be developed in complying with the consultative opinions of Local Authorities and displaced persons for developing a high degree of their participation in resettlement plan and resettlement implementation as well as in other socio - economic benefits. Local Authorities and displaced persons will be consulted and participated in the line route direction, resettlement policies, implementation of resettlement plan, institution of complaint and grievances in supervising and evaluating the living standard restoration of displaced persons after project implementation. 5. Complaint and grievances: During the process of project implementation, all complaint and grievances of displaced persons will be handled under Project RPF and the Law of Vietnam. 10 Rural Distribution Project (RD) - Dak Lak province All will be handled fairly and will be guided by the related Agencies on the procedure of complaint and grievances. The complainants will be free of charge for complaint and grievances. The Central Power Network Project Management Unit and Local Authorities will be responsible for supervising the process of resettlement plan implementation. Besides, an independent consulting agency will be responsible for independent supervision. This agency will be chosen by the Project Management Unit or the Central Power Network Project Management Unit and will sign a contract after the resettlement plan had been approved and supervision activities shall be carried out since the stage of starting project implementation. This Independent Monitoring Agency will make report on the results of their supervising activities to World Bank. 6. Institutional Arrangements: The Project Management Unit of EVN will be responsible for managing the activities on guidelines of investment and communication between Local Authorities, Power Corporations, Provincial People's Committee and World Bank. The correlative Central Power Network Project Management Unit will support the Power Corporation appointed by EVN in carrying out the duty of constructing power network system, including resettlement implementation. 7. Implementation schedule: The process of implementing Resettlement Plan will be as follows: - Resettlement plan consideration and approval - Employing Independent Monitoring Agency - Detailed measurement survey : July 2011 : August 2011 : August Compensation payment and site clearance : December Independent and Internal monitoring: During the period of project implementation. - Commencement : June 2012 All activities of resettlement plan will be completed before World Bank had approved the contracts for sub-projects. Cost estimate The total cost estimate for compensation is about: 4,179,997,468 VND (or 203,902 USD). In Cost estimate for resettlement plan, there is also cost of inventory work, monitoring, management, independent and internal monitoring and 15% for contingency. The total cost estimate for the whole program is about: 5,112,506,575 VND (or 249,390 USD) (1USD~O.500VND). 9. Information disclosure The draft Resettlement plan will be publicly disseminated at the People's Committee of Dak Lak province and the Vietnamese Development Information Centre belonged to World Bank Office in Ha Noi. The Central Power Network Project Management Unit of Central Power Corporation (EVN CPC) will send the copies of the RP to host District/City, Ward/Commune. 12 Rural Distribution Project (RD) - Dak Lak province CHAPTER 1: INTRODUCTION 1.1. Policy framework The Rural Distribution project (RD) has a common policy framework of resettlement. This policy framework is based on World Bank's policy for involuntary resettlement (OP4.12) and State Law on Land Acquisition of the Government. The main objectives of the policy framework for compensation, resettlement and living standard restoration are to ensure that all project-affected households will be provided with compensation for their losses at the replacement price and the solutions of living standard restoration in order to improve, or at least, achieve full restoration of incomes and living standards to the pre-project levels. Also, the policy framework presents the principles, objectives, and regulation standard on displaced persons, as well as entitlements, legal policy framework, measures of compensation, life stability, characteristics of community participation and consultation and procedure of complaint and grievances in order to orient the compensation, resettlement and living standard restoration. Resettlement plan will be carried out based on this policy framework Objectives and suggestion: Objectives of resettlement plan are to define compensation and resettlement programs for the project on the basis of limiting as much as possible the number of project-affected households and assets. The program will present the articles for compensating and helping project-affected households in improving or at least preserving their living standards to the pre-project levels. Compensation and resettlement program is aimed at. mitigating the negative effects caused by the project and providing chances to project displaced persons for restoring their living conditions. Resettlement plan is carried o~t with displaced persons' participation and consultations. Resettlement plan is approved by Vietnamese Government and World Bank. To ensure that the objectives of project resettlement plan are met, the compensation price must be at the level of the market price or replacement one. Project Development Unit, Central Power Network Project Management Unit, Provincial People's Committee, Independent Monitoring Agency will be responsible for supervising and readjusting the price of compensation (If necessary) at the moment of carrying out the Resettlement Plan in order to ensure that the compensation price is equal to the replacement value Project component in Dak Lak province: - The Ea Kar - Krong Pak 110kV substation and line consists of: + Installation of 110kV line route of27,576 m long. + Expansion ofea Kar 110kV substation. + Construction of Krong PakiiO kv substation with the total capacity of 2x25MVA. 14 Rural Distribution Project (RD) - Dak Lak province CHAPTER 2: SOLUTIONS OF MITIGATING THE LOSSES 2.1. Solution of mitigating project impacts at the designing stage: Solutions of mitigating the impacts at the preparation stage are based on: a) The usage of appropriate designs; and b) The consultation organization in localities. The power network will be designed appropriately to mitigate the impacts to land, crops and avoid highly sensitive areas. The power line should be designed to avoid natural forests, residential areas, preserved areas and public projects. Also, it is designed to avoid to a minimum of getting across houses and other building projects. If getting across houses and structures, technical treatments should be considered so that the houses can be existed in the ROW. These measures will increase the safety and mitigate tree cutting and relocation. The line route is decided with the consultation of local inhabitants and Authorities. This work is carried out at the stage of establishing the investment. project. However, during the period of designing, the line route as well as the design can be readjusted to avoid houses and mitigate negative impacts. By consultation of local inhabitants, local authorities and line route correction, project's negative impacts will be mitigated Location of substation: The expanded position of Ea Kar llokv substation is constructed in the residential land of local households. However, these households moved out and this residential land is only used for fruit trees and industrial trees. The Krong Pak llokv substation is designed to locate on the land of perennial trees. The area of land acquisition does not have much impact on the total land area of this household. This substation is near th~ available traffic road. At least 2 to 3 alternatives for the substation's location should be prepared. 