3 GLOSSARIES Displaced person (DP) - Means any person or persons, household, firm, private or public institution that are fully or partially, permanently or temporarily physically displaced (relocated, lost residential land, or lost shelter) and/or economically displaced (lost land, assets, access to assets, income sources or means of livelihood) due to (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. AHs could be of three types: (i) persons with formal legal rights to land lost; (ii) persons who have claims to such lands that are recognized or recognizable under national laws; and (iii) persons who have neither formal legal rights nor recognized or recognizable claims to the lost land. In the case of a household, the term DP includes all members residing under one roof and operating as a single economic unit, who are adversely affected by a project or any of its components. Compensation Cut-off date Detailed Measurement Survey (DMS) Ethnic Minority (EM) Entitlement - Means payment in cash or in kind to replace losses of land, housing, income and other assets caused by the Project. All compensation is based on the principle of replacement cost, which is the method of valuing assets to replace the loss at current market rates, plus any transaction costs such as administrative charges, taxes, registration and titling costs. - Means the date of project land acquisition announcement by competent agency. The AHs will be informed of the cut-off date for each project component, and any person who settled or assets created in the project area after the cut-off date will not be entitled to compensation and assistance under the project. The cut-off date of this subproject was 26/12/2011 for phase 1 and 05/02/2015 for phase 2. - Based on the approved detailed engineering design, this activity involves the finalization of subproject land acquisition and resettlement impacts, including final cost of resettlement. This is the process where all fixed assets (i.e., lands used for residence, commerce, agriculture, including ponds; dwelling units; stalls and shops; secondary structures, such as fences, tombs, wells; trees with commercial value; etc.) and sources of income and livelihood inside the Project right-of-way (project area) are identified, measured, their owners identified, their exact location pinpointed, and their replacement costs calculated. Additionally, the severity of impact to the affected assets and the severity of impact to the livelihood and productive capacity of AHs will be determined. - Any ethnic group of Vietnam, except the dominant Kinh Group, who has the following characteristics at different levels - living in the rural and remote area or having ancestor s territory in the project area and depending on natural resources of these area and territory, and having a social or cultural identity distinct from that of the dominant group (Kinh-Viet). - A range of various activities including compensation, assistance in income restoration, shift in occupation, relocation... etc, ii

4 provided to affected people based on the type and level of impact which aims to restore their socio-economic conditions. Income Restoration Program - A program designed with various activities that aim to support affected persons to recover their income / livelihood to pre-project levels. The program is designed to address the specific needs of the affected persons based on the socio-economic survey and consultations. Land acquisition - Refers to the process whereby an individual, household, firm or private institution is compelled by a public agency to alienate all or part of the land it owns or possesses to the ownership and possession of that agency for public purposes in return for compensation at replacement costs Rehabilitation - This refers to additional support provided to AHs losing productive assets, incomes, employment or sources of living, to supplement payment of compensation for acquired assets, in order to achieve, at a minimum, full restoration of living standards and quality of life Relocation - This is the physical relocation of an AP from her/his pre-project place of residence and/or business. Resettlement and Ethnic Minorities Development Plan (REMDP) Replacement Cost Replacement Cost Survey Resettlement - A plan for resettlement of an ethnic minority population, combining the resettlement plan with specific ethnic minority concerns and cultural sensitivity for the specific needs of the ethnic minority groups. - The amount needed to replace an affected asset net of transaction costs such as administrative charges, taxes, registration and titling costs - This refers to the process involved in determining replacement costs of affected assets based on empirical data - This