1 Waterloo, Iowa November 3, 2015 The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment. The meeting was called to order and on roll call there were present: Tom Little, Chair; Linda Laylin, Frank Magsamen, John Miller and Craig White. Absent: None. Unless otherwise noted, all actions were approved unanimously. Moved by Laylin, seconded by Miller that the AGENDA be received and place on file with the County Auditor as approved. Motion carried. County Engineer Cathy Nicholas said that Canfield Road is now open, and that Aspro is patching some spots on C-57 where two culverts have settled over the years. That there was a good chance that all the ditches on her list would be cleaned out before bad weather comes. County Sheriff Tony Thompson said his officers are raising money by growing beards in No-Shave November again, that they raised $1,000 for cancer research last year, but this year they will donate their proceeds to the Honor Flight. White said that the Honor Flight was a healing process for many who have participated. Magsamen thanked the Sheriff s Office on behalf of the veterans. Moved by White, seconded by Laylin that the MINUTES of the Board Meeting held October 27, 2015 be and are hereby approved as submitted. Motion carried. CONSENT AGENDA White moved the following RESOLUTION seconded by Miller. A. TO APPROVE, RECEIVE, PLACE ON FILE WITH THE COUNTY AUDITOR 1. The Board of Supervisors APPROVE INTERGOVERNMENTAL JOURNAL ENTRIES, and that the County Auditor be authorized and directed to TRANSFER monies within the various funds as submitted. (None submitted) B. TO RECEIVE AND PLACE ON FILE WITH THE COUNTY AUDITOR 1. The PERMIT FOR UTILITY WORK WITHIN THE RIGHT OF WAY for Waverly Communications, Waverly, Iowa for placement of a buried fiber optic cable on the right of way described as Waverly Addition East Project located on the west side of Highway 19 and Leversee Road to Highway 57 T90-13 Section 5 as recommended by Catherine Nicholas, County Engineer. CONSENT AGENDA ENDS Miller moved the following resolution seconded by Laylin. BE IT HEREBY RESOLVED that that the GIS DATA ACQUISITION AGREEMENT between Black Hawk County and CoreLogic Spatial Solutions, LLC including its parents, affiliates, and subsidiaries, Austin, Texas for the acquisition of GIS parcel data at a onetime fee of $ be approved and direct the Chair to sign for same as recommended by Kim Veeder, Information Technology Director. Miller moved the following resolution seconded by Laylin. BE IT HEREBY RESOLVED that the SUSPENSION requested by April Angel on taxes owed for 2015/2016 installments in the amount of $2,318 for Parcel # be approved pursuant to of the Code of Iowa and the Treasurer be authorized and directed to adjust her records accordingly. Magsamen asked County Treasurer Rita Schmidt about the process. Schmidt said that applicants fill out an eight-page form about their assets and needs, and noted that the taxes are only frozen temporarily and must be paid when the suspension is lifted. Little said the amounts seem to have increased. Schmidt said that some applications are automatically approved under Department of Human Services guidelines, and the tax amounts are going up because property valuations are going up. She said she bases her recommendations on need and it is up to the Board whether or not to approve them. Miller moved the following resolution seconded by White. BE IT HEREBY RESOLVED that the SUSPENSION requested by Jason Magee on taxes owed for 2015/2016 installments in the amount of $3,038 for Parcel # be approved pursuant to of the Code of Iowa and the Treasurer be authorized and directed to adjust her records accordingly. Moved by Magsamen, seconded by Laylin that the REQUEST FOR PURCHASE OF CAPITAL EQUIPMENT submitted by Catherine Nicholas, County Engineer, be approved and direct the chair to sign for same: $14,083 for a GPS Laser Transmitter and Rover. Motion carried. The Board of Supervisors discussed whether to fill the VACANCY, effective November 20, 2015, in the office of County Attorney, by appointment or by special election, pursuant to the provisions of 69.14A(2) of the Code of Iowa. The supervisors agreed that the Board should fill the vacancy by appointment. Little said they would go through the same process that they used when former County Attorney Tom Ferguson resigned July 1. Magsamen moved the following resolution seconded by White. BE IT HEREBY RESOLVED to fill the VACANCY, effective July 1, 2015, in the office of County Attorney, by appointment, pursuant to the provisions of 69.14A(2) of the Code of Iowa.

