5 SEIER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line EXECUTIVE SUMMARY 1 Introduction 1.1 Project objectives Investment in the construction of 220kV Quang Ninh - Hoanh Bo transmission line aims at transmitting electricity from the Quang Ninh and Cam Pha thermal power plants to the national power network. Meanwhile, it shall ensure a stable and reliable power supply for the socio-economic development for Quang Ninh, Hai Phong and Ha Noi which is the main economic region of northern Vietnam. The line covers several following areas: Quang Ninh province: district of Hoanh Bo: communes of Thong Nhat, Son Duong, Troi town; and Ha Long city: Viet Hung ward. 1.2 Project components Contruction of 220 kv Quang Ninh TPP - Hoanh Bo transmission line: 20.1 h.. Expansion of 220kV bays at 220kV Hoanh Bo substation. In-auguration : Total investment of project : 1 11 billions VND. 1.3 Implementation schedule Main milestones : - Completion of Investment report Completion of Technical design - Total estimate: Preparation of construction Construction, acceptance In-auguration Total estimate The total investment of project would be: 1 11 billions VND. 1.5 Policy framework This resettlement policy framework is prepared basing on the OP 4.12 of the World Bank. The principle objective of this Policy Framework is to ensure that all DPs will be compensated for their losses at the replacement cost and provided with rehabilitation measures to assist them. in improve or at least in maintaining their preproject living standards and income earning capability.

6 SEIER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line The Policy Framework lays down the principles and objectives, eligibility criteria of DP, entitlements, legal and institutional framework, manner of compensation and rehabilitation, features of consulted people, and grievances procedures that will guide compensation, resettlement and rehabilitation of DPs. 1.6 Displaced Persons The impacted structures would not have to move out of the ROW for the following reasons: The 220 kv Quang Ninh TPP - Hoanh Bo transmission line is designed to be in the ROW of the feeder No.175 of the 110 kv Hoanh Bo - Mong Duong transmission line. The line is designed in complaince with item 6 of the Decree No. 106/2005/ND-CP with the minimum vertical clearance to such structures of 13m in densely populated areas and 8m in sparsely populated areas. As such these houses do not have to be relocated. 1.7 Principles and Objectives The principles outlined in the World Bank's Operational Policies 4.12 (OP 4.12) have.been adopted in preparing this Policy Framework. In this regard, the following principles and objectives would be applied: a) All DPs residing, working, doing business or cultivating land in right of way (ROW) of transmission line (TIL), surrounding areas of tower foundations, the substation areas, in the service roads under the projects as of the date of the baseline surveys are entitled to be provided with rehabilitation measures. b) According to the Government Decree No. 106/2005/ND-CP, August 17th, 2005 on the protection of the high voltage networks, houses or building in ROW will be provided with subsidy allowance for fireproof materials and lightning arrestors for the existing house/building; cash compensation for the arable land; cash compensation for the directly affected rooms at the substitution cost and cost for demolishing an affected partlroom (No land-forland compensation). c) Plans for acquisition of land and other assets and provision of rehabilitation measures will be carried out via consultation with DPs to ensure minimal disturbance. Entitlements will be provided to DP prior to expected start-up of works at the respective project site. Compensation, resettlement, assistance and rehabilitation activities will only commence upon the WB's acceptance and PPC's approval of the RP. 2. Institutional framework

7 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line This RP has been prepared on the basis of the Project Policy Framework with all GOV and WB policies related to land acquisition, compensation and resettlement (OP 4.12) applied for this RP. Where GOV and WB poiicies are not compatible, the WB's OP 4.12 shall prevail with certain required waivers. 3. Entitlement policy This resettlement policy fiamework is prepared basing on the OP 4.12 of the World Bank. The principle objective of this Policy Framework is to ensure that all DPs will be compensated for their losses at the replacement cost and provided with rehabilitation measures to assist them in improve or at least in maintaining their preproject living standards and income earning capability. The Policy Framework lays down the principles and objectives, eligibility criteria of DP, entitlements, legal and institutional framework, manner of compensation and rehabilitation, resettlement and rehabilitation of DPs. Refer to entitlement matrix for detail. 4. Mitigation measures 4.1 Mitigation measures in design stage Expansion of 220kV bays at 220kV Hoanh Bo substation Expansion of 220kV bays at kV Hoanh Bo substation shall be in a hill with eucalyptus and mixed trees. The total land acquisition shall be 9,328 m2. The design is so selected to have an optimum site elevation in order to minimize soil and rock leveling. As such, the impact is rendered as inconsiderable kv Quang Ninh TPP - Hoanh Bo transmission line + The 220 kv Quang Ninh TPP - Hoanh Bo transmission line is designed to be in the ROW of the feeder No. 175 of the 1 10 kv Hoanh Bo - Mong Duong transmission line. Therefore, its ROW would be mainly the existing ROW area and expansion 4 meters on both sides. + Line route is designed as process and regulation of Electricity unit (distance between lowest line to earth is 13m in densely populated areas and 8m in sparsely populated areas) + Earthing: according to current regulation, all towers in line route are earthed as regulation to ensure construction operation and human safety. (This is also one of measures to minimize efects to property, building of habitants in right-ofway without removing;) + To minimize effects to highway and waterway transportation, at crossroad of highway and waterway, distance from the line to these construction sites should be calculated according to regulation.

8 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line + Height sign and danger sign is designed to avoid unfortunate problems happening in construction and operation. + Conductor and lightning line is protected by anti-shaking shot weight suitable for each kind of line. + Auxiliaries for conductor and lightning line are suitable for line size and ensure safe factor according to regulation. + All towers have restricted sign and number Impact mitigation measures in construction stage - Reasonable construction project, with many shifts, increasing produ.ctivity, finishing at given moment for each item to reduce temporary land requisition time. - Construction activities should be conducted after harvesting crops. - Do not allow the Contractor to extend plant cutting area outside of defined right-. of-way. - Do not cut trees under safe height as regulation. - Supervise quality of highway on temporary road to timely recover, repair damage and avoid effect to local transportation. - With special characteristics of this construction, we should build new camp for workers but renting houses at habitants region. Worker's camp and material store should be in region which the line goes through. 5. Public Participation Information dissemination to, consultation with and participation of affected people and involved agencies (i) reduce the potential for conflicts, (ii) minimize the risk of project delays, and (iii) enable the project to design the resettlement and rehabilitation program as a comprehensive development program to fit the needs and priorities of the affected people, thereby maximizing the economic and social benefits of the project investment. 6. ~aseline information 6.1 Data gathering activities Power Engineering Consulting Company No.1 with the help of local authorities conducted a census in rural areas, Inventory of project' impact in May The inventory works include: Survey on the project impact was conducted in Quang Ninh province: district of Hoanh Bo: communes of Thong Nhat, Son Duong, Troi town; and Ha Long city: Viet Hung ward. The survey shows that 77 PAHs would be affected by the project.