includes all measures taken to mitigate any and all adverse impacts of a project on AP property and/or livelihoods, including compensation, relocation (where relevant), and rehabilitation as needed. Severely affected household (SAH) - This refers to affected households who will (i) lose 10% or more of their total productive land and/or assets, (ii) have to relocate; and/or (iii) lose 10% or more of their total income sources due to the subproject. Stakeholders - Individuals, groups, or institutions that have an interest or stake in the outcome of a project. The term also applies to those potentially affected by a project. Stakeholders include land users, country, regional and local governments, implementing agencies, iii

5 Vulnerable group project executing agencies, groups contracted to conduct project activities at various stages of the project, and other groups in the civil society which may have an interest in the project. - These are distinct groups of people who might suffer disproportionately or face the risk of being further marginalized by the effects of resettlement and specifically include: (i) female headed households with dependents, (ii) disabled household heads, (iii) households falling under the generally accepted indicator for poverty, (iv) children and the elderly households who have no other means of support, (v) landless, and (vi) severely affected ethnic minorities. This due diligence report is a document of the borrower. SUMMARY This DDR was prepared for the subproject Upgrading infrastructure of Ia M lah irrigation system, Krong Pa district, Gia Lai province to fully comply with updated Resettlement and Ethnic Minority Development Framework (uremdf) of the Productive Rural Infrastructure Sector project. According to MARD and Gia Lai DARD, Ia M La irrigation subproject was initially invested by state bond since 2011, however during the implementation due to shortage of fund, Ia M La irrigation subproject was proposed to be invested under Productive Rural Infrastructure Sector Project in the Central Highlands Provinces by end of 2014 after Loan agreement signed between ADB and Vietnamese Government. Land acquisition of Ia M La subproject was implemented by local authority in two phases with the source of fund from State bond: (i) from , applying the 2003 Land Law (13/2003/QH11), decree 197/2004/ND-CP on compensation, support and resettlement in the event of land acquisition by the State and decision 05/2011/QD-UBND of Gia Lai PPC; (ii) from 2015, following new policies such as the 2013 Land Law (45/2013/QH13), Decree 47/2014/ND-CP on compensation, support and resettlement in the event of land acquisition by the State and decision 21/2014/QD-UBND of Gia Lai PPC. The Inventory of Losses (IOL) and census were conducted since 2011 to 2014 with Socio- Economic Survey (SES) undertaken in parallel. The compensation process was free-of-charge for all the AHs with the Government covering all administrative costs, taxes and grievance redress. Due diligence for Ia M La suproject in Krong Pa district, Gia Lai Province was conducted by Project Management Unit (PMU) Gia Lai with the support of Safeguard Consultant by end of Jan 2016 and additional survey in August The methodology of the due diligence review included project document reviews, interviews with PMU, DRC, AHs and stakeholders, and site inspections. Due diligence was done on the compensation payments completed in period and 2015, comparing levels of compensation and assistance with entitlements in the approved uremdf. A Corrective Action Plan (CAP) has been made based on the findings of the due diligence review. The main actions in the CAP are additional provisions of allowance for vocational trainning/ job creation for households who lost agricultural land, life rehabilitation allowance for severely affected households, special allowance for affected households belonging to vulnerable group and proposed activities for livelihood restoration of severely affected households and vulnerable households. Also as corrective action, reguarly monitoring is required for the sub-project, which will be tasked to the LIC consultant. Budget for the corrective actions will be taken from counterpart fund of Gia Lai PPC. 2. INTRODUCTION 2.1 Subproject overview The subproject (SP) Upgrading infrastructure of Ia M lah irrigation system, Krong Pa district, Gia Lai province is located in Krong Pa district, Gia Lai province about 150 km from the provincial center. The SP area includes Ia Mlah, Chu Gu and Phu Can communes and Phu Tuc town. Subproject s objectives are (i) to complete the primary canal system with irrigated area F < 150 ha, secondary canal with F> 20 ha and inland canal system to increase the irrigation service area up to 1,614.0 ha; (ii) to upgrade some roads from residential to production areas within la Mlah reservoir area; and (iii) to contribute to improved livelihoods and quality of life of people in the region. According to the design, the SP consists of two components: Irrigation and Rural transportation road. The scope of these components is as below: 1