7 Moved by White, seconded by Miller to direct the County Auditor to advertise for a public hearing to be held at 9:07 a.m. on Tuesday, November 17, 2015 in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5 th Street, Waterloo, Iowa on the proposed Ordinance No on the request by Bill Gutknecht to rezone 2.0 acres from A Agricultural District to A-R Agricultural-Residential District, to allow for the construction one (1) new single family home located west of 8505 W Ridgeway Avenue. (Legally described as: The West 75.3 feet of the North feet of the Northeast Fractional Quarter (NE FRL ¼); Except the North 50 feet thereof. And; The East feet of the North feet of the Northwest Fractional Quarter (NW FRL ¼); Except the North 50 feet thereof. All in Section No. 6, Township No. 88 North, Range No. 14 West of the Fifth Principal Meridian, Black Hawk County, Iowa.) Motion carried. Moved by White, seconded by Miller to direct the County Auditor to advertise for a public hearing to be held at 9:09 a.m. on Tuesday, November 17, 2015 in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5 th Street, Waterloo, Iowa on the proposed Ordinance No on the request by Bertha Eastman Trust to rezone 1.5 acres from A Agricultural District to A-R Agricultural-Residential District, for the purpose of subdividing off a residence constructed on a farm after 1982 located at 9827 La Porte Road. (Legally described as: Commencing at the W ¼ corner of Section No. 3, Township No. 87 North, Range 12 West of the Fifth Principle Meridian, Black Hawk County, Iowa, thence Due South 1, ; thence Due East to the point of beginning; thence continuing Due East to the Northwest corner of Parcel A as described in Misc. 315 Page 846; thence along the Westerly line of said Parcel A South East ; thence Due West ; thence North West to the Point of beginning.) Motion carried. At Nine-twenty-three o clock (9:23) a.m., a public hearing was held as provided by law in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa at which time all interested persons could appear to file objections on the proposed Chiller Upgrade Projects at the Pinecrest and Jail Facilities. Moved by Magsamen, seconded by White to receive and place on file proof of publication of notice of public hearing. Motion carried. Moved by Laylin, seconded by Miller to close the hearing after oral/written comments are received. Motion carried. At nine-twenty-three (9:23) a.m. the Chair announced the time had arrived in accordance with prior action and as advertised, for the receiving and opening of bids for the proposed Chiller Upgrade Projects at the Pinecrest and Jail facilities. The Board of Supervisors examined proof of publication of notice to bidders and determined that said notice had been published in the Waterloo Courier on October 16, 2015 in accordance with the requirements of the Code of Iowa. Little asked why there were so many alternate bids included on the bid sheet. Superintendent of Maintenance Rory Geving said that he had learned after the pre-bid meeting that different options had different power requirements, and he wanted to be able to consider whatever choice was in the best interests of the county. White said the engineering firm that helped write the specifications should have known about the options. Geving said that some manufacturers may be lesser known. Little said that bidders should meet the original specifications. Finance Director James Bronner said that investigating alternate bids can help to prevent change orders after the project starts. The Chair announced the following sealed bids were all received by Eight-thirty (8:30) a.m. Tuesday November 3, 2015, as stated in the Notice to Bidders. ANY REPORTS OR INFORMATION FROM THE BOARD. Magsamen encouraged people to vote in the day s city elections. White thanked the Sheriff s Office once again for its donation to the Honor Flights, saying that they had hit a brick wall in fundraising. CLOSED SESSION Laylin moved the following resolution seconded by Magsamen. BE IT HEREBY RESOLVED that pursuant to the provisions of the Iowa Open Meetings Law, the Black Hawk County Board of Supervisors shall proceed into CLOSED SESSION AT 9:42 A.M., with attorney to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation pursuant to Iowa Code 21.5(c). Moved by seconded by to adjourn the Board of Supervisors meeting in CLOSED SESSION at 10:10 am. Motion carried. On motion and vote the meeting adjourned.