9 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line 6.2 Socio-economic survey Quang Ninh is a mountainous province, it is north east of the country. The province total area is 5,938.6 km2, its population in 2005 was - 1,184,200 Quang Ninh province has 12 urban districts and 1 city Statistics and survey Survey on the project impact was conducted in Quang Ninh province: district of Hoanh Bo: communes of Thong Nhat, Son Duong, Troi town; and Ha Long city: Viet Hung ward. The survey shows that: Total number of DPs: Permanently affected structures: 1,13 9 m2 Temporarily affected structures: 77 HHs (362 persons) 0 m2 Temporary impact on residential and garden land: 15 HHs DPs with houses/structures, which are partially impacted: 25 HHs DPs with permanent acquisition of residential land, agriculture or forestry land: 52 HHs HHs to be resettled: 0 Average income of PAHs: Average number of people per household : 5 PAHs' facilities : 13,000,000 VND/year above average All PAHs in the project area are supplied electricity by the power network Farmers represent 50% of PAHs Few PAHs have main income from trade. These PAHs mainly concentrate in the town center, along the highways. However, some farmer families also make earning from trade but the quantity is not much. 7. Temporary land requisition Land will be requisited temporarily in 2 cases for: foundation works, tower erection, material transport to the line route, conductor and earthwire pulling and stringing. The total temporary requisition of the project is 80,344 m 2. Refer to Chapter VII for statistics on the project temporarily acquired land b. Impact on permanent land acquisition. The total permanent acquisition of the project is included of agricultural land, garden and residential land, waste land and pond area. Permanently occupied agricultural and land tenure land area for building foundation is: 15,979m 2 Refer to Chapter VII for statistics on the project permanently acquired land c. Impact on houses and structures

11 SEER Proiect 220kV QU& Ninh TPP - Hoanh Bo Transmission Line The line routes mainly traverse rice field, crop and fruit areas, populated areas. According to survey statistics, totally there are 5 structures crossed by the line and 20 ones located in the line ROW. Refer to Chapter VII for statistics on the impact on houses and structures. d. Impact on trees and crop Refer to Chapter VII for statistics on the impact on trees and crop. 8. Implementation arrangement ' 8.1. Main activities Activity I: Right after approval of the RAP, PME! must select and contract an independent monitoring organization, the organization shall be approved by Hai Phong PC and WB. Activity 2: Basing on the contract requirement of PME!, the involved provinces shall decide to start RAP programs. Activity 3: DRBs shall obtain statistics on affected assets and specify the compensation rates, check and adjust, if necessary, the compensation according to the unit price and equivalent cost. Activity 4: Upon completion of statistics works, DRBs shall review and specify the exact number of PAHs,affected assets and total compensation for PAHs. Activity 5: RBs shall inform RAP policies, project schedule and information on RAP implementation for PAHs via meetings. Such advices include issues relating to compensation and resettlement program. Activity 6: Compensation payment to PAHs having houses affected first, help them to repair houses and stable their lives. Then comes compensation for other properties. Temporary LURCs shall be granted to all PAHs and permanent LURCs shall be given to their representatives. Activify 7: During all implementation process, IMO, independent monitoring organization shall monitor the project implementation, propose keys for problems Grievance and appeals

12 SEIER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line The mechanism is designed. to be easy, transparent and fair, the procedures are as follows: First step: If any person is aggrieved by any aspects of the resettlement and rehabilitation program, helshe can lodge an oral or written grievance with the commune authorities. The Commune People's Committee will resolve the issue within fifteen days from the date it receive the complaint. Second step: If any aggrieved person is not satisfied with the decision in stage 1, shehe can bring the complaint to the District People's or District Resettlement Committee (CRC) within fifteen days from the date of the receipt of the decision in stage 1. The District Resettlement will reach a decision on the complaint within fifteen days. Third step: If the DP is still not satisfied with the decision at district level, helshe can appeal to the Provincial People's Committee (PPC) or Provincial Resettlement Committee (PRC) within 15 days of receiving the decision of the DPC or DRC. The Provincial People's Committee or Provincial Resettlement Committee will reach a decision on the complaint within fifteen days. Fourth step: If the DP is not satisfied with the decision of the Provincial level, the case may be submitted for consideration by the District Court within 15 days of receiving the decision of the PPC or PRC. The district court's decision will be a legal basis for compensation. DPs will be exempted from all administrative and legal fees. DPs can make an appeal on any aspects of resettlement and rehabilitation program, including the compensation unit price. The detail procedures of solving grievance will be disclosed to all DPs in the public meetings and at the CRC offices. This information is also contained in RIB, disseminates to all DPs promptly after the commencement of the project. 8.3 Monitoring and supervision The implementation of RP shall be constantly supervised and monitored by PMB in co-ordination with the local People's Committees Internal monitoring IMO shall prepare a detail report on activities to submit to PMB and WB every 3 months to see weather the process are in compliant with policies of the government, WB External monitoring

13 SEER Project 220kV Quang Ninh TPP - Moanh Bo Transmission Line Resettlement Pla - Write final report (6 months after entire accomplishment of the resettlement program). This report shall provide detailed evaluation of RP and its implementation? including the content of interview with DPs about the situation and their opinions after receiving compensation and resettlement. - Finally, on the bases of RP implementation experience, this final report shall provide suggestions to enhance the local RP implementation experience and improve RP in the future - Terms of reference for independent monitoring will be prepared by PMB and sent to WB for its concurrence prior to invitation for independent monitoring consultant. 9. Project Objectives Investment in the construction of 220kV Quang Ninh - Hoanh Bo transmission line aims at transmitting electricity fkom the thermal power plants to the national power network. As such these houses do not have to be relocated. 4. Principles and Objectives The principles outlined in the World Bank's Operational Policies 4.12 (OP 4. i2) have been adopted in preparing this Policy Framework. In this regard, the following principles and objectives would be applied: a) Acquisition of land and other assets, and resettlement of people will be minimized as much as possible. b) All DPs residing, working, doing business or cultivating land in right of way (ROW) of transmission line (T/L), surrounding areas of tower foundations, the substation areas, in the service roads under the projects as of the date of the baseline surveys are entitled to be provided with rehabilitation measures sufficient to assist them to improve or at least maintain their pre-project living standards, income earning capability. Lack of legal rights - to the assets lost should not bar the DP from entitlement to such rehabilitation measures. c) According to the Government Decree No. 106/2005/ND-CP, August 17th, 2005 on the protection of the high voltage networks, houses or building in ROW will be provided with subsidy allowance for fireproof materials and lightning arrestors for the existing househuilding; cash compensation for the arable land; cash compensation for the directly affected rooms at the substitution cost and cost for demolishing an affected partlroom (No land-forland compensation).

17 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line - d) Plans for acquisition of land and other assets and provision of rehabilitation measures will be carried out via consultation with DPs to ensure minimal iiispli~b~ce. Eniitlements wiii be provided to DP prior to expected start-up of works at the respective project site. e) Institutional arrangements will ensure defective and timely design, planning, consultation and implementation of RP. fl Effective and timely supervision, monitoring and evaluation of the implementation of RJ? will be carried out. The entitlement will be provided to DPs prior to expected constructiol~ commencement at the respective project site. This RP preparation has been carried out by Power Engineering Consulting Company No. 1 in accordance with the provision of the Policy Framework with consultation and participation of DPs and local authorities. This 'RP has been agreed upon by the relevant local authorities and will be valid after EVN's and WB's approval. Compensation, resettlement, assistance and rehabilitation activities will only commence upon the WB's acceptance and PPC's approval of the RP. 5. Mitigation measures a) Design stage In order to avoid or mitigate the adverse impacts on land, assets, structures and crop of local people, the line is so selected to be along or closed to the existing roads to facilitate future operation and maintenance; or cross the agricultural or garden land. By this solution, the route will cross over the road some times to avoid impact on houses or structures. Construction of the new roads are limited, try to use the existing ones. The temporary roads will be mainly built in the ROW area. b) Construction stage The suitable measures and construction arrangement are to be thoroughly considered as the construction period will be implemented after the harvest collection, and ended before the following harvest. To gain this target, some daily workings will be changed and planned in order to shorten the temporarily affected period. Workers' camps will be located at vacant site or at the public land nearby the commune steering board and will not be built near the residential areas. Appropriate workforces with working shifts will be scheduled to shorten the temporarily affected period.