10 (i) (ii) Irrigation Component: Building 57 new canals with a total length of 43,357 m to irrigate 1,614 ha of four communes and one town (Phu Can, Chu Gu, Ia Mlah communes and Phu Tuc town). The 57 canals are divided into 2 groups: a) 30 primary and secondary canals with a total length of 30,544 m for 1,473ha of irrigated area; and b) 27 canals with a total length of 12,813 m covering 141 ha of irrigated area. Rural transportation road component: Upgrading 5,439 m of Type B rural transportation roads that are 4 m wide roadbed, 3m wide pavement from soil road to concrete road of 3 routes (road from Proong village to productive area with 977 m long; the road from Bluk village, Thim villages to productive area with 2,730 m long and the road from Tang village to productive area with 1,732 m long). These routes will be built on the existing roads without compensation for site clearance. 2.2 Objectives of the DDR The purpose of this DDR is to review and appraise the compliance with compensation policy of Vietnam and relevance to the project uremdf in compensation and site acquisition at the time of compensation, in order to document (i) compensation and land acquisition has complied with the general resettlement policy of the project without REMDP; (ii) in cases of non-compliance, determine the gaps using the uremdf as reference, and (iii) recommending an action plan to overcome the differences subjecting to monitoring and evaluation results. The updated Resettlement and Ethnic Minority Development Framework (uremdf) of the project proposed processes, procedures and guidelines for involuntary resettlement policy per ADB Safeguard Policy Statement (SPS 2009). All components/ subprojects with REMDP or DDR must comply with the general resettlement policies of the project as embodied in the REMDF. At the time it was proposed as a subproject of PRISP, the compensation and site acquisition of this subproject was nearly completed by Krong Pa DRC, Gia Lai province per regulations of Gia Lai & Vietnam with the fund from the Government bond. And at the end of 2015, the compensation and site acquisition of the subproject was completed. Thus, the DDR must be prepared in compliance with SPS Land acquisition and compensation payment of the subproject was implemented in 2 phases: From , applying the 2003 Land Law (13/2003/QH11), decree 197/2004/ND-CP on compensation, support and resettlement in the event of land acquisition by the State and decision 05/2011/QD-UBND of Gia Lai PC; (ii) from 2015, following new policies such as the 2013 Land Law (45/2013/QH13), Decree 47/2014/ND-CP on compensation, support and resettlement in the event of land acquisition by the State and decision 21/2014/QD-UBND of Gia Lai PPC. Therefore, compensation and land acquisition of the subproject will be appraised per each phase and a corrective action plan will be proposed respectively if any differences with the project policy framework. 3. METHODOLOGIES The following methods were utilized in the preparation of this DDR: (i) collecting secondary data and safeguard documents, reviewing all relevant safeguard documents, compensation plans collected from the Central Project Management Unit (CPMU), Provincial Project Management Unit (PPMU) and District resettlement committee (DRC); (ii) discussions held with key stakeholders about compensation and acquisition activities, and (iii) interviews conducted with affected households (AHs) via questionnaires. 3.1 Secondary data collection To collect the required information and documents, the safeguards preparation consultant (SPC) worked with CPMU, PPMU, DRC and collected all documents and specific information as shown in table below 2

Determine compliance to the entitlements outlined in REMDF This is the basis to determine the sample size for the baseline survey and final evaluation Whether AHs got full compensation at replacement cost or not as well as timeliness of compensation. What was the number of AHs with grievance and outstanding complaint issues? Were grievances addressed in compliance with State s laws and/ or regulations of the project? Was there any fee? Were grievances resolved in a satisfactory manner? 