15 Rural Distribution Project (RD) - Dak Lak province preservation zone, and cultural heritage; and will not go in parallel with or nearby the communication system, gas area, arms depot, etc. In order to avoid or mitigate impacts, line route direction is selected to lie right in ROW along the available traffic-way, or crossing agricultural land, inhabited land or garden land. Some of line routes will be cornered from 30 to 60. However, if necessary, the rudder angle will be 90, the line route direction must cross the road many times so as to prevent impacts on houses and structures. Selected line location will be less than Han far from existing traffic-ways. Hence, existing traffic-ways will be used while the building of new roads is limited. For each project, at least 2 or 3 alternatives of line route directions should be considered and the optimal one will be chosen Technical solutions: The average distance between towers of the line route will be from 200m to 300m. The positions at bare land will be prior to set up towers. Selecting different dimensions for the foundations so that they will be suitable to the selected positions. Temporary foundation area will be 100m 2 for each tower foundation, 787m 2 for the expanded position of 11 OkV Ea Kar substation and 5,516m 2 for each substation. To mitigate the impacts, temporary access roads will be constructed at the area of ROW (along the road) Community participation and consultations: At the stage of project preparation, the Central Power Network Project Management Unit will cooperate with consultants to carry out the community participation and consultations with Local Inhabitants and Authorities in selecting substation location and line route direction. All valuable feedbacks from Local Inhabitants and Authorities were considered while designing Solution of mitigating project impacts at the implementation stage The best solution and organization for project implementation were already considered. For instance, the implementation will be started after the harvest time and completed before new cultivation crop. In order to reach these objectives, working in shift should be carried out in certain days to shorten the period of causing impacts by means of livelihoods, access to income sources. 16 Rural Distribution Project (RD) - Dak Lak province camps during implementation should be located in bare land or uncultivated public land near the office of People's Committee of communes, not in residential area. During the period of project preparation: Line route is decided with the consultation of Local inhabitants and Authorities. This is carried out at the stage of establishing the investment project. However, at the technical detail designing stage, line route as well as design project will be readjusted to avoid houses and mitigate impacts. By consultation of local inhabitants, local authorities and line route correction, project negative impacts will be mitigated. During the period of project implementation: There are 4 mitigation principles during the period of project implementation: 1) The site clearance should be done by manual equipment and all vegetation that is lower than required minimum height should be saved. 2) Completion of construction as fast as possible. 3) During the period of project construction, agricultural activities must be considered, for instance, construction should be carried out at the end of the harvest season and at the beginning of a new crops. 4) Finally, if it is necessary to build camps for workers, public unused land should be mobilized. According to the report, each commune has a certain amount of unused public land for camps and building materials storage yard. This will considerably mitigate the impacts on land and vegetation. During the period of operation: The maintenance and protection of line route are very necessary to ensure the minimum safety distance during the period of operation. On the other hand, trees growing higher than power lines must be cut down for safety Results achieved from the solutions of mitigating impacts At the stage of project preparation, at least 2 or 3 alternatives of line route directions as well as substation locations should be considered to choose the optimal one that causes the least impacts. The total affected landholding is 1, 172,862m 2 However, the project only affects 419,943 m 2, in which 17,103 m 2 will be pennanently acquired; accounting for 1.46% of the totalland area and 402,840 m 2 is temporarily acquired in the ROW. No impacts to business. No impacts to natural preservation zone, cultural heritage and Buddhist temples. In the sphere of impacts, losses are mostly inconsiderable; all affected households select to be compensated in cash at the replacement price. Resettlement arrangement is not necessary. On an average, each household loses 130m 2 for each tower substations, accounting for low percentage in the total area of agricultural and residential land; 02 households lose an area of 6,303m 2 to build substations (01 household suffers from land lost with an area of 787m 2 for the expansion of Ea Kar substation and 01 household loses agricultural land with an area of 5,516m 2 for the new installation of Krong Pak substation). Affected crops and trees consist of: 1) Standing crops and trees located in the expected area of tower foundations and substation; 2) All trees in the area of tower foundations and high trees in the corridor of power network. Those are the trees that their tops to conductors are less than 3m (when trees develop at the maximum height) and in the danger of touching conductors when they fall down. However, during implementation and site clearance m ROW, any affected tall trees will be compensated (30%/tree) It is noted that after project approval and before project implementation, a Detail Measurement Survey (DMS) will be carried out. During the period of DMS, it is necessary to adjust project-affected households and redefine the total numbers of affected trees. 27 Rural Distribution Project (RD) - Dak Lak province CHAPTER 4: SOCIO-ECONOMIC INFORMATION 4.1. Baseline information: This resettlement plan is based on the statistics of project displaced households for building the power network in Ea Kar District and Krong Pak District, Dak Lak province. The Central Power Network Project Management Unit of EVN CPC had cooperated with Local Authorities in counting up the affected land, assets and surveying the affected households from May 12th, 2011 to May 17 th, Land acquisition and resettlement requirements are calculated on the basis of detailed data of land use and design. Census and other detailed measurement survey are necessary during the project implementation to define precisely the projectaffected households. Hence, resettlement plan will be updated and current information will be reflected. The socio-economic survey on project-affected households is aimed at defining the characteristics of affected community, evaluating the population, houses' conditions, main economic activities and displaced persons' living standards, etc. Detailed interviews on resettlement plan of affected groups are carried out in order to collect data on: (i) demand of detailed resettlement of serious displaced peasants and vulnerable groups; (ii) concerns and selections of affected households, and (iii) solutions of mitigating the adverse impacts Natural features: Dak Lak province is located in the center of high land area. This land is famous for its coffee, rubber and festivals. Dak Lak lies in the longitude from l07 28'57"E and from 12 9'45" '06" N. It is adjacent to Gia Lai to the North, to Lam Dong province to the South, to Phu Yen and Khanh Hoa province to the East and to Cambodia and Dak Nong province to the West Terrain: The terrain here is large with a majority of area lies in the West of Truong Son range, lower from the South-East to the North-West. The rainy season is from May to Octorber, they dry season is from November to April of the following year. The average temperature is from C. The average rainfall is from 1,600mm to 1,800mm, suitable for many trees Natural resources and minerals: * Land resources: The total natural land area is km 2, among which is the grayish group, red bazan and others soil groups. The high homogeny of the natural and actual fertilization of the soil groups and soil types is very good for all types of trees. * Rivers and streams: Dak Lak province has a variety of rivers and streams system. There are two main river systems in the region: the Srepok and the Ba, hundreds of lakes and 833 streams of more than 10km long that create a dense river system for Dak Lak. * Forests: Dak Lak has a forest area of 608,886.2 ha, among which the natural one accounts for 594,488.9 ha, planted forest accounts for 14,397.3 ha. The forest coverage reaches 46.62%. Forests are equally allocated in every commune. The forests here are very rich and have many special trees that have both economic and scientific value. There are also many endangered species of animals that appear in the red book nationally and internationally. * Mineral resources: Dak Lak has a variety of mineral resources. There are many mineral fields with different capacity and many valuable minerals such as: kaolin clay, brick clay, gold, lead, phosphor, peat coals, gems, devitrified stones, building stones and sand, etc in the province Socio-economic features: Population: In 2009, the population of Dak Lak province is 1,728,380 people, among which the urban population accounts for 22.5%, the rest mainly live in rural area, accounting for 77.5%. The population in Dak Lak consists of 44 ethnic groups, among which the Kinh people account for 70%; the ethnic minorities such as Ede, M'nong, Thai, Tay, Nung accounts for nearly 30% of the total population. The ethnic minorities live in communes in the province, mainly in mountainous and remote communes.," Economy - Commerce - Tourism: Dak: Lak: is located in the