3 2 To: From: City Commission Dean Jones: Public Works Manager City of Anna Maria Date: 08/04/2017 Re: Sixty-two North Shore (Grand Tree) Sixty-two North Shore Drive Anna Maria, Florida Property tax ID# The above mentioned property contains two native water oaks. The builder plans to remove these trees in order to build a single family residence. According two Sec sub sections (h) these trees meet the grand tree ordinance. The builder s plan shows that both trees must be removed and lay in the footprint of the structure. The builder is asking commission permission to remove these from the property. Sub-section (i) states that the trees must be re placed with native trees on the same lot or parcel. The builder must demonstrate to the satisfaction of the commission that the location of the grand trees renders the parcel or lot unbuildable. In the matter of any Bert Harris claims, on the property, these issues will be deferred to Becky Vose. Sec Plantings Landscape and trees (a) (h) Purpose and intent. (1) This section shall be known and referred to as the "City of Anna Maria Landscape and Tree Ordinance." (2) The purpose is to establish minimum landscaping standards and criteria to preserve and establish vegetative communities; to protect plant and wildlife habitats from adverse impacts of growth while contributing to the process of air purification, recharging groundwater, and the retarding of erosion by stormwater; to provide vegetative buffering between land uses; to promote the conservation of water by encouraging the preservation of existing and the planting of new native vegetation; to promote the planting of native vegetation; to promote the use of sitespecific plant materials; and to establish requirements for the installation and maintenance of landscape materials. Such requirements will help delineate visual separation of land uses and provide relief from the built-up environment, while improving the value of property. Grand trees. The removal, relocation, destruction of any grand tree, defined as any tree with a 24-inch circumference or greater measured at breast height (DBH, 4.5 feet above ground level), excluding ficus and Australian pine trees, is prohibited unless it can be demonstrated to the satisfaction of the city commission that the location of the grand tree renders the lot or parcel as non-buildable.

4 (i) Tree protection. Native trees under this section may not be removed unless a replacement native tree is installed on the same lot or parcel. (j) Prohibited plants. Prohibited plant species, as listed and specified on the city prohibited plants list, shall not be permitted to be planted in the city. Such species are known to be of invasive exotic vegetation.

17 3 ORDINANCE NO AN ORDINANCE OF THE CITY OF ANNA MARIA, FLORIDA, CREATING A NEW ARTICLE III, FORMULA RETAIL AND FORMULA COMMERCIAL ESTABLISHMENTS, OF CHAPTER 18, BUSINESSES OF THE CODE OF THE CITY OF ANNA MARIA; PROVIDING FOR FINDINGS OF FACT; PROVIDING DEFINITIONS; PROHIBITING FORMULA RETAIL AND FORMULA COMMERCIAL ESTABLISHMENTS IN THE CITY; PROVIDING FOR SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ANNA MARIA, FLORIDA: SECTION 1. Chapter 18, Businesses of the Code of Ordinances of the City of Anna Maria is hereby amended by the addition of a new Article III, Formula Retail and Formula Commercial Establishments, to read as follows: ARTICLE III. FORMULA RETAIL AND FORMULA COMMERCIAL ESTABLISHMENTS Sec Authority, Scope and Purpose This article is enacted under the home rule power of the City of Anna Maria pursuant to Chapter 166, Florida Statutes, in the interest of the health, peace, safety and general welfare of the City and its residents, businesses and visitors. The purpose of this article is to preserve to the extent possible the unique charm, ambiance, and Old Florida atmosphere of the City of Anna Maria. Sec Findings of Facts Based on information presented at various city commission meetings by residents of Anna Maria and owners and operators of businesses in Anna Maria, and the practical first-hand experience and observations of city commissioners, common sense deductions of city commissioners based on long term experiences in Anna Maria, information learned by city commissioners from various residents and visitors, as well as evidence and testimony presented at public hearings before the city commission, the city commission finds: 1) The City is home to both full-time and part-time residents and is also a destination for tourism. 2) The City is particularly attractive to both residents and visitors alike due in part to having a non-commercialized Old Florida atmosphere where there are virtually no national chain type establishments a/k/a Formula Retail or