3.2 Discussions with DRC, PPMU and local authorities SPC discussed with PPMU, DRC to understand advantages and disadvantages in implementing compensation and resettlement implementation. In addition, discussions were also conducted with commune representatives where the subproject will be conducted. Details of discussed issues are provided in Table 2. Table 2. (i) To assess changes and ability for AHs to recover pre-project quality of life; (ii) To assess compliance to REMDF as regards compensation and assistance; (iii) To determine grievances and document issues and constraints in implementing compensation and land acquisition. 3.3 Questionnaire survey method A structured survey questionnaire was designed by the SPC (See Annex 3) to collect household information and aspects related to land acquisition activities. The main contents of the survey questionnaire focused on aspects like information disclosure, DMS, compensation cost and compensation amount, timing for land acquisition and compensation payment, grievance and grievance redress and compensation satisfaction of the AHs, livelihood restoration. 87 HHs (20.5% of AHs) were interviewed, including compensated AHs in 2015 and before Information collection at site Fieldwork was conducted by end of January 2016 (According to document 175/DANN-HTTN, dated 01/25/2016 of Productive Rural Infrastructure Sector Project in the Central Highlands Provinces). The collected information/ data were analyzed to appraise the compliance in land 4

13 acquisition implementation and from that, a corrective action plan to be proposed if any. The number of SAHs, VAHs was also complementarily surveyed in August 2016 by PPMU & DRC. 4. SCOPE OF LAND ACQUISITION AND IMPACT ON HOUSEHOLDS 4.1 Impact on households A total of 434 AHs were affected by the land acquisition for construction of Ia M la subproject. None of them was affected main house and had to relocate to new place or rebuild house on remaining land. Among of them, 44 HHs were SAHs due to loss of 10% or more their holding productive land (37 AHs were acquired from 10 % - 30% their productive land area; 06 AHs were acquired 30% - 70% their holding productive land area and 01 AH was acquired more than 70%) and 64 HHs have been verified by the complementary survey as vulnerable affected households (03 female-headed with dependents; 04 AHs with disabled members; 39 poor AHs per criteria of Ministry of Labor, Invalids and Social Affairs; 01 elderly without support; 17 ethnic minority households lost more than 10% of productive land). (See annex 2.3 for SAHs and VAHs list). Such affected groups were identified and their compensation plans were reviewed with corresponding entitlements in uremdf. Please see the table below for more detail the types of affected households. Table 3. Besides, 64 vulnerable households were affected by agricultural land and their livelihood also was affected. The income source of affected households was mainly from agriculture. For such households, cash allowance shall be provided such as allowance for life rehabilitation, allowance for vulnerable households, allowance for job change and creation as measures for livelihood restoration. In addition, such households if having need on vocational training, local authority shall provide free of charge training course to them. 4.7 Land use right certificates All AHs had LURCs. After the land acquisition of the household, Office of Natural Resources and Environment of Krong Pa district has adjusted the LURC for them at no cost to the AHs Social economic condition of affected households Social economic conditions of the AHs were surveyed at the same time as IOL and DMS by working group set up by DRC in 2011, and updated in However due to long time, the social economic survey (SES) data in 2011 is not available at the time of surveyed. Therefore, secondary social economic survey data collected from communes and via questionaire with sample households as well as supplement survey in August 2016 were the basis for socioeconomic analysis. Three key following aspects were collected and analyzed as (i) impact on livelihoods of households; (ii) land ownership and (iii) social economic condition of affected household. Impact on livehoods of households: The subproject would affect both nagatively and positively livelihood of households. Negative aspects would be land acquisition, impacts on structures/ trees as mention above item 4.1 to 4.5. However, the impacts were not serious while only 44HHs/ 434HHs were severely affected due to loss of 10% or more their holding productive land, neither HH must relocate nor change/ lose their job because of the project. All affected land/ assets were fully compensated. Besides, additional provisions of allowance for vocational trainning/ job creation for households who lost agricultural land, life rehabilitation allowance for severely affected households, special allowance for affected households belonging to vulnerable group will also be paid after this report being approved. Land ownership: 100% of surveyed AHs owned the LURC. Socioeconomic condition of affected households: 10