19 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Chapter 11 INSTITUTIONAL AND LEGAL FRAMEWORK 2.1 Institutional framework Overall responsibility The overall responsibility for enforcement of the Policy Framework and for planning and implementing this RP is rest with Northern Vietnam Power Project Management Board, and related institutions/departments of Finance, Industry, Construction, etc.). Northern Vietnam Power Project Management Board, Power Engineering Consulting Company No.1 are responsible for carrying out census, socio-economic surveys, population and inventories and preparing RP within their respective jurisdiction. The related District and Commune People's Committees will participate in the RP preparation and implementation. These administrative units will also ensure the active and effective participation of the DPs in RP preparation and implementation. In order to make RP acceptable to the WB and to implement RP smoothly, PMB is responsible for (i) hiring a qualified consultant in preparing RP, (ii) appointing qualified social safeguard staffs at Northern Vietnam Power Project Management Board and provincial/district resettlement committees. Funds for implementing RP will be from EVN budget Detail responsibility a) EVN: is the project investor responsible for approving the project documents, providing PMB with fund and guidance on the project control and implementation as well as RAP preparation and implementation. b) PMB: MPPMB on behalf of EVN is the project manager and responsible for the whole project covering investigation, consultancy, design, bidding, resettlement, construction, assignment for specialized bodies to prepare and implement the project, submission to EVN for approval on decisions concerning resettlement submitted by PPCs, monitoring the resettlement activities. Overall planning, management and monitoring of the resettlement programs;

20 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line c) PECCl Ensuring that all eligible PAHs are identified, provided with their respective entitlement according to the resettlement policy and is relocated as per the implementation schedule and with minimum hardships to PAHs; Ensuring that all PAHs are informed about their entitlements and provided with the resettlement Information Booklet (RIB), as proof of their eligibility to resettlement benefits; Explaining the scope of the project to Peoples' Committees at various levels; Providing copies of the RAP to resettlement boards and explaining the approach adopted and the categories of entitlement that will be used. Coordinating with resettlement boards at each level on the implementation of resettlement activities; Carrying out internal monitoring of RAP implementation and appointing a competent agency for external monitoring of land acquisition and resettlement activities; Providing the budget for resettlement and rehabilitation; Reporting on the progress of resettlement activities to EVN. Surveying, measuring and confirming AA Coordinating with DRB in classification of affected property. Studying and classifying affected people and houses. Undertaking to collect data, plan RP for the project basing on collected data fiom RBs. Coordinating with PMB in training enumerators d) City/Provincial People's Committee The PPC is responsible for endorsing the RP and clearly direddemarcate the responsibilities for their relevant institutions in implementing RP Approve the compensation unit cost, allowances and establish evaluation committees, compensation committees at all administrative levels and approve lands for compensation. Redress complaints and grievances. e) RP related provincial departments The Provincial DOF is responsible for studying and issuing unit prices of compensation and submitting to PPC for approval. Right fiom the initial stage of

21 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line the RP implementation, the DOF will closely co-ordinate. with DOCS, DCH, DARDs, District People's Committees and independent external monitoring agency in order to evaluate the applicable unit prices in RP and submit to PPC for approval and ensuring that the compensation unit prices to be at the replacement value at the time of compensation payment. f) Provincial compensation/resettlement committee The Provincial CRCs are responsible for implementing RP according to the approvad schedule. The Provincial CRCs will be headed by the Vice Chairman of the Provincial People's Committees. The Provincial CRCs are responsible for: Assisting PMB and District CRCs in preparing detailed plans for compensation and resettlement. Checking all inventory of impacts and detailed implementation plans submitted by District CRCs, approving the implementation plans submitted by the District CRCs, ensuring that the compensation unit prices to be at the replacement value at the time of compensation payment. Solving complaints if the redressed.is fail at the districts level. The City/provincial CRCs will consist of representatives of: Department of Finance and Pricing Department of Construction Department of Natural Resources and Environment (Cadastral and Mousing section) Chairmen of People's Committees of related districts. Representatives of CityProvincial PMB. g) District People's Committees The District People's Committees are responsible for guiding the compensation and. resettlement activities in their respective district areas: Direct the relevant institutional for carrying out impact survey; public consultation, information dissemination on the resettlement policy and RP' implementation. Establish District CRCs. Be responsible for settling complaints of DPs at district level. h) Districts Compensation/Resettlement Committees

The District CRCs recruit experienced persons for gathering of baseline information and inventory. The District CRCs are responsible for: Organizing the survey team to carry out Detailed Measurement Survey (DM9 For affected houses and assets; finalize DMS and Entitlement forms for each DP. Checking the unit prices of compensation as applied in W, suggest for adjusting the unit prices in conformation with market priceslreplacement costs (if required). In co-ordination with PMB, organize meetings with DPs and communes, disseminate the RIB, DMS and entitlement forms to DPs. Based on the policy and approved process in W, prepare the detailed implementation plan (quarterly, semi-annual, annual plans) and together with PMB deliver entitlements to DPs in a timely manner. Settling the complaint and grievances of DPs, solving any difficulties during the implementation period, and suggest the solutions for the outstanding issues to ProvinciaVCity CRC. The District CRCs will be headed by the Vice Chairmen of the DistrictlCommune People's Committees. The District CRCs will consist of the following representatives: Department of Finance and Pricing Department of Natural Resources and Environment (Cadastral and Housing Section) Department of Industry - Affected Communes DPs i) Commune People's Committees People's Committees of communes will be responsible for: Participating in census surveys and asset inventory. In co-ordination with District CRCs for public meetings, information dissemination, compensation/allowance payment to DPs. Transferring all feedbacks of DPs to District CRCs and settle the complaint at the commune level. Suggesting solution for slient features.