center economic zone of the Vietnamese high land area. The province has a rapid economic development and has all the necessary conditions to become an industrial province in The economic agriculture here basically turns into the commodity economy, planting and breeding develops quickly that improve the local benefits. Industrial production and small industry develop quickly. GDP in 2010 reach 12,813 billion VND, increasing 12.2% in comparison to 2009, in which: - Agriculture-Forestry-Aqua culture is expected to reach 6,367 billion VND, increasing 5.1% in comparison to 2009 (expected to increase 5-6%); - Industry-construction is expected to reach 2,253 billion VND, increasing 19% (expected to increase 28-30%); Industry is expected to reach 1,699 billion VND, increasing 20% (expected to increase 22-23%, about 1,710 billion VND) - Services reach 4,193 billion VND, increasing 20.8% (expected to increase %). Economic structure (at current price): Agriculture-forestry-aqua culture: 53.2%; Industry-construction: 18.4%; services: 28.4% In tourism, in 2010, the total number of tourists reaches 200,000 trips, accounting for 54.14%, increasing 11.73% in comparison to the same period in 2009, among which international tourists reach 18,500 trips, domestic tourists reach 181,570 trips. Develop economy, ensure social fairness, protect the environment and enhance the mental and spiritual life for the local people". Invest in infrastructure. This is the basic factor that creates premise for the developing process and also is the crucial point of the development and scheming progress in the next years * Goal until 2020: - The specific economic goal until 2020 is to increase the total GDP 3.03 times more than that of2010, the average income per capita reaching million VND. Try to reach the speed of economic development at about 12.5%-l3% in the period of , in which: Industry and construction increase 19-20%; agriculture and forestry reaches 4.4%-4.5%; services reach l3-14%. - The social goal is to reduce the percentage of natural population increase in 2020 down to 1.1 %, appropriately solve the social issues: no poor household in 2020, reduce the percentage of malnutrition children down to 15%, increase the percentage of HHs with power supply up to 100%; ensure 100% clean water for local people. - Environmental goal: Planting trees on bare land, increase the percentage of forest coverage up to 54%. Krong Pak district is adjacent to Buon Ma Thuoc to the West, to eu M'gar district to the North-West, to Buon Ho district to the North, to Ea Kar to the East, to Krong Bong district to the South-East. In 2010, the economic development of the commune reaches 8.3%, in which agriculture and forestry production increases 6%, industry and small industry increases 12.2%, services and commerce is approximately 7%. Legal framework: The World Bank's policy on Involuntary Resettlement (OP 4.12) and Vietnamese laws about clearance and compensation will be applied Policies and Legal framework of Vietnamese Government: Policies and Legal framework of Government: - The 2003 Land Law enacted by National Assembly of Vietnam on November 26 th, 2003; - Decree No ND-CP issued on October 29 th, 2004 guiding the implementation of the Land Law. - Decree No 197/20041ND-CP issued on December 3 rd, 2004 on compensation, support and resettlement when land is recovered by the state. This Decree guides the implementation of compensation for land, compensation for assets, support policies and resettlement relating to land acquisition. - Circular NO 116/2004m-BTC, issued on December 7 th, 2004 by the Ministry of Finance provides guidelines to implement the Decree NO 197/20041ND CPo - Decree No 188/20041ND-CP issued by Government of Vietnam on November 16 th, 2004 on methods to determine land prices for different types of land. This Decree set forth the minimum and maximum prices of different types and categories of land covering the whole country. These prices are established for the purpose of land acquisition by the Government, tax value for transfer of land use rights, tax for leasing government land and public purposes. - Decree 84/20071ND-CP issued on 2515/2007 by Government regulating on granting additional land use right certificates, land acquisition, implementation of land use rights, procedures of compensation, assistance and resettlement when the Government acquisition the land and solve land claims. - Circular No 114/2004m-BTC issued on November 26 th, 2004 by the Ministry of Finance guiding the implementation of the Government's decree NO 188. 36 Rural Distribution Project (RD) - Dak Lak province produce on land when land acquisition in Dak Lak being carried out by the Government. The price of land is calculated based on the average price of free market. Under free market, land prices between cities, zones in the same district, between front roads and rear ones are different from one another. This point contributed to defining the price framework for the right of land use and compensation for land that is acquired by State and also defining framework of organization for defining own framework of land price which is within the common price framework of the whole country. With the price framework of the region, People's Committee of province/city has the right of applying adjustment coefficient. People's Committee of Districts, People's Committee of communes is responsible for defining the area of affected land and affected structures as well as eligibility to compensation payment. Some essential contents in Policies and Legal framework of Vietnamese Government: The 2003 Land Law enacted by National Assembly of Vietnam on November 26 th, 2003, provides that: "the persons with land to be recovered shall be compensated with the assignment of new land of the same use purposes; if having no land for compensation, shall be compensated with the land use that is equivalent to the value at the time of recovery. Provincial People's Committees and Centrallyrun Cities shall elaborate and execute resettlement projects before the land recovery for compensations with dwelling houses, residential land for persons having residential land recovered and having to move their places of residence. The resettlement zones must have development conditions being equal to or better than the conditions in the former places of residence. In cases of having no resettlement zones, the persons having land recovered shall be compensated with money and given priority to purchase or lease dwelling houses under the State's ownership, for urban areas; be compensated with residential land, for rural areas. The infrastructure condition in resettlement area has to be equivalent to or better than the condition in previous places. In case there is no land for resettlement, people who sufffer from land acquisition will be compensated in cash and be prior to buy State's houses in urban area, compensated by residential land in rural areas. 37 Rural Distribution Project (RD) - Dak Lak province land of households and/or individuals, that is directly engaged in production, but having no land for compensation for continued production Guideline OP 4.12 of World Bank According to OP 4.12 guideline of World Bank on Involuntary Resettlement, all the project affected persons (PAP's) who lose property will be compensated in replacement price and will be provided with restoring methods to help them improve or at least remain their living standards and incomes to the pre-project level. The acquisition of land and other assets, and resettlement will be minimized to possible extent. All project affected households that are listed in the inventory tables will be compensated for their affected assets. Individual project affected households encroaching on the areas after the cut-off date will be considered to be illegal and not to be compensated. In accordance with the OP 4.12 guideline of World Bank, compensation price will be at replacement price for land, houses, trees; and market price for crops. According to WB policies, measures required to ensure that resettlement will have positive results include: Consulting with potential DPs on feasible measures for resettlement and rehabilitation; Providing DPs with options for resettlement and rehabilitation; Enabling their participation in planning and selecting these options; Providing compensation at replacement cost for losses; Choosing resettlement site that ensure benefits and services as the replaced sites. 