19 Demography: 87 surveyed households comprises of 423 people, in which 223 male (52.7%) and 200 female (47.3%). The average household size was 4.86 persons (the least household had 01 person and the crowdest one had 7 persons). Gender and age of AHs: 5 HHs out of 87 HHs were female-headed households (accounting for 5.7%) while male-headed HHs accounted for 94.3%. The group of male and female head from years old prevailed with 78%, they were persons who create main income for their family and they were the decision makers as well. No household head was younger than 18 years old but 11% of household head were older than 60. The labor force, years old, of household members overwhelmed as it accounted for 77% of total members ( 258 persons/ 336 persons). Among the non-working age persons, the percentage of whom less than 18 years old was nearly one and half of group elderly (14% versus 9%). Table 8. Among 423 of surveyed persons, 39 were under-aged of school (9%) while the illiterate persons were 30 (7%), mainly was the elderly and ethnic minority. These activities aimed to equip people with basic knowledge about the project, reduce complaints from AHs and contribute to accelerating the progress related to SP. a) Results of information collection The following table is the results of information collection of public consultation, information disclosure activities implemented by the local officials. Hence, AHs understood the subproject information and entitlements policy as evident in the above table. 5.3 DMS and affected household categorization a) Results of information collection To evaluate whether all affected assets were compensated or not, SPC (i) reviewed all compensation records and compensation liquidation; (ii) interviewed 87 AHs (20% of the AHs including VAHs, SAHs who lost agricultural land) and (iii) checked, discussed with the DRC complaints from AHs about missing of affected asset in the DMS. See table below for more details. Table 15. None of the AHs complained about the number of affected assets after compensation. So, it could be said that quantity of affected assets was adequately inventoried. 5.4 Replacement cost and Compensation payment for land and assets on land a) Results of information collection The compensation policy in 2015 was based on Decision No. 21/2014/QD-UBND, dated September 12, 2014 of Gia Lai PPC on the compensation, support and resettlement in the event of land acquisition by the Government in Gia Lai province. The compensation cost for land was applied per Decision No. 875/QD-UBND, dated December 23, 2015 of Gia Lai PPC on price adjustment factor for compensation upon land acquisition by the State for the SP Upgrading infrastructure of Ia M lah irrigation system, Krong Pa district, Gia Lai province. According to this decision, the land cost applied for this SP was higher than the land cost issued by the PPC for Krong Pa district applicable from (Decision No. 38/2014/QD-UBND, dated December 30, 2014). The compensation cost for houses and structures was applied per Decision No. 10/2013/QD-UBND, dated 22/05/2013 of Gia Lai PPC. The compensation cost for plants and crops was applied per Decision No. 818/QD-UBND, dated 30/11/2010 and the Decision No. 290/QD-UBND, dated 26/04/2011. Compensation policy from 2011 to 2014 applied for the subproject was based on Decision No. 05/2011/QD-UBND, dated 25/04/2011 of Gia Lai PPC on the compensation, support and resettlement in the event of land acquisition by the Government in Gia Lai province. The compensation rate for land was applied per decisions of the PPC issued annually. It included: Decision No. 37/2010/QD-UBND dated 20/12/2010 of Gia Lai PPC on the issuance of land price in Krong Pa district, Gia Lai Province in 2011; Decision No. 36/2011/ QD-UBND dated 21/12/2011 of Gia Lai PPC on the issuance of land price in Krong Pa district, Gia Lai Province in 2012; Decision No. 41/2012/QD-UBND dated 20/12/2012 of Gia Lai PPC on the issuance of land price in Krong Pa district, Gia Lai Province in 2013; Decision No. 53/2013/QD-UBND dated 20/12/2013 of Gia Lai PPC on the issuance of land price in Krong Pa district area, Gia Lai Province in The compensation rate for houses and structures was applied by Decision No. 407/QD-UBND, dated 21/06/2010 and the Decision No. 657/QD-UBND, dated 30/9/2010 of Gia Lai PPC. The compensation cost for plants and crops was applied per Decision No. 818/QD-UBND dated 30/11/2010 and the Decision No. 290/QD-UBND dated 26/04/2011 of Gia Lai PPC. Overall, the compensated rates for land of this SP in 2015 were higher than those issued by the PPC which is applicable for the period (Decision no.38/2014/qd-ubnd on 31/12/2014 of Gia Lai PPC which was applicable for ) because the compensation cost was surveyed and valuated (Decision no. 875/QD-UBND on 31/12/2015 of Gia Lai PPC). Land compensation cost in period was applied per the land price annually issued by the Gia Lai PPC via survey, thus it was close to the market price and accepted by AHs. Compensation cost for structures and trees/ crops was issued by Gia Lai PPC at the time of 15