24 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Fund for land acquisition and resettlement Fund for land acquisition and resettlement will be at EVN's costs as part of the project budgets. 2.2 Legal Framework Vietnamese laws Compensation and Resettlement The key national laws, decrees, circulars governing land acquisition, compensation and resettlement consist of the followings: Constitution of Vietnam (1992) confms the right of citizens to own a house and protect the ownership of the house. The new 2003 Land Law on December 10" GOV Decree No.l81//2004/ND-CP dated October 29" 2004 on guidance of implementation of the new 2003 Land Law. GOV Decree No.l97/2004/ND-CP dated December 3rd, 2004 on the compensation, assistance and resettlement in case of land acquisition by the state. - - GOV Decree No.l88/2004/ND-CP dated November 16", 2004 on methodology for price verification and price framework of various types and categories of land. Circular No. 1 14/2004/TT-BTC dated November 26", 2004 of the Ministry of Finance guiding the implementation of-~ecree No. 188/2004/NPCP. GOV Decree No.l7//2006/ND-CP dated 27/01/2004 on guidance of implementation of the new land Law. GOV Decree No.84//2007ND-CP dated May ~ on regulation of land management and land uses, land acquisition, implementation of land use, compensation, resettlement. Circular No.l16/2004/TT-BTC dated May 25", 2004 of the Ministry of Finance guiding the implementation of Decree No MD-CP dated -December 3", 2004 on the compensation, assistance and resettlement in case of land acquisition by the state World Bank policies The legal fiarnework governing the implementation of this Policy Framework and the Inventories and RP are OP 4.12 on Involuntary Resettlement of the World Bank. Involuntary resettlement (OP 4.12).

25 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line The primary objective of the World Bank policy is to explore all alternatives to avoid or- at least minimize involuntary resettlement. Where resettlement is unavoidable, the living standards of displaced persons should be restored or improved to the pre-project conditions. The policy applies to the taking of land and other assets when land acquisition results in the loss for the case of shelter, the loss of all or part of productive assets, or access to them and loss of income sources or other means of livelihood. According to the OP 4.12 on involuntary resettlement, DPs shall be compensated and assisted in such a way as to warrant the improvement or at least the maintenance of pre-project living standard condition. Measures to ensure that resettlement has a positive outcome include: Consulting.with potential displaced persons on feasible measures for resettlement and rehabilitation; Providing DPs with options for resettlement and rehabilitation; Enabling their participation in planning and selecting these options; Providing compensation at full replacement cost for losses; Choosing relocation sites that at least guarantee the same benefits and services as the sites they replace; Providing allowances, training as income support to assist a smooth transition period; Identifying vulnerable groups and providing special assistance to these groups; and Establishing an institutional and organizational structure that supports this process to a successful end. The Eligibility Criteria and Compensation defines that the DPs eligible for compensation include: a) Those who have formal legal rights to'land or other assets; b) Those who initially do not have formal legal rights to land or other assets but have to acclaim for legal rights based upon the laws of the country; upon the possession of documents such as land tax receipts and residence certificates; upon the permission of local authorities to occupy or use the project affected piots; and c) Those who have no recognizable legal right or claim to the land they are occupying.

DPs whose houses are in part or in total affected (temporarily or permanently) by the project or whose residential and premise andlor agricultural land is in part or in total affected (temporarily or perrnanently) by the project are provided compensation for the lost land, and other assistance as necessary to achieve the objectives set out in this policy, if they occupy the project area prior to the cut-offdate defined in this FW. DPs whose business are affected in part or in total (temporarily or perrnanently) by the project are provided with resettlement assistance and other supports as necessary to achieve the objectives set out in this policy, if they occupy the project area prior to the cut-off-date defined in this W. Persons who encroach on the areas after the cut-off-date defined in this RP are not entitled to compensation or any other forms of resettlement assistance. The methodology to be used in the valuation of losses for this project is based on the replacement cost. In this project, losses comprise land, structures and other assets. Residential cost for land includes the value of land at the market price plus the costitaxes and frees to get LURC. For houses and other structures, the market cost of the materials shall be used to calculate the replacement cost for an equivalent structure with area and quality should be at least as good as those affected. For both totally and partially affected structures, compensation includes market cost of material, plus the costs of materials transport, labor and contractor fees, and registration and transfer taxes. Depreciation of the asset and amount saved in material will not form part of replacement cost Comparison of GOV and WB approaches There are a number of ways in which approaches of the Vietnam Government-either in policy or practice-are compatible with the World Bank guidelines. The most important compatibilities are: Vietnam has a process. whereby most people without legal land rights may meet conditions of legalization and receive compensation for losses. Permanent residents are provided with options that include relocation to an improved site, or cash, or a combination of the two. Resettlement sites offer not only better improved infrastructure and services but represent a higher standard of living. Allowances are provided to help DPs in the transition period and there is an institutional structure through which people are informed, can negotiate compensation, and appeal.

27 SEER Project 220kV Ouang: Ninh TPP - Hoanh Bo Transmission Line Differences between approaches and measures that need to be addressed within the program also exist. However, in this context, procedures exist within national and city government that allow the granting of wavers of domestic iaw on specific projects which may be conflict with that of the funding agency. On the issue of land tenure and legal right to compensation, the Government and World Bank approaches are compatible. The Government has its own process in place whereby land occupied without legal documentation can be legalized; this land, however, is compensated for at a rate equal to 100% of land price minus the taxes and fee for land use right registration from October 15' 1993 (Clause 49,50 of Article 42 of the 2003 Land Law). Compensation at replacement cost is ensured in Article 6 of Decree No. 197/2004/ND-CP dated December 3rd, 2004 that '....People who have land being required shall be compensated with land of similar use purpose. If there is no land for compensation, cash compensation equal to land use rights value at the time of land acquisition shall be applied. If there is any differences in value, in case of compensation by new land or house, such differences shall be settled in cash' and, Article 19 of the same Decree that '...Houses and structures of domestic use of the household or individual shall be compensated with the value for construction of new houses, structures of similar technical standard....' Required waivers In order to meet the requirement of the world Bank OP 4.12 on Involuntary Resettlement, a number of articles in various Vietnamese laws and regulations which do not ensure compensation at the replacement cost or set eligibility provisions which do not extend the right to rehabilitation and or assistance to households without proper land papers, will be waived. The articles of law and regulations that will be waived are mentioned below. (i) Eligibility to compensation andlor assistance - Article 7 of the Decree No. l97/nd-cp dated December 3d, 2004 Article 7 - (Cases where land is recovered without compensation) stipulates that any person whose land is recovered and who has not met one of the conditions of Article 8 of this Decree, or who has violated the plan, or who violates the protecting ROW, or who illegally occupies land shall not receive compensation when the state: recovers the land. In case of necessity, the Provincial People's Committee shall consider and decide on a case-by-case basis. Article 18 (Items 3&4), Article 20 (Item 2b,c) of the Decree No.l97/ND-CP stipulate the compensation principle for assets:

28 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Resett1emen.t Plan o.houses and structures on non-eligible-for-compensation land, which have not violated the announced land use plans or the right of way-shall be assisted at 80% of replacement compensation. o Houses and structures on non-eligible-for-compensation land but at the time of building violated the announced land use plans or the right of way will not be assisted. If necessary, the PPC will consider assistance on the case by case basis. To ensure that the objectives of this resettlement policy are met, a special decision of the Government waiving Articles 7,18,19,20,28,29 of Decree No. l97md-cp is needed to permit assistance and rehabilitation measures for illegal users of land as proposed in the policy. (ii) Land price for compensation calculation According to the Vietnamese regulation, calculation of the unit price for land compensation will be based on the GOV Decrees No MD-CP, MD-CP with their Guidance (Circular No. 114/2004/TT-BTC and No lTT-BTC, respectively) Decree No MD-CP dated December 03", 2004 Article 9 This article states that land price for the compensation calculation is the land price in respect of land use purpose at the time of land acquisition, promulgated by the provincial People's committee inline with the Government regulation (within the GOV's range of minimum and maximum prices). Decree No IND-CP dated November 1 6th, This Decree promulgates the methodologies to define land price and, at the same time, set forth the land price framework (min. and max. unit price for various types of land) throughout the country. Article 2 This Article states that the land price shall be defined by the Provincial People's committee and/or cities directly under the central govenament..the compensation unit prices established by the Provincial/District CRCs, provincial DOFs, DOCS and approved by the provincial People's committee may be adjusted to meet the replacement costs, by the time of compensation, to ensure the objectives of the RP policy are met. v) GOV commitment