18 Formula Commercial Establishments that are typical to most commercial areas nationwide. 3) This trait is an important part of the City of Anna Maria s charm, positive image and desirability both to its residents and visitors alike. 4) The absence of Formula Retail Establishments is an important part of the City s charm, desirability and economic viability, along with the fact that the City s commercial/retail areas are made up primarily of small locally unique establishments. 5) The potential of Formula Retail Establishments locating in the City of Anna Maria poses a genuine threat to the City s established character and the economic health of its commercial and residential districts. 6) The regulation in this article is the only solution that will adequately protect the economic vitality of the City s commercial areas, and this regulation is necessary to protect the economic viability of the City s commercial areas and residential neighborhoods and preserve and enhance the charm and small beach town atmosphere that is recognized as a unique characteristic of the City that makes it an attractive place to live, work and visit. Sec Definitions The following definitions shall apply to this article: 1. Color Scheme. Color scheme shall be defined as selection of colors used throughout, such as on the furnishings, permanent fixtures, and wall coverings, or as used on the façade. 2. Décor. Decor shall be defined as the style of interior furnishings, which may include but is not limited to, style of furniture, wall coverings or permanent fixtures. 3. Development, development activity. Development or development activity shall be defined as provided in Section , Florida Statutes, and includes but is not limited to renovations, conversions, building permits, site plans, development orders, demolition permits, etc. 4. Façade. Facade shall be defined as the face or front of a building, including awnings, looking onto a street or an open space. 5. Formula Retail or Formula Commercial Establishment. A Formula Retail or Formula Commercial Establishment are defined as types of retail sales or commercial service activity or retail sales or commercial service establishment that has three or more other retail sales or commercial establishments in

19 operation, or with entitlements already approved, located anywhere in the world. In addition to the three establishments either in operation or with entitlements approved for operation, the business maintains two or more of the following features: a Standardized Array of Merchandise, a standardized Facade, a standardized Decor and Color Scheme, Uniform Apparel, standardized signage, a Trademark, or a Servicemark. 6. Servicemark. Servicemark shall be defined as word, phrase, symbol or design, or a combination of words, phrases, symbols or designs that identifies and distinguishes the source of a service from one party from those of others. 7. Standardized Array of Merchandise. Standardized array of merchandise shall be defined as 50% or more of in-stock merchandise from a single distributor bearing uniform markings. 8. Trademark. Trademark shall be defined as a word, phrase, symbol or design, or a combination of words, phrases, symbols or designs that identifies and distinguishes the source of the goods from one party from those of others. 9. Uniform Apparel. Uniform Apparel shall be defined as standardized items of clothing including, but not limited to, aprons, pants, shirts, smocks or dresses, hats, and pins (other than name tags) as well as standardized use of colors of clothing. Sec Prohibition of Formula Retail and Formula Commercial Establishments Formula Retail Establishments and Formula Commercial Establishments are prohibited in the city limits of the City of Anna Maria. No development order shall be issued for the purpose of development or development activity furthering the establishment of a Formula Retail Establishment or Formula Commercial Establishment within the city limits of the City of Anna Maria. SECTION 2. SEVERABILITY. In the event that any word(s), phrase(s), portion(s), subsub-section(s), sub-section(s), or section(s) of this Ordinance, or application thereof, is contrary to law, or against public policy, or shall for any reason whatsoever held to be invalid, illegal or unconstitutional, by any court of competent jurisdiction, such word(s), phrase(s), portion(s), subsub-section(s), sub-section(s), or section(s) of this Ordinance shall be null and void, and shall be deemed severed, and a separate, distinct, and independent provision from the remaining provisions of this ordinance, and such holding shall in no manner affect the validity of the remaining words, phrases, portions, sub-sub-sections, sub-sections, or sections of this Ordinance, which shall remain in full force and effect. This ordinance shall be construed in a manner to accomplish, to the greatest extent legally possible, the purposes of this ordinance as expressed herein. SECTION 3. CODIFICATION. The provisions of this Ordinance shall be codified as, and become and be made a part of the Code of Ordinances of the City of Anna Maria. The sections of this Ordinance may be renumbered or re-lettered to accomplish such intention.