24 compensation and it was similar with the market price, therefore it was also accepted by AHs. Details of these evaluation indicators and the level of satisfaction of people with compensation cost are provided in table below. Table 16. Through interviewing, only 3.4% of interviewed AHs are dissatisfied with compensation cost however none of them had the complaint. This reveals that satisfaction level is very high. All AHs expected the subproject to be commenced as soon as possible because local people were always lack of water for cultivation. 5.5 Allowances a) Results of information collection According to the compensation plan that DRC prepared and paid for AHs, the approved compensation plan had not included 03 following allowances: (i) Job changing/ creation allowance per Gia Lai regulation because at that time the fund was not enough; (ii) allowance for SAHs per the project policy; (iii) Allowance for vulnerable groups has not been paid per the project policy because the compensation plan was only prepared per Gia Lai s policy, not the project policy. b) Comment / evaluation The compensation had not been fully complied with because it was lack of allowances for i) SAHs, ii) VAHs and, iii) job changing/creation 5.6 The compatibility between compensation and construction progress According to the DRC report, compensation and site clearance had started in 2011 and completed in late All AHs received full compensation allowances and expected that the SP will be constructed soon. Construction was expected to commence within the last 6 months of Although compensation was completed and AHs had handed over the site, some allowances as mentioned above in item 5.5 had not been included in the approved compensation plan and paid for AHs. Thus, these allowances must be promptly complemented for AHs before any notice to proceed being issued. 5.7 Grievances and grievances redress a) Information collection results The uremdf required that competent authorities shall address all AHs complaints. So far, there were 14 cases of complaints. The indicators for complaint evaluation are shown in table below. Table 18. All of missing was complemented and paid for AHs. 6. DIFFERENCES BETWEEN REMDF AND ACTUAL IMPLEMENTATION Based on the collected information and the assessment above, SPC had found some gaps between the ABD policies and the actual resettlement implementation of this subproject. Details of outstanding issues as below: 6.1 DMS and AHs categorization After DMS, the AHs must be categorized as severely affected, relocated AHs, VAHs so that appropriate allowances could be applied. The monitoring results show that AHs were only preliminarily categorized. Per this, all HHs were partially affected. The minutes of DMS did not indicate the total area each AH owned, which is necessary for calculating severity of loss. If an AH loses 10% or more of their total productive asset, it will be considered as severely affected. Moreover, HHs in vulnerable group were also not identified (poor, disabled, veterans, femaleheaded HHs with dependents, HHs with disabled people, landless HHs). However, this missing information was complementarily surveyed by the PPMU in August Per this survey, 44 SAHs and 64 VAHs were identified. 6.2 Livelihood restoration and missing allowances The approved compensation plan has not included the 03 following allowances relating to livelihood restoration for households who lost prodictive land, SAHs and VAHs: (i) Job changing/ creation allowance for AHs losing productive land; (ii) allowance for SAHs; and (iii) Allowance for vulnerable group as the project s policy. 7. CORRECTIVE ACTION PLAN Based on results of DDR, there were some activities to be corrected for SAHs, VAHs and those who are entitled to receive the aforementioned allowances. The Corrective Actions in this DDR have been consulted with local authorities such as the DRC and the Krong Pa DPC and affected households. So far, PPMU have approved the fund for corrective actions. Once this DDR-CAP has been endorsed by Gia Lai PPC and ADB, it will be 18