38 Rural Distribution Project (RD) - Dak Lak province In order to meet the requirements of the World Bank's OP 4.12 on Involuntary Resettlement, some articles in various Vietnamese laws and regulations which do not ensure compensation at replacement cost or articles about legal rights but no recovery or assistance to households without proper land paper, will be waived. The articles of law and regulations that will be waived are mentioned below: Eligibility for compensation and! or assistance - Decree 197 and 69 Article 7 of Decree 197 (in case of land being recovered without compensation) stipulates that any person whose land is recovered and who has not meet one of the conditions of Article 8 of this Decree, or who violates the land, or who violates the protection corridor, or who illegally occupies land, shall not receive compensation when the state recovers the land. In case of necessity, the Provincial People's Committee shall consider and decide on a case-by-case baseline. Articles 18, 19 and 20 of Decree 197 and Article 24 of Decree 69: Houses and structures on non-compensated land that are eligible to land compensation without violating land in ROW will be assisted at 80% of replacement cost. Houses and structures on non-eligible-for-compensation land, which do not violates land or land in ROW will not be assisted. If necessary, the Provincial People's Committee will consider specific cases. Articles 20 and 22 of Decree 69: Project displaced persons who lose more than 30% of productive land will be entitled to living stabilization and job training. To ensure that the objectives of this resettlement policy are met, a special decision of the Government waiving Articles 7, 18, 20, 28, 29 of Decree 197 is needed to allow assistance and rehabilitation measures for illegal users of land as proposed in the policy. Land price for Calculation of Compensation Article 9 of Decree 197: The compensation rates for land are determined by the Provincial People's Committee for the type of land use at the time of land acquisition. Assistance Policy for DPs who rent State-owned dwelling houses - Decree 197 Article 21 of Decree 197/20041ND-CP states that DPs who rent State-owned dwelling houses shall be provided with monetary supports equal to 60% of the land value and 60% of the value of currently rented houses, in cases of no resettlement houses to be arranged for them. Government commitment: To ensure that the objectives of the policy are met, a special decision of the Government of Vietnam regarding waiver of Article 21 of Decree 197/20041ND-CP is needed to permit assistance and rehabilitation measures for DPs who rent Stateowned dwelling houses as proposed in this policy. Article 2 of Decree 188/20041ND-CP on December 16 t h, 2004 states that the land price shall be defmed by People's Committees of Province/City to meet the replacement costs. Item 4, Article 2 of Decree ND-CP on November 09, 2006 guiding on the ada management stipulates that "in the case of the international agreements on ada have been signed between Vietnamese Government and sponsors stipulates other contents, then that international agreements will be followed", Government of Vietnam and World Bank Approaches There are various ways of the Vietnam Government approaches- either in policy or practice - that are compatible with World Bank guidelines. The most important compatibilities are:,/ Vietnam makes it possible for compensation for people without legal land rights but able to meet conditions of land legalization../' Permanent residents are provided with options that include relocation to a better site, or cash, or both../' Resettlement sites offer not only better improved infrastructure and services but represent higher living standard. 40 Rural Distribution Project (RD) - Dak Lak province./ Supports are provided to help the DPs in the transition period and there is an institutional structure through which people are informed and thanks to it, they can negotiate the compensation and express their disagreement, if any../ For the DPs which are not entitled to compensation, the Government will have proper support policies which are in consintence with the WB' s policies in order to assist people to recover their living. Differences between the approaches and measures that need to be addressed within the program also exist. However, procedures exist within national and City governments that allow the granting of waivers of domestic law on specific projects that may be in conflict with that of the funding agency../ On the issue of land tenure and the legal right to compensation, the Vietnamese Government and World Bank approaches are compatible. The Vietnamese government has its own process in place whereby land occupied without legal documentation can be legalized; this land, however, is compensated for at a rate equal to 100% of land price minus the taxes and fee for land use right registration after October 15th / According to Article 14 of Decree 69/2009/ND-CP on 13 August 2009, any person whose land is recovered shall receive compensation by providing new land with the same used purposes at the time of land acquisition in accordance with current regulations. If there is no land for compensation, compensation in cash with equivalent value of the value of land use right at the time of acquirement in accordance with current rules and regulations. In case of compensation by new land or house allotment, if there are any differences of value, they will be payable in cash The definition of eligibility and limit of compensation: Persons are displaced by project are: a) persons whose residential, garden or agricultural land is affected in part or in total (permanently or temporarily) by the project; b) Persons whose crops (annual and perennial) and trees are affected in part or in total by the Project. c) persons whose houses are affected in part or III total (temporarily or permanently) by the project; RP project report: The Ea Kar- Krong Pak 1 JOkV line and Krong Pak J 10kV substation- June 20/1 38

41 Rural Distribution Project (RD) - Dak Lak province d) persons whose businesses are affected in part or in total (temporarily or permanently) by the project Resettlement and compensation principles: The basic principles and objectives outlined in the World Bank's OP 4.12 will be approved in preparing this Policy Framework. The following principles and objectives will be applied: - Acquisition of land and other assets, and resettlement will be minimized as much as possible. - All DP's residing, working, doing business or cultivating land in ROW of transmission line (TIL), surrounding areas of tower foundation, the substation areas, in the service roads under the project on the date of the baseline surveys are entitled to be provided with rehabilitation measures sufficient to assist them to improve, or at least maintain their pre-project living standards and income earning capacity and production levels. Lack of/ega/ rights to the assets lost does not prevent the DPs (rom entitlement to rehabilitation of living standards. (c) The rehabilitation measures to be provided are: (i) compensation at replacement cost, without depreciation or salvage materials for houses and other structures; (ii) agricultural land with equal productive capacity acceptable to the DPs or being paid in cash according to DP's demand; (iii) replacement of residential, garden land of equal size acceptable to the DP or being compensated in cash according to DP's choice; and (iv) transfer and subsistence costs. Implementation should ensure effective and timely design, planning, consultation and implementation of DPs. Effective and timely Supervision, monitoring and evaluation of the implementation for DPs will be carried out. Besides, the project displaced persons eligible for compensation are all the project affected households or institutions whose occupations and/or business and income sources are impacted as the result of permanent or temporary acquisition of land or other assets. The cut-off date is the last day of the population survey (May 17 th, 2011). The project displace persons eligible for legal right includes: (a) those who have formal legal rights to land or other assets; (b) those who initially do not have formal legal rights to land or other assets but have a claim to legal rights based upon the laws of the country; upon the possession of documents such as land tax receipts and residence certificates; or upon the permission of local authorities to occupy or use the project affected plots; and (c) those who have no recognizable legal right or claim to the land they are occupying. Persons covered under (a) and (b) are provided compensation for the land and other assets they lose, and other assistance. Persons covered under (c) are provided with resettlement assistance, in lieu of compensation for the land they occupy, and other assistance, if necessary, to achieve the objectives set out in this policy, if they occupy the project area prior to a cut-off dates defined in RPs. Persons who encroach on the areas after the cut-off date defined in RPs are not entitled to compensation or any other form of resettlement assistance. Such regulations are applied for those whose incomes are impacted by the project Compensation policy: Displaced persons will be entitled to the following types of rehabilitation and assistance measures, such as: DPs that lose agricultural, productive