20 SECTION 4. EFFECTIVE DATE. This Ordinance shall be effective upon adoption by the City Commission and approval by the Mayor in accordance with the Charter of the City of Anna Maria. 23 4 ORDINANCE AN ORDINANCE OF THE CITY OF ANNA MARIA, FLORIDA AMENDING THE CITY OF ANNA MARIA COMPREHENSIVE PLAN, AS PREVIOUSLY AMENDED, TO REFLECT CHANGES REQUIRED BY THE COMMUNITY PLANNING ACT PURSUANT TO FLORIDA STATUTES, SECTION , AND THE CITY S EVALUATION AND APPRAISAL NOTIFICATION LETTER, THAT WOULD IF ADOPTED, PROVIDE FOR AMENDMENT AND REVISIONS TO THE COMPREHENSIVE PLAN AS TO THOSE ISSUES, AND ADDING AN HISTORIC PRESERVATION ELEMENT, AMENDING THE COASTAL AND CONSERVATION ELEMENT, AND ADDING TO THE CITY S ADOPTED CAPITAL IMPROVEMENT PROGRAM WITH PROJECTED FUNDING; MAKING FINDINGS; DIRECTING TRANSMITTAL OF SAID AMENDMENT TO THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY (DEO) FOR REVIEW AND A FINDING OF COMPLIANCE; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the City of Anna Maria is committed to planning and managing the future growth and development of the City; and WHEREAS, pursuant to Article VIII, Section 2(b) of the Constitution of the State of Florida, the Anna Maria City Charter, and the Community Planning Act, Florida Statutes, Section , et seq., (the Act ), the City of Anna Maria is authorized and required to adopt a Comprehensive Plan; and WHEREAS, the City of Anna Maria currently has an adopted Comprehensive Plan; and WHEREAS, pursuant to Florida Statutes, Section , the City prepared and the City Commission approved an evaluation and appraisal notification letter and transmitted the letter to the Department of Economic Opportunity; and WHEREAS, consistent with the Community Planning Act and the approved evaluation and appraisal notification letter, the City has prepared amendments to the elements of the Comprehensive Plan, which reflect changes in state law and local conditions, and have added an historic preservation element, a coastal and conservation element, and the City s adopted capital improvement program with projected funding; and WHEREAS, the City of Anna Maria Planning and Zoning Board, acting as the Local Planning agency, held a duly advertised public hearing on May 9, 2017, and recommended transmittal of the Comprehensive Plan amendments; and WHEREAS, the City Commission held a duly advertised transmittal stage public hearing on June 8, 2017, pursuant to Florida Statutes, Section ; 1

24 WHEREAS, the City of Anna Maria has complied with all requirements and procedures of Florida law in processing this amendment to the City of Anna Maria Comprehensive Plan including, but not limited to, Section , Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF ANNA MARIA, FLORIDA: Section 1. Legislative findings and intent. (a) The recitals listed above are incorporated by reference as findings of fact as if expressly set forth herein. (b) The updated City of Anna Maria Comprehensive Plan is attached hereto as Exhibit A. Section 2. Adoption and acceptance of the amendments, revisions, and additions to the elements of the City of Anna Maria Comprehensive Plan (a) The City Commission of the City of Anna Maria hereby approves and adopts the updated City of Anna Maria Comprehensive Plan, copies of which are attached hereto as Exhibit A. (b) The City Commission of the City of Anna Maria directs that said documents be transmitted to the Florida Department of Economic Opportunity, pursuant to Florida Statutes, Section The Mayor and the City Planner are authorized and directed to take all necessary actions to transmit these documents to the Florida Department of Economic Opportunity. Section 3. Severability. If any section, sentence, phrase, word, or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity of the ordinance or effect of any other action or part of this Ordinance. Section 4. Conflicts. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. Effective Date. The effective date of this plan amendment, if the amendment is not timely challenged, shall be 31 days after the Department of Economic Opportunity notifies the local government that the plan amendment package is complete. If timely challenged, this amendment shall become effective on the date the Department of Economic Opportunity or the Administration Commission enters a final order determining this adopted amendment to be in compliance. No development orders, development permits, or land uses dependent on this amendment may be issued or commence before it has become effective. If a final order of noncompliance is issued by the Administration Commission, this amendment may nevertheless be made effective by adoption of a resolution affirming its effective status, a copy of which resolution shall be sent to the Department of Economic Opportunity. 2