27 disclosed by posting in commune offices and village halls. Disclosure will be monitored and reported in monitoring reports. The plan to remedy the differences between the uremdf and actual compensation of la M lah sub-project could be summarized as below. 7.1 The number of entitled households and the amount of allowances Job changing / creation allowance According to data collection results from Krong Pa s compensation Unit, 409 AHs will receive the allowance of job changing / creation. Such activities will be implemented through local programs organized annually by Gia Lai Department of Labor, Invalids and Social Affairs and DARD for households who have agricultural land acquired by the state. The budget for such activies will be born by Gia Lai PPC. 20

29 7.1.5 Budget for Corrective Action Plan Based on the above assessment and as agreed with local officials, SPC recommends remedial actions for the gaps between the uremdf and the actual resettlement implementation following Gia Lai province policy. In the implementation progress, Central Project Management Unit (CPMU) is responsible for the following tasks: Overall monitoring of DDR implementation Instructing the implementing agency (DRC) and PPMUs to implement the activities of this plan in compliance with approved policies; consulting the local authorities to timely handle any mistakes or shortcomings detected in the internal monitoring to ensure the achievement of the objectives of the policy framework. Completing DDR, submit to the PPMU and ADB approve before implementing Setting up data system about AHs for each section as well as the entire of the project. Setting up internal monitoring process, reporting the project progress and monitoring compliance with the policies of the project; Setting up a monitoring process of coordination between contractors and local authorities in order to identify and compensate for impacts occurring during the constructing; Establishing regulations to implement remedy action and resolve grievances quickly; Reporting to ADB periodically about DDR implementation progress. 21

30 7.2.2 Provincial level Gia Lai PC is responsible for resettlement implementing under its administrative jurisdiction. Main missions of PC are: Approving the final DDR; Promulgating decisions about the above approved allowances; Allocating budget to implement DDR; Directing and monitoring relevant provincial agencies to implement DDR effectively; Directing stakeholders to resolve questions and grievances of AHs related to compensation, resettlement and support in compliance with current law; Directing stakeholders to check and handle mistakes related to compensation, support, resettlement Gia Lai PPMU is responsible for DDR implementing and internal monitoring. Main missions of PPMU are: Guiding DRC to implement all approved resettlement activities and other activities related to DDR; resolving any mistakes identified in internal monitoring to meet the requirement of the DDR; having technical and financial supports for DRC and commune unit; Coordinating with DRC and PPC (Province People s Committee) to execute information dissemination and DDR implementing; Coordinating with stakeholders to ensure the supporting, recovering and improving measures implementing for AHs quickly and timely; Monitoring DDR internal implementation, establishing and maintaining database of APs in accordance with established procedures and writing reports regularly to submit CPMU; Implementing remedy actions in accordance with internal monitoring District level Krong Pa DPC is responsible for comprehensive management of compensation, supporting and resettlement activities. DPC has responsibility for reporting to PPC about the rate of progress as well as land acquisition result. Main missions of DPC are: Approving plans and monitoring land acquisition- resettlement progress in accordance with updated DDR; Establishing DRC and resettlement group, directing DRC and relevant district departments to assess and implement compensation, supporting and resettlement in detail; Approving and being responsible for legal basic and accuracy of compensation, supporting and resettlement programs at local; approving budget estimates for compensation, supporting and resettlement; Being responsible for acquisition of LURC, land ownership certificates of individuals and households who has land or whose house is recovered; modify LURC for individuals and households who has land or whose house is partial recovered; Directing CPC and relevant agencies to implement resettlement; Grievance redress District compensation, supporting and resettlement committee The components of DRC are vice president of DPC (as Chairman of the Council), representatives of Natural Resources and Environment Office, Department of Finance, Department of Agriculture, presidents of CPCs and AHs (including, members of District Farmers and Women Associations. Main missions of district agencies and/or DRC are: Planning, organizing and implementing compensation, supporting, resettlement activities; Monitoring, consulting and disseminating information about the project, and coordinating with relevant agencies to implement income recovery programs; 22