lanel crops and trees: If the portion of the land to be lost represents 10% compared with the cultivation land, and the remaining land is still viable for economic value, DPs can receive compensation is cash for the acquired area. 43 Rural Distribution Project (RD) - Dak Lak province acquire the entire landholding and provide "land for land" arrangements of equal productive capacity, satisfactory to the project displaced persons. However, if the DPs prefer to receive cash instead of land, then cash compensation at replacement cost is applied. DPs will be compensated for the loss of crops at market price, and productive trees will be compensated at replacement cost. DPs whose land is temporarily taken by the works under the project will be compensated for the loss of income, crops and for the cost of soil restoration and damaged infrastructure. Temporary land acquisition will be rehabilitated by Construction unit and CPNPMB after project construction. DPs that lose residential land and house/structure: The mechanism for compensating loss of residential land and structures will be: (1) Cash compensation at replacement cost for the residential land that is only marginally affected and the remaining areas are still economically viable. (2) Provision of residential land or cash compensation according to the DPs' choice, if the remaining areas are not sufficient for reorganizing DPs' houses. (3) Cash compensation at replacement cost of the house/structures, without deduction for depreciation or salvage materials or compensation according to DPs' choice. (4) If residential land is only partially being affected by the project and the remaining areas are not sufficient for reorganizing DP's house then at the request of the DPs, the entire residential land will be acquired at replacement cost in the form of "land for land" that is satisfactory to the DPs or cash compensation according to the DPs' choice. (5) If houses and other structure are only partially being affected by the project and the remaining areas are not viable for economic use, the entire houses and structure will be acquired at replacement cost, without depreciation. Tenants, who have leased a house for residential purpose, will be provided with a cash grant of three months rental fee at the prevailing market price rate in the area, and will be assisted in identifying alternative accommodation. 44 Rural Distribution Project (RD) - Dak Lak province The mechanism for compensating loss of business will be: (1) the provision of alternative business site of equal size and accessibility to customers, satisfactory to the DPs; (2) cash compensation for lost business structure at replacement cost of the structures, without depreciation; and (3) cash compensation for the loss of income during the transition period; DP's will also be provided with compensation at replacement cost, without deduction of salvage materials for any other fixed assets affected in part or in total by the project, such as tombs and wells. In cases where community infrastructure such as schools, factories, system of water supply, roads, damaged sewage systems, Provincial People's Committee and EVN will ensure that these would be restored or repaired as the case and at no cost to the community. Subsidies/allowances: Besides the direct compensation for the losses, DPs will also be entitled to remove households and receive additional assistance (subsidies/allowances) as stated in Decree 197 of Government. These allowances are as below: (i) Transportation assistance: - All DPs relocating -within the province are entitled to a minimum allowance of 4 million VND and maximum of 6 million VND. All DPs relocating out of the province are entitled to a minimum allowance of 8 million VND. This subsidy allowance is for the transportation of their salvageable materials and living_ facilities. While waiting for new houses at resettlement area, DPs will be entitled to: (i) temporary accommodation, or (ii) subsidies for temporary house rent. (U) Subsistence allowance for resettlement: All relocating DPs who do not set up new residence will be entitled to temporary accommodation or subsidized temporary house rent. Minimum assistance level is 1 million VND/ household and maximum of 1,500,000 VNDlhousehold in a period of 4 months counting from hand-over of field land. (iii) Restoration allowance: DPs, who are permanently affected more than 10% of productive land or incomes, or have to relocate, will be entitled to attend training or other economic restoration RP project report: The Ea Kar - Krong Pak llokv line and Krong Pak llokv substation- June

45 Rural Distribution Project (RD) - Dak Lak province programs at about 300,000 VND for each mouths/month, maximum allowance in 36 months for each month. (iv) Relocation bonus: DPs that dismantle their houses in accordance with the resettlement schedule of will get a maximum bonus of 1 million VNDlhousehold Classification of impacts and Entitlement policy: There are two main impacts on the resettlement: Temporary impacts: Those whose productive land, crops, trees and house structures that are in the ROW, around the tower foundations, on the temporary access roads are only temporarily affected at the stage of project construction. Group 1: Those whose land and garden used for profitable purposes acquired temporarily at the stage of project construction. Group 2: Those whose trees and crops are temporarily affected at the stage of executing, building temporary access roads or stretching conductors Permanent impacts: All the owners whose land and assets are permanently acquired for the purpose of execution and project maintenance, including tower foundations, area of substation, permanent road for the project and those whose auxiliary construction or high trees are in the ROW must be taken down or cut down. Impacts on residential, garden, agricultural land.and land in the ROW that are used for other purposes will be considered temporary impact, if can be, they will be used again with limited purposes. Group 3: All the owners whose productive land, residential land, garden land and land used for the other purposes are permanently acquired for the purpose of temporary access roads and project maintenance. Displaced persons who suffer from the permanent loss of land will be divided into four groups: For the productive land/agriculture: The area of acquired land is more than 10%. The rest land is equal or more than 60 m 2 (in the city) and 100 m 2 (in the countryside). Group 4: Those whose house structures are partially affected and this part does not impact the safety or using purpose of the whole structure (the part of taking down is under 10% of the area) and the lost part of the house can be able to rebuild nearby and also on the old part of land. Impacts on the residential land clearance that is in ROW will be considered to be temporary because it can be reused with the limited purposes. Group 5: Those whose houses are partially or wholly affected and these impact the safety or using purpose of the whole house structure (the part of taking down is more than 10% or even under 10% of the area, but the rest part can not be in use or inconvenient for usage), therefore, the house will be transferred and rebuilt nearby and also on the old part of land. Impacts on residential land clearance will be considered to be temporary because it can be reused with the limited purposes. Group 6: Those whose house structures are partially or wholly affected and these parts impact the safety or using purpose of the whole structures and therefore, the house will be wholly transferred and rebuilt. However, the land owners haven't got enough land to rebuild a new house that has the same area of the old one. The residential land that is enough to rebuild a new house must be at least 60 m 2 (in the city) and 100 m 2 (in the countryside). Group 7: Those whose business are affected Temporary impacts on business. Permanent impacts on business. EVN is the investment unit for the medium and lower voltage grid. Both EVN and Dak Lak Provincial People's Committee are responsible for project implementation, including the implementation of RPs. Implementing Agencies closely co-ordinate with Local Authorities to ensure effective and easy implementation of RPs to avoid delay during implementation Institutional Arrangements EVN is responsible for the construction of power grids. Functions, competencies and responsibilities In order to implement successfully the Resettlement plan, the closing coordination between Electricity of Vietnam, Central Power Corporation, Local Authorities, Central Power Network Project Management Board and other Executive Agencies is required. One or two teams from Power Network Project Management Unit of Central Power Corporation who undertakes the resettlement will generally regulate all resettlement activities with the assistance of consultant staffs EVN: Electricity of Vietnam is a common regulation