1 Page 1 of 5 Mercer County Commission Minutes The meeting was called to order at 9:00 AM CT by Chairman Murray, also present was Commissioner Scheurer, Commissioner Entze, Commissioner Tveit, Commissioner Gunsch, State s Attorney Binder, Auditor Brost, Wanda Knutson, and Darbie Berger. Motion made by Commissioner Scheurer, second by Commissioner Entze to approve the agenda with additions. All members voted Aye, motion carried. Motion made by Commissioner Tveit, second by Commissioner Gunsch to approve the minutes of the June 17 th regular meeting. All members voted Aye, motion carried. The board discussed board appointments. Commissioner Tveit stated he would stay on the Planning and Zoning Board until Commissioner Gunsch was replaced on the Beulah Planning board; therefore, Commissioner Gunsch will take over on the Planning & Zoning board after the August meeting. Motion made by Commissioner Scheurer, second by Commissioner Gunsch to appoint Frank Bitterman to the Mercer County Housing Authority board beginning until June 30, All members voted Aye, motion carried. Motion made by Commissioner Entze, second by Commissioner Gunsch to reappoint Marvin Sutheimer to the Mercer County Housing Authority board beginning until June 30, All members voted Aye, motion carried. The board asked the Planning & Zoning board appointment be added to the next agenda. No further action was taken. Motion made by Commissioner Tveit, second by Commissioner Gunsch to adopt the following resolution as follows: RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION OF A WARRANT TO THE BOARD OF UNIVERISTY AND SCHOOL LANDS, TRUSTEE OF A SPRECIAL DEPLETED NATURAL RESOURCE TRUST. BE IT RESOLVED, by the County of Mercer Commission, that the chairman and the auditor of said county of Mercer are hereby authorized and directed to execute a Warrant to the Board of University and School Lands, trustee of Coal Development Trust Fund, a special depleted natural resource trust, in the amount of seven million and no/100 dollars ($7,000,000.00) at three percent (3%) interest per annum. The indebtedness under said warrant is to be paid over a period of twenty (20) years as set out in the amortization schedule attached to the Warrant. The execution of the Warrant by Gary Murray, chairman, and Shana Brost, auditor, on, is hereby ratified. The governing body of the political subdivision acted on the foregoing resolution at its regularly scheduled meeting on at 9:16 AM as follows: Adoption moved by Commissioner Tveit, seconded by Commissioner Gunsch. Roll call vote; Tveit, Aye, Gunsch, Aye, Entze, Aye, Scheurer, Aye, Murray, Aye. Chairman Murray declared the resolution adopted. Candice Strand, Landfill Supervisor, discussed the installation of security cameras at the landfill with the board. Strand stated there has been unauthorized dumping that has been happening after hours and on the weekends. Strand knows several employees have keys to the landfill, but stated it could be the general public in there dumping. The quote from West River Telecommunications was $1, for equipment and an additional $ for labor. Strand noted she has the funds available in her budget. Motion made by Commissioner Scheuer, second by Commissioner Gunsch to approve the quote from WRT for a surveillance system. Upon roll call vote; Scheurer, Aye, Gunsch, Aye, Tveit, Aye, Entze, Aye, Murray, Aye, motion carried.

3 Page 3 of 5 Motion made by Commissioner Scheurer, second by Commissioner Gunsch to approve raffle # for the Golden Valley Rural Fire Protection District. Upon roll call vote; Scheurer, Aye, Gunsch, Aye, Tveit, Aye, Entze, Aye, Murray, Aye, motion carried. Motion made by Commissioner Gunsch, second by Commissioner Tveit to approve liquor license #394 to the Nite Owl Bar for On Sale/Off Sale Liquor and Beer for the Dakota Walleye Classic July 24 & 25, Upon roll call vote; Gunsch, Aye, Tveit, Aye, Scheurer, Aye, Entze, Aye, Murray, Aye, motion carried. Gary Emter, Tax Director/Land Use Administrator, discussed FEMA updating the county s flood maps. Emter stated it has been a lengthy process and Mercer County s maps will be finalized on October 16, In the meantime, the county must develop a flood plain management process, hold a public hearing, and adopt an ordinance. Emter recommended holding the hearing on August 5, 2015 at 11:00 AM; the board accepted. No further action was taken. The board recessed at 9:55 AM. The board reconvened at 10:03 AM. In road issues, the board discussed how they would allocate HB 1358 ($2,818,090.00), SB 2103 ($2,696,799.00), HB 1176 ($2,853,355.00), and the federal aid dollars ($1,931,997.00). Ken Miller, Road Superintendent, stated a three inch overlay on County 26 has already been approved by the NDDOT for a total cost of $2,867,151.95, with the county using SB 2103 and $170, of their monies plus engineering fees. HB 1358 is being allocated for an overlay on County 21 and County 17 grading and aggregate surfacing, with the state paying 90% of the project and the county responsible for 10% plus engineering fees. The federal aid dollars were being allocated to a three inch overlay on County 37, and Miller hoped they could use a portion of the HB 1176 where the federal dollars didn t cover. Commissioner Gunsch asked Steve Mamer, Interstate Engineering, how far the county could overlay County 37 with $1.8 million while allocating $1.0 million to County 25 overlay. Mamer replied just about five miles. Miller asked how much Coyote Creek was willing to cost share to get County 25 paved. Commissioner Gunsch asked Jim Melchior, Coyote Creek, if $1 million would be sufficient. Melchior replied that it wouldn t because the road will cost $4 million to pave and Coyote Creek can only cost share $1.5 million at most. Commissioner Gunsch stated he didn t think it would be fair to use all of HB 1176 on County 25. Commissioner Entze stated there is a need for paving on County 25 because you would never know that was a newly constructed $2 million road. Entze added the product is separating and it is a mess. Entze stated that with numerous people using that road he would like to see it paved, but didn t think the county should use the entire HB 1176 to do it. Motion made by Commissioner Tveit, second by Commissioner Scheurer to designate $2 million to County 25 paving and $853,355 to County 37 overlay. Upon roll call vote; Tveit, Aye, Scheurer, Aye, Gunsch, Nay, Entze, Nay, Murray, Aye, motion carried. In other road issues, Mamer discussed the miscommunication that took place over a bill paid at the last meeting that was a final bill, but not written as such. Mamer stated that even though the bill was paid, it does not release the contractor because the road has yet to be accepted. Mamer added the contractor is still down at the mine doing work for Coyote Creek and has not left the area. Mamer stated there is a soft spot that needs to be fixed and the contractor asked to fix it in the fall after they are done with County 15 Cut-Across. Commissioner Entze stated there is erosion on the south side of the ditch that needs to be addressed. Mamer stated there will be issues and the county has a one year warranty on the

