6 1. GENERAL INFORMATION OF THE PROJECT 1.1. Project objectives 1. Bac Giang, Mong Cai, and Sa Pa are the towns in Viet Nam participating in the Second Greater Mekong Subregion Corridor Towns Development Project. 1 The three town-subprojects in Vietnam consist small infrastructure and environmental improvement investments that are being implemented with the immediate and ultimate goals improving urban environments, and promoting socioeconomic development Project components 2. GMS 2 Subproject for Bac Giang city (Bac Giang province) includes the following BG Packages: a. Package BG 1: Construction Tran Quang Khai road; b. Package BG 2:Construction North-East Ring Road; c. Package BG 3: Improvement wastewater collection system and lakes upgrading; d. Package BG 4: Improvement rainwater system; e. Package BG 5: Design, provide technology equipment and construction (EPC): Expand waste water treatment plant 3. The Mong Cai subproject (Quang Ninh province) consists two components as below: a. Package MC 1: Improvement wastewater and rainwater system; Construction the plant on the east Hai Xuan commune. b. Package MC 2: Improvement wastewater and rainwater system; Construction the plant on the west Hai Yen ward. c. Package MC 3: Protection Ka Long River bank. Description Sapa Subproject 4. Sapa subproject (Lai Cai province) consists three components which are related to construction activities as below: (i) SP1: Upgrading provincial road 152, section from Sa Pa town to Ban Den. (ii) SP 2: Sapa wastewater system management. (iii) SP 3: Construction and upgrading existing infrastructures in Sapa town. 1 Cambodia and the Lao PDR also participate in the Second Corridor Towns Development Project 6

8 Bac Giang subproject 5. Based on approved U RP total land permanently acquired for two roads is 100,053.8 m2 with 589 AHs (in 2,297 APs) and 04 ward/commune PCs affected by loss land for two roads. Out 589 affected households, there are 314 households affected by BG1- Tran Quang Khai road in which 245 AHs in Song Mai CPC and 69 AHs in Tho Xuong ward PC. Total 275 households affected by BG2- Ring Northeast road, in which 141 AHs in Dinh Ke and 134 AHs in Xuong Giang. There are 265 households severely affected, in which 262 AHs losing more than 10% total productive land and 03 relocated AHs 6. There are 82 vulnerable households (44 AHs belongings BG1 construction Tran Quang Khai road and 38 AHs belongings BG2 -construction Ring Northeast road) including 02 woman headed households; 02 households with disable person; 01 poor household; 08 alone elderly household and 69 policy households). Mong Cai subproject 7. According to site clearance report (11/2017), the number affected households: There are 47 AHs, which 32 AHs are severely affected. 3 agencies/organizations (Quang Ninh construction transportation loading and unloading company - Ka Long ward, and the Urban environment company Hoa Lac ward and 01 cultural house).package MC 1: Hai Xuan commune has 35 AHs (27 severe AHs and 8 slightly AHs). Package MC 2: Hai Yen, Ka Long: There are 12 AHs (5 severe AHs and 7 slightly AHs). 09 households received compensation and support for affected assets on land.16 households received compensation for plantation. 13 households received policy support (female headed households with dependents, households with wounded soldiers, Dang Tien Hung resettled household Package MC2 - drainage system in Ka Long ward). No household have affected graves. There are no poor or ethnic minority households (Note: 1 household may receive different types support) Sapa Subproject 8. Based on U REMDP total land permanently acquired for two components is 115,906 m2 with 486 AHs (in persons) and 01 organizarion, in which rehabilitation Road 152 will affect the total land 97,666 m2 owned by 477 households and Total affected land caused by the Construction Northeast wastewater treatment plant is 18,240 m2 with 09 AHs 9. This subproject has 16 severely affected households, losing more than 10% their productive assets. Additionally, there are 3 relocation households. 10. Vulnerable group: Of the 486 AHs, there are 401 ethnic minority households: 201households are Hmong people, 103 households are Giay and 97 household is Tay. Out 401 ethnic minority households, 16 poor households 2 are found to be vulnerable within the impacted areas. There are no female-headed household, disabled/elderly household heads, households considered as landless with no other means support. 2 Households in rural area with average income from VND400,000/person/month or less (VND4,800,000/person/year) according to the Decision 09/2011/QD-TTg by the Prime Minister on issuance applicable standards for poor and poor households for periods. 8

