1 BONNER COUNTY PUBLIC WORKS SOLID WASTE DEPARTMENT 1500 Highway 2, Suite 101 Sandpoint, ID Phone; (208) July 5, 2016 To: Commissioners Memorandum PUBLIC WORKS Item #2 From: Matt Klingler, Public Works Director Re: Adopt of Roadway Program Resolution The Bonner County Adopt a Roadway Program began in 1999 to provide an opportunity for concerned citizens and organizations to donate their time and effort in support ofa clean community. This program has not been active for several years. Now due to recent public interest the Solid Waste Department has spent several months revamping the 1999 documents ofthe Adopt a Roadway Program. Through the suggestionoflegal counsel we reviewed a similar program sponsored by the Idaho Transportation Departments and we have mirrored our program to theirs. The attached resolution will allow Bonner County to once again assist concerned citizens/volunteers within our county to support a clean community through roadway clean up. This resolution was reviewed/approved by our legal counsel, Scott Bauer and our Risk Specialist, Christian Jostlein. 2 RESOLUTION NO. 16- PUBLIC WORKS / SOLID WASTE ADOPT A ROADWAY PROGRAM A resolution of Bonner County, a governmental subidivision of the State of Idaho, the Bonner County Board of Commissioners provide for this resolution to be in full force and in effect upon its passage and approval. WHEREAS, the Adopt A Roadway Program provides an opportunity for concerned citizens and organizations to donate their time and effort in support of a clean community; and WHEREAS, the Bonner County Public Works Department acting as the Solid Waste segment have provided means for a Bonner County Adopt A Roadway Program; and WHEREAS, the Bonner County Public Works Director shall administer the program and WHEREAS, this Resolution hereby replaces Resolution # in it's entirety; and WHEREAS, the public has made requests for a roadway cleanup program. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the following is hereby approved as follows: An Agreement will be entered into between the Bonner County Solid Waste Department, hereinafter called the "Department" and an organization, group, business, et cetera, hereinafter called the "Group" upon which time the Group provides the Department with a completed application. The Department does hereby authorize the Group permission to participate in the Adopt A Roadway Program by picking up litter within the assigned section of County designated roadway, in accordance with the following terms and conditions: The Group does herebv agree to: 1. Conduct cleanup activities in a safe manner and in accordance with the Safety Guidelines. All participants in the litter pickup group must wear a reflective safety vest provided by Bonner County. Safety of participants Is the number one priority of the program. Page 1 of4
3 2. Assign a crew leader to each cleanup party, and that crew leader shall have a signed copy of this agreement with them during the cleanup activity. 3. The crew leader will have each group member complete the Individual Registration & Release of Liability form and the Volunteer Roster form and provide a minimum of two (2) days prior to the scheduled cleanup. 4. Participants younger than 18 years of age must have their Individual Registration & Release of Liability form signed by a parent or guardian. 5. All forms must be turned into Bonner County one (1) week prior to your scheduled cleanup day. 6. The Group agrees to pick up litter no less than two (2) times per year. Additional cleanups should be done as necessary to maintain a neat appearance. Recommended interval for cleanup is: once in the spring and once in the fall. 7. The Group shall arrange with the Department one (1) week prior to each cleanup to arrange pick up of safety signs, safety vests, gloves, first aid kit, flag markers and trash collection bags. All participants must wear a safety vest and gloves furnished by the Department during cleanup activities. No less than ty^ (2) people shall participate in the cleanup activity at one time. The cleanup activity must be completed during daylight hours. 8. A minimum number of vehicles shall be used to transport the participants to the assigned area. Park vehicles on the road shoulder within the assigned area during a cleanup activity. 9. It is not recommended to have children age eight (8) or under participate in the event. The Group shall furnish supervision by a minimum of one adult for every eight (8) minors (under 18 years of age) participating in a roadside cleanup. 10. Participants shall receive safety materials provided by the Department before participating in a roadside cleanup. 11. Participants are responsible for placing the litter bags at the road shoulder for pick up, or the Group may deliver them to any attended Solid Waste collection site. Bags are not to be overfilled and must be tied. 12. Roadside litter pick up traffic control signs are provided and are to be set up as shown on the Traffic Control Plan prior to beginning the cleanup. Signs and equipment must be returned to Bonner County within two (2) days of your cleanup. Page 2 of4

In the event of an emergency notify Emergency Services by dialing 911 or call Dispatch at Participants who find explosives, firearms are to flag the item and notify Bonner County Dispatch and leave for disposal by the proper authorities. 15. Cleanups shall not be scheduled during a legal holiday or on holiday weekends. 16. Provide the Department with a completed participant roster within two (2) calendar days following the cleanup. 17. The Crew Leader shall report any injuries incurred by participants during cleanup activities to the Department within two (2) working days of the injury. Notification should include: Name of injured person; nature of injury; date and time of injury; how the injury occurred. 18. Return to the Department the portable advanced warning signs, first aid kit, unused equipment and materials within two (2) working days after cleanup. 19. It is recommended that the Group have a cell phone available at the cleanup site, and at least one person with valid First Aid/CPR Card be present during cleanup activities. 20. Persons or Volunteer Groups shall not be denied the opportunity to participate in this program because of their race, religion, color, age sex or national origin. 21. Volunteer Groups that promote a political affiliation, racial intolerance or harassment in any form are not eligible to participate in this program. The Public Works Director will make the final and binding decision on eligibility. 22. Each Volunteer Group shall be responsible for prohibiting participants from either possessing or consuming alcoholic beverages or illegal drugs during the cleanup activity. The Department does hereby agree to: 1. Provide "Adopt A Roadway" signage, poles, and an employee to install Group signs. 2. Provide safety materials and supplies to the Group's representative for use by the Group's participants. Page 3 of4
5 3. Furnish the Group trash bags, "Litter Crew Ahead" advanced warning signage, gloves, bags, safety vests, first aid kit, and flag markers for participants to use during the cleanup activity. 4. Pick up the filled trash bags off the road shoulder unless they have been delivered to an attended site by the Group. 5. Notify the Road & Bridge Department when large, heavy, hazardous are found. General Terms 1. The Department may suspend this agreement temporarily because of future construction that will take place with the limits of the assigned area. Once these activities have been completed, the Group will be notified and the agreement will be restored. 2. The term of this agreement shall commence on the date of execution indicated below and shall terminate two (2) years after the execution date unless terminated previously by the Department or the Group with a 30 day notice. 3. The Volunteer Group shall pick up trash on the specific roadway chosen for a distance of not less than 1/2 mile but not to exceed 2 miles at any given time on both sides of the roadway. 4. The Volunteer Group acknowledges and agrees that if any actions by the Volunteer Group relative to the performance of this Agreement are determined to have not been followed Bonner County has the right to remove the organization from the Adopt a Road program. 5. The Volunteer Group accepts the responsibility of picking up litter on their road section at least two (2) times per year.