29 SEER Project 220kV Quang Ninh TPP - Boanh Bo Transmission Line GOV Decree No. 13 1/2006/ND-CP dated November 1 l m 2006 guiding the ODA management (Addmendment of Decree No. 19/200 1/ND-CP dated May 4m 200 1) and Decree No. 197/2004/ND-CP dated December 3' The Item 2 (Article 2.5) of the GOV Decree No. 13 1/2006/ND-CP dated November 11& 2006 on guiding the ODA management stipulates that "in the case of the international agreement on ODA have been signed between GOV and sponsor stipulates other contents, the international agreements will prevail". The Item 1 (Article 2) of the GOV Decree No. 17/200 1MD-CP dated May 4m on guiding the ODA management clearly states that "in the case of the international agreement on ODA have been signed between GOV and sponsor stipulates other contents, the international agreements will prevail". The waivers will be approved by GOV in the decision of project investment before negotiation. The Project Provincial People's Committees will issue the official letter for their agreement implementing the policies set forth in RP. 2.3 Definition of eligibility and limitation to eligibility DPs are all individual, firms or institution with or without land registration papers that owned, rented, or used land, properties and business, which are affected by the project. All DPs will be entitled to full compensation for their respective losses as long as they are include in the RP inventory list or can prove that they owned the affected items before the cut-off date. The same applies to DPs whose incomes are affected by the project. The subproject surveys have been carried out; the sub-project issues have been communicated to the people in the project related localities along with community participation; and T/L routes have been approved by the local authorities. It is agreed between the local authorities and PMB that the cut-off date shall be August 2nd, The cut off date is officially declared by the competent local authorities. Encroachers who settled into the proposed affected area after the cut off date will have no entitlement to compensation and resettlement. They will be required to demolish their structure and cut the trees or harvest their crops for land clearances for the project. In necessary case, they will be forced to remove out of the proposed project area. Nevertheless, they do not have to pay any fine or sanction. The cut-off date and the provision of "no compensation for encroachers" have been clearly declared in the community meetings. 2.4 Eligibility to compensation entitlement The DPs eligible for compensation include:

30 SEIER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Resettlemenit Plan a) Those who have formal legal rights to land or other assets; b) Those who initially do not have formal legal rights to land or other assets but have a claim to legal rights based upon the laws; upon the possession of documents such as land tax receipts and residence certificates; or upon permission of local authorities to occupy or use the project affected plots; and c) Those who have no recognizable legal right or claim to the land they are occupying, if they occupy the area prior to the cut off date defined in the RJ? The DPs are identified by the baseline information collected for RP: a) Persons whose houses are in part or in total affected (temporarily or permanently) by the project b) Persons whose residential and premise andlor agricultural land is in part or in total affected (temporarily or perrnanently) by the project. c) Persons whose crops and (annual and penenual) trees are affected in part or in total by the project. d) Persons whose businesses are affected in part or in total (temporarily or permanently) by the project

31 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Resettlemer~t Plan CHAPTER Ill ENTITLEMENT POLICY 3.1 Definition of Eligibility and Limitation to Eligibility Project Affected Households (PAHs) are all individuals, households, firms or institutions with or without land registration papers who owned, rented, or used land, properties and businesses which are affected by the Project. All PAHs will be entitled to full compensation for their respective losses as long as they are included in the PAP inventory list or can prove that they use the affected items before the cut-off date. The same applies to PAHs whose incomes are affected by the project. Encroachers who settled into the proposed affected area after the cut-off date will have no entitlement to compensation and resettlement. They will be required to demolish their structures and cut the trees or harvest their crops for land clearance to the project. In necessary case, they will be forced to be removed out the proposed project area. Nevertheless, they do not have to pay any fine or sanction Principles on Compensation and Resettlement The principles and objectives of this RP are defined in accordance with Vietnamese laws and WE3 directives, which have been adapted to fit the specific conditions of the project. The principles outlined in the World Bank OP 4.10 have been adopted in preparing this policy framework. In this regard, the following principles and objective would be applied: a) Acquisition of land and other assets, and resettlement of people will be minimized as much as possible. b) All DPs residing, working, doing business or cultivating land in right of way (ROW) of transmission line (T/L), surrounding areas of tower foundations, the substation areas, in the service roads under the projects as of the date of the baseline surveys are entitled to be provided with rehabilitation measures sufficient to assist them to improve or at least maintain their pre-project living standards, income earning capability. Lack of legal rights to the assets lost should not bar the DP from entitlement to such rehabilitation measures.

32 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Resettlement Plm c) According to the Government Decree No. 106/2005/ND-CP, August 17th, 2005 on the protection of the high voltage networks, houses or building in RO-W- wiii be provided with subsidy aiiowance for fireproof materiais and lightning arrestors for the existing househuilding; cash compensation for the arable land; cash compensation for the directly affected rooms at the substitution cost and cost for demolishing an affected partlroom (No land-forland compensation). d) Plans for acquisition of land and other assets and provision of rehabilitation measures will be carried out via consultation with DPs to ensure minimal disturbance. Entitlements will be provided to DP prior to expected start-up of works at the respective project site. e) Institutional arrangements will ensure defective and timely design, planning, consultation and implementation of RP. Effective and timely supervision, monitoring and evaluation of the implementation of RP will be carried out. The entitlement will be provided to DPs prior to expected construction commencement at the respective project site. Compensation for land losses less than 25% of total land holding of PAP and all other losses will be provided in cash. Compensation for land losses greater than 25% of' total land holding of PAP would be provided in terms of land at the equivalent area and quality of the land acquired by the project. This RP preparation has been carried out by Power Engineering Consulting Company No. 1 in accordance with the provision of the Policy Framework with consultation and participation of DPs and local authorities. This RP has been agreed upon by the relevant local authorities and will be valid after EVN's and WB's approval. Compensation, resettlement, assistance and rehabilitation activities will only commence upon the WB's acceptance and PPC's approval of the RP Compensation policy Compensation for crops will be provided at the market price; compensation of land, houses, buildings, trees, and other assets will be provided at the replacement cost basing on the provincial unit price.

33 SEIER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Since the time from RP preparation to time of project implementation may be long, at the implementation time such prices may not correspond to the replacement rates. - lherefore, aii applied prices wiii be checked again at the beginning of W implementation and adjusted, if necessary. The Detailed Measurement Survey (DMS) will be also carried out by Resettlement committees at the beginning of project implementation. The evaluation of unit prices at the implementation time will be done by independent monitoring agency, provincial DOF. This activity will later be required in TOR for independent monitoring Entitlement Policy PAHs are classified into two kinds on basis of impact property: 1. Temporary impact: including the Households whose lands, annual crops and trees of lower than 4m are within ROW or surround tower foundation area, access roads during construction process. 2. Permanent impact: including the households whose lands are acquired for tower foundations or affected by access roads for construction or for further use during operation and management as well as the households whose structures/houses and trees are over 4m high within ROW. ~ccordingly, -the entitlement policy is defined as the follows: A. Compensation policy: I. Households impacted on lands of agriculture, forestry and trees, crops within the ROW: Lands within the ROW that are temporarily affected during construction process (due to pulling and stringing line) will not be compensated. In case of rice and annual crops, the compensation will be paid in cash to the farmers at the full market value of affected crops on base of three recent years' average harvest for the affected area within the ROW. In case of perennial plants, trees of over 4m high will be cut down. Compensation for lost of timber trees will be in cash at substitution value on the basis of type, age and productive value. Additionally, PAHs will be entitled to an one-time allowance equal to the value of a crop harvest to enable PAHs to shift another cultivation (e.g: plants of not more than 4m high or crops). 2. Households impacted on residential and garden lands within the ROW:

34 SEER Project 220kV QU& Ninh TPP - Hoanh Bo Transmission Line - No compensation is made for land temporarily affected during construction process. Lands within the ROW will still be used in compliance with electricity safety regulations. The cut down trees or affected trees due to conductor and earthwire pulling and stringing will be compensated at the substitution cost on base of type, age and affected quantity. The temporarily affected area around the foundation will be cleared and cleaned before returning to the owner. All the PAHs without LURC will be granted identification by the local authority at the earliest possible time. B. Policy on allowances and subsidies: In addition to the compensation on damages, the PAHs will be granted the allowances and subsidies as regulated in Decree No. 197/2004/ND-CP dated December 3'*, Namely: - An allowance on business income will be granted to the Households borne damages in business due to the land requisition or removing to another place. The allowance will be equivalent to the PAHs' monthly income, namely 3,000,000~/H.H. - Special Allowance: Under the law of Vietnam, a special allowance of 2,000,000 to 3,000,000VND will be granted to revolutionary families. Catego? 5: PAP has house, which are partially or totally damaged, and the damaged portion will affect to the safety of the entire house or structure, so the house need to be totally removed and rebuild. But PAP does not have spare residential land for the reconstruction of a house of equal dimensions as the house lost. Impact within foundation or substation area Catenow 6: PAP - has residential land, agriculture or forestry land which will be acquired permanently for the project, including permanent roads construction and maintenance of the project. The total land acquisition shall be 9328 m 2. The design is so selected to have an optimum site elevation in order to minimize soil and rock leveling. 44 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Chapter V Public Participation 5.1 Objectives of information campaign and consultation program Information dissemination to, consultation with and participation of affected people and involved agencies (i) reduce the potential for conflicts, (ii) minimize the risk of project delays, and (iii) enable the project to design the resettlement and rehabilitation program as a comprehensive development program to fit the needs and priorities of the affected people, thereby maximizing the economic and social benefits of the project investment. Minutes of community meetings are attached in the annex. The objectives of the Public Information Campaign and PAP consultation^ Program are as follows: - To share hlly information on the proposed project, its components and its activities, with the affected people. - To obtain information about the needs and priorities of the effected people, as well as information about their reactions to proposed policies and activities. - To obtain the cooperation and participation of the affected people and communities required to be undertaken for resettlement planning and implementation. - To ensure transparency in all activities related to land acquisition, resettlement and rehabilitation. There are two phases of the public information campaign and PAP consultation: Phase I: RP preparation During resettlement planning and RP preparation activities. This phase consisted of line route selection, detailed measurement survey (DMS) of affected assets, and identification of strategies for relocation. Phase 11: RP implementation During the implementation of resettlement and rehabilitation activities. This phase will consist of information dissemination and consultation regarding: resettlement policies and procedures; calcstilation and payment of compensation; relocation options, sits and designs, resettlement site and house construction, and clearance from the project area.

45 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line 5.2 Phase I: Information campaign, PAP & agency consultation during resettlement planning and RP preparation During phase I, the phase of detailed resettlement planning and RP preparation, the following activities were carried out sequentially: * Phase I - Activity 1: Information & discussion with local authorities on the line route to be rehabilitated. After studying maps and visiting the site, PECC 1 had envisaged a preliminary route on 1150,000 scale map. This map was sent to all locations passed by the line and relevant local authorities. The local authorities have agreed on the project line routes. This activity was completed in Phase I - Activity 2: Impact survey and statistics Based on the agreed line routes, survey teams had realized the routes at sites, made the piling and coordinated with the commune officials to make a list of PAHs' affected land and crops. The socio-economic survey forms were delivered to affected households (for each commune) as basis for SLS. This activity was completed in Phase I - Activity 3: Meetings with PAHs When the survey finished, PECC 1 in coordination with the commune officials held meetings with PAHs having land in the line ROW and with village representatives. In these meetings, PECC 1 officials informed the participants of the project purposes; presented the project impacts on land and crops in detail; introduce the principles and policies of compensation and advised people not to build new structures in the line ROW. PAHs were consulted on the entitlement policy and the compensation in cash had been accepted. This activity was completed in Phase I - Activity 4: Meetings with concerned PPCs Together with working with the communes, in 6+7/2007 PECC 1 would send missions to work with the provincial functional agencies such as Financial and pricing service, Planning and investment service, Agriculture and rural development service, Natural resources and environment service, etc. and make the project purposes clear to PPCs; at the same time discuss with local officials on the aims and principles of ground clearance, on the proposed policies of RP, legal and illegal issue, grant of LURC in the localities and the local organization working on resettlement and compensation; collect the local compensation rates for land and crops. Phase I - Activity 5: Consultation on RP

46 SEER Project Resettlement Pla 220kV Quang Ninh TPP - Hoanh Bo Transmission Line - Basing on the survey result, PECCl shall prepare RP to submit to Hai Phong power one-member company Ltd., WB and concerned PPCs for revision. All - comments shall be taken into consideration, incorporated in the next version for approval by relevant authorities. Phase I - Activity 6: Approval of RP The revised RP shall be submitted to WB for approval. EVN shall ask the provincial authority for approval of RP policies to enforce them in the province. This shall be legal basis for RP implementation. However, 25 PAHs are located sparsely in the project area and most of.them argreed to remain within the line ROW with adequate compensation. Therefore, there is no mention of a resettlement site in this report. 5.3 Information campaign & consultation during resettlement implementaltion Phase I1 - Activity 1: Information dissemination and training of RBs: After the signing of the loan agreement, the first resettlement activity is to sign contract with PRBs on resettlement implementation. NPPMB will provide local RBs at all levels with information on policies for PAHs, detailed information about RAP policies and implementation procedures of local meetings. Phase I1 - Activity 2: Information on resettlement document and compensation form distribution to PAHs before starting another DMS: Local RBs will carry out an additional DMS to make a detailed compensation form for PAHs as basis for preparing. The following activities must be implemented before starting the additional DMS: * Activity 2a: Distribution of compensation forms for lost assets and resettlement information booklets (RIBs) to PAHs. RIBS described in item 7.4 will be distributed to PAHs together with a form for listing lost assets. Additionally, they are given by radio, TV, local broadcasting means, posted public notices at tlhe offices of commune people's committee and DRBs. * Activity 2b: After distributing RIBS and compensation forms, RBs of ixll communes should organize meetings to explain RIB and instruct PAHs to list their affected assets in the compensation forms. Meeting invitations must be given to PAHs. Time, place of the meeting must be informed by local broadcasting means and posted public notices. In these meetings, PAHs can raise their questions on any resettlement issues. Phase I1 - Activity 3: Meeting with PAHs on compensation payment.