9 1.4. Objectives internal monitoring 11. The process internal monitoring is implemented for the following objectives: (i) (ii) (iii) (iv) (v) Compliance with the agreed updatedrp/updated REMDP; The availability resources and the efficient, effective use these resources to implement land acquisition and resettlement activities; That resettlement institutions are well-functioning during the course project implementation; Resettlement activities are undertaken in accordance with the implementation schedule described in the updated-rp/updated REMDP; To identify problems, if any, and remedial actions. 2. DETAILED RESETTLEMENT IMPLEMENTATION PROGRESS 2.1. General progress in RP implementation 12. In Quarter 3 and , the Consultant carried out preparing updated RPs/ REMDP for each subproject based on draft compensation options and DMS subproject. 13. Bac Giang subproject: The U RP was approved by ADB dated September 28, Mong Cai subproject: The U RP was approved by ADB on July 10, Sapa subproject: The U REMDP was approved by ADB on December 3, DMS for SP1 and SP2 completed in November, 2017 and LFDC carried out payment for 289 AHs with total amount 15,260,574,330 VND. 9

11 2.2. Disclosure, consultation & participation 16. The information was fully implemented by the LFDC in coordination with the ward authorities to disseminate to the affected households (AHs), including: subproject scope; expected schedule; compensation policy; and grievance redress mechanism the Subproject. The consultation with AHs showed that they were disseminated about the grievance redress mechanism and the compensation policy as well as the complaint procedures the Subproject. Mong Cai: community meetings at 03 CPCs from November 13 to 15, 2017 and interviews 8 affected households ( 5 men and 3 women). 11

12 Sa Pa: community meetings at 06 CPCs from Jan 8 to 12, 2018 with 22 partcipants ( 3 women and 19 men ). 3 Information dissemination and public consultation activities conducted with the ethnic minorities Sa Pa: community meetings at 06 CPCs from Jan 8 to 12, 2018 with 22 partcipants (in which 19 ethnic minoritie hhs ). 3. DMS PROCESS 17. Bac Giang subproject: DMS for Tran Quang Khai road started in June, 2016 and completed at the end September, 2016 and DMS for North- East ring road started in June, 2017 and completed in September, 2017 to identify impacts affected by construction two roads. Before implementing DMS, all AHs were invited to the cultural house for project information disclosure. AHs also were informed the time DMS and they were involved in all steps DMS and signed DMS minutes. 18. Mong Cai subproject: Detail measurement survey (DMS) implemented: (i) Wastewater treatment plant East Hai Xuan commune: start from March 18, 2016 and end on December 30, 2016; Cut-f date: March 18, (ii) Wastewater treatment plant East Hai Xuan commune: start from March 18, 2016 and end on August 30, 2016; Cut-f date: March 18, (iii) Ka Long river embankment: start from February 12, 2017 and end on March 03, Cut-f date: February 13, Before implementing DMS, all AHs invited to cultural house for project information disclosure. AHs also were informed the time DMS and they were involved in all steps DMS and signed DMS minutes. 19. Sapa Subproject: DMS for upgrading 152 road started in May 2017 and completed at November, 2017 and DMS for waste water treatment plant started in November 2017 and completed at December, However, as the AHs is the indigenous people with their customary land use and farming practices specific settled agriculture habits, there are some agricultural land lots whose owners have not been identified yet.to address this problem, Lao Cai PMU in collaboration with the Land Development Center Sa Pa town has publicly notified on the local mass media and on Lao Cai Newspaper so as to disseminate the information to the AHs. 12

13 4. STATUS OF DISBURSEMENT 20. Bac Giang subproject: Up to December, 2017, PMU paid total amount VND 31,323,380,538 for 701 cases households under BG1 and BG2 with 15 approved compensation plans. 21. Mong Cai subproject: The total direct cost estimate for compensation and assistance is VND inclusive 2% management fee and 10% contingency; with, the total cost compensation, support and resettlement for 47 affected households, 02 organizations/agencies and 01 cultural house is expected to be VND14,368,074,006 ( Site clearance report) and Restoration Programwith an estimated budget VND 1,478,000,000 for 37 hhs (URP). Up to November 2017, 3/47 AHs have not received compensation money, the compensation and support to affected households, agencies and organizations in the three Packages reached 76.5% (remaining about VND 3,371,325,022). in which Package MC 1 paid 100%, Package MC2 paid 75%, and Package MC 3 paid 70%. The payment has been made from August 2017 till now (November 2017). 22. 14 5. RELOCATION/RESETTLEMENT 23. Mong Cai subproject has one relocating household Ka Long river embankments. They received compensation payment in September, 2017 and PMU arranged resettlement plots in a Dong Ca resettlement site in same ward to re build their houses.. Up to December, 2017 these households received land use right certification for the allocated land plots, but they have stayed old house because this is end lunar year. Besides, due to culture Vietnamese, they have to consider carefully to select the time building housing. 14