4 Page 4 of 5 road from the date they accept it. He added they are putting counters on County 25 to see how traveled it is, because he believes it is currently the most traveled road in the county. Commissioner Tveit stated he is concerned over paying a final bill and no one at the last meeting knew it was final. Tveit suggested better communication between Mamer and Road Superintendent Miller. Mamer updated the board on County 17, stating the box will be delivered mid-august, the bypass is already in, and things are going well. Mamer reported Drewes won t be up to County 15 until the first part of August. Miller presented the board with two Utility Occupancy Application and Permits. Motion made by Commissioner Scheurer, second by Commissioner Entze to approve permit #1566 issued to Roughrider Electric Cooperative for a new service in Sections 20 & 21 T147N R85W. Upon roll call vote; Scheurer, Aye, Entze, Aye, Tveit, Aye, Gunsch, Aye, Murray, Aye, motion carried. Motion made by Commissioner Gunsch, second by Commissioner Tveit to approve permit #1567 issued to Bartlett and West for directional drilling of 2 PVC potable waterline. Upon roll call vote; Gunsch, Aye, Tveit, Aye, Scheurer, Aye, Entze, Aye, Murray, Aye, motion carried. Miller reported the project at Harmony Lake was just getting finished up on the west side. Commissioner Entze stated the scoria patches throughout the county were hard on taxpayer s tires. Miller stated they road crew is working on getting them covered but they have been working on the soft spots on County 13 and also been busy with the Harmony Lake project. Miller asked the question whether the crew should have been working on Harmony Lake or shutting down County 27. Miller stated the road crew will get to the scoria patches but he can t help Mother Nature throwing curve balls at them. Miller noted the only complaints he has come from County 13; no one else calls him about the issues. Commissioner Entze stated the road crew needs to make a plan to get them covered as fast as they get them fixed. The board recessed at 10:55 AM. The board reconvened at 11:03 AM. Auditor Shana Brost, presented the board with a contract from Klein McCarthy Architects for the redesign fees in the amount of $43, Motion made by Commissioner Gunsch, second by Commissioner Scheurer to table the contract until the July 3 rd meeting to speak with Klein McCarthy Architects about it. Upon roll call vote; Gunsch, Aye, Scheurer, Aye, Tveit, Aye, Entze, Aye, Murray, Aye, motion carried. Jim Albers, Maintenance Engineer, discussed with the board updating the county s phone system. Albers stated the last upgrade was in 2003 and they are now three updates behind. Albers added it is hard to get parts for the current system and there is only one certified technician to work on the system due to training not being available for this system. Motion made by Commissioner Gunsch, second by Commissioner Entze to approve the updates to the phone system. Upon roll call vote; Gunsch, Aye, Entze, Aye, Tveit, Aye, Scheurer, Aye, Murray, Aye, motion carried. The board discussed the Courthouse/Jail Expansion. Wanda Knutson, Clerk of Courts, stated there have been things taken out of departmental budgets over the years that need to be done and putting them off will not solve anything; but if the county is going to build, the maintenance items should be included in the building process. Commissioner Entze stated it may be cost effective to split these items out of the expansion project and put them in departmental budgets to avoid paying charges to the construction manager. Emter asked if

5 Page 5 of 5 the county could take the remodeling of courthouse or the jail portion and get a bond for that. Carmen Reed, Emergency Manager/911 Coordinator, stated there is a mitigation grant available right now that cost shares with the state; state would pay 75% and the county would be responsible for 25%. Reed stated the grant was due August 15 th and will work with Albers on the paperwork. State s Attorney Binder stated the entire courthouse/jail expansion is a need, and she thinks the public will understand that. No further action was taken. The board reviewed the initial commission guidance for the 2016 budget season and set the special revenue accounts budget hearings for the afternoon of August 19 th and the departmental budget hearings for September 3, 2015 at 8:30 AM. There being no further business, on motion duly made and second, the meeting was adjourned at 12:15 PM CST.