unit. EVN will establish a National Steering Committee to call, if necessary, any member to discuss about the common problems that impact the project implementation. This Steering Committee consists of one high-level officer of the Ministry of Industry and Commerce or Electricity of Vietnam who will be the Chairman and Power Services as well as the host provinces will be the members. The specific tasks of resettlement are quickly in presenting the solutions of resettlement problems for host provinces Central Power Corporation of Electricity of Vietnam - EVN CPC EVN CPC will be responsible for resettlement activities as follows: + Collect and classify the reports on the process of land acquisition and resettlement for EVN and World Bank. The approved resettlement plans of host provinces will be sent to World Bank. Collect and classify the final balance-sheet of project and review the project audit. + Recruit and supervise the consultancy, including external independent organizations in supervising the resettlement. + Assist Project Implementation Units, Central Power Network Project Management Unit with training courses on resettlement work for carrying out detailed measurement survey and other activities in resettlement plan. Its main responsibilities are: + Establishing implementation plan, managing and supervising project resettlement program. + Updating the information for project resettlement plan. Implementing and co-ordinate with Local Authorities in carrying out project resettlement activities. + Unifying the construction with land requisition and project resettlement activities. + Speeding up information campaigns, including information documents for the community, consultations of displaced persons in accordance with the project guidance. This work consists of responsibilities on exchange letters, forms of applications and requests and other necessary concerned documents. Cocoordinating with Local Authorities to hold the meeting with community, detailed measurement survey and inventory forms of displaced persons' entitlements. + Co-coordinating with other services for implementing sufficiently project resettlement plan in accordance with the principles and objectives of World Bank. Ensuring the right implementation of restorative solutions and other supported activities. + Presenting institution of compensation payment and expenditure payment for resettlement. Preparing necessary and concerned documents. + Supervising, checking compensation payment, land requisition and site clearance. + Ensure to pay compensation in time. + Carrying out the work of accountancy and audit when implementing the resettlement. +Reporting regularly to EVN and WB on the construction progress and activities of resettlement plan Provincial People's Committee: Dak Lak Provincial People's Committee will be responsible for resettlement policy implementation that approved by the Prime Minister, satisfying the RP project report: The Ea Kar - Krong Pak J JOkV line and Krong Pak} JOkV substation- June 10J J 47

Provincial People's Committee is also the one of highest administrative organ who is responsible for supervising project resettlement plan and presenting decisions that concern project resettlement program such as ratio of compensation and assistance for displaced persons. Entrusting Executive Agencies with work of resettlement plan for implementing the project. After having detail design, numbers of displaced persons and affected assets will be reviewed basing on detail measurement survey. The unit price of compensation and all the assistance for displaced persons and affected assets will be updated. Provincial People's Committee is responsible for conducting and supervising resettlement plan implementation, including the presentation of solutions on displaced persons' or Local Authorities' complaint and grievances Natural Resources and Environmental Service, Industry Commerce Service, Natural resources and Environmental Department, Agriculture and Rural Development Department belongs to District People's Committees: The Provincial Natural Resources and Environmental Service is responsible for studying and putting forward the unit price of compensation to Provincial People's Committee. When starting resettlement plan implementation, Natural Resources and Environmental Service co-ordinates with Industry-Commerce Service, Natural resources and Environment department, Agriculture and Rural Development Department of District People's Committees and Independent Monitoring Unit for defining types of soil, specifying the unit price of resettlement plan as well as for putting forward to Provincial People's Committee to adjust, if necessary, in order to ensure that the unit price of compensation is in accordance with the replacement price at the timing date of payment for resettlement activities to be carried out easily People's Committee of District People's Committee of District is responsible for defining land and structures, appointing members to coordinate with Central Power Network Project Management Unit in RP implementation. Members of these Units consist of Chainnan/vice Chainnan of District People's Committee who will be the chairman; representatives of District Departments such as: Construction department, Financial~Planning Department, Natural Resources and Environment Department, City Management Department, members of mass organizations, representatives of displaced persons and other members. For this project, District compensative, assistant and resettlement Council assists and c~ordinates (if necessary) with Central Power Network Project Management Board in carrying out the following tasks: + Participate in making plan of implementation for all resettlement activities. + Participate in infonning project infonnation to displaced persons and in consulting the community in accordance with the project guidance. + Co-ordinate with Central Power Network Project Management Unit in carrying out detail measurement survey, making plans for compensation and resettlement assistance, applying the unit price of compensation to the loss of assets, completing inventory fonns of displaced persons' compensation and payment. + Appointing inspectors for handling the complaint and grievances on resettlement policies and the eligibility to compensation. + Paying attention to the special groups of people (ethnic minority groups) or vulnerable people (children, old people, the single father or single mother households). + Co-coordinating closely with external monitoring organizations Commune People's Committee: Commune People's Committee is responsible for: + Contributing to the census and inventory. + In coordination with Power Network Project Management Unit, holding meeting with the community, announcing infonnation, carrying out detail measurement survey, setting up a file of compensation, paying the compensation/assistance for displaced persons. The information file on resettlement program will be prepared by the Central Power Network Project Management Unit and will be guided to displaced persons or informed at the consultant meeting with displaced persons at the communes, districts and will be advertised at community places such as at administrative headquarters of Town, Culture - Information Centre, market, etc. Information to displaced persons will be carried out right after the Government of Vietnam and WB have approved the project. The information file on resettlement program consists of: (i) The project data. (ii) Project impacts and compensation policies. (iii) Eligibility to compensation and resettlement. (iv) Implementation arrangements of compensation and resettlement. (v) Responsibilities of related partners for implementation of resettlement plan. (vi) Settlement of complaint and grievances Compensation schedule Compensation payment for agricultural land, trees, crops and all other assistance must be carried out one month after the date of land acquisition as latest. Compensation payment for residential land and house structures must be carried out three months after the date of land acquisition as latest. Activity 1: Establishing the action staff After the approval of WB on the fmancing, the Central Power Network Project Management Unit of EVN CPC will develop the project. The Central Power Network Project Management Unit will establish the staff who are in charge of project RP implementation and will divide the resettlement work into daily activities for the parts of building high voltage network and substations. Activity 2: Employing the independent monitoring agency The Central Power Network Project Management Unit ofevn CPC will employ an agency with qualified qualifications on social sciences or human civilization for monitoring the whole project. Activity 3: Arrangement of budget for resettlement implementation Central Power Network Project Management Unit of EVN CPC is responsible for preparing sufficient resettlement budget in order to