31 Preparing a compensation plan and submitting it to DPC for approving, Implementing compensation, supporting, resettlement projects; be responsible for legal basic accuracy of resettlement compensation policy in compliance with approved DRC; Assisting in identifying and allocating land to relocated households if any; Directing and coordinating with the CPC to transfer compensation promptly as well as other benefits to AHs; Supporting in grievances redress; Commune level CPC will support DRC implementing their resettlement responsibility. Specifically, the CPC will be responsible for the following tasks: Coordinating with commune and district organizations to mobilize people; responsible for compensation, supporting and resettlement implementing in accordance with approved DDR; Coordinating with DRC and groups to disseminate reasons of land acquisition with households, announcing and publishing all compensation, supporting and resettlement options; Assigning the commune officers to support the DRC in updating DDR and carrying out resettlement activities; Specifying replacement land for AHs; Contracting compensation agreements with APs; Supporting in grievances redress; Participating in all activities related to resettlement implementation Proposed schedule for DDR implementation DDR implementation is summarized in table below, including: (i) DDR approving and disseminating; (ii) DDR implementing, (iii) Internal monitoring. Resettlement implementation will be monitored through community monitoring and internal monitoring Community monitoring Community monitoring will be applied to supervise the DDR implementation of this SP. PPMU will encourages people, especially AHs of SP, in monitoring the DDR implementation Internal monitoring This internal monitoring is aimed to assess: Whether DDR is complied with; The available resources and the efficient use of these resources in order to implement the activities of land acquisition and resettlement; The performance of agencies involved in the resettlement during the SP implementation; Whether resettlement activities are carried out in accordance with the implementation plan outlined in DDR or not; and Any potential issues and remedies. CPMU as the implementing agency will be responsible for the internal monitoring. CPMU will monitor the establishment process, functions as well as activities of provincial and district agencies who are responsible for resettlement. CPMU needs to ensure that DRC will write and submit reports related to DDR implementation quarterly. CPMU will incorporate information in all reports of provinces into SP s monitoring system to prepare periodic progress reports and send them to ADB. All data will be divided into gender and ethnic group. CPMU will develop internal monitoring plan, progress and requirement of all SP report. Number of assets to be compensated and supported by category. Number and value of compensation payments, supports. Timeliness of compensation and supports. Compensation, supporting at agreed cost. Number of vulnerable group supported. Number of AHs receiving supports due to severe impact (losing 10% land area). Number of AHs supported with job changing at 2.5 times of compensation cost. The land acquisition of Ia M lah SP is compliant with the updated REMDF of the Productive Rural Infrastructure Sector Project in the Central Highlands Provinces in specific aspects as follows: i) AHs participated in the project information disclosure and public consultation; ii) AHs were consulted and involved in the process of land acquisition; iii) All AHs participated in DMS process and signed on its minutes; iv) Draft detailed compensation plans were disclosed; v) Complaints were promptly solved by DRC / CPC; vi) AHs received compensation before handing over site; and Although majority of households were satisfied with and accepted the compensation cost, there are still gaps between the actuality and the uremdf. Particularly, none of AHs was received job changing / creation allowance, 44 SAHs and 64 VAHs were not received allowances for SAHs and VAHs. Therefore, a corrective action plan as above is necessary. 8.2 Recommendations The policy of Gia Lai province missed 03 allowances in comparison with the project s uremdf but now, PPMU Gia Lai accepts to supplement fund for these allowances; Therefore, Gia Lai PPMU needs to coordinate with stakeholders to speed up the approval and payment progresses in compliance with REMDF. 25