47 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line ' After getting statistics on lost assets in the line ROW, organize meeting with PAHs to introduce the compensation rates for different impacts. Table of compensation rates wiii be posted in the ofiices of commune peopie's committees. At the meeting PAHs can comment on the proposed compensation rates. Disagreement on compensation rates will be noted down and collected for consideration. Recommendations, if any, will be sent to PAHs for revision and modification if necessary. Besides, PAHs will be informed of time, location and process of compensation payment for the damages. plan. This meeting is scheduled to be held right after completion of compensation Phase 11 - Activity 4: Application of compensation price. The adjusted compensation rates are proposed to be made valid by DRBs and district RBs. PAHs who agree with compensation price for their assets will sign on the compensation form. Disagreement comments will be recorded. Phase I1 - Activity 5: Information to local authorities on implementation schedule. Inform commune authorities and PAHs about construction schedule and procedures as well as the project schedule. PPSs will keep the commune and district RBs informed of schedule for the project components concerning each locality. Commune and district RBs must coordinate with PPSs to ensure that all PAHs know well about compensation and implementation schedule. -

48 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line - Chapter VI BASELINE INFORMATION 6.1 Data gathering activities Power Engineering Consulting Company No.1 with the help of local authorities conducted a census in rural areas, Inventory of project impact in May The inventory works include: Census of all DPs impacted by the project. Survey for DPs, who have houses in the proposed location. Survey for DPs, who have trees impacted in the proposed locations or ROW (according to Decree No. 106/2005-NDICP dated 17/08/2005). Survey for impacted public infrastructure, properties, and means of transport. Survey for land acquisition area for tower foundation. Survey for temporary land acquisition area. Survey for other impacted area. 6.2 Socio-economic survey. The 220 kv Quang Ninh TPP - Hoanh Bo transmission line would traverse following areas: Quang Ninh province: district of Hoanh Bo: communes of Thong Nhat, Son Duon,g, Troi town; and Ha Long city: Viet Hung ward. The total length of the line in the selected alternative would be 20.1 km and its ROW would be m wide. Quang Ninh is a mountainous province, it is north east of the country. The province total are is 5,938.6 km2, its population in 2005 was - 1,184,200 Quang Ninh province has 12 urban districts and 1 city Statistics and survey Surveys on the project impact were conducted during preliminary survey stage. PECCl had sent 2 survey teams to the relevant provinces for site survey arid measurement. Each survey team of 5+6 persons was responsible for 10 km. Duririg the survey, these teams had worked with the local cadastral officials.

49 SEER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line In addition to statistics on the project impacts, socio-economic data on PAHs were also collected. These data are used not only for RAP but also for FS preparation, evaluate the project socio-economic benefits. The census forms were prepared for PAHs having houses in the line ROW (severe impact) and some PAHs having land in the line ROW (small impact). Refer to survey form in the Annex. Survey on socio-economic conditions was carried out to evaluate and. identify characteristics of the project communities, evaluate standings of population, houses, main economic activities and income, etc. These data were used in. establishment of RAP policies as well as assess the project economic efficiency. The survey shows that: *:* Population Household characteristics: - The average number of people per household is 5, compared to 5 of the: whole country. Large households usually comprise of 193 generations. - Most households are headed by men, female heads of households are mostly windows - Young people (Os17 years) represent 15-20%. - The productive age group (18s54 years) accounts for 35-55%. - Old people (over 55 years) take 25-50%. *:* Housing condition Type of dwellings Ministry of construction classifies buildings into 4 classes: 1,2,3,4. Buildings of class 1 & 2 are permanent structures with modem facilities & interior decorations, private toilets & bathrooms, separate living rooms & bedrooms. This type of buildings is usually located in big city centers, there is no such building in the ROW. Buildings of class 3 are permanent structures with brick wall, reinforced concrete roof, brick floor, conventional facilities & interior decorations. There are 3 structures of this type. Buildings of class 4 are semi-permanent structures with brick wall or wooden "wall in the rural areas, tile roof zind-"galvanized iron sheet, brick or cement floor and usually without toilets.

Bo Transmission Line Beside the above mentioned classes, in the rural Vietnam there are a lot of non-standard houses such as class 4 houses with soil wall, thatched roof & soil floor. Additionally, there are huts with thatched roof surrounded by bamboo's only. These structures are usually used as auxiliary structures, by-road hutches, animal stables, etc. ones. The survey data show that most houses belong to class 4 and the temporary Plot size Most households have large arable plots. About 113 of households have garden area of over 500m 2. Houses are usually constructed in this area therefore: sometimes it is difficult to identify residential & arable area. Generally, the project areas are sparsely populated, the average residential area is m2/household~, very small compared to the household garden area. Beside garden, PAHs also have 500m2+3000m2 agricultural land for cultivation. Cultivation in this area is mainly on rice, maize, corn, industrial crops like teas, litchis, longans, eucalyplus, jacqkfruits, pines, etc. Amenities PAHs' modem facilities are not much. 80% PAHs have motorbikes, over 90% PAHs have TV sets, 95% have bicycles, 100% have radios. Pumped water accounts for 90% while stream water and well water account for 10% of the total PAHs. A11 PAHs in the project area are supplied electricity by the power network. *:* Economic activities Agriculture Farmers represent 50% of PAHs. Most of these PAHs are affected by agricultural land acquisition and impact on crops in the line ROW during construction process. The line traverses low population density area. The survey shows that PAHs have large arable land, many PAHs have over 1500m 2 of arable area. PAHs' main cultivation is on rice, maize, cassava. Besides, they also plant orchard trees, etc. Through working sessions with local au~horities, it is known that there are relatively large wild lands in the project areas. Some areas are not filly exploited. Water sources & initial investment capital (quite a big amount) for industrial trees are main difficulties.

51 SEIER Project 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Trade PAHs with income mainly from trade account for moderate portion. These PAHs mainly concentrate in the town center, along the highways. However, some fmer families also make earning from trade but the quantity is not much. Forestry The affected forested land is scattered through out the concerned province. However, only few PAHs have gross income from forestry, they also make income fiom agriculture. It is usually very difficult to point out the main income source. Income * Source of income: PAP'S main source of income is from agriculture (30%), livestock breeding and services (10%). About 60% of survey PAHs have secondary source of income. This source accounts for 10% of the total income. * Level of income It is very difficult to specify PAP exact income as PAHs themselves can not point out their income exactly. PAP income changes frequently when the price of' agricultural products, especially coffees change so much & so often. The average monthly income of PAHs is 1,000,800 VND. Some PAHs earn over 30,400,000 VNDhonth. Meanwhile many PAHs earn less than 1,000,000 VND/month.