Sapa subproject: According to the approved uremdp, total number displaced households TL 152 Road is 02. They are eligible for in-place resettlement. Currently, Mr Nguyen Viet Que has been building his house. For the Wastewater treatment plants, there are 01 AHs eligible to be relocated into the northwestern Sa Pa resettlement area. IRP implementation 25. Bac Giang subproject: A preliminary survey was carried out for the updated URP, estimated about 318 severely affected households and vulnerable affected households participating in the livelihood rehabilitation program. The survey results on the needs the AHs presented that AHs want to take part in following activities : (i) Provision credit (113 AHs); (ii) Provision training courses on high tech-oriented agricultural development (91 AHs) and (iii) Vocational training allowance (114 AHs). 26. Total cost estimation IRP is VND 3,889,000,000. Currently the program has not been implemented; therefore the program activities will be updated by the Consultant and the PMU in the next report. Mong Cai subproject 27. A preliminary survey was carried out for the updated URP, estimated about 37 severely affected HHs/vulnerable households that need an Income Restoration Program in which 16 HHs will choose agricultural development activities, 14 selected vocational training 16

17 and 7 selected small business. Total cost estimation IRP is VND 1,478, Currently the program has not been implemented; therefore the program activities will be updated by the Consultant and the PMU in the next report. 28. Sa Pa Subproject: the total number eligible households participating in the proposed program is 486 households with total cost estimation IRP is VND 2,210,414,000. However, the program has not been implemented; therefore the program activities will be updated by the Consultant and the PMU in the next report. 29. The survey results on the needs the AHs presented that AHs want to take part in following activities: - Provision credit - Provision training courses on high tech-oriented agricultural development - Vocational training allowance/ Introducing the appropriate jobs - Supporting for the vulnarable groups 30. There is not lesson learnt for IRP implementation in reality, propose to have a meeting between PMUs, PISC- safeguards and ADB s social speacialist in following mission ADB in March, 2018 to discuss next steps IRP. By doing so, the actual implementation 03 subprojects gets more effectively Institutional Arrangement 31. The Income Restoration Program for severely AHs/vulnerable AHs will be established with the linkage between the stakeholders like the PMUs, the TAs, the PCCs, Agriculture Extension Center ( in Mong Cai), Vocational Training and Job Promotion Center Mong Cai city (under DOLISA), Department Economic infrastructure Bac Giang CPC/ Lao Cai District Agriculture Extension Center (under DARD), Women s Union 3 city/town; DOLISA ;policy banks in each ward/commune, companies/enterprises in the area etc. (i) (ii) (iii) (iv) (v) PMU: Based on actual demands households, PMU coordinates with relevant stakeholders to implement activities mentioned in IRP; Mong Cai Agriculture Extension Center (under DARD)/ Department Economic infrastructure Bac Giang CPC/ Lao Cai District Agriculture Extension Center (under DARD): Based on the needs among affected households, the agency will contact with relevant organizations to provide training courses on high tech-oriented agricultural development in coordination with the PMU. Women s Union 3 cities/towns: is proposed to be main responsible for managing and operating credit activities for AHs Households: Participate in surveys, training courses and implement guidance the PMU and stakeholders. Relevant agencies: local woman union; centre Land fund development, Vocational Training and Job Promotion Center Mong Cai city (under DOLISA), will provide the support and co-ordination with PMU to implement IRP activities. 17