27 5 ORDINANCE NO AN ORDINANCE OF THE CITY OF ANNA MARIA, FLORIDA, CREATING A NEW SECTION 34-3, CAMPING PROHIBITED; CONDITIONS AND EXCEPTIONS, OF CHAPTER 34, OFFENSES OF THE CODE OF THE CITY OF ANNA MARIA; PROVIDING FOR THE PROHIBITION OF CAMPING ON PROPERTY IN THE CITY AND PROVIDING CONDITIONS AND EXCEPTIONS; PROVIDING FOR SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ANNA MARIA, FLORIDA: SECTION 1. Chapter 34, Offenses of the Code of Ordinances of the City of Anna Maria is hereby amended by the addition of a new Section 34-3, Camping prohibited; conditions and exceptions, to read as follows: Sec Camping Prohibited; conditions and exceptions. (1) For the purposes of this section, camping is defined as: (a) Sleeping or otherwise being in a temporary shelter out-of-doors at any time between 11:00 p.m. and dawn; or (b) Sleeping out-of-doors at any time between 11:00 p.m. and dawn; or (c) Cooking over an open flame or fire out-of-doors at any time, except in a location specifically authorized for such cooking by the appropriate governmental authority. (2) Camping is prohibited on all public property, except as may be specifically authorized by the appropriate governmental authority. (3) Camping is prohibited on all property in the City used for residential purposes; provided, however, that camping is permitted on such property with the permission and consent of the property owner. (4) In the event a person is found to be camping illegally and volunteers that he/she has no other place to live, he/she should be informed of alternative shelter available in Manatee County. (5) A violation of this section shall be punished as set forth in section 1-12 of this Code of Ordinances. SECTION 2. SEVERABILITY. CALL TO ORDER PLEDGE TO THE FLAG ROLL CALL Present: Mayor Dan Murphy, Commissioner Carol Carter, Commissioner Brian Seymour, Chair Doug Copeland, Commissioner Dale Woodland, and Commissioner Nancy Yetter. Others Present: City Clerk LeAnne Addy, Deputy City Clerk Debbie Haynes, City Attorney Becky Vose, Islander, and the AMI Sun. Bert Harris Vose City Attorney Becky Vose stated that she has one Bert Harris recommendations for approval. Motion: To approve the one Bert Harris recommendation from the City Attorney. (507 Spring Avenue) Action: Motion by Commissioner Seymour, seconded by Commissioner Woodland. On roll call vote, the motion passed 4-1, Commissioner Yetter, opposed. 3. Authorization for Mayor to issue RFQ (Request for Qualifications) Mayor Murphy stated that this RFQ would be for Engineering Services. It is a state law to publically bid it and based off of the qualifications. He was sent the agreement for LTA Engineering a couple of years ago and again recently and he forwarded it to the City Attorney for review. She advised us not to sign the agreement as we have to send it out as an Request for Qualifications (RFQ). This will be to bring us in compliance with state law. Motion: To send the RFQ (Request for Qualification) for Engineering Services out for bid. Action: Motion by Commissioner Carter, seconded by Commissioner Yetter. On roll call vote, the motion passed unanimously. 4. City Pier Park Update Mayor Mayor Murphy stated that LeAnne and he met with the company that will be installing the sail shade at the City Pier Park. He listed the steps that were discussed and this project will be completed by October 31, 2017.