52 SEER project' 220kV Quang Ninh TPP - Hoanh Bo Transmission Line Resettlement P1a1 Chapter VII PROJECT IMPACTS The 220 kv Qnang Ninh TPP - Hoanh Bo transmission line would traverse mainly rice fields in Quang Ninh province: district of Hoanh Bo: communes of Thong Nhat, Son Duong, Troi town; and Ha Long city: Viet Hung ward. The total area of the project ROW is 80,344 m 2, of which 39,1% is agricultural land; 12.5% is forest land; 6.2% is garden and residential land; the remaining 42.2% is waste land. As the scope of the project is inconsiderable, each component can be completed in 2+4 months. Thus the impact will be on one crop time. Consider commencement right after harvest of annual crops, if possible, to minimize the project impacts. The total temporary requisition of the project is 80,344 m 2. Implementation measures Information to PAHs Chapter VIII IMPLEMENTATION ARRANGEMENT All PAHs are entitled to be informed of the entitlement policy, compensation rates for each type of impacts, right to participate into land acquisition, avenue l:o grievances, etc. RIB shall be distributed to all PAHs or at meetings of provinces, districts, communes; be announced on television, radios, newspapers; be macle public in places like CPCs' offices, schools. Dissemination to people right after project approval of EVN and WB. The content of the RIB are outlined below: 1. Date of project implementation 2. Eligibility and ineligibility to rights on compensation and resettlement 3. Principle on compensation for only PAHs that use the land before surve:y and official announcement of the state agencies for land acquisition Time for compensation and resettlement As the project only has impacts on houses, st&ctures, trees and crops, compensation payment shall be made only once for the entire loss. Compensatioln for land, houses and trees, crops shall be made at least 2 months prior to land acquisition. Allowances shall be made at beginning of each month (within 1-5 f ~st days) for the period entitled to allowance RAP implementation process RAP activities are classified into 3 types: a. Overall activity: takes place only once at beginning of the project implementation b. Separate activity: takes place at beginning of each project componerit implementation c. Continuous activity: takes place continuously during RAP implementation Basic activities of project Activity 1 :

Activity 2: Basing on the contract requirement of PMB, the involved provinces shall decide to start RAP programs. Activity 3: DRBs shall obtain statistics on affected assets and specify the compensatioln rates, check and adjust, if necessary, the compensation according to the unit price and equivalent cost. Activity 4: Upon completion of statistics works, DRBs shall review and specify th~e exact number of PAHs, affected assets and total compensation for PAHs. Activity 5: RBs shall inform RAP policies, project schedule and information on RAP implementation for PAHs via meetings. Such advices include issues relating to compensation and resettlement program. Activity 6: Compensation payment to PAHs having houses affected first, help them to repair houses and stable their lives then comes compensation for other properties. Temporary LURCs shall be granted to all PAHs and permanent LURCs shall be given to their representatives. Activity 7: During all implementation process, IMO, independent monitoring organization shall monitor the project implementation, propose keys for problems. 8.3 Grievance and appeals Since the entire resettlement and rehabilitation program is being carried out withthe participation of DPs and the impacted scale of this scale is relatively small, :it is expected that there would be no grievance (related to the resettlement and compensation), the detail procedures for solving grievance are prepared for the project. The mechanism is designed to be easy, transparent and fair, the procedures are as follows:

59 Rural Distribution Project 220 kv Quang Ninh TPP - Hoanh Bo transmission line First step: If any person is aggrieved by any aspects of the resettlement and rehabilitation program, he/she tail lodge an oral or written grievance with the commune authorities. The Commune People's Committee will resolve the issue within fifteen days fiom the date it receive the complaint. Second step: If any aggrieved person is not satisfied with the decision in stage 1, shehe can bring the complaint to the District People's Committee (DPC) lor District Resettlement Committee (CRC) within fifteen days fiom the date of the receipt of the decision in stage 1. The District Resettlement will reach a decision on the complaint within fifteen days. Third step: If the DP is still not satisfied with the decision at district level, he/she can appeal to the Provincial People's or Provincial Resettlement Committee (PRC) within 15 days of receiving the decision of the DPC or DRC. The Provincial People's Committee or Provincial Resettlement Committee will reach a decision on the complaint within fifteen days. Fourth step: If the DP is not satisfied with the decision of the Provincial level, the case may be submitted for consideration by the District Court within 15 days of receiving the decision of the PPC or PRC. The district court's decision will be a legal basis for compensation. DPs will be exempted fiom all administrative and legal fees. DPs can make an appeal on any aspects of resettlement and. rehabilitation program, including the compensation unit price. The detail procedures of solving grievance will be disclosed to all DPs in tlhe public meetings and at the CRC offices. This information is also contained in RIB, disseminates to all DPs promptly after the commencement of the project. 8.4 Monitoring and supervision The implementation of RP shall be constantly supervised and monitored by PMB in co-ordination with the local People's Committees Internal monitoring Internal monitoring includes the following activities: - Monitoring the population, socio-economic surveys, and inventory of DPs' assets. Monitoring whether the implementation of compensation, resettlement and rehabilitation for DPs in accordance with the provisions that DPs agreed. - Monitoring the implementation of compensation and resettlement tasks. - Monitoring the availability of finance and schedule of RP implementation. - Investigating and fairly assessing each case of grievance and complaint.

Such report should be made available to GOV authorities, WB and external monitoring agencies External monitoring - In addition to verifying the information furnished in the internal supervision and monitoring reports of the respective PCs, the external monitoring agency will be responsible for the following: - At the beginning of RP implementation, review compensation unit cost applied in RP, check at the site for ensuring that the compensation costs are at the replacement value, or otherwise recommend to PMB and PPC for adjustment. - Evaluation of DMS, inventory and entitlement to DPs. - Evaluation of socio-economic project impact on the DPs. - Supervision of the implementation of RP to achieve the objectives of the RP in particular "to improve or at least maintain the incomes and living conditions of the DPs after resettlement" - Recommendations on amendments for the implementation of RP so as to achieve: the objective of this RP. - Recornniendations on improvement of RP programs. - Closely monitoring of compensation activities and be ready for evaluation of' complaint and grievance cases. - Preparation of reports and submission to PMB, appropriate GOV authorities, the WB and the representatives of the DPs every 6 months. - Write final report (6 months after entire accomplishment of the resettlement program). This report shall provide detailed evaluation of RP and its implementation, including the content of interview with DPs about the situation and their opinions after receiving compensation and resettlement. - Finally, on the bases of RP implementation experience, this final report shall provide suggestions to enhance the local RP implementation experience and improve FU? in the future - Terms of reference for independent monitoring will be prepared by PMB and will be sent to WB for its concurrence prior to invitation for independent monitoring consultant.

Budget Funds for implementing RPs: Fund for land acquisition and resettlement will be at E\Ws cost as part of the project budgets. The Provincial Investment Department will transfer money to PRBs and then money will be transferred to the following agencies: - DRBs: compensation for PAP, payment for ground clearance in their areas. - Other institutions engaging in resettlement activities: IMO and those providing training services. - DRBs receive money from PRBs and will be responsible for: (a) payment of compensation directly to affected persons for lost of land, crops, trees and structures, allowance (b) payment of compensation for permanerit land acquisition Inflation adjustment The rates of compensation and cash entitlements for rehabilitation and allowances payable to the affected persons will be adjusted amiually, based on the actual annual inflation rate upon request of Ms Implementation, administration and contingencies costs Preparation costs include costs already made for land demarcation, spotting and DMS.