18 6.3. Consultation with Eligible APs 32. Bac Giang subproject: Consultation activities implemented with 100% eligible APs to identify their needs for IRP from May to July 2017 through community consultation meetings with 201 people (93 women ( 46,3%) and 108 men (45,7%)) and questionnaire for 329 AHs. Overall 82 vulnerable AH took part in both survey and community consultation meetings Additionally, 30 depth interviews carried out to understand their demand for IRP implementation. Additionally, in December 2017, Consultant carried out 04 meetings with local authorities, head hamlet 04 subproject wards/communes and interviewed with 40 AHs to monitor the implementation site clearance report. 33. Mong Cai subproject: Consultant had implemented the SES survey from April 17 to April 27, All severely AHs and vulnerable AHs participated in the survey 100%. Consultant had organized 2 public consultation meetings in Hai Yen and Hai Xuan communes on May 20 and 21, 2017 meetings with 62 people, in which 24 women (38,7%) and 38 men (61,3%). Consultation activities implemented with 37 HHs to identify their needs for IRP. Additionally, in Octocber 2017, Consultant carried out 03 meetings with head wards/communes and interviewed AHs to monitor the implementation site clearance report. 34. Sapa Subproject: Consultation activities were conducted for eligible PAPs to determine their needs for IRP from May 22 to May 26, 2017 through community consultation meetings and questionnaires. In summary, the AHs consulted all agreed to the construction the infrastructures to create a less polluted environment. They agreed to give land on condition they get fair compensation price. During the discussions, residents also given their knowledge the project, relevant rights and policies relating to AHs Other Remarks on Livelihood Restoration 35. Difficulties: In reality there are not many lesson learnt, as well as implemented Livelivehood Restoration Programme in 3 towns/cities for the PMU to study and refer to, so there might be difficulties during implementation. 36. Proposal: (i) In each PMU there needs to be a sub-unit to be responsible for the implementation this programme, including people from related authorities/agencies. (ii) each PMU needs 01 appointed staff to monitor the implementation/reporting IRP. (iii) There needs to be specific guidance from ADB s specialist and stakeholders on the implementation process IRP programme from start to end the programme (iv) There needs to be clear directions, specified tasks/responsibilities and coordination between relevant parties during implementation. 7. There are following pending issues under all 02 subprojects Bac Giang and Mong Cai. Bac Giang subproject Additional allowance for vulnerable AHs has not yet implemented (LFDC submiited a compensation plan in Decmber, 2017, but, currently Bac Giang city PC has not approved ) 43 pending cases has not yet received compensation payment, in which 2 HH An Phu hamlet, Song Mai commune (under BG1) the inventory is incorrect and LFDC has been re - measured and 41 HH under BG2 ( 37 AHs in Giap Tieu residential zone, Dinh Ke ward has not yet received compensation payment due to compensations plan has not yet approved and 04 affected organizations has been completed in Jan, 2018 and expect to complet payment in Quarter 1, 2018; Complaint 10 AHs in Giap Tieu residential zone, Dinh Ke ward under BG2 about the wrong identification origin land. They said that that acquired land belongs private land not public land. Currently, local authority said that after having approved compensations plan, they will explain and discuss AHs understand and accept with payment. Complaint 22 AH Huong residential zone, Tho Xuong ward under BG1 about the wrong identification origin land.they said that that acquired land belongs private land not public land. Currently, the pending case has not solved completely. Mong Cai subproject Currently, there are 03 AHs which have not received compensation, about VND 3,370,000,000 in total. 01 HH Lam Van Gai has petition for land origin and compensation unit prices for site clearance (MC2). 01 HH Nguyen Duc Tu is currently in family dispute (MC 19

20 2). 01 HH Nguyen Phu Hung (MC2) households have not agreed with the compensation prices. The complaint HH Lam Van Gai is being handled by the LFDC no ficial results, still reviewing and verifying the grievance. For HH Nguyen Duc Tu the People's Committee Hai Yen ward is inviting the household to the People's Committee to resolve disputes. This information will be updated by the Consultant and the PMU in the next internal monitoring report. 8. OTHER ISSUES 8.1. Mong Cai subproject: 02 staffs PMU took part in the training course on resettlement, dated August 24 and 25, Venue: Hotel Ninh Kieu 2; No3, Hoa Binh street, Can Tho city. (ii) (iii) Deployment safeguards-related staff within PMUs and project implementation support consultants: There is not any change for safeguards-related staff Lao Cai, Mong Cai and Bac Giang PMU. Assessment adequacy resources for PMU staff and consultants: A independent monitoring consultant need to be mobilized to prepare monitoring reports on the implementation urps, u REMDP. (iv) Issues in coordination with different agencies : Currently, the coordination between PMUs and stake holder is good and in ensuring to implement in accordance with ADB s request. 8.2 Temporary Impacts during Civil Works 40. At this moment, there is no information related to temporary impacts during implementation Bac Giang, Mong Cai and Sapa subprojects. This temporary impact may be determined during the civil works by PMU and external monitoring consultant. If there are such cases, these impacts will be monitored and included in the next monitoring reports 20