carry out the implementation of compensation, removal and resettlement. Activity 4: Training the staff in charge of resettlement EVN coordinates with WB in holding training courses for the staff of Power Corporations and Central Power Network Project Management Unit who are in charge of project resettlement work in order to giving them guidance for implementation of the project resettlement plan. Activity 5: Campaign on information distribution on the project After project approval, Central; Power Network Project Management Unit of EVN CPC will supply Local Authorities with detailed information of project and implementation schedule. During the first months of project implementation, Central Power Network Project Management Unit of EVN CPC coordinates with Local Authorities in carrying out an information campaign on the project at all project communes in order to announce the project impacts, plan and activities to displaced persons and communities. Activity 6: Census, inventory and evaluation of losses Central Power Network Project Management Unit coordinates with District Resettlement Committee and Local Authorities to cany out the detailed measurement survey (DMS) on affected land and assets and socio-economic situations of affected households. With the detailed measurement survey (DMS), the Independent Monitoring Agency and the related Services will define the unit price applying for resettlement plan and present to Provincial People's Committee to adjust, if necessary, in order to ensure that the unit price of compensation is in accordance with the replacement price at the timing date of implementing the resettlement plan. Activity 7: Definition of displaced persons' entitlements and measures of compensation The results of detail measurement survey is the basis of defining displaced persons' entitlements and applying unit price of compensation for affected assets as well as solutions of resettlement assistance and the choice of compensation measures. Activity 8: Consulting displaced persons on compensation measures Central Power Network Project Management Unit will supply displaced persons with the consultation questionnaires on the measures of compensation at the meeting of community consultation, agree on the measures of compensation and handle the complaint and grievances concerning to their entitlements. Activity 9: Preparation for recovery of living standard Beside compensation, the serious affected households are also supplied with the recovery program to recover or improve living conditions. When carrying out the compensation, Central Power Network Project Management Unit coordinates with Local Authorities and related Organizations in preparing the program of restoration and assistance for the serious displaced persons. Consulting displaced persons on the difficulties, demands and entitlements of the region and presenting the prior solutions. d. The prior solutions consist of: 1. Preparing the objectives of solutions. 2. Reviewing the program which was and being carried out in the region. 3. Consulting displaced persons and presenting the list of program participants. 4. The results of consulting Local Authorities, Training Centre and Departments that relate to the program. S. Anticipating the program. 6. Implementation arrangements. 7. Costs and budget. 8. Supervision and evaluation. Activity 10: Compensation payment and assistance implementation Central Power Network Project Management Unit of EVN CPC coordinates with District compensation and resettlement Council, with the assistance of Local Authorities will pay compensation for displaced persons. Displaced persons who lost more than 10% of productive land or income will be supported with living standard recovery. They will be supplied with training courses on agriculture, breeding or other program. These programs will be organized by Central Power Network Project Management Unit of EVN CPC during the period of resettlement plan implementation. These programs are based on the results of consulting with Local Authorities and displaced persons, and also consider the capacity of providing jobs after training courses. Activity 11: Supervision and evaluation. During the period of project implementation, Central Power Network Project Management Unit of EVN CPC and Independent Monitoring Agency will examine/supervise all activities of project resettlement implementation and program of living standard recovery. Budget CHAPTER 8: COSTS AND BUDGET Budget for resettlement plan implementation will be from EVN CPC counterpart fund Compensation cost estimate: Compensation Cost estimate for the permanent and temporary loss of houses, structures, agricultural, forestry and cultivated land, trees, crops are based on: Decree ND CP issued on October 29 t h, 2004 guiding the implementation of the Land Law.. Decree 197/2004fND-CP issued by Government of Vietnam on December 3 rd, 2004, on compensation, support and resettlement when land is recovered by the State. This Decree guides the implementation of compensation for land and assets, as well as the policies assistance and resettlement relating to land acquisition. - Circular No 116/2004ill-BTC on December 7 th, 2004 by the Ministry of Finance provides guidelines to implement the Decree I 97/20041ND-CP. - Decree 188/20041NP-CP issued by Government of Vietnam on November 16 th, 2004 about the methodologies for defining land prices and land price framework of various categories of land. This Decree set forth the minimum and maximum prices of different types and categories of land covering the whole country. These prices have been established for the purpose of land acquisition by the Government, tax value for transfer of land use rights, leasing government land and national and public purposes. - Decree fND-CP Regulation on May 25 th 2007, granting additional land use right certificates, land acquisition, implementation of land use rights, procedures of compensation, assistance and resettlement when the land acquisition and settlement of land claims are carried out by State - Circular No 114/2004ill-BTC issued by the Ministry of Finance on November 26 th, 2004 guiding the implementation of Decree No 118. Therefore, when implementing the resettlement plan, compensation price for losses must be updated to ensure that displaced persons are compensated and supported sufficiently Cost estimate: i) Cost estimate for resettlement plan consists of: Preparation work: + All official work such as investigation, design, preparation of sample survey. + Survey work: census and inventory, socio-economic survey. The survey work shall be carried out in two stages: preliminary stage (preparation of resettlement plan) and detailed measurement survey (at the first stage of project implementation and resettlement plan). ii) Costs for compensation and living standard recovery Based on the affected categories and affected rate as stated in previous chapters, costs for compensation and living standard restoration consist of: Compensation to pennanent land acquisition. Compensation to affected trees, standing crops because of temporary or pennanent losses of land. Assistance of living standard restoration for the peasants who lost more than 10% of land area. Assistance of residential land and structures in ROW. iii) Costs for operation/management consist of: Costs for the staves of Central Power Network Project Management Board of EVN CPC, the local authorities consist of: material facilities, salary and assistance for management arrangements, the staffs who are in charg~ of full time or part time resettlement. Costs for training, seminar, infonnation campaign, etc. The management cost has not been listed in details yet. Because the cost of supervision has not yet standardized by the government regulations, it is expected that this will account for 3% of total compensation costs. Independent Monitoring Agencies being interested in the project will prepare the documents of technology and finance for bidding, the actual cost will be defmed by Independent Monitoring Agency who is awarded of contract. v) Arising costs/contingency According to previous project's experiences, arising cost is occupied about 15% of total cost of compensation and resettlement plan preparation. Objectives of community participation and consultation The infonnation and community participation and consultation are aimed at: (i) limiting the possibility of conflicts, (ii) mitigating the risk of delaying the project, and (iii) allowing the project to present the resettlement and restored program in accordance with the demand of displaced persons, therefore, highly exploiting the project's socio-economic benefits. Objectives of infonnation campaign and community participation and consultation are: - Sharing the whole infonnation of the project as well as the project's activities with displaced persons. - Gathering infonnation of displaced persons' demands and their feedbacks for the policies