3 CITY OF HUBER HEIGHTS STATE OF OHIO RESOLUTION 2015-R- DECLARING CERTAIN CITY PROPERTY IN THE POLICE DIVISION NO LONGER NEEDED FOR MUNICIPAL PURPOSES AS SURPLUS AND AUTHORIZING DISPOSAL OF SAID SURPLUS PROPERTY, AND DECLARING AN EMERGENCY. WHEREAS, the City of Huber Heights is in possession of a vehicle assigned to the Police Division; and WHEREAS, the property is no longer needed for municipal purposes; and WHEREAS, the vehicle has been slated for sale at auction, and has had a winning bid awarded; and WHEREAS, the winning bidder is awaiting the finalization of the auction and pick-up of the vehicle. NOW, THEREFORE, BE IT RESOLVED by the City Council of Huber Heights, Ohio that: Section 1. Consistent with the provisions of the Ohio Revised Code Section and applicable City codified ordinances and purchasing procedures, the following equipment is declared surplus, no longer needed for municipal purposes and authorization is hereby provided to dispose of the property consistent with the provisions of the Huber Heights Codified Ordinances. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its Committees that resulted in such formal action were in meetings open to the public and in compliance with all legal requirements including Section of the Ohio Revised Code. Section 3. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare and for the further reason that the vehicle is awaiting release to the winning bidder; therefore, this Resolution shall be in full force and effect immediately upon its adoption by Council. City Staff are seeking City Council approval to apply for and accept these grant funds. Fiscal Impact Source of Funds: Law Enforcement Fund Cost: $ Recurring Cost? (Yes/No): No Funds Available in Current Budget? (Yes/No): Yes Financial Implications: These vest have a service life of 5 years. These vests are due for replacement this calendar year. 5 CITY OF HUBER HEIGHTS STATE OF OHIO RESOLUTION NO R- AUTHORIZING THE CITY MANAGER TO APPLY FOR AND ACCEPT GRANT FUNDS FROM THE BUREAU OF JUSTICE ASSISTANCE BULLETPROOF VEST PARTNERSHIP FOR THE PURPOSE OF PURCHASING REPLACEMENT PROTECTIVE BODY ARMOR, AND DECLARING AN EMERGENCY. WHEREAS, the City of Huber Heights supports the need for additional police related equipment, specifically bulletproof vests; and WHEREAS, the U.S Bureau of Justice Assistance provides the allocation of funding in the form of the Bulletproof Vest Partnership program for purchasing new or additional bulletproof vests; and WHEREAS, the Bureau of Justice Assistance Bulletproof Vest Partnership Act of 2000 requires that funding priority be given to jurisdictions with populations under 100,000; and, WHEREAS, the Huber Heights Police Division has been a past recipient of Bulletproof Vest Partnership funds which provide for a 50% reimbursement to the City for the purchase of bulletproof vests. NOW, THEREFORE, BE IT RESOLVED by the City Council of Huber Heights, Ohio that: Section 1. The City of Huber Heights hereby endorses and supports the submission of an application for the Bulletproof Vest Partnership program and authorizes the necessary actions to implement said grant, if approved by the U.S. Bureau of Justice Assistance. Section 2. The City Manager is hereby authorized to apply for and, if awarded, enter into an agreement with the U.S. Bureau of Justice Assistance to administer the grant to implement the Bulletproof Vest Partnership program. Section 3. Reimbursement made to the Police Division under this grant will be re-appropriated to the Law Enforcement Fund. Section 4. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its Committees that resulted in such formal action were in meetings open to the public and in compliance with all legal requirements including Section of the Ohio Revised Code. Section 5.