32 Mayor Murphy stated that we need to pinpoint the location of the structure; the company will come in and place their footings, then place the steel, and later come and attach the fabric. Mayor Murphy stated that Dean the Public Works Manager will be painting and staking out the location for the sail. This will be reviewed by the Mayor and Dean on Tuesday. 5. City Pier RFP Update Mayor The RFP should be ready to go within the next days. It is in the status of review from our City Attorney and looked over by some professional staff that specializes in this area. 6. Mayor s Comments Mayor Murphy stated that the Sheriff s Department had witnessed several people sleeping on the beach and we don t currently have an ordinance in place prohibiting sleeping on the beach. The City Commissioners had the consensus to have the City Attorney draft an Ordinance to prohibit sleeping on the beach. Mayor Murphy stated that we will be converting to Microsoft Office 365. If anyone has any problems with the migration, please contact LeAnne. 7. Commissioners Comments Commissioner Carter stated that the Manasota League of Cities stated that they will be discussing at the conference in Orlando next week. The overriding priority will be the Home Rule issues with some related to short term rentals. Tourist Development tax is one of the issues also on the agenda for discussion. Chair Copeland stated that we should be notifying The Center about if we are having a workshop meeting or to have Mayor Murphy notify the Center that there will not be a workshop at this time. 8. 33 12a1 City of Anna Maria CITY COMMISSION BUDGET WORKSESSION MEETING MINUTES AUGUST 10, :30 P.M. Pledge of Conduct: We may disagree, but we will be respectful of one another. We will direct all comments to the issues. We will avoid personal attacks. CALL TO ORDER PLEDGE TO THE FLAG ROLL CALL Present: Mayor Dan Murphy, Commissioner Carol Carter, Commissioner Brian Seymour, Chair Doug Copeland, Commissioner Dale Woodland, and Commissioner Nancy Yetter. Others Present: City Clerk LeAnne Addy, Deputy City Clerk Debbie Haynes, City Attorney Becky Vose, Islander, and the AMI Sun. WORK SESSION 1. FY Budget Review and Discussion Mayor Murphy presented the FY Open Items: Multi-Use Path Construction Mayor Murphy stated that the multi-use path would be from Cross Pointe Fellowship Church to Willow Avenue. He is asking the Commission to pick from the following three options: 1. Deploy and move the $171,722 to contingency, Stormwater, or another category. 2. Do a portion of the trail by starting with drainage. 3. Adopt the path. Chair Copeland stated that he feels that we should go ahead and complete the project since we are always ahead of the other cities. Commissioner Woodland stated that he is in favor of moving with the construction of the trail for safety purposes. Commissioner Yetter stated that she doesn t feel that we should put this amount of money towards the path right now since the proposed is for a very short distance. She thinks we should put it into drainage and then wait until we get more into the construction of Pine Avenue. Commissioner Carter stated that she would like to do the drainage now and look at the path at a later date. Commissioner Seymour stated that he would like to do the drainage in the area but he still feels that it is

34 not the right time to continue with the bike path. Chair Copeland would go with the fellow Commissioners to do the drainage in that area now and look at the bike path at a later date. The consensus of the Commissioners is to do the drainage and to move $71,722 to the contingency account. Contracted Sheriff s Services Mayor Murphy stated that addressing the Sergeant s concerns about safety he feels is important and will let the Sergeant speak on behalf of this. Sergeant Schnering stated that we would need two additional officers due to the 24/7 shift. He would like to provide more coverage on the beach during the summer months. Adding two officers would at times allow for three on shift at a time. He explained how his officers work the areas of the City currently. Currently there is an officer alone from 5:00 p.m. to 5:00 a.m. He stated that it will increase response times and have more available officers to patrol other issues within the city. Sergeant Schnering stated some of the UCR Crime Stats with the Commissioners. Commissioner Seymour stated that he is for the additional two officers as he has been here for several years and the number of officers has been stagnant. He asked if we would save money over time being that we have to have people who are in the upper pay scale range and have a lot of retirement. Commissioner Yetter stated that she feels that we should investigate different avenues for beach patrol. She stated that she had witnessed an area for over three hours that people were parked illegally. She is expecting a lot more that what we are currently getting. Commissioner Woodland stated that it may be a good time to look at other options for beach patrol or code enforcement. Chair Copeland asked if there is a consensus to add the additional officers or to take the time to look into other options. The Commissioners discussed having some time to look into additional ideas. Mayor Murphy stated that we will address this over the next six months and he will come back with some various options. Contingency To add $71,722 from the Multi-Use Path Construction. Revenues Stormwater and Expenditures - Stormwater Mayor Murphy stated that there were additional projects added last year. Now that we are adding an additional $100,000 in revenue for stormwater from the Multi-use path for drainage in that area that brings the amount to $488, He also stated that the expenditures are more clear due to the work of City Clerk/Treasurer LeAnne Addy. Mayor Murphy then explained to the Commissioners what is currently on the schedule to be done for stormwater per the map and it is in the total of the $361,800. He also explained to them what we could complete additional work in stormwater for the increase of $200,000 for stormwater improvements. Mayor Murphy stated that he would like to know if there is consensus to go with a more aggressive plan

35 for Stormwater. Chair Copeland stated that there is a consensus from the Commissioners to increase the amount $200,00 which will bring the total to $661,800 for the Stormwater Improvements.