and project activities. - Looking for the coordination and participation of displaced persons and community for the plan establishment and resettlement implementation. - Ensuring the obviousness in all activities that related to land acquisition, resettlement and restoration. This draft will be submitted to the secretariat of Provincial People's Committee and the WB Office in Vietnam. All the feedbacks from Local Authorities and concerned Departments will be brought into the resettlement plan. Stage 2: During the period of resettlement plan implementation In this stage, consultations will be organized in each commune. Implementation of resettlement activities and rehabilitation including the policies of resettlement, entitlement calculation and compensation payment, last approval for displaced persons' options on the measures of compensation, training, etc Community participation and consultation at the stage of resettlement plan establishment and preparation During the first stage, (preparation of resettlement plan), the following activities will be carried out: Stage 1- Activity 1: Inform and discuss with Local Authorities on the line route direction After studying the map and visiting the site, the Consultancy Unit, Central Power Network Project Management Board of EVN CPC formed the preliminary line route direction on the map of ratio 1125,000. This map will be sent to Local Authorities where there are lines passing through. Local Authorities agreed with the line route direction. These activities were carried out in March Stage 1- Activity 2: Inventory of losses Based on the approval of line route direction, the survey teams, Central Power Network Project Management Board co-ordinates with Commune Authority in making the list of displaced persons whose land and assets are impacted as well as carrying out the survey on socio-economic situation of affected households. The consultations were carried out in all host communes in May At these periods of consultations, the Consultants informs the project, objectives of the project, activities of the project, impacts of the project on land, crops and other assets, explain the objectives of RP, inform the policies of compensation and the displaced persons not to build new structures or not to plant trees in affected area. All affected households will be consulted about compensation policies and the majority agrees with payment in cash for losses of land and assets due to small areas of impact. All consulted households support the project construction and are ready to suffer losses of project development. They are desired to be informed about the project implementation schedule as soon as possible. 71 Rural Distribution Project (RD) - Dak Lak province co-ordinates with Local Authorities to hold a meeting in each commune for clarifying thoroughly the policy of resettlement plan for displaced persons. In these meetings, displaced persons will raise their queries on the possible problems of resettlement plan. Stage 2 - Activity 3: Consulting with displaced persons on compensation After having receiving the data of the project losses of assets, Central Power Network Project Management Unit and Commune People's Committee will announce the unit price of compensation for all categories of impacted assets in accordance with the regulations of Provincial People's Committee to displaced persons. The price list of compensation will be put up at the headquarters of Commune People's Committee. At the meeting, displaced persons can express their opinions on the compensation price. DP's objections will be noted down for consideration. Displaced persons who agree with the compensation price will sign their names in compensation inventory. 73 Rural Distribution Project (RD) - Dak Lak province CHAPTER 10: COMPLAINT AND GRIEVANCES To ensure that all complaint and grievances of displaced persons on compensation and resettlement will be handled, the project brought out the procedure of handling complaint and grievances with an objective of quickly and clearly handling the complaint and grievances of displaced persons. When complaint and grievances are handled, the progress of the project will be more reliable. The procedures of complaint and grievances are as follows: Stage 1: The complaint and grievances of displaced persons on resettlement program and discounted losses, first of all, must be reported to the Commune People's Committee in oral or by writing. In case of oral, the complaint and grievances will be written down and treated by Commune People's Committee, who will be responsible for resolving the issue within fifteen days from the date it receives the complaint. Stage 2: If any aggrieved person is not satisfied with the decision or does not receive any replies from Commune People's Committee within 15 days from the date of bringing out the complaint and grievances, displaced persons can bring the complaint and grievances to the District People's Committee and the Central Power Network Project Management Board. District People's Committee and the Central Power Network Project Management Board will reach a decision on the complaint within 1 month from the date it receives the complaint. Stage 3: If displaced persons are still not satisfied with the decision at district level or do not receive any replies from the Central Power Network Project Management Board, displaced persons can appeal to Provincial People's Committee. Provincial People's Committee and the representatives of Central Power Network Project Management Board will reach a decision on the complaint within 30 days from the date it receives the complaint. An Independent Monitoring Agency will be entrusted with external monitoring task. The selection of this agency will be approved by the Central Power Network Project Management Board ofevn CPC. The Central Power Network Project Management Board will sign the contract with Independent Monitoring Agency right after resettlement plan approval and the activities of supervision and monitoring will start at the beginning period of resettlement plan implementation Internal monitoring: Implementation of RPs will be periodically supervised and monitored by the EVN NPMU in a close coordination with the respective People's Committees at different administrative units and independent monitoring agencies. The reports will be made quarterly to be presented to EVN. Internal monitoring and supervision is aimed at: (a) Verifying that the baseline information of all DP's has been carried out and that the valuation of assets lost or damaged, and the compensation, resettlement and other rehabilitation entitlements have been carried out in accordance with the provisions of this Policy Framework and the respective RP. (b) Monitoring that the RPs is implemented as designed and approved. (c) Verifying that funds for implementing the RPs are provided to the respective CPNPMU in due date and in amounts sufficient for their purposes, and that such funds are used in accordance with the proposed objective of the RP and policy framework. The independent agencies can be academic or research institutions, non Governmental Organization (NGO) or independent consulting firms with qualified and experienced staff and terms of reference acceptable to the World Bank. In addition to verify the information furnished in the internal supervision and monitoring reports of the respective PMUs, the external monitoring agency will visit, interview/discuss with affected household of the project (DPs). Detailed method will be described in TORs of the tasks of the consultants, every six months after implementation of each RP in order to: (a) Determine whether the procedures for DPs participation a:nd delivery of compensation and other rehabilitation entitlements has been done in accordance with this Policy Framework; (b) Assess if the Policy Framework objective of enhancement or at least restoration of living standards and income levels ofdps have been met. (c) Gather qualitative indications of the social and economic impact of Project implementation on the DPs. (d) Suggest modification in the implementation procedures of resettlement plan, as the case may be, to achieve the principles and objectives of this Policy Framework. Report of independent monitoring consists of (i) the report on the progress of resettlement plan implementation, the combination between the implementation of resettlement plan and the executive activities, (ii) the differences, if there are, about the articles and principles of resettlement plan, (iii) raising the questions and proposals of solution so that all the agencies carry out in accordance with these information and can solve the problems in time, and (iv) the report on the progress of the problems stated in the previous report. Based on the experiences of Resettlement Plan implementation to propose the solution of strengthening the present resettlement plan and improving the resettlement plan